<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8dc0ceb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h"><num value="12653h">§ 12653h.</num><heading> National Service Reserve Corps</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8dc0cec-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8dc0ced-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/a/1"><num value="1">(1)</num><chapeau> the term “National Service Reserve Corps member” means an individual who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0cee-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/a/1/A"><num value="A">(A)</num><content> has completed a term of national service or is a veteran;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0cef-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/a/1/B"><num value="B">(B)</num><content> has successfully completed training described in subsection (c) within the previous 2 years;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0cf0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/a/1/C"><num value="C">(C)</num><content> completes not less than 10 hours of volunteering each year (which may include the training session described in subparagraph (B)); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0cf1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/a/1/D"><num value="D">(D)</num><content> has indicated interest to the Corporation in responding to disasters and emergencies in a timely manner through the National Service Reserve Corps; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8dc0cf2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/a/2"><num value="2">(2)</num><content> the term “term of national service” means a term or period of service under <ref href="/us/usc/t42/s12573">section 12573 of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8dc0cf3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment of National Service Reserve Corps</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0cf4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">In consultation with the Federal Emergency Management Agency, the Corporation shall establish a National Service Reserve Corps to prepare and deploy National Service Reserve Corps members to respond to disasters and emergencies in support of national service programs and other requesting programs and agencies.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0cf5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Grants or contracts</heading><content><p style="-uslm-lc:I12" class="indent1">In carrying out this section, the Corporation may enter into a grant or contract with an organization experienced in responding to disasters or in coordinating individuals who have completed a term of national service or are veterans, or may directly deploy National Service Reserve Corps members, as the Corporation determines necessary.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8dc0cf6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/c"><num value="c" class="bold">(c)</num><heading class="bold"> Annual training</heading><content><p style="-uslm-lc:I11" class="indent0">The Corporation shall conduct or coordinate annual training sessions, consistent with the training requirements of the Federal Emergency Management Agency, for individuals who have completed a term of national service or are veterans, and who wish to join the National Service Reserve Corps.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8dc0cf7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/d"><num value="d" class="bold">(d)</num><heading class="bold"> Designation of organizations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0cf8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Corporation shall designate organizations with demonstrated experience in responding to disasters or emergencies, including through using volunteers, for participation in the program under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0cf9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I12" class="indent1">The Corporation shall ensure that every designated organization is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0cfa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/d/2/A"><num value="A">(A)</num><content> prepared to respond to disasters or emergencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0cfb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/d/2/B"><num value="B">(B)</num><content> prepared and able to utilize National Service Reserve Corps members in responding to disasters or emergencies; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0cfc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/d/2/C"><num value="C">(C)</num><content> willing to respond in a timely manner when notified by the Corporation of a disaster or emergency.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8dc0cfd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/e"><num value="e" class="bold">(e)</num><heading class="bold"> Databases</heading><chapeau style="-uslm-lc:I11" class="indent0">The Corporation shall develop or contract with an outside organization to develop—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8dc0cfe-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/e/1"><num value="1">(1)</num><content> a database of all National Service Reserve Corps members; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8dc0cff-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/e/2"><num value="2">(2)</num><content> a database of all nonprofit organizations that have been designated by the Corporation under subsection (d).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8dc0d00-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f"><num value="f" class="bold">(f)</num><heading class="bold"> Deployment of National Service Reserve Corps</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0d01-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Major disasters or emergencies</heading><content><p style="-uslm-lc:I12" class="indent1">If a major disaster or emergency is declared by the President pursuant to section 102 of the Robert T. Stafford Disaster Relief and Assistance Act <ref class="footnoteRef" idref="fn004011">1</ref><note type="footnote" id="fn004011"><num>1</num> See References in Text note below.</note> (<ref href="/us/usc/t42/s5122">42 U.S.C. 5122</ref>), the Administrator of the Federal Emergency Management Agency, in consultation with the Corporation, may task the National Service Reserve Corps to assist in response.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0d02-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Other disasters or emergencies</heading><content><p style="-uslm-lc:I12" class="indent1">For a disaster or emergency that is not declared a major disaster or emergency under section 102 of the Robert T. Stafford Disaster Relief and Assistance Act <sup>1</sup> (<ref href="/us/usc/t42/s5122">42 U.S.C. 5122</ref>), the Corporation may directly, or through a grant or contract, deploy the National Service Reserve Corps.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0d03-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Deployment</heading><chapeau style="-uslm-lc:I12" class="indent1">Under paragraph (1) or (2), the Corporation may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0d04-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/3/A"><num value="A">(A)</num><content> deploy interested National Service Reserve Corps members on assignments of not more than 30 days to assist with local needs related to preparing or recovering from the incident in the affected area, either directly or through organizations designated under subsection (d);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0d05-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/3/B"><num value="B">(B)</num><content> make travel arrangements for the deployed National Service Reserve Corps members to the site of the incident; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0d06-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/3/C"><num value="C">(C)</num><content> provide funds to those organizations that are responding to the incident with deployed National Service Reserve Corps members, to enable the organizations to coordinate and provide housing, living stipends, and insurance for those deployed members.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0d07-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Allowance</heading><content><p style="-uslm-lc:I12" class="indent1">Any amounts that are utilized by the Corporation from funds appropriated under <ref href="/us/usc/t42/s12681/a/4/D">section 12681(a)(4)(D) of this title</ref> to carry out paragraph (1) for a fiscal year shall be kept in a separate fund. Any amounts in such fund that are not used during a fiscal year shall remain available to use to pay National Service Reserve Corps members an allowance, determined by the Corporation, for out-of-pocket expenses.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0d08-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/5"><num value="5" class="bold">(5)</num><heading class="bold"> Information</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8dc0d09-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> National service participants</heading><content><p style="-uslm-lc:I13" class="indent2">The Corporation, the State Commissions, and entities receiving financial assistance for programs under division C of this subchapter,<sup>1</sup> or under part A of title I of the Domestic Volunteer Service Act of 1973 (<ref href="/us/usc/t42/s4951">42 U.S.C. 4951</ref> et seq.), shall inform participants about the National Service Reserve Corps upon the participants’ completion of their term of national service.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8dc0d0a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Veterans</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary of Veterans Affairs, in consultation with the Secretary of Defense, shall inform veterans who are recently discharged, released, or separated from the Armed Forces about the National Service Reserve Corps.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8dc0d0b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/6"><num value="6" class="bold">(6)</num><heading class="bold"> Coordination</heading><chapeau style="-uslm-lc:I12" class="indent1">In deploying National Service Reserve Corps members under this subsection, the Corporation shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0d0c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/6/A"><num value="A">(A)</num><content> avoid duplication of activities directed by the Federal Emergency Management Agency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8dc0d0d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12653h/f/6/B"><num value="B">(B)</num><content> consult and, as appropriate, partner with Citizen Corps programs and other local disaster agencies, including State and local emergency management agencies, voluntary organizations active in disaster, State Commissions, and similar organizations, in the affected area.</content>
