<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd8f8963a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317"><num value="13317">§ 13317.</num><heading> Renewable energy production incentive</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f8963b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a"><num value="a" class="bold">(a)</num><heading class="bold"> Incentive payments</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idd8f8963c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/1"><num value="1">(1)</num><content> For electric energy generated and sold by a qualified renewable energy facility during the incentive period, the Secretary shall make, subject to the availability of appropriations, incentive payments to the owner or operator of such facility.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f8963d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/2"><num value="2">(2)</num><content> The amount of such payment made to any such owner or operator shall be as determined under subsection (e).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f8963e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/3"><num value="3">(3)</num><content> Payments under this section may only be made upon receipt by the Secretary of an incentive payment application which establishes that the applicant is eligible to receive such payment.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idd8f8963f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I11" class="indent0" id="idd8f89640-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/4/A"><num value="A">(A)</num><chapeau> Subject to subparagraph (B), if there are insufficient appropriations to make full payments for electric production from all qualified renewable energy facilities for a fiscal year, the Secretary shall assign—</chapeau><clause style="-uslm-lc:I12" class="indent1" id="idd8f89641-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/4/A/i"><num value="i">(i)</num><content> 60 percent of appropriated funds for the fiscal year to facilities that use solar, wind, ocean (including tidal, wave, current, and thermal), geothermal, or closed-loop (dedicated energy crops) biomass technologies to generate electricity; and</content>
</clause>
<clause style="-uslm-lc:I12" class="indent1" id="idd8f89642-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/4/A/ii"><num value="ii">(ii)</num><content> 40 percent of appropriated funds for the fiscal year to other projects.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I11" class="indent0" id="idd8f89643-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/a/4/B"><num value="B">(B)</num><content> After submitting to Congress an explanation of the reasons for the alteration, the Secretary may alter the percentage requirements of subparagraph (A).</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f89644-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/b"><num value="b" class="bold">(b)</num><heading class="bold"> Qualified renewable energy facility</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section, a qualified renewable energy facility is a facility which is owned by a not-for-profit electric cooperative, a public utility described in <ref href="/us/usc/t26/s115">section 115 of title 26</ref>, a State, Commonwealth, territory, or possession of the United States, or the District of Columbia, or a political subdivision thereof, an Indian tribal government or subdivision thereof, or a Native Corporation (as defined in <ref href="/us/usc/t43/s1602">section 1602 of title 43</ref>), and which generates electric energy for sale in, or affecting, interstate commerce using solar, wind, biomass, landfill gas, livestock methane, ocean (including tidal, wave, current, and thermal), or geothermal energy, except that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd8f89645-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/b/1"><num value="1">(1)</num><content> the burning of municipal solid waste shall not be treated as using biomass energy; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd8f89646-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/b/2"><num value="2">(2)</num><chapeau> geothermal energy shall not include energy produced from a dry steam geothermal reservoir which has—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd8f89647-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/b/2/A"><num value="A">(A)</num><content> no mobile liquid in its natural state;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8f89648-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/b/2/B"><num value="B">(B)</num><content> steam quality of 95 percent water; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd8f89649-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/b/2/C"><num value="C">(C)</num><content> an enthalpy for the total produced fluid greater than or equal to 1200 Btu/lb (British thermal units per pound).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f8964a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/c"><num value="c" class="bold">(c)</num><heading class="bold"> Eligibility window</heading><content><p style="-uslm-lc:I11" class="indent0">Payments may be made under this section only for electricity generated from a qualified renewable energy facility first used before <date date="2016-10-01">October 1, 2016</date>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f8964b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/d"><num value="d" class="bold">(d)</num><heading class="bold"> Payment period</heading><content><p style="-uslm-lc:I11" class="indent0">A qualified renewable energy facility may receive payments under this section for a 10-fiscal year period. Such period shall begin with the fiscal year in which electricity generated from the facility is first eligible for such payments, or in which the Secretary determines that all necessary Federal and State authorizations have been obtained to begin construction of the facility.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f8964c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/e"><num value="e" class="bold">(e)</num><heading class="bold"> Amount of payment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8f8964d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Incentive payments made by the Secretary under this section to the owner or operator of any qualified renewable energy facility shall be based on the number of kilowatt hours of electricity generated by the facility through the use of solar, wind, biomass, landfill gas, livestock methane, ocean (including tidal, wave, current, and thermal), or geothermal energy during the payment period referred to in subsection (d). For any facility, the amount of such payment shall be 1.5 cents per kilowatt hour, adjusted as provided in paragraph (2).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd8f8964e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Adjustments</heading><content><p style="-uslm-lc:I12" class="indent1">The amount of the payment made to any person under this subsection as provided in paragraph (1) shall be adjusted for inflation for each fiscal year beginning after calendar year 1993 in the same manner as provided in the provisions of <ref href="/us/usc/t26/s29/d/2/B">section 29(d)(2)(B) of title 26</ref>,<ref class="footnoteRef" idref="fn004081">1</ref><note type="footnote" id="fn004081"><num>1</num> See References in Text note below.</note> except that in applying such provisions the calendar year 1993 shall be substituted for calendar year 1979.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f8964f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/f"><num value="f" class="bold">(f)</num><heading class="bold"> Sunset</heading><content><p style="-uslm-lc:I11" class="indent0">No payment may be made under this section to any facility after <date date="2026-09-30">September 30, 2026</date>, and no payment may be made under this section to any facility after a payment has been made with respect to such facility for a 10-fiscal year period.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd8f89650-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13317/g"><num value="g" class="bold">(g)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There are authorized to be appropriated such sums as are necessary to carry out this section for each of fiscal years 2006 through 2026, to remain available until expended.</p>
