L. 114–201, title VII, § 701(b), July 29, 2016, 130 Stat. 814.)","seq_in_title":6731,"parent_identifier":"/us/usc/t42/ch131","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch131","level":"chapter","num":"CHAPTER 131—","heading":"HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id0bce55e9-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902\"><num value=\"12902\">§ 12902.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of this chapter:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55ea-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/1\"><num value=\"1\">(1)</num><content> The term “acquired immunodeficiency syndrome and related diseases” or “AIDS” means the disease of acquired immunodeficiency syndrome or any conditions arising from the etiologic agent for acquired immunodeficiency syndrome.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55eb-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/2\"><num value=\"2\">(2)</num><content> The term “applicant” means a State, a unit of general local government, or a nonprofit organization eligible to receive assistance under this chapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55ec-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/3\"><num value=\"3\">(3)</num><content> The term “low-income individual” means any individual or family whose incomes do not exceed 80 percent of the median income for the area, as determined by the Secretary of Housing and Urban Development, with adjustments for smaller and larger families, except that the Secretary may establish income ceilings higher or lower than 80 percent of the median income for the area if the Secretary finds that such variations are necessary because of prevailing levels of construction costs or unusually high or low family incomes.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55ed-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/4\"><num value=\"4\">(4)</num><content> The term “grantee” means a State or unit of general local government receiving grants from the Secretary under this chapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55ee-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/5\"><num value=\"5\">(5)</num><content> The term “metropolitan statistical area” means a metropolitan statistical area as established by the Office of Management and Budget. Such term includes the District of Columbia.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55ef-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/6\"><num value=\"6\">(6)</num><content> The term “locality” means the geographical area within the jurisdiction of a local government.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55f0-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/7\"><num value=\"7\">(7)</num><content> The term “recipient” means a grantee or other applicant receiving funds under this chapter.<ref class=\"footnoteRef\" idref=\"fn004058\">1</ref><note type=\"footnote\" id=\"fn004058\"><num>1</num> See References in Text note below.</note></content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55f1-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/8\"><num value=\"8\">(8)</num><content> The term “Secretary” means the Secretary of Housing and Urban Development.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55f2-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/9\"><num value=\"9\">(9)</num><content> The term “State” means a State of the United States, the District of Columbia, and the Commonwealth of Puerto Rico, or any agency or instrumentality thereof that is established pursuant to legislation and designated by the chief executive to act on behalf of the jurisdiction with regard to provisions of this chapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55f3-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/10\"><num value=\"10\">(10)</num><content> The term “unit of general local government” has the same meaning as in <ref href=\"/us/usc/t42/s12704\">section 12704 of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55f4-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/11\"><num value=\"11\">(11)</num><content> The term “city” has the meaning given the term in <ref href=\"/us/usc/t42/s5302/a\">section 5302(a) of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55f5-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/12\"><num value=\"12\">(12)</num><content> The term “eligible person” means a person with acquired immunodeficiency syndrome or a related disease and the family of such person.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55f6-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/13\"><num value=\"13\">(13)</num><chapeau> The term “nonprofit organization” means any nonprofit organization (including a State or locally chartered, nonprofit organization) that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0bce55f7-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/13/A\"><num value=\"A\">(A)</num><content> is organized under State or local laws;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0bce55f8-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/13/B\"><num value=\"B\">(B)</num><content> has no part of its net earnings inuring to the benefit of any member, founder, contributor, or individual;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0bce55f9-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/13/C\"><num value=\"C\">(C)</num><content> complies with standards of financial accountability acceptable to the Secretary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0bce55fa-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/13/D\"><num value=\"D\">(D)</num><content> has among its purposes significant activities related to providing services or housing to persons with acquired immunodeficiency syndrome or related diseases.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55fb-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/14\"><num value=\"14\">(14)</num><content> The term “project sponsor” means a nonprofit organization or a housing agency of a State or unit of general local government that contracts with a grantee to receive assistance under this chapter.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55fc-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/15\"><num value=\"15\">(15)</num><content> The term “HIV” means infection with the human immunodeficiency virus.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id0bce55fd-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/16\"><num value=\"16\">(16)</num><chapeau> The term “individuals living with HIV or AIDS” means, with respect to the counting of cases in a geographic area during a period of time, the sum of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id0bce55fe-80bc-11ea-808b-a3be13bc391b\" identifier=\"/us/usc/t42/s12902/16/A\"><num value=\"A\">(A)</num><content> the number of living non-AIDS cases of HIV in the area;
