<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad474b9f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872"><num value="12872">§ 12872.</num><heading> Planning grants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad4772b0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary is authorized to make planning grants to applicants for the purpose of developing homeownership programs under this part. The amount of a planning grant under this section may not exceed $200,000, except that the Secretary may for good cause approve a grant in a higher amount.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad4772b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligible activities</heading><chapeau style="-uslm-lc:I11" class="indent0">Planning grants may be used for activities to develop homeownership programs (which may include programs for cooperative ownership), including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/1"><num value="1">(1)</num><content> development of resident management corporations and resident councils;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/2"><num value="2">(2)</num><content> training and technical assistance of applicants related to the development of a specific homeownership program;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/3"><num value="3">(3)</num><content> studies of the feasibility of a homeownership program;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/4"><num value="4">(4)</num><content> inspection for lead-based paint hazards, as required by <ref href="/us/usc/t42/s4822/a">section 4822(a) of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/5"><num value="5">(5)</num><content> preliminary architectural and engineering work;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/6"><num value="6">(6)</num><content> tenant and homebuyer counseling and training;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/7"><num value="7">(7)</num><content> planning for economic development, job training, and self-sufficiency activities that promote economic self-sufficiency for homebuyers and homeowners under the homeownership program;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/8"><num value="8">(8)</num><content> development of security plans; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/b/9"><num value="9">(9)</num><content> preparation of an application for an implementation grant under this part.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad4772bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c"><num value="c" class="bold">(c)</num><heading class="bold"> Application</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad4772bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Form and procedures</heading><content><p style="-uslm-lc:I12" class="indent1">An application for a planning grant shall be submitted by an applicant in such form and in accordance with such procedures as the Secretary shall establish.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad4772bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Minimum requirements</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall require that an application contain at a minimum—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad4772be-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c/2/A"><num value="A">(A)</num><content> a request for a planning grant, specifying the activities proposed to be carried out, the schedule for completing the activities, the personnel necessary to complete the activities, and the amount of the grant requested;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad4772bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c/2/B"><num value="B">(B)</num><content> a description of the applicant and a statement of its qualifications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad4772c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c/2/C"><num value="C">(C)</num><content> identification and description of the eligible property involved, and a description of the composition of the tenants, including family size and income;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad4772c1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c/2/D"><num value="D">(D)</num><content> a certification by the public official responsible for submitting the comprehensive housing affordability strategy under <ref href="/us/usc/t42/s12705">section 12705 of this title</ref> that the proposed activities are consistent with the approved housing strategy of the State or unit of general local government within which the project is located (or, during the first 12 months after <date date="1990-11-28">November 28, 1990</date>, that the application is consistent with such other existing State or local housing plan or strategy that the Secretary shall determine to be appropriate); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad4772c2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/c/2/E"><num value="E">(E)</num><content> a certification that the applicant will comply with the requirements of the Fair Housing Act [<ref href="/us/usc/t42/s3601">42 U.S.C. 3601</ref> et seq.], title VI of the Civil Rights Act of 1964 [<ref href="/us/usc/t42/s2000d">42 U.S.C. 2000d</ref> et seq.], section 504 of the Rehabilitation Act of 1973 [<ref href="/us/usc/t29/s794">29 U.S.C. 794</ref>], and the Age Discrimination Act of 1975 [<ref href="/us/usc/t42/s6101">42 U.S.C. 6101</ref> et seq.], and will affirmatively further fair housing.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad4772c3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/d"><num value="d" class="bold">(d)</num><heading class="bold"> Selection criteria</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall, by regulation, establish selection criteria for a national competition for assistance under this section, which shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad4772c4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/d/1"><num value="1">(1)</num><content> the qualifications or potential capabilities of the applicant;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772c5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/d/2"><num value="2">(2)</num><content> the extent of tenant interest in the development of a homeownership program for the property;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772c6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/d/3"><num value="3">(3)</num><content> the potential of the applicant for developing a successful and affordable homeownership program and the suitability of the property for homeownership;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772c7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/d/4"><num value="4">(4)</num><content> national geographic diversity among housing for which applicants are selected to receive assistance; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad4772c8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s12872/d/5"><num value="5">(5)</num><content> such other factors that the Secretary shall require that (in the determination of the Secretary) are appropriate for purposes of carrying out the program established by this part in an effective and efficient manner.</content>
