<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd9047c49-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631"><num value="13631">§ 13631.</num><heading> Requirement to provide service coordinators</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9047c4a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">To the extent that amounts are made available for providing service coordinators under this section, the Secretary shall require owners of covered federally assisted housing projects (as such term is defined in subsection (d)) receiving such amounts to provide for employing or otherwise retaining the services of one or more individuals to coordinate the provision of supportive services for elderly and disabled families residing in the projects (in this section referred to as a “service coordinator”). No such elderly or disabled family may be required to accept services.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9047c4b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/b"><num value="b" class="bold">(b)</num><heading class="bold"> Responsibilities</heading><chapeau style="-uslm-lc:I11" class="indent0">Each service coordinator of a covered federally assisted housing project provided pursuant to this subtitle <ref class="footnoteRef" idref="fn004103">1</ref><note type="footnote" id="fn004103"><num>1</num> See References in Text note below.</note> or the amendments made by this subtitle— <ref class="footnoteRef" idref="fn004103">1</ref></chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd9047c4c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/b/1"><num value="1">(1)</num><content> shall consult with the owner of the housing, tenants, any tenant organizations, any resident management organizations, service providers, and any other appropriate persons, to identify the particular needs and characteristics of elderly and disabled families who reside in the project and any supportive services related to such needs and characteristics;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9047c4d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/b/2"><num value="2">(2)</num><content> shall manage and coordinate the provision of such services for residents of the project;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9047c4e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/b/3"><num value="3">(3)</num><content> may provide training to tenants of the project in the obligations of tenancy or coordinate such training;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9047c4f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/b/4"><num value="4">(4)</num><content> shall meet the minimum qualifications and standards required under <ref href="/us/usc/t42/s8011/d/4">section 8011(d)(4) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9047c50-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/b/5"><num value="5">(5)</num><content> may carry out other appropriate activities for residents of the project.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9047c51-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/c"><num value="c" class="bold">(c)</num><heading class="bold"> Included services</heading><content><p style="-uslm-lc:I11" class="indent0">Supportive services referred to under subsection (b)(1) may include health-related services, mental health services, services for nonmedical counseling, meals, transportation, personal care, bathing, toileting, housekeeping, chore assistance, safety, group and socialization activities, assistance with medications (in accordance with any applicable State laws), case management, personal emergency response, education and outreach regarding telemarketing fraud in accordance with the standards issued under subsection (f), and other appropriate services. The services may be provided through any agency of the Federal Government or any other public or private department, agency, or organization.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9047c52-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/d"><num value="d" class="bold">(d)</num><heading class="bold"> Covered federally assisted housing</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of this subtitle,<sup>1</sup> the term “covered federally assisted housing” means housing that is federally assisted housing (as such term is defined in <ref href="/us/usc/t42/s13641/2">section 13641(2) of this title</ref>), except that such term does not include housing described in subparagraphs (C) and (D) of such section.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9047c53-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/e"><num value="e" class="bold">(e)</num><heading class="bold"> Services for low-income elderly or disabled families residing in vicinity of certain projects</heading><content><p style="-uslm-lc:I11" class="indent0">To the extent only that this section applies to service coordinators for covered federally assisted housing described in subparagraphs (B), (C), (D), (E), (F), and (G) of <ref href="/us/usc/t42/s13641/2">section 13641(2) of this title</ref>, any reference in this section to elderly or disabled residents of a project shall be construed to include low-income elderly or disabled families living in the vicinity of such project.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9047c54-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f"><num value="f" class="bold">(f)</num><heading class="bold"> Protection against telemarketing fraud</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9047c55-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary, in coordination with the Secretary of Health and Human Services, shall establish standards for service coordinators in federally assisted housing who are providing education and outreach to elderly persons residing in such housing regarding telemarketing fraud. The standards shall be designed to ensure that such education and outreach informs such elderly persons of the dangers of telemarketing fraud and facilitates the investigation and prosecution of telemarketers engaging in fraud against such residents.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9047c56-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I12" class="indent1">The standards established under this subsection shall require that any such education and outreach be provided in a manner that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9047c57-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/A"><num value="A">(A)</num><chapeau> informs such residents of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd9047c58-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/A/i"><num value="i">(i)</num><content> the prevalence of telemarketing fraud targeted against elderly persons;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9047c59-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/A/ii"><num value="ii">(ii)</num><content> how telemarketing fraud works;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9047c5a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/A/iii"><num value="iii">(iii)</num><content> how to identify telemarketing fraud;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9047c5b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/A/iv"><num value="iv">(iv)</num><content> how to protect themselves against telemarketing fraud, including an explanation of the dangers of providing bank account, credit card, or other financial or personal information over the telephone to unsolicited callers;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9047c5c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/A/v"><num value="v">(v)</num><content> how to report suspected attempts at telemarketing fraud; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9047c5d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/A/vi"><num value="vi">(vi)</num><content> their consumer protection rights under Federal law;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9047c5e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/B"><num value="B">(B)</num><content> provides such other information as the Secretary considers necessary to protect such residents against fraudulent telemarketing; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9047c5f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s13631/f/2/C"><num value="C">(C)</num><content> disseminates the information provided by appropriate means, and in determining such appropriate means, the Secretary shall consider on-site presentations at federally assisted housing, public service announcements, a printed manual or pamphlet, an Internet website, and telephone outreach to residents whose names appear on “mooch lists” confiscated from fraudulent telemarketers.</content>
