<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad2eba22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637"><num value="12637">§ 12637.</num><heading> Nonduplication and nondisplacement</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2eba23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/a"><num value="a" class="bold">(a)</num><heading class="bold"> Nonduplication</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad2eba24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Assistance provided under the national service laws shall be used only for a program that does not duplicate, and is in addition to, an activity otherwise available in the locality of such program.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad2eba25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Private nonprofit entity</heading><content><p style="-uslm-lc:I12" class="indent1">Assistance made available under the national service laws shall not be provided to a private nonprofit entity to conduct activities that are the same or substantially equivalent to activities provided by a State or local government agency that such entity resides in, unless the requirements of subsection (b) are met.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2eba26-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b"><num value="b" class="bold">(b)</num><heading class="bold"> Nondisplacement</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad2eba27-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An employer shall not displace an employee, position, or volunteer (other than a participant under the national service laws), including partial displacement such as reduction in hours, wages, or employment benefits, as a result of the use by such employer of a participant in a program receiving assistance under the national service laws.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad2eba28-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Service opportunities</heading><content><p style="-uslm-lc:I12" class="indent1">A service opportunity shall not be created under the national service laws that will infringe in any manner on the promotional opportunity of an employed individual.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad2eba29-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitation on services</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad2eba2a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Duplication of services</heading><content><p style="-uslm-lc:I13" class="indent2">A participant in a program receiving assistance under the national service laws shall not perform any services or duties or engage in activities that would otherwise be performed by an employee as part of the assigned duties of such employee.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad2eba2b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Supplantation of hiring</heading><chapeau style="-uslm-lc:I13" class="indent2">A participant in any program receiving assistance under the national service laws shall not perform any services or duties, or engage in activities, that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad2eba2c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/B/i"><num value="i">(i)</num><content> will supplant the hiring of employed workers; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad2eba2d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/B/ii"><num value="ii">(ii)</num><content> are services, duties, or activities with respect to which an individual has recall rights pursuant to a collective bargaining agreement or applicable personnel procedures.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idad2eba2e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Duties formerly performed by another employee</heading><chapeau style="-uslm-lc:I13" class="indent2">A participant in any program receiving assistance under the national service laws shall not perform services or duties that have been performed by or were assigned to any—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad2eba2f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C/i"><num value="i">(i)</num><content> presently employed worker;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad2eba30-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C/ii"><num value="ii">(ii)</num><content> employee who recently resigned or was discharged;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad2eba31-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C/iii"><num value="iii">(iii)</num><chapeau> employee who—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idad2eba32-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C/iii/I"><num value="I">(I)</num><content> is subject to a reduction in force; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idad2eba33-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C/iii/II"><num value="II">(II)</num><content> has recall rights pursuant to a collective bargaining agreement or applicable personnel procedures;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad2eba34-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C/iv"><num value="iv">(iv)</num><content> employee who is on leave (terminal, temporary, vacation, emergency, or sick); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad2eba35-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/b/3/C/v"><num value="v">(v)</num><content> employee who is on strike or who is being locked out.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2eba36-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/c"><num value="c" class="bold">(c)</num><heading class="bold"> Labor market information</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary of Labor shall make available to the Corporation and to any program agency under this subchapter such labor market information as is appropriate for use in carrying out the purposes of this subchapter.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2ee147-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/d"><num value="d" class="bold">(d)</num><heading class="bold"> Treatment of benefits</heading><content><p style="-uslm-lc:I11" class="indent0">Allowances, earnings, and payments to individuals participating in programs that receive assistance under this subchapter shall not be considered to be income for the purposes of determining eligibility for and the amount of income transfer and in-kind aid furnished under any Federal or federally assisted program based on need, other than as provided under the Social Security Act (<ref href="/us/usc/t42/s301">42 U.S.C. 301</ref> et seq.).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2ee148-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/e"><num value="e" class="bold">(e)</num><heading class="bold"> Standards of conduct</heading><content><p style="-uslm-lc:I11" class="indent0">Programs that receive assistance under this subchapter shall establish and stringently enforce standards of conduct at the program site to promote proper moral and disciplinary conditions.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad2ee149-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/f"><num value="f" class="bold">(f)</num><heading class="bold"> Parental involvement</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad2ee14a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Programs that receive assistance under the national service laws shall consult with the parents or legal guardians of children in developing and operating programs that include and serve children.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad2ee14b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12637/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Parental permission</heading><content><p style="-uslm-lc:I12" class="indent1">Programs that receive assistance under the national service laws shall, before transporting minor children, provide the children’s parents with the reason for the transportation and obtain the parents’ written permission for such transportation, consistent with State law.</p>
