In developing the plan, the Secretary shall consider, as appropriate, any energy assessments under section 944.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f87419a-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12712/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Initial plan</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary of Housing and Urban Development shall establish the first plan under this section not later than the expiration of the 1-year period beginning on <date date=\"1990-11-28\">November 28, 1990</date>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f87419b-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12712/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Updates</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary of Housing and Urban Development shall revise and update the plan under this section not less than once for each 2-year period, the first such 2-year period beginning on the date of the submission of the initial plan under subsection (b) to the Congress (as provided in subsection (d)). Each such update shall revise the plan for the 5-year period beginning upon the submission of the updated plan to the Congress.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id8f87419c-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s12712/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Submission to Congress</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary of Housing and Urban Development shall submit the initial plan established under subsection (b) and any updated plans under subsection (c) to the Congress not later than the date by which such plans are to be established or updated under such paragraphs.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id8f87419d-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/101/625/tIX/s945\">Pub. L. 114–94, div. G, title LXXXI, § 81001</ref>, <date date=\"2015-12-04\">Dec. 4, 2015</date>, <ref href=\"/us/stat/129/1792\">129 Stat. 1792</ref>, provided that:<quotedContent origin=\"/us/pl/114/94/dG/tLXXXI/s81001\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Establishment</inline>.—</heading><chapeau>The Secretary of Housing and Urban Development (in this section referred to as the ‘Secretary’) shall establish a demonstration program under which the Secretary may execute budget-neutral, performance-based agreements in fiscal years 2016 through 2019 that result in a reduction in energy or water costs with such entities as the Secretary determines to be appropriate under which the entities shall carry out projects for energy or water conservation improvements at not more than 20,000 residential units in multifamily buildings participating in—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the project-based rental assistance program under section 8 of the United States Housing Act of 1937 (<ref href=\"/us/usc/t42/s1437f\">42 U.S.C. 1437f</ref>), other than assistance provided under section 8(<i>o</i>) of that Act;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the supportive housing for the elderly program under section 202 of the Housing Act of 1959 (<ref href=\"/us/usc/t12/s1701q\">12 U.S.C. 1701q</ref>); or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> the supportive housing for persons with disabilities program under section 811(d)(2) of the Cranston-Gonzalez National Affordable Housing Act (<ref href=\"/us/usc/t42/s8013/d/2\">42 U.S.C. 8013(d)(2)</ref>).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Requirements.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Payments contingent on savings.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Secretary shall provide to an entity a payment under an agreement under this section only during applicable years for which an energy or water cost savings is achieved with respect to the applicable multifamily portfolio of properties, as determined by the Secretary, in accordance with subparagraph (B).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Payment methodology.—</inline></heading><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Each agreement under this section shall include a pay-for-success provision that—</chapeau><subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"I\">     “(I)</num><content> shall serve as a payment threshold for the term of the agreement; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"II\">     “(II)</num><content> requires that payments shall be contingent on realized cost savings associated with reduced utility consumption in the participating properties.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><heading> <inline class=\"small-caps\">Limitations</inline>.—</heading><chapeau>A payment made by the Secretary under an agreement under this section—</chapeau><subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"I\">     “(I)</num><content> shall be contingent on documented utility savings; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I36\" class=\"indent4 firstIndent-4\"><num value=\"II\">     “(II)</num><content> shall not exceed the utility savings achieved by the date of the payment, and not previously paid, as a result of the improvements made under the agreement.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Third-party verification</inline>.—</heading><chapeau>Savings payments made by the Secretary under this section shall be based on a measurement and verification protocol that includes at least—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> establishment of a weather-normalized and occupancy-normalized utility consumption baseline established pre-retrofit;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> annual third-party confirmation of actual utility consumption and cost for utilities;</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> annual third-party validation of the tenant utility allowances in effect during the applicable year and vacancy rates for each unit type; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> annual third-party determination of savings to the Secretary.</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I26\" class=\"indent2 firstIndent-2\">  An agreement under this section with an entity shall provide that the entity shall cover costs associated with third-party verification under this subparagraph.</continuation>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Terms of performance-based agreements</inline>.—</heading><chapeau>A performance-based agreement under this section shall include—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the period that the agreement will be in effect and during which payments may be made, which may not be longer than 12 years;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> the performance measures that will serve as payment thresholds during the term of the agreement;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> an audit protocol for the properties covered by the agreement;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> a requirement that payments shall be contingent on realized cost savings associated with reduced utility consumption in the participating properties; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> such other requirements and terms as determined to be appropriate by the Secretary.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Entity eligibility</inline>.—</heading><chapeau>The Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> establish a competitive process for entering into agreements under this section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> enter into such agreements only with entities that, either jointly or individually, demonstrate significant experience relating to—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> financing or operating properties receiving assistance under a program identified in subsection (a);</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> oversight of energy or water conservation programs, including oversight of contractors; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> raising capital for energy or water conservation improvements from charitable organizations or private investors.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Geographical diversity</inline>.—</heading><content>Each agreement entered into under this section shall provide for the inclusion of properties with the greatest feasible regional and State variance.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Properties</inline>.—</heading><content>A property may only be included in the demonstration under this section only if the property is subject to affordability restrictions for at least 15 years after the date of the completion of any conservation improvements made to the property under the demonstration program. Such restrictions may be made through an extended affordability agreement for the property under a new housing assistance payments contract with the Secretary of Housing and Urban Development or through an enforceable covenant with the owner of the property.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Plan and Reports.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Plan</inline>.—</heading><content>Not later than 90 days after the date of enactment of this Act [<date date=\"2015-12-04\">Dec. 4, 2015</date>], the Secretary shall submit to the Committees on Appropriations and Financial Services of the House of Representatives and the Committees on Appropriations and Banking, Housing, and Urban Affairs of the Senate a detailed plan for the implementation of this section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Reports</inline>.—</heading><chapeau>Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> conduct an evaluation of the program under this section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> submit to Congress a report describing each evaluation conducted under subparagraph (A).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Funding</inline>.—</heading><content>For each fiscal year during which an agreement under this section is in effect, the Secretary may use to carry out this section any funds appropriated to the Secretary for the renewal of contracts under a program described in subsection (a).”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id8f878fc2-86fb-11e9-b915-8b3e54686b9f\"><heading class=\"centered smallCaps\">Energy Assessment Report</heading><p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/101/625/tIX/s944\">Pub. L. 101–625, title IX, § 944</ref>, <date date=\"1990-11-28\">Nov. 28, 1990</date>, <ref href=\"/us/stat/104/4415\">104 Stat. 4415</ref>, directed Secretary of Housing and Urban Development to submit a report to Congress, not later than one year after <date date=\"1990-11-28\">Nov. 28, 1990</date>, assessing any activity undertaken by the Secretary to increase energy efficiency in housing, such report to include an analysis of the <date date=\"1990-08-15\">Aug. 15, 1990</date>, DOE-HUD program to expand energy efficiency and increase affordability of federally-assisted housing, and provided that in such report Secretary of Housing and Urban Development (in consultation with Secretary of Energy) was to establish, and include a description of, a standard measure by which changes over time in residential energy efficiency could be compared.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id8f878fc3-86fb-11e9-b915-8b3e54686b9f\"><heading class=\"centered smallCaps\">Uniform Mortgage Financing Plan for Energy Efficiency</heading><p><ref href=\"/us/pl/101/625/tIX/s946\">Pub. L. 101–625, title IX, § 946</ref>, <date date=\"1990-11-28\">Nov. 28, 1990</date>, <ref href=\"/us/stat/104/4416\">104 Stat. 4416</ref>, as amended by <ref href=\"/us/pl/102/486/tI/s105/b\">Pub. L. 102–486, title I, § 105(b)</ref>, <date date=\"1992-10-24\">Oct. 24, 1992</date>, <ref href=\"/us/stat/106/2792\">106 Stat. 2792</ref>; <ref href=\"/us/pl/102/550/tIX/s914/b\">Pub. The plan shall be promulgated not later than 2 years after the date of the enactment of the Cranston-Gonzalez National Affordable Housing Act [<date date=\"1990-11-28\">Nov. 28, 1990</date>].</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Task Force</inline>.—</heading><content>To develop the plan, the Secretary shall form a task force to make recommendation[s] on financing energy efficiency in private mortgages, through the policies of Federal agencies and federally chartered financial institutions, mortgage bankers, homebuilders, real estate brokers, private mortgage insurers, energy suppliers, and nonprofit housing and energy organizations. The task force shall include, but not be limited to, individuals representing the Federal Housing Administration mortgage programs of the Department of Housing and Urban Development, the Farmers Home Administration mortgage loan and insurance programs of Department of Agriculture, the Federal Home Loan Mortgage Corporation, and the Federal National Mortgage Association. The Task Force shall determine whether notifying potential home purchasers of the availability of energy efficient mortgages would promote energy efficiency in residential buildings, and if so, the Task Force shall recommend appropriate notification guidelines, and agencies and organizations referred to in the preceding sentence are authorized to implement such guidelines.”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"id8f87b6d4-86fb-11e9-b915-8b3e54686b9f\"><heading class=\"centered smallCaps\">Energy Efficiency Demonstration</heading><p style=\"-uslm-lc:I21\" class=\"indent0\"><ref href=\"/us/pl/101/625/tIX/s961\">Pub.
