L. 102–550, title VI, § 652, Oct. 28, 1992, 106 Stat. 3823.)","seq_in_title":6925,"parent_identifier":"/us/usc/t42/ch135/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch135","level":"chapter","num":"CHAPTER 135—","heading":"RESIDENCY AND SERVICE REQUIREMENTS IN FEDERALLY ASSISTED HOUSING","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch135/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"AUTHORITY TO PROVIDE PREFERENCES FOR ELDERLY RESIDENTS AND UNITS FOR DISABLED RESIDENTS IN CERTAIN SECTION 8 ASSISTED HOUSING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad5f8eae-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13612\"><num value=\"13612\">§ 13612.</num><heading> Reservation of units for disabled families</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad5f8eaf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13612/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Requirement</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of law, for any project for which an owner gives preference in occupancy to elderly families pursuant to <ref href=\"/us/usc/t42/s13611\">section 13611 of this title</ref>, such owner shall (subject to sections 13613, 13614, and 13615 of this title) reserve units in the project for occupancy only by disabled families who are not elderly or near-elderly families (and who have applied for occupancy in the housing) in the number determined under subsection (b).</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad5f8eb0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13612/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Number of units</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Each owner required to reserve units in a project for occupancy under subsection (a) shall reserve a number of units in the project that is not less than the lesser of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad5f8eb1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13612/b/1\"><num value=\"1\">(1)</num><chapeau> the number of units equivalent to the higher of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad5f8eb2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13612/b/1/A\"><num value=\"A\">(A)</num><content> the percentage of units in the project that were occupied by such disabled families upon <date date=\"1992-10-28\">October 28, 1992</date>; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad5f8eb3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13612/b/1/B\"><num value=\"B\">(B)</num><content> the percentage of units in the project that were occupied by such families upon <date date=\"1992-01-01\">January 1, 1992</date>; or</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad5f8eb4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s13612/b/2\"><num value=\"2\">(2)</num><content> 10 percent of the number of units in the project.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idad5f8eb5-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/102/550/tVI/s652\">Pub.
