<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida6f937d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a"><num value="1314a">§ 1314a.</num><heading> Measurement and reporting of welfare receipt</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6f937d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/a"><num value="a" class="bold">(a)</num><heading class="bold"> Congressional policy</heading><chapeau style="-uslm-lc:I11" class="indent0">The Congress hereby declares that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida6f937d6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/a/1"><num value="1">(1)</num><content> it is the policy and responsibility of the Federal Government to reduce the rate at which and the degree to which families depend on income from welfare programs and the duration of welfare receipt, consistent with other essential national goals;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6f937d7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/a/2"><num value="2">(2)</num><content> it is the policy of the United States to strengthen families, to ensure that children grow up in families that are economically self-sufficient and that the life prospects of children are improved, and to underscore the responsibility of parents to support their children;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6f937d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/a/3"><num value="3">(3)</num><content> the Federal Government should help welfare recipients as well as individuals at risk of welfare receipt to improve their education and job skills, to obtain child care and other necessary support services, and to take such other steps as may be necessary to assist them to become financially independent; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6f937d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/a/4"><num value="4">(4)</num><content> it is the purpose of this section to provide the public with generally accepted measures of welfare receipt so that it can track such receipt over time and determine whether progress is being made in reducing the rate at which and, to the extent feasible, the degree to which, families depend on income from welfare programs and the duration of welfare receipt.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6f937da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Development of welfare indicators and predictors</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary of Health and Human Services (in this section referred to as the “Secretary”) in consultation with the Secretary of Agriculture shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida6f95eeb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/1"><num value="1">(1)</num><chapeau> develop—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f95eec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/1/A"><num value="A">(A)</num><content> indicators of the rate at which and, to the extent feasible, the degree to which, families depend on income from welfare programs and the duration of welfare receipt; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f95eed-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/1/B"><num value="B">(B)</num><content> predictors of welfare receipt;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6f95eee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/2"><num value="2">(2)</num><content> assess the data needed to report annually on the indicators and predictors, including the ability of existing data collection efforts to provide such data and any additional data collection needs; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida6f95eef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/3"><num value="3">(3)</num><chapeau> not later than 2 years after <date date="1994-10-31">October 31, 1994</date>, provide an interim report containing conclusions resulting from the development and assessment described in paragraphs (1) and (2), to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f95ef0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/3/A"><num value="A">(A)</num><content> the Committee on Ways and Means of the House of Representatives;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f95ef1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/3/B"><num value="B">(B)</num><content> the Committee on Education and Labor of the House of Representatives;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f95ef2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/b/3/C"><num value="C">(C)</num><content> the Committee on Agriculture of the House of Representatives;</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6f95ef7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Advisory Board on Welfare Indicators</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95ef8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">There is established an Advisory Board on Welfare Indicators (in this subsection referred to as the “Board”).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95ef9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Composition</heading><content><p style="-uslm-lc:I12" class="indent1">The Board shall be composed of 12 members with equal numbers to be appointed by the House of Representatives, the Senate, and the President. The Board shall be composed of experts in the fields of welfare research and welfare statistical methodology, representatives of State and local welfare agencies, and organizations concerned with welfare issues.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95efa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Vacancies</heading><content><p style="-uslm-lc:I12" class="indent1">Any vacancy occurring in the membership of the Board shall be filled in the same manner as the original appointment for the position being vacated. The vacancy shall not affect the power of the remaining members to execute the duties of the Board.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95efb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Duties</heading><chapeau style="-uslm-lc:I12" class="indent1">Duties of the Board shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f95efc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/4/A"><num value="A">(A)</num><content> providing advice and recommendations to the Secretary on the development of indicators of the rate at which and, to the extent feasible, the degree to which, families depend on income from welfare programs and the duration of welfare receipt; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f95efd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/4/B"><num value="B">(B)</num><content> providing advice on the development and presentation of annual reports required under subsection (d).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95efe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Travel expenses</heading><content><p style="-uslm-lc:I12" class="indent1">Members of the Board shall not be compensated, but shall receive travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of chapter 57 of title 5 for each day the member is engaged in the performance of duties away from the home or regular place of business of the member.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95eff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/6"><num value="6" class="bold">(6)</num><heading class="bold"> Detail of Federal employees</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall detail, without reimbursement, any of the personnel of the Department of Health and Human Services to the Board to assist the Board in carrying out its duties. Any detail shall not interrupt or otherwise affect the civil service status or privileges of the Federal employee.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95f00-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/7"><num value="7" class="bold">(7)</num><heading class="bold"> Voluntary service</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding <ref href="/us/usc/t31/s1342">section 1342 of title 31</ref>, the Board may accept the voluntary services provided by a member of the Board.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95f01-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/c/8"><num value="8" class="bold">(8)</num><heading class="bold"> Termination of Board</heading><content><p style="-uslm-lc:I12" class="indent1">The Board shall be terminated at such time as the Secretary determines the duties described in paragraph (4) have been completed, but in any case prior to the submission of the first report required under subsection (d).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida6f95f02-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Annual welfare indicators report</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95f03-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Preparation</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall prepare annual reports on welfare receipt in the United States.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f95f04-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Coverage</heading><content><p style="-uslm-lc:I12" class="indent1">The report shall include analysis of families and individuals receiving assistance under means-tested benefit programs, including the program of aid to families with dependent children under part A of subchapter IV of this chapter, the supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<ref href="/us/usc/t7/s2011">7 U.S.C. 2011</ref> et seq.), and the Supplemental Security Income program under subchapter XVI of this chapter, or as general assistance under programs administered by State and local governments.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f98615-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I12" class="indent1">Each report shall set forth for each of the means-tested benefit programs described in paragraph (2)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f98616-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3/A"><num value="A">(A)</num><chapeau> indicators of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6f98617-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3/A/i"><num value="i">(i)</num><content> the rate at which and, to the extent feasible, the degree to which, families depend on income from welfare programs, and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f9861c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3/E"><num value="E">(E)</num><content> patterns of multiple program receipt;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f9861d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3/F"><num value="F">(F)</num><content> such other information as the Secretary deems relevant; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida6f9861e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3/G"><num value="G">(G)</num><chapeau> such recommendations for legislation, which shall not include proposals to reduce eligibility levels or impose barriers to program access, as the Secretary may determine to be necessary or desirable to reduce—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida6f9861f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3/G/i"><num value="i">(i)</num><content> the rate at which and the degree to which families depend on income from welfare programs, and</content>

<clause style="-uslm-lc:I14" class="indent3" id="ida6f98620-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/3/G/ii"><num value="ii">(ii)</num><content> the duration of welfare receipt.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida6f98621-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1314a/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Submission</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall submit such a report not later than 3 years after <date date="1994-10-31">October 31, 1994</date>, and annually thereafter, to the committees specified in subsection (b)(3). Each such report shall be transmitted during the first 60 days of each regular session of Congress.</p>
