<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad4528a6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806"><num value="12806">§ 12806.</num><heading> Home repair services grants for older and disabled homeowners</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad4528a7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall make available a model program to provide home repair services for older homeowners and disabled homeowners, including such services as the examination of homes, repair services, and follow-up to ensure the continued effectiveness of the repairs provided.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad4528a8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligible recipients</heading><chapeau style="-uslm-lc:I11" class="indent0">Home repair services shall be provided to homeowners who—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad4528a9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/b/1"><num value="1">(1)</num><content> own and reside in the dwellings for which services are provided;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4528aa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/b/2"><num value="2">(2)</num><content> are older or disabled; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4528ab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/b/3"><num value="3">(3)</num><content> are members of low-income families.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad4528ac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/c"><num value="c" class="bold">(c)</num><heading class="bold"> Permitted restrictions</heading><chapeau style="-uslm-lc:I11" class="indent0">Guidelines for the model program shall require that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad4528ad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/c/1"><num value="1">(1)</num><content> assisted dwelling units be the primary residence of the homeowner for whom services are provided;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4528ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/c/2"><num value="2">(2)</num><content> preferences be provided for (A) very low-income families, and (B) individuals with intense need characterized by noneconomic factors such as physical and mental disabilities, language barriers, and cultural, social, or geographical isolation caused by racial or ethnic status that restricts the ability of an individual to perform normal daily tasks or that threatens the capacity of the individual to live independently;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad454fbf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12806/c/3"><num value="3">(3)</num><content> any fees charged be based on the income of the individual receiving the home repair services.</content>
