<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8ef1ff9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903"><num value="12903">§ 12903.</num><heading> General authority</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8ef1ffa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants authorized</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall, to the extent of amounts approved in appropriations Acts under <ref href="/us/usc/t42/s12912">section 12912 of this title</ref>, make grants to States, units of general local government, and nonprofit organizations.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8ef1ffb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/b"><num value="b" class="bold">(b)</num><heading class="bold"> Implementation of eligible activities</heading><content><p style="-uslm-lc:I11" class="indent0">A grantee shall carry out eligible activities under <ref href="/us/usc/t42/s12904">section 12904 of this title</ref> through project sponsors. Any grantee that is a State that enters into a contract with a nonprofit organization to carry out eligible activities in a locality shall obtain the approval of the unit of general local government for the locality before entering into the contract.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8ef1ffc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c"><num value="c" class="bold">(c)</num><heading class="bold"> Allocation of resources</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8ef1ffd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Allocation of resources</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef1ffe-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Allocation formula</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall allocate 90 percent of the amount approved in appropriations Acts under <ref href="/us/usc/t42/s12912">section 12912 of this title</ref> among States and metropolitan statistical areas as follows:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8ef1fff-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/A/I"><num value="I">(I)</num><chapeau> <ref class="footnoteRef" idref="fn004059">1</ref><note type="footnote" id="fn004059"><num>1</num> So in original. Probably should be “(i)”.</note> 75 percent of such amounts among—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd8ef2000-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/A/I/I"><num value="I">(I)</num><content> cities that are the most populous unit of general local government in a metropolitan statistical area with a population greater than 500,000, as determined on the basis of the most recent census, and with more than 2,000 individuals living with HIV or AIDS, using the data specified in subparagraph (B); and</content>

<subclause style="-uslm-lc:I16" class="indent4" id="idd8ef2001-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/A/I/II"><num value="II">(II)</num><content> States with more than 2,000 individuals living with HIV or AIDS outside of metropolitan statistical areas.</content>
</subclause>

<clause style="-uslm-lc:I14" class="indent3" id="idd8ef2002-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/A/ii"><num value="ii">(ii)</num><content> 25 percent of such amounts among States and metropolitan statistical areas based on the method described in subparagraph (C).</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2003-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Source of data</heading><content><p style="-uslm-lc:I13" class="indent2">For purposes of allocating amounts under this paragraph for any fiscal year, the number of individuals living with HIV or AIDS shall be the number of such individuals as confirmed by the Director of the Centers for Disease Control and Prevention, as of December 31 of the most recent calendar year for which such data is available.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2004-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Allocation under subparagraph (A)(ii)</heading><chapeau style="-uslm-lc:I13" class="indent2">For purposes of allocating amounts under subparagraph (A)(ii), the Secretary shall develop a method that accounts for—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="idd8ef2005-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/c/1/C/I"><num value="I">(I)</num><content> <sup>1</sup> differences in housing costs among States and metropolitan statistical areas based on the fair market rental established pursuant to <ref href="/us/usc/t42/s1437f/c">section 1437f(c) of this title</ref> or another methodology established by the Secretary through regulation; and</content>
</subclause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I14" class="indent3" id="idd8ef2006-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/ii"><num value="ii">(ii)</num><chapeau> differences in poverty rates among States and metropolitan statistical areas based on area poverty indexes or another methodology established by the Secretary through regulation.</chapeau><level style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8ef2007-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/ii/2"><num value="2" class="bold">(2)</num><heading class="bold"> Maintaining grants</heading><level style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2008-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/ii/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Continued eligibility of fiscal year 2016 grantees</heading><chapeau style="-uslm-lc:I13" class="indent2">A grantee that received an allocation in fiscal year 2016 shall continue to be eligible for allocations under paragraph (1) in subsequent fiscal years, subject to—</chapeau><level style="-uslm-lc:I14" class="indent3" id="idd8ef2009-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/ii/2/A/i"><num value="i">(i)</num><content> the amounts available from appropriations Acts under <ref href="/us/usc/t42/s12912">section 12912 of this title</ref>;</content>

</subsection>

<level style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef200d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/C"><num value="C" class="bold">(C)</num><heading class="bold"> Redetermination of continued eligibility</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall redetermine the continued eligibility of a grantee that received an allocation in fiscal year 2016 at least once during the 10-year period following fiscal year 2016.</p>

<level style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef200e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/D"><num value="D" class="bold">(D)</num><heading class="bold"> Adjustment to grants</heading><content><p style="-uslm-lc:I13" class="indent2">For each of fiscal years 2017, 2018, 2019, 2020, and 2021, with respect to a grantee that received an allocation in the prior fiscal year, the Secretary shall ensure that the grantee’s share of total formula funds available for allocation does not decrease more than 5 percent nor gain more than 10 percent of the share of the total available formula funds that the grantee received in the preceding fiscal year.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8ef200f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/3"><num value="3" class="bold">(3)</num><heading class="bold"> Alternative grantees</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2010-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary may award funds reserved for a grantee eligible under paragraph (1) to an alternative grantee if—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="idd8ef2011-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/3/A/I"><num value="I">(I)</num><content> <sup>1</sup> the grantee submits to the Secretary a written agreement between the grantee and the alternative grantee that describes how the alternative grantee will take actions consistent with the applicable comprehensive housing affordability strategy approved under <ref href="/us/usc/t42/s12705">section 12705 of this title</ref>; <sup>2</sup></content>
</subclause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8ef2012-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/3/A/ii"><num value="ii">(ii)</num><content> the Secretary approves the written agreement described in clause (I) and agrees to award funds to the alternative grantee; and</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I14" class="indent3" id="idd8ef2013-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii"><num value="iii">(iii)</num><chapeau> the written agreement does not exceed a term of 10 years.</chapeau><level style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2014-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/B"><num value="B" class="bold">(B)</num><heading class="bold"> Renewal</heading><content><p style="-uslm-lc:I13" class="indent2">An agreement approved pursuant to subparagraph (A) may be renewed by the parties with the approval of the Secretary.</p>

<level style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2015-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/C"><num value="C" class="bold">(C)</num><heading class="bold"> Definition</heading><content><p style="-uslm-lc:I13" class="indent2">In this paragraph, the term “alternative grantee” means a public housing agency (as defined in <ref href="/us/usc/t42/s1437a/b">section 1437a(b) of this title</ref>), a unified funding agency (as defined in <ref href="/us/usc/t42/s11360">section 11360 of this title</ref>), a State, a unit of general local government, or an instrumentality of State or local government.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8ef2016-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/4"><num value="4" class="bold">(4)</num><heading class="bold"> Reallocations</heading><chapeau style="-uslm-lc:I12" class="indent1">If a State or metropolitan statistical area declines an allocation under paragraph (1)(A), or the Secretary determines, in accordance with criteria specified in regulation, that a State or metropolitan statistical area that is eligible for an allocation under paragraph (1)(A) is unable to properly administer such allocation, the Secretary shall reallocate any funds reserved for such State or metropolitan statistical area as follows:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8ef2017-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/4/A"><num value="A">(A)</num><chapeau> For funds reserved for a State—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="idd8ef2018-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/4/A/I"><num value="I">(I)</num><content> <sup>1</sup> to eligible metropolitan statistical areas within the State on a pro rata basis; or</content>
</subclause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8ef2019-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/4/A/ii"><num value="ii">(ii)</num><content> if there is no eligible metropolitan statistical areas within a State, to metropolitan cities and urban counties within the State that are eligible for grant under <ref href="/us/usc/t42/s5306">section 5306 of this title</ref>, on a pro rata basis.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8ef201a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/4/B"><num value="B">(B)</num><content> For funds reserved for a metropolitan statistical area, to the State in which the metropolitan statistical area is located.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8ef201b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/4/C"><num value="C">(C)</num><content> If the Secretary is unable to make a reallocation under subparagraph (A) or (B), the Secretary shall make such funds available on a pro rata basis under the formula in paragraph (1)(A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8ef201c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/5"><num value="5" class="bold">(5)</num><heading class="bold"> Nonformula allocation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef201d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall allocate 10 percent of the amounts appropriated under <ref href="/us/usc/t42/s12912">section 12912 of this title</ref> among—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd8ef201e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/5/A/i"><num value="i">(i)</num><content> States and units of general local government that do not qualify for allocation of amounts under paragraph (1); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd8ef201f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/5/A/ii"><num value="ii">(ii)</num><content> States, units of general local government, and nonprofit organizations, to fund special projects of national significance.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2020-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Selection</heading><content><p style="-uslm-lc:I13" class="indent2">In selecting projects under this paragraph, the Secretary shall consider (i) relative numbers of acquired immunodeficiency syndrome cases and per capita acquired immunodeficiency syndrome incidence; (ii) housing needs of eligible persons in the community; (iii) extent of local planning and coordination of housing programs for eligible persons; and (iv) the likelihood of the continuation of State and local efforts.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd8ef2021-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/iii/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> National significance projects</heading><content><p style="-uslm-lc:I13" class="indent2">For the purpose of subparagraph (A)(ii), in selecting projects of national significance the Secretary shall consider (i) the need to assess the effectiveness of a particular model for providing supportive housing for eligible persons; (ii) the innovative nature of the proposed activity; and (iii) the potential replicability of the proposed activity in other similar localities or nationally.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8ef2022-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/d"><num value="d" class="bold">(d)</num><heading class="bold"> Applications</heading><chapeau style="-uslm-lc:I11" class="indent0">Funds made available under this section shall be allocated among applications submitted by applicants and approved by the Secretary. Applications for assistance under this section shall be submitted by an applicant in such form and in accordance with such procedures as the Secretary shall establish. Such applications shall contain—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8ef2023-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/d/1"><num value="1">(1)</num><content> a description of the proposed activities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8ef2024-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/d/2"><num value="2">(2)</num><content> a description of the size and characteristics of the population that would be served by the proposed activities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8ef2025-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/d/3"><num value="3">(3)</num><content> a description of the public and private resources that are expected to be made available in connection with the proposed activities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8ef2026-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/d/4"><num value="4">(4)</num><content> assurances satisfactory to the Secretary that any property purchased, leased, rehabilitated, renovated, or converted with assistance under this section shall be operated for not less than 10 years for the purpose specified in the application, except as otherwise specified in this chapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8ef2027-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/d/5"><num value="5">(5)</num><content> evidence in a form acceptable to the Secretary that the proposed activities will meet urgent needs that are not being met by available public and private sources; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8ef2028-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/d/6"><num value="6">(6)</num><content> such other information or certifications that the Secretary determines to be necessary to achieve the purposes of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8ef2029-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/e"><num value="e" class="bold">(e)</num><heading class="bold"> Additional requirement for metropolitan areas</heading><content><p style="-uslm-lc:I11" class="indent0">In addition to the other requirements of this section, to be eligible for a grant to a metropolitan area under this section, the major city, urban county, and any city with a population of 50,000 or more in that metropolitan area shall establish or designate a governmental agency or organization for receipt and use of amounts received from a grant under this section and shall submit to the Secretary, together with the application under subsection (d) a proposal for the operation of such agency or organization.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8ef202a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s12903/f"><num value="f" class="bold">(f)</num><heading class="bold"> Additional requirement for city formula grantees</heading><content><p style="-uslm-lc:I11" class="indent0">In addition to the other requirements of this section, to be eligible for a grant pursuant to subsection (c)(1), a city shall provide such assurances as the Secretary may require that any grant amounts received will be allocated among eligible activities in a manner that addresses the needs within the metropolitan statistical area in which the city is located, including areas not within the jurisdiction of the city. Any such city shall coordinate with other units of general local government located within the metropolitan statistical area to provide such assurances and comply with the assurances.</p>
