value=\"12910\">§ 12910.</num><heading> Grants for community residences and services</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad4bdebe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Grant authority</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary of Housing and Urban Development may make grants to States and metropolitan areas to develop and operate community residences and provide services for eligible persons.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad4bdebf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Community residences and services</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad4bdec0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Community residences</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4bdec1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">A community residence under this section shall be a multiunit residence designed for eligible persons for the following purposes:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad4bdec2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/A/i\"><num value=\"i\">(i)</num><content> To provide a lower cost residential alternative to institutional care and to prevent or delay the need for institutional care.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad4bdec3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> To provide a permanent or transitional residential setting with appropriate services that enhances the quality of life for individuals who are unable to live independently.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad4bdec4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/A/iii\"><num value=\"iii\">(iii)</num><content> To prevent homelessness among eligible persons by increasing available suitable housing resources.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad4bdec5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/A/iv\"><num value=\"iv\">(iv)</num><content> To integrate eligible persons into local communities and provide services to maintain the abilities of such eligible persons to participate as fully as possible in community life.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4bdec6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Rent</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Except to the extent that the costs of providing residence are reimbursed or provided by any other assistance from Federal or non-Federal public sources, each resident in a community residence shall pay as rent for a dwelling unit an amount equal to the following:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad4bdec7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/B/i\"><num value=\"i\">(i)</num><content> For low-income individuals, the amount of rent paid under section 3(a) of the United States Housing Act of 1937 (<ref href=\"/us/usc/t42/s1437a/a\">42 U.S.C. 1437a(a)</ref>) by a low-income family (as the term is defined in section 3(b)(2) of such Act (<ref href=\"/us/usc/t42/s1437a/b/2\">42 U.S.C. 1437a(b)(2)</ref>)) for a dwelling unit assisted under such Act [<ref href=\"/us/usc/t42/s1437\">42 U.S.C. 1437</ref> et seq.].</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad4c05d8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/B/ii\"><num value=\"ii\">(ii)</num><content> For any resident that is not a low-income resident, an amount based on a formula, which shall be determined by the Secretary, under which rent is determined by the income and resources of the resident.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05d9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Fees</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Fees may be charged for any services provided under subsection (c)(2) to residents of a community residence, except that any fees charged shall be based on the income and resources of the resident and the provision of services to any resident of a community residence may not be withheld because of an inability of the resident to pay such fee.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05da-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Section 1437f assistance</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Assistance made available under section 8 of the United States Housing Act of 1937 (<ref href=\"/us/usc/t42/s1437f\">42 U.S.C. 1437f</ref>) may be used in conjunction with a community residence under this subsection for tenant-based assistance.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad4c05db-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Services provided with a grant under this section shall consist of services appropriate in assisting eligible persons to enhance their quality of life, enable such individuals to more fully participate in community life, and delay or prevent the placement of such individuals in hospitals or other institutions.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad4c05dc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Use of grants</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Any amounts received from a grant under this section may be used only as follows:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad4c05dd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Community residences</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For providing assistance in connection with community residences under subsection (b)(1) for the following activities:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05de-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Physical improvements</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Construction, acquisition, rehabilitation, conversion, retrofitting, and other physical improvements necessary to make a structure suitable for use as a community residence.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05df-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Operating costs</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Operating costs for a community residence.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05e0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Technical assistance</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Technical assistance in establishing and operating a community residence, which may include planning and other predevelopment or preconstruction expenses, and expenses relating to community outreach and educational activities regarding acquired immunodeficiency syndrome and related diseases provided for individuals residing in proximity of eligible persons assisted under this chapter.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05e1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> In-house services</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Services appropriate for individuals residing in a community residence, which may include staff training and recruitment.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad4c05e2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For providing services under subsection (b)(2) to any individuals assisted under this chapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad4c05e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Administrative expenses</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For administrative expenses related to the planning and carrying out activities under this section (subject to the provisions of <ref href=\"/us/usc/t42/s12905/g\">section 12905(g) of this title</ref>).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad4c05e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Limitations on use of grants</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad4c05e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Community residences</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Any jurisdiction that receives a grant under this section may not use any amounts received under the grant for the purposes under subsection (c)(1), except for planning and other expenses preliminary to construction or other physical improvement under subsection (c)(1)(A), unless the jurisdiction certifies to the Secretary, as the Secretary shall require, the following:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/d/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Service agreement</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">That the jurisdiction has entered into a written agreement with service providers qualified to deliver any services included in the proposal under subsection (c) to provide such services to eligible persons assisted by the community residence.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/d/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Funding and capability</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">That the jurisdiction will have sufficient funding for such services and the service providers are qualified to assist eligible persons.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/d/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Zoning and building codes</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">That any construction or physical improvements carried out with amounts received from the grant will comply with any applicable State and local housing codes and licensing requirements in the jurisdiction in which the building or structure is located.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad4c05e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/d/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Intensive assistance</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">That, for any individual with acquired immunodeficiency syndrome or related diseases who resides in a community residence assisted under the grant and who requires more intensive care than can be provided by the community residence, the jurisdiction will locate for and refer the individual to a service provider who can appropriately care for the individual.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad4c2cfa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s12910/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any jurisdiction that receives a grant under this section may use any amounts received under the grant for the purposes under subsection (c)(2) only for the provision of services by service providers qualified to provide such services to eligible persons.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit
