L. 102–486, title VI, § 613, Oct. 24, 1992, 106 Stat. 2902.)","seq_in_title":6809,"parent_identifier":"/us/usc/t42/ch134/schIV/ptA","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch134","level":"chapter","num":"CHAPTER 134—","heading":"ENERGY POLICY","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch134/schIV","level":"subchapter","num":"SUBCHAPTER IV—","heading":"ELECTRIC MOTOR VEHICLES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch134/schIV/ptA","level":"part","num":"Part A—","heading":"Electric Motor Vehicle Commercial Demonstration Program","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad53a725-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283\"><num value=\"13283\">§ 13283.</num><heading> Discount payments</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad53a726-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Certification</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall provide a discount payment to a proposer of a proposal selected under this part for purposes of reimbursing the proposer for a discount provided to the users if the proposer certifies to the Secretary that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad53a727-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/a/1\"><num value=\"1\">(1)</num><content> the electric motor vehicles have been purchased or leased by a user or users in accordance with the requirements of this part; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad53a728-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/a/2\"><num value=\"2\">(2)</num><content> the proposer has provided to the user or users a discount payment in accordance with the requirements of this part.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad53a729-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Payment</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 30 days after receipt from the proposer of certification that the Secretary determines satisfies the requirements of subsection (a), the Secretary shall pay to the proposer the full amount of the discount payment, to the extent provided in advance in appropriations Acts.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad53ce3a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Calculations of discount payments</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad53ce3b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/c/1\"><num value=\"1\">(1)</num><chapeau> The discount payment shall be no greater than—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad53ce3c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/c/1/A\"><num value=\"A\">(A)</num><content> the price differential; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad53ce3d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/c/1/B\"><num value=\"B\">(B)</num><content> the price of the comparable conventionally fueled motor vehicle.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad53ce3e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/c/2\"><num value=\"2\">(2)</num><content> The purchase price of the electric motor vehicle, less the discount payment and less any additional reduction in the purchase price of the electric motor vehicle that may result from contributions provided by other parties, may not be less than the manufacturer’s suggested retail price of a comparable conventionally fueled motor vehicle.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad53ce3f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13283/c/3\"><num value=\"3\">(3)</num><content> The maximum discount payment shall be no greater than $10,000 per electric motor vehicle.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idad53ce40-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/102/486/tVI/s613\">Pub.
