<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida733cfdd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g"><num value="1382g">§ 1382g.</num><heading> Payments to State for operation of supplementation program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida733cfde-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/a"><num value="a" class="bold">(a)</num><heading class="bold"> Eligibility; agreement with Commissioner</heading><chapeau style="-uslm-lc:I11" class="indent0">In order for any State which makes supplementary payments of the type described in <ref href="/us/usc/t42/s1382e/a">section 1382e(a) of this title</ref> (including payments pursuant to an agreement entered into under <ref href="/us/pl/93/66/s212/a">section 212(a) of Public Law 93–66</ref>), on or after <date date="1977-06-30">June 30, 1977</date>, to be eligible for payments pursuant to subchapter XIX with respect to expenditures for any calendar quarter which begins—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida733cfdf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/a/1"><num value="1">(1)</num><content> after <date date="1977-06-30">June 30, 1977</date>, or, if later,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida733cfe0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/a/2"><num value="2">(2)</num><content> after the calendar quarter in which it first makes such supplementary payments,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">such State must have in effect an agreement with the Commissioner of Social Security whereby the State will—</continuation>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida733cfe1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/a/3"><num value="3">(3)</num><content> continue to make such supplementary payments, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida733cfe2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/a/4"><num value="4">(4)</num><content> maintain such supplementary payments at levels which are not lower than the levels of such payments in effect in December 1976, or, if no such payments were made in that month, the levels for the first subsequent month in which such payments were made.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida733cfe3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/b"><num value="b" class="bold">(b)</num><heading class="bold"> Levels of supplementary payments</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida733cfe4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/b/1"><num value="1">(1)</num><content> The Commissioner of Social Security shall not find that a State has failed to meet the requirements imposed by paragraph (4) of subsection (a) with respect to the levels of its supplementary payments for a particular month or months if the State’s expenditures for such payments in the twelve-month period (within which such month or months fall) beginning on the effective date of any increase in the level of supplemental security income benefits pursuant to <ref href="/us/usc/t42/s1382f">section 1382f of this title</ref> are not less than its expenditures for such payments in the preceding twelve-month period.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida733cfe5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/b/2"><num value="2">(2)</num><content> For purposes of determining under paragraph (1) whether a State’s expenditures for supplementary payments in the 12-month period beginning on the effective date of any increase in the level of supplemental security income benefits are not less than the State’s expenditures for such payments in the preceding 12-month period, the Commissioner of Social Security, in computing the State’s expenditures, shall disregard, pursuant to a 1-time election of the State, all expenditures by the State for retroactive supplementary payments that are required to be made in connection with the retroactive supplemental security income benefits referred to in section 5041 of the Omnibus Budget Reconciliation Act of 1990.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida733f6f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/c"><num value="c" class="bold">(c)</num><heading class="bold"> Election to apply subsection (a)(4)</heading><content><p style="-uslm-lc:I11" class="indent0">Any State which satisfies the requirements of this section solely by reason of subsection (b) for a particular month or months in any 12-month period (described in such subsection) ending on or after <date date="1982-06-30">June 30, 1982</date>, may elect, with respect to any month in any subsequent 12-month period (so described), to apply subsection (a)(4) as though the reference to December 1976 in such subsection were a reference to the month of December which occurred in the 12-month period immediately preceding such subsequent period.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida733f6f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/d"><num value="d" class="bold">(d)</num><heading class="bold"> Determinations respecting any portion of period <date date="1980-07-01">July 1, 1980</date>, through <date date="1981-06-30">June 30, 1981</date></heading><content><p style="-uslm-lc:I11" class="indent0">The Commissioner of Social Security shall not find that a State has failed to meet the requirements imposed by paragraph (4) of subsection (a) with respect to the levels of its supplementary payments for any portion of the period <date date="1980-07-01">July 1, 1980</date>, through <date date="1981-06-30">June 30, 1981</date>, if the State’s expenditures for such payments in that twelve-month period were not less than its expenditures for such payments for the period <date date="1976-07-01">July 1, 1976</date>, through <date date="1977-06-30">June 30, 1977</date> (or, if the State made no supplementary payments in the period <date date="1976-07-01">July 1, 1976</date>, through <date date="1977-06-30">June 30, 1977</date>, the expenditures for the first twelve-month period extending from July 1 through June 30 in which the State made such payments).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida733f6f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/e"><num value="e" class="bold">(e)</num><heading class="bold"> Meeting subsection (a)(4) requirements for any month after March 1983</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida733f6f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/e/1"><num value="1">(1)</num><chapeau> For any particular month after March 1983, a State which is not treated as meeting the requirements imposed by paragraph (4) of subsection (a) by reason of subsection (b) shall be treated as meeting such requirements if and only if—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="ida733f6fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/e/1/A"><num value="A">(A)</num><content> the combined level of its supplementary payments (to recipients of the type involved) and the amounts payable (to or on behalf of such recipients) under <ref href="/us/usc/t42/s1382/b">section 1382(b) of this title</ref> and <ref href="/us/pl/93/66/s211/a/1/A">section 211(a)(1)(A) of Public Law 93–66</ref>, for that particular month,</content>
</subparagraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">is not less than—</continuation>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida733f6fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/e/1/B"><num value="B">(B)</num><content> the combined level of its supplementary payments (to recipients of the type involved) and the amounts payable (to or on behalf of such recipients) under <ref href="/us/usc/t42/s1382/b">section 1382(b) of this title</ref> and <ref href="/us/pl/93/66/s211/a/1/A">section 211(a)(1)(A) of Public Law 93–66</ref>, for March 1983, increased by the amount of all cost-of-living adjustments under <ref href="/us/usc/t42/s1382f">section 1382f of this title</ref> (and any other benefit increases under this subchapter) which have occurred after March 1983 and before that particular month.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida733f6fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/e/2"><num value="2">(2)</num><content> In determining the amount of any increase in the combined level involved under paragraph (1)(B) of this subsection, any portion of such amount which would otherwise be attributable to the increase under <ref href="/us/usc/t42/s1382f/c">section 1382f(c) of this title</ref> shall be deemed instead to be equal to the amount of the cost-of-living adjustment which would have occurred in July 1983 (without regard to the 3-percent limitation contained in <ref href="/us/usc/t42/s415/i/1/B">section 415(i)(1)(B) of this title</ref>) if section 111 of the Social Security Amendments of 1983 had not been enacted.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida733f6fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/f"><num value="f" class="bold">(f)</num><heading class="bold"> Passthrough relating to optional State supplementation</heading><content><p style="-uslm-lc:I11" class="indent0">The Commissioner of Social Security shall not find that a State has failed to meet the requirements imposed by subsection (a) with respect to the levels of its supplementary payments for the period <date date="1984-01-01">January 1, 1984</date>, through <date date="1985-12-31">December 31, 1985</date>, if in the period <date date="1986-01-01">January 1, 1986</date>, through <date date="1986-12-31">December 31, 1986</date>, its supplementary payment levels (other than to recipients of benefits determined under <ref href="/us/usc/t42/s1382/e/1/B">section 1382(e)(1)(B) of this title</ref>) are not less than those in effect in December 1976, increased by a percentage equal to the percentage by which payments under <ref href="/us/usc/t42/s1382/b">section 1382(b) of this title</ref> and <ref href="/us/pl/93/66/s211/a/1/A">section 211(a)(1)(A) of Public Law 93–66</ref> have been increased as a result of all adjustments under section 1382f(a) and (c) of this title which have occurred after December 1976 and before February 1986.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida7341e0e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g"><num value="g" class="bold">(g)</num><heading class="bold"> Mandatory pass-through of increased personal needs allowance</heading><chapeau style="-uslm-lc:I11" class="indent0">In order for any State which makes supplementary payments of the type described in <ref href="/us/usc/t42/s1382e/a">section 1382e(a) of this title</ref> (including payments pursuant to an agreement entered into under <ref href="/us/pl/93/66/s212/a">section 212(a) of Public Law 93–66</ref>) to recipients of benefits determined under <ref href="/us/usc/t42/s1382/e/1/B">section 1382(e)(1)(B) of this title</ref>, on or after <date date="1987-10-01">October 1, 1987</date>, to be eligible for payments pursuant to subchapter XIX with respect to any calendar quarter which begins—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida7341e0f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g/1"><num value="1">(1)</num><content> after <date date="1987-10-01">October 1, 1987</date>, or, if later</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida7341e10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g/2"><num value="2">(2)</num><content> after the calendar quarter in which it first makes such supplementary payments to recipients of benefits so determined,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">such State must have in effect an agreement with the Commissioner of Social Security whereby the State will—</continuation>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida7341e11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g/3"><num value="3">(3)</num><content> continue to make such supplementary payments to recipients of benefits so determined, and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="ida7341e12-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g/4"><num value="4">(4)</num><chapeau> maintain such supplementary payments to recipients of benefits so determined at levels which assure (with respect to any particular month beginning with July 1988) that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida7341e13-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g/4/A"><num value="A">(A)</num><content> the combined level of such supplementary payments and the amounts payable to or on behalf of such recipients under <ref href="/us/usc/t42/s1382/e/1/B">section 1382(e)(1)(B) of this title</ref> for that particular month,</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">is not less than—</continuation>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida7341e14-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g/4/B"><num value="B">(B)</num><chapeau> the combined level of such supplementary payments and the amounts payable to or on behalf of such recipients under <ref href="/us/usc/t42/s1382/e/1/B">section 1382(e)(1)(B) of this title</ref> for October 1987 (or, if no such supplementary payments were made for that month, the combined level for the first subsequent month for which such payments were made), increased—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida7341e15-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1382g/g/4/B/i"><num value="i">(i)</num><content> in a case to which clause (i) of such <ref href="/us/usc/t42/s1382/e/1/B">section 1382(e)(1)(B) of this title</ref> applies or (with respect to the individual or spouse who is in the hospital, home, or facility involved) to which clause (ii) of such section applies, by $5, and</content>
