The Administrator of the Energy Information Administration shall annually update and analyze such inventory using available data. This subsection does not provide any new data collection authority.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad58898a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Voluntary reporting</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad58898b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Issuance of guidelines</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 18 months after <date date=\"1992-10-24\">October 24, 1992</date>, the Secretary shall, after opportunity for public comment, issue guidelines for the voluntary collection and reporting of information on sources of greenhouse gases. Such guidelines shall establish procedures for the accurate voluntary reporting of information on—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad58898c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/A\"><num value=\"A\">(A)</num><chapeau> greenhouse gas emissions—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad58898d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/A/i\"><num value=\"i\">(i)</num><content> for the baseline period of 1987 through 1990; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad58898e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> for subsequent calendar years on an annual basis;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad58898f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/B\"><num value=\"B\">(B)</num><content> annual reductions of greenhouse gas emissions and carbon fixation achieved through any measures, including fuel switching, forest management practices, tree planting, use of renewable energy, manufacture or use of vehicles with reduced greenhouse gas emissions, appliance efficiency, energy efficiency, methane recovery, cogeneration, chlorofluorocarbon capture and replacement, and power plant heat rate improvement;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad588990-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/C\"><num value=\"C\">(C)</num><chapeau> reductions in greenhouse gas emissions achieved as a result of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad588991-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/C/i\"><num value=\"i\">(i)</num><content> voluntary reductions;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad588992-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/C/ii\"><num value=\"ii\">(ii)</num><content> plant or facility closings; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad588993-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/C/iii\"><num value=\"iii\">(iii)</num><content> State or Federal requirements; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad588994-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/1/D\"><num value=\"D\">(D)</num><content> an aggregate calculation of greenhouse gas emissions by each reporting entity.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">Such guidelines shall also establish procedures for taking into account the differential radiative activity and atmospheric lifetimes of each greenhouse gas.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad588995-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Reporting procedures</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Administrator of the Energy Information Administration shall develop forms for voluntary reporting under the guidelines established under paragraph (1), and shall make such forms available to entities wishing to report such information. Persons reporting under this subsection shall certify the accuracy of the information reported.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad588996-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Confidentiality</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Trade secret and commercial or financial information that is privileged or confidential shall be protected as provided in <ref href=\"/us/usc/t5/s552/b/4\">section 552(b)(4) of title 5</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad58b0a7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Establishment of data base</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not later than 18 months after <date date=\"1992-10-24\">October 24, 1992</date>, the Secretary, through the Administrator of the Energy Information Administration, shall establish a data base comprised of information voluntarily reported under this subsection. Such information may be used by the reporting entity to demonstrate achieved reductions of greenhouse gases.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad58b0a8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13385/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Consultation</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In carrying out this section, the Secretary shall consult, as appropriate, with the Administrator of the Environmental Protection Agency.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idad58b0a9-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/102/486/tXVI/s1605\">Pub.
