<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad2dcf59-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631"><num value="12631">§ 12631.</num><heading> Family and medical leave</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2dcf5a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631/a"><num value="a" class="bold">(a)</num><heading class="bold"> Participants in private, State, and local projects</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of title I of the Family and Medical Leave Act of 1993 [<ref href="/us/usc/t29/s2611">29 U.S.C. 2611</ref> et seq.], if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad2dcf5b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631/a/1"><num value="1">(1)</num><content> a participant has provided service for the period required by section 101(2)(A)(i) (<ref href="/us/usc/t29/s2611/2/A/i">29 U.S.C. 2611(2)(A)(i)</ref>), and has met the hours of service requirement of section 101(2)(A)(ii), of such Act with respect to a project authorized under the national service laws; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad2dcf5c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631/a/2"><num value="2">(2)</num><content> the service sponsor of the project is an employer described in section 101(4) of such Act (other than an employing agency within the meaning of subchapter V of chapter 63 of title 5),</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the participant shall be considered to be an eligible employee of the service sponsor.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2df66d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631/b"><num value="b" class="bold">(b)</num><heading class="bold"> Participants in Federal projects</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of subchapter V of chapter 63 of title 5, if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad2df66e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631/b/1"><num value="1">(1)</num><content> a participant has provided service for the period required by section 6381(1)(B) of such title with respect to a project; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad2df66f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631/b/2"><num value="2">(2)</num><content> the service sponsor of the project is an employing agency within the meaning of such subchapter,</content>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">the participant shall be considered to be an employee of the service sponsor.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2df670-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12631/c"><num value="c" class="bold">(c)</num><heading class="bold"> Treatment of absence</heading><content><p style="-uslm-lc:I11" class="indent0">The period of any absence of a participant from a service position pursuant to title I of the Family and Medical Leave Act of 1993 [<ref href="/us/usc/t29/s2611">29 U.S.C. 2611</ref> et seq.] or subchapter V of chapter 63 of title 5 shall not be counted toward the completion of the term of service of the participant under <ref href="/us/usc/t42/s12593">section 12593 of this title</ref>.</p>
