<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8f6241d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235"><num value="13235">§ 13235.</num><heading> State and local incentives programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f6241e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment of program</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idd8f6241f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/1"><num value="1">(1)</num><content> The Secretary shall, within one year after <date date="1992-10-24">October 24, 1992</date>, issue regulations establishing guidelines for comprehensive State alternative fuels and alternative fueled vehicle incentives and program plans designed to accelerate the introduction and use of such fuels and vehicles. Such guideline <ref class="footnoteRef" idref="fn004078">1</ref><note type="footnote" id="fn004078"><num>1</num> So in original. Probably should be “guidelines”.</note> shall address the development, modification, and implementation of such State plans and shall describe those program elements, as described in paragraph (3), to be addressed in such plans.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f62420-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/2"><num value="2">(2)</num><chapeau> The Secretary, after consultation with the Secretary of Transportation and the Administrator of the Environmental Protection Agency, shall invite the Governor of each State to submit to the Secretary a State plan within one year after the effective date of the regulations issued under paragraph (1). Such plan shall include—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62421-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/2/A"><num value="A">(A)</num><content> provisions designed to result in scheduled progress toward, and achievement of, the goal of introducing substantial numbers of alternative fueled vehicles in such State by the year 2000; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62422-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/2/B"><num value="B">(B)</num><content> a detailed description of the requirements, including the estimated cost of implementation, of such plan.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f62423-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3"><num value="3">(3)</num><chapeau> Each proposed State plan, in order to be eligible for Federal assistance under this section, shall describe the manner in which coordination shall be achieved with Federal and local governmental entities in implementing such plan, and shall include an examination of—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62424-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/A"><num value="A">(A)</num><content> exemption from State sales tax or other State or local taxes or surcharges (other than such taxes or surcharges which are dedicated for transportation purposes) with respect to alternative fueled vehicles, alternative fuels, or alternative fueling facilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62425-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/B"><num value="B">(B)</num><content> the introduction of alternative fueled vehicles into State-owned or operated motor vehicle fleets;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62426-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/C"><num value="C">(C)</num><content> special parking at public buildings and airport and transportation facilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62427-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/D"><num value="D">(D)</num><content> programs of public education to promote the use of alternative fueled vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62428-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/E"><num value="E">(E)</num><content> the treatment of sales of alternative fuels for use in alternative fueled vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62429-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/F"><num value="F">(F)</num><chapeau> methods by which State and local governments might facilitate—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idd8f6242a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/F/i"><num value="i">(i)</num><content> the availability of alternative fuels; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd8f6242b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/F/ii"><num value="ii">(ii)</num><content> the ability to recharge electric motor vehicles at public locations;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f6242c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/G"><num value="G">(G)</num><chapeau> allowing public utilities to include in rates the incremental cost of—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idd8f6242d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/G/i"><num value="i">(i)</num><content> new alternative fueled vehicles;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd8f6242e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/G/ii"><num value="ii">(ii)</num><content> converting conventional vehicles to operate on alternative fuels; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd8f6242f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/G/iii"><num value="iii">(iii)</num><content> installing alternative fuel fueling facilities,</content>
</clause>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">but only to the extent that the inclusion of such costs in rates would not create competitive disadvantages for other market participants, and taking into consideration the effect inclusion of such costs would have on rates, service, and reliability to other utility customers;</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62430-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/H"><num value="H">(H)</num><content> such other programs and incentives as the State may describe;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62431-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/I"><num value="I">(I)</num><content> whether accomplishing any of the goals in this subsection would require amendment to State law or regulation, including traffic safety prohibitions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62432-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/J"><num value="J">(J)</num><content> services provided by municipal, county, and regional transit authorities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62433-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/a/3/K"><num value="K">(K)</num><content> effects of such plan on programs authorized by the Intermodal Surface Transportation Efficiency Act of 1991 and amendments made by that Act.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f62434-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b"><num value="b" class="bold">(b)</num><heading class="bold"> Federal assistance to States</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idd8f62435-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/1"><num value="1">(1)</num><chapeau> Upon request of the Governor of any State with a plan approved under this section, the Secretary may provide to such State—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62436-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/1/A"><num value="A">(A)</num><content> information and technical assistance, including model State laws and proposed regulations relating to alternative fueled vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62437-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/1/B"><num value="B">(B)</num><content> grants of Federal financial assistance for the purpose of assisting such State in the implementation of such plan or any part thereof; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62438-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/1/C"><num value="C">(C)</num><content> grants of Federal financial assistance for the acquisition of alternative fueled vehicles.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f62439-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/2"><num value="2">(2)</num><chapeau> In determining whether to approve a State plan submitted under subsection (a), and in determining the amount of Federal financial assistance, if any, to be provided to any State under this subsection, the Secretary shall take into account—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f6243a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/2/A"><num value="A">(A)</num><content> the energy-related and environmental-related impacts, on a life cycle basis, of the introduction and use of alternative fueled vehicles included in the plan compared to conventional motor vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f6243b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/2/B"><num value="B">(B)</num><content> the number of alternative fueled vehicles likely to be introduced by the year 2000, as a result of successful implementation of the plan; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f6243c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/2/C"><num value="C">(C)</num><content> such other factors as the Secretary considers appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f6243d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/3"><num value="3">(3)</num><content> The Secretary, in consultation with the Administrator of General Services, shall provide assistance to States in procuring alternative fueled vehicles, including coordination with Federal procurements of such vehicles.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f6243e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/b/4"><num value="4">(4)</num><content> The Secretary may not approve a State plan submitted under subsection (a) unless the State agrees to provide at least 20 percent of the cost of activities for which assistance is provided under paragraph (1).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f6243f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c"><num value="c" class="bold">(c)</num><heading class="bold"> General provisions</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idd8f62440-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c/1"><num value="1">(1)</num><content> In carrying out this section, the Secretary shall consult with the Secretary of Transportation on matters relating to transportation and with other appropriate Federal and State departments and agencies.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f62441-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c/2"><num value="2">(2)</num><chapeau> The Secretary shall report annually to the President and the Congress, and shall furnish copies of such report to the Governor of each State participating in the program, on the operation of the program under this section. Such report shall include—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62442-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c/2/A"><num value="A">(A)</num><content> an estimate of the number of alternative fueled vehicles in use in each State;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62443-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c/2/B"><num value="B">(B)</num><content> the degree of each State’s participation in the program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62444-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c/2/C"><num value="C">(C)</num><content> a description of Federal, State, and local programs undertaken in the various States, whether pursuant to a State plan under this section or not, to provide incentives for introduction of alternative fueled vehicles;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62445-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c/2/D"><num value="D">(D)</num><content> an estimate of the energy and environmental benefits of the program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idd8f62446-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/c/2/E"><num value="E">(E)</num><content> the recommendations of the Secretary, if any, for additional action by the Federal Government.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f62447-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/d"><num value="d" class="bold">(d)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this section, the following definitions apply:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8f62448-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Governor</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Governor” means the chief executive of a State.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8f62449-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and any other Commonwealth, territory, or possession of the United States.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f6244a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13235/e"><num value="e" class="bold">(e)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated for carrying out this section, $10,000,000 for each of the 5 fiscal years beginning after <date date="1992-10-24">October 24, 1992</date>.</p>
