L. 110–140, title IV, § 481, Dec. 19, 2007, 121 Stat. 1648.)","seq_in_title":6643,"parent_identifier":"/us/usc/t42/ch130/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch130","level":"chapter","num":"CHAPTER 130—","heading":"NATIONAL AFFORDABLE HOUSING","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch130/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROVISIONS AND POLICIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad3ebfda-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709\"><num value=\"12709\">§ 12709.</num><heading> Energy efficiency standards</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad3ebfdb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad3ebfdc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary of Housing and Urban Development and the Secretary of Agriculture shall, not later than <date date=\"2006-09-30\">September 30, 2006</date>, jointly establish, by rule, energy efficiency standards for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad3ebfdd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/a/1/A\"><num value=\"A\">(A)</num><content> new construction of public and assisted housing and single family and multifamily residential housing (other than manufactured homes) subject to mortgages insured under the National Housing Act [<ref href=\"/us/usc/t12/s1701\">12 U.S.C. 1701</ref> et seq.];</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad3ebfde-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/a/1/B\"><num value=\"B\">(B)</num><content> new construction of single family housing (other than manufactured homes) subject to mortgages insured, guaranteed, or made by the Secretary of Agriculture under title V of the Housing Act of 1949 [<ref href=\"/us/usc/t42/s1471\">42 U.S.C. 1471</ref> et seq.]; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad3ebfdf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/a/1/C\"><num value=\"C\">(C)</num><content> rehabilitation and new construction of public and assisted housing funded by HOPE VI revitalization grants under <ref href=\"/us/usc/t42/s1437v\">section 1437v of this title</ref>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad3ebfe0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Such standards shall meet or exceed the requirements of the 2006 International Energy Conservation Code (hereafter in this section referred to as “the 2006 IECC”), or, in the case of multifamily high rises, the requirements of the American Society of Heating, Refrigerating, and Air-Conditioning Engineers Standard 90.1–2004 (hereafter in this section referred to as “ASHRAE Standard 90.1–2004”), and shall be cost-effective with respect to construction and operating costs on a life-cycle cost basis. In developing such standards, the Secretaries shall consult with an advisory task force composed of homebuilders, national, State, and local housing agencies (including public housing agencies), energy agencies, building code organizations and agencies, energy efficiency organizations, utility organizations, low-income housing organizations, and other parties designated by the Secretaries.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad3ebfe1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> International Energy Conservation Code</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If the Secretaries have not, by <date date=\"2006-09-30\">September 30, 2006</date>, established energy efficiency standards under subsection (a), all new construction and rehabilitation of housing specified in such subsection shall meet the requirements of the 2006 IECC, or, in the case of multifamily high rises, the requirements of ASHRAE Standard 90.1–2004.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad3ebfe2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Revisions of the International Energy Conservation Code</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">If the requirements of the 2006 IECC, or, in the case of multifamily high rises, ASHRAE Standard 90.1–2004, are revised at any time, the Secretaries shall, not later than 1 year after such revision, amend the standards established under subsection (a) to meet or exceed the requirements of such revised code or standard unless the Secretaries determine that compliance with such revised code or standard would not result in a significant increase in energy efficiency or would not be technologically feasible or economically justified.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad3ee6f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Failure to amend the standards</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">If the Secretary of Housing and Urban Development and the Secretary of Agriculture have not, within 1 year after the requirements of the 2006 IECC or the ASHRAE Standard 90.1–2004 are revised, amended the standards or made a determination under subsection (c), all new construction and rehabilitation of housing specified in subsection (a) shall meet the requirements of the revised code or standard if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad3ee6f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/d/1\"><num value=\"1\">(1)</num><content> the Secretary of Housing and Urban Development or the Secretary of Agriculture make a determination that the revised codes do not negatively affect the availability or affordability of new construction of assisted housing and single family and multifamily residential housing (other than manufactured homes) subject to mortgages insured under the National Housing Act (<ref href=\"/us/usc/t12/s1701\">12 U.S.C. 1701</ref> et seq.) or insured, guaranteed, or made by the Secretary of Agriculture under title V of the Housing Act of 1949 (<ref href=\"/us/usc/t42/s1471\">42 U.S.C. 1471</ref> et seq.), respectively; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad3ee6f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12709/d/2\"><num value=\"2\">(2)</num><content> the Secretary of Energy has made a determination under <ref href=\"/us/usc/t42/s6833\">section 6833 of this title</ref> that the revised code or standard would improve energy efficiency.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idad3ee6f6-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/101/625/tI/s109\">Pub.
