firstIndent-2\" id=\"ida8bb8157-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Receipt of benefits through enrollment in PACE program; definitions for PACE program related terms</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bb8158-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Benefits through enrollment in a PACE program</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In accordance with this section, in the case of an individual who is entitled to benefits under part A or enrolled under part B and who is a PACE program eligible individual (as defined in paragraph (5)) with respect to a PACE program offered by a PACE provider under a PACE program agreement—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bba869-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/1/A\"><num value=\"A\">(A)</num><content> the individual may enroll in the program under this section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bba86a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/1/B\"><num value=\"B\">(B)</num><chapeau> so long as the individual is so enrolled and in accordance with regulations—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bba86b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/1/B/i\"><num value=\"i\">(i)</num><content> the individual shall receive benefits under this subchapter solely through such program; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bba86c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/1/B/ii\"><num value=\"ii\">(ii)</num><content> the PACE provider is entitled to payment under and in accordance with this section and such agreement for provision of such benefits.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bba86d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> “PACE program” defined</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section, the term “PACE program” means a program of all-inclusive care for the elderly that meets the following requirements:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bba86e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Operation</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The entity operating the program is a PACE provider (as defined in paragraph (3)).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bba86f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Comprehensive benefits</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The program provides comprehensive health care services to PACE program eligible individuals in accordance with the PACE program agreement and regulations under this section.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bba870-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Transition</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In the case of an individual who is enrolled under the program under this section and whose enrollment ceases for any reason (including that the individual no longer qualifies as a PACE program eligible individual, the termination of a PACE program agreement, or otherwise), the program provides assistance to the individual in obtaining necessary transitional care through appropriate referrals and making the individual’s medical records available to new providers.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bbcf81-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> “PACE provider” defined</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bbcf82-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this section, the term “PACE provider” means an entity that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bbcf83-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/3/A/i\"><num value=\"i\">(i)</num><content> subject to subparagraph (B), is (or is a distinct part of) a public entity or a private, nonprofit entity organized for charitable purposes under section 501(c)(3) of the Internal Revenue Code of 1986; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bbcf84-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/3/A/ii\"><num value=\"ii\">(ii)</num><content> has entered into a PACE program agreement with respect to its operation of a PACE program.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bbcf85-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Treatment of private, for-profit providers</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Clause (i) of subparagraph (A) shall not apply—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bbcf86-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/3/B/i\"><num value=\"i\">(i)</num><content> to entities subject to a demonstration project waiver under subsection (h); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bbcf87-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/3/B/ii\"><num value=\"ii\">(ii)</num><content> after the date the report under section 4804(b) of the Balanced Budget Act of 1997 is submitted, unless the Secretary determines that any of the findings described in subparagraph (A), (B), (C), or (D) of paragraph (2) of such section are true.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bbf698-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> “PACE program agreement” defined</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section, the term “PACE program agreement” means, with respect to a PACE provider, an agreement, consistent with this section, <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref> (if applicable), and regulations promulgated to carry out such sections, between the PACE provider and the Secretary, or an agreement between the PACE provider and a State administering agency for the operation of a PACE program by the provider under such sections.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bbf699-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> “PACE program eligible individual” defined</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section, the term “PACE program eligible individual” means, with respect to a PACE program, an individual who—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bbf69a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/5/A\"><num value=\"A\">(A)</num><content> is 55 years of age or older;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bbf69b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/5/B\"><num value=\"B\">(B)</num><content> subject to subsection (c)(4), is determined under subsection (c) to require the level of care required under the State medicaid plan for coverage of nursing facility services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bbf69c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/5/C\"><num value=\"C\">(C)</num><content> resides in the service area of the PACE program; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bbf69d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/5/D\"><num value=\"D\">(D)</num><content> meets such other eligibility conditions as may be imposed under the PACE program agreement for the program under subsection (e)(2)(A)(ii).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bbf69e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> “PACE protocol” defined</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section, the term “PACE protocol” means the Protocol for the Program of All-inclusive Care for the Elderly (PACE), as published by On Lok, Inc., as of <date date=\"1995-04-14\">April 14, 1995</date>, or any successor protocol that may be agreed upon between the Secretary and On Lok, Inc.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bc1daf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> “PACE demonstration waiver program” defined</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section, the term “PACE demonstration waiver program” means a demonstration program under either of the following sections (as in effect before the date of their repeal):</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc1db0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/7/A\"><num value=\"A\">(A)</num><content> Section 603(c) of the Social Security Amendments of 1983 (<ref href=\"/us/pl/98/21\">Public Law 98–21</ref>), as extended by section 9220 of the Consolidated Omnibus Budget Reconciliation Act of 1985 (<ref href=\"/us/pl/99/272\">Public Law 99–272</ref>).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc1db1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/7/B\"><num value=\"B\">(B)</num><content> Section 9412(b) of the Omnibus Budget Reconciliation Act of 1986 (<ref href=\"/us/pl/99/509\">Public Law 99–509</ref>).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bc1db2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> “State administering agency” defined</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section, the term “State administering agency” means, with respect to the operation of a PACE program in a State, the agency of that State (which may be the single agency responsible for administration of the State plan under subchapter XIX in the State) responsible for administering PACE program agreements under this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref> in the State.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bc1db3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> “Trial period” defined</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bc44c4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/9/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this section, the term “trial period” means, with respect to a PACE program operated by a PACE provider under a PACE program agreement, the first 3 contract years under such agreement with respect to such program.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bc44c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/9/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Treatment of entities previously operating PACE demonstration waiver programs</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each contract year (including a year occurring before the effective date of this section) during which an entity has operated a PACE demonstration waiver program shall be counted under subparagraph (A) as a contract year during which the entity operated a PACE program as a PACE provider under a PACE program agreement.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bc44c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/a/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> “Regulations” defined</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this section, the term “regulations” refers to interim final or final regulations promulgated under subsection (f) to carry out this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida8bc44c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Scope of benefits; beneficiary safeguards</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bc44c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Under a PACE program agreement, a PACE provider shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc44c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/1/A\"><num value=\"A\">(A)</num><chapeau> provide to PACE program eligible individuals enrolled with the provider, regardless of source of payment and directly or under contracts with other entities, at a minimum—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bc44ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/1/A/i\"><num value=\"i\">(i)</num><content> all items and services covered under this subchapter (for individuals enrolled under this section) and all items and services covered under subchapter XIX, but without any limitation or condition as to amount, duration, or scope and without application of deductibles, copayments, coinsurance, or other cost-sharing that would otherwise apply under this subchapter or such subchapter, respectively; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bc6bdb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> all additional items and services specified in regulations, based upon those required under the PACE protocol;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc6bdc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/1/B\"><num value=\"B\">(B)</num><content> provide such enrollees access to necessary covered items and services 24 hours per day, every day of the year;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc6bdd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/1/C\"><num value=\"C\">(C)</num><content> provide services to such enrollees through a comprehensive, multidisciplinary health and social services delivery system which integrates acute and long-term care services pursuant to regulations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc6bde-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/1/D\"><num value=\"D\">(D)</num><content> specify the covered items and services that will not be provided directly by the entity, and to arrange for delivery of those items and services through contracts meeting the requirements of regulations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bc6bdf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Quality assurance; patient safeguards</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The PACE program agreement shall require the PACE provider to have in effect at a minimum—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc6be0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/2/A\"><num value=\"A\">(A)</num><content> a written plan of quality assurance and improvement, and procedures implementing such plan, in accordance with regulations; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bc92f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/2/B\"><num value=\"B\">(B)</num><content> written safeguards of the rights of enrolled participants (including a patient bill of rights and procedures for grievances and appeals) in accordance with regulations and with other requirements of this subchapter and Federal and State law that are designed for the protection of patients.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bc92f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Treatment of medicare services furnished by noncontract physicians and other entities</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bc92f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Application of medicare advantage requirement with respect to medicare services furnished by noncontract physicians and other entities</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\"><ref href=\"/us/usc/t42/s1395w–22/k/1\">Section 1395w–22(k)(1) of this title</ref> (relating to limitations on balance billing against MA organizations for noncontract physicians and other entities with respect to services covered under this subchapter) shall apply to PACE providers, PACE program eligible individuals enrolled with such PACE providers, and physicians and other entities that do not have a contract or other agreement establishing payment amounts for services furnished to such an individual in the same manner as such section applies to MA organizations, individuals enrolled with such organizations, and physicians and other entities referred to in such section.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bc92f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Reference to related provision for noncontract providers of services</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For the provision relating to limitations on balance billing against PACE providers for services covered under this subchapter furnished by noncontract title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida8bcba06-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Eligibility determinations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bcba07-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The determination of whether an individual is a PACE program eligible individual—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bcba08-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/1/A\"><num value=\"A\">(A)</num><content> shall be made under and in accordance with the PACE program agreement; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida8bcba09-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/1/B\"><num value=\"B\">(B)</num><content> who is entitled to medical assistance under subchapter XIX, shall be made (or who is not so entitled, may be made) by the State administering agency.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bcba0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Condition</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An individual is not a PACE program eligible individual (with respect to payment under this section) unless the individual’s health status has been determined by the Secretary or the State administering agency, in accordance with regulations, to be comparable to the health status of individuals who have participated in the PACE demonstration waiver programs. Such determination shall be based upon information on health status and related indicators (such as medical diagnoses and measures of activities of daily living, instrumental activities of daily living, and cognitive impairment) that are part of a uniform minimum data set collected by PACE providers on potential PACE program eligible individuals.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bce11b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Annual eligibility recertifications</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bce11c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Subject to subparagraph (B), the determination described in subsection (a)(5)(B) for an individual shall be reevaluated at least annually.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bce11d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The requirement of annual reevaluation under subparagraph (A) may be waived during a period in accordance with regulations in those cases where the State administering agency determines that there is no reasonable expectation of improvement or significant change in an individual’s condition during the period because of the severity of chronic condition, or degree of impairment of functional capacity of the individual involved.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bce11e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Continuation of eligibility</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An individual who is a PACE program eligible individual may be deemed to continue to be such an individual notwithstanding a determination that the individual no longer meets the requirement of subsection (a)(5)(B) if, in accordance with regulations, in the absence of continued coverage under a PACE program the individual reasonably would be expected to meet such requirement within the succeeding 6-month period.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bd082f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Enrollment; disenrollment</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bd0830-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Voluntary disenrollment at any time</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The enrollment and disenrollment of PACE program eligible individuals in a PACE program shall be pursuant to regulations and the PACE program agreement and shall permit enrollees to voluntarily disenroll without cause at any time.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bd0831-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Limitations on disenrollment</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida8bd0832-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Regulations promulgated by the Secretary under this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>, and the PACE program agreement, shall provide that the PACE program may not disenroll a PACE program eligible individual except—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bd0833-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5/B/i/I\"><num value=\"I\">(I)</num><content> for nonpayment of premiums (if applicable) on a timely basis; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bd0834-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5/B/i/II\"><num value=\"II\">(II)</num><content> for engaging in disruptive or threatening behavior, as defined in such regulations (developed in close consultation with State administering agencies).</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida8bd0835-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> No disenrollment for noncompliant behavior</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Except as allowed under regulations promulgated to carry out clause (i)(II), a PACE program may not disenroll a PACE program eligible individual on the ground that the individual has engaged in noncompliant behavior if such behavior is related to a mental or physical condition of the individual. For purposes of the preceding sentence, the term “noncompliant behavior” includes repeated noncompliance with medical advice and repeated failure to appear for appointments.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida8bd2f46-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/c/5/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Timely review of proposed nonvoluntary disenrollment</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">A proposed disenrollment, other than a voluntary disenrollment, shall be subject to timely review and final determination by the Secretary or by the State administering agency (as applicable), prior to the proposed disenrollment becoming effective.</p>\n</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida8bd2f47-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Payments to PACE providers on capitated basis</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bd2f48-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In the case of a PACE provider with a PACE program agreement under this section, except as provided in this subsection or by regulations, the Secretary shall make prospective monthly payments of a capitation amount for each PACE program eligible individual enrolled under the agreement under this section in the same manner and from the same sources as payments are made to a Medicare+ÐChoice organization under <ref href=\"/us/usc/t42/s1395w–23\">section 1395w–23 of this title</ref> (or, for periods beginning before <date date=\"1999-01-01\">January 1, 1999</date>, to an eligible organization under a risk-sharing contract under <ref href=\"/us/usc/t42/s1395mm\">section 1395mm of this title</ref>). Such payments shall be subject to adjustment in the manner described in <ref href=\"/us/usc/t42/s1395w–23/a/2\">section 1395w–23(a)(2) of this title</ref> or <ref href=\"/us/usc/t42/s1395mm/a/1/E\">section 1395mm(a)(1)(E) of this title</ref>, as the case may be.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bd5659-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Capitation amount</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The capitation amount to be applied under this subsection for a provider for a contract year shall be an amount specified in the PACE program agreement for the year. Such amount shall be based upon payment rates established for purposes of payment under <ref href=\"/us/usc/t42/s1395w–23\">section 1395w–23 of this title</ref> (or, for periods before <date date=\"1999-01-01\">January 1, 1999</date>, for purposes of risk-sharing contracts under <ref href=\"/us/usc/t42/s1395mm\">section 1395mm of this title</ref>) and shall be adjusted to take into account the comparative frailty of PACE enrollees and such other factors as the Secretary determines to be appropriate. Such amount under such an agreement shall be computed in a manner so that the total payment level for all PACE program eligible individuals enrolled under a program is less than the projected payment under this subchapter for a comparable population not enrolled under a PACE program.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bd565a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Capitation rates determined without regard to the phase-out of the indirect costs of medical education from the annual Medicare Advantage capitation rate</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Capitation amounts under this subsection shall be determined without regard to the application of <ref href=\"/us/usc/t42/s1395w–23/k/4\">section 1395w–23(k)(4) of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida8bd7d6b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> PACE program agreement</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bd7d6c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Requirement</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bd7d6d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary, in close cooperation with the State administering agency, shall establish procedures for entering into, extending, and terminating PACE program agreements for the operation of PACE programs by entities that meet the requirements for a PACE provider under this section, <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>, and regulations.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bd7d6e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Numerical limitation</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida8bd7d6f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The Secretary shall not permit the number of PACE providers with which agreements are in effect under this section or under section 9412(b) of the Omnibus Budget Reconciliation Act of 1986 to exceed—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bd7d70-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/B/i/I\"><num value=\"I\">(I)</num><content> 40 as of <date date=\"1997-08-05\">August 5, 1997</date>; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bd7d71-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/B/i/II\"><num value=\"II\">(II)</num><content> as of each succeeding anniversary of <date date=\"1997-08-05\">August 5, 1997</date>, the numerical limitation under this subparagraph for the preceding year plus 20.</content>\n</subclause>\n</clause>\n\n<continuation style=\"-uslm-lc:I66\" class=\"indent3 firstIndent-1\"> Subclause (II) shall apply without regard to the actual number of agreements in effect as of a previous anniversary date.</continuation>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida8bd7d72-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Treatment of certain private, for-profit providers</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">The numerical limitation in clause (i) shall not apply to a PACE provider that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bda483-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/B/ii/I\"><num value=\"I\">(I)</num><content> is operating under a demonstration project waiver under subsection (h); or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bda484-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/1/B/ii/II\"><num value=\"II\">(II)</num><content> was operating under such a waiver and subsequently qualifies for PACE provider status pursuant to subsection (a)(3)(B)(ii).</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bda485-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Service area and eligibility</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bda486-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">A PACE program agreement for a PACE program—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bda487-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2/A/i\"><num value=\"i\">(i)</num><content> shall designate the service area of the program;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bda488-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2/A/ii\"><num value=\"ii\">(ii)</num><content> may provide additional requirements for individuals to qualify as PACE program eligible individuals with respect to the program;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bda489-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2/A/iii\"><num value=\"iii\">(iii)</num><content> shall be effective for a contract year, but may be extended for additional contract years in the absence of a notice by a party to terminate and is subject to termination by the Secretary and the State administering agency at any time for cause (as provided under the agreement);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bda48a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2/A/iv\"><num value=\"iv\">(iv)</num><content> shall require a PACE provider to meet all applicable State and local laws and requirements; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bda48b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2/A/v\"><num value=\"v\">(v)</num><content> shall contain such additional terms and conditions as the parties may agree to, so long as such terms and conditions are consistent with this section and regulations.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bda48c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Service area overlap</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In designating a service area under a PACE program agreement under subparagraph (A)(i), the Secretary (in consultation with the State administering agency) may exclude from designation an area that is already covered under another PACE program agreement, in order to avoid unnecessary duplication of services and avoid impairing the financial and service viability of an existing program.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bdcb9d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Data collection; development of outcome measures</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bdcb9e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Data collection</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida8bdcb9f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">Under a PACE program agreement, the PACE provider shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bdcba0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3/A/i/I\"><num value=\"I\">(I)</num><content> collect data;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bdcba1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3/A/i/II\"><num value=\"II\">(II)</num><content> maintain, and afford the Secretary and the State administering agency access to, the records relating to the program, including pertinent financial, medical, and personnel records; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8bdcba2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3/A/i/III\"><num value=\"III\">(III)</num><content> make available to the Secretary and the State administering agency reports that the Secretary finds (in consultation with State administering agencies) necessary to monitor the operation, cost, and effectiveness of the PACE program under this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"ida8bdcba3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Requirements during trial period</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">During the first 3 years of operation of a PACE program (either under this section or under a PACE demonstration waiver program), the PACE provider shall provide such additional data as the Secretary specifies in regulations in order to perform the oversight required under paragraph (4)(A).</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bdf2b4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Development of outcome measures</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Under a PACE program agreement, the PACE provider, the Secretary, and the State administering agency shall jointly cooperate in the development and implementation of health status and quality of life outcome measures with respect to PACE program eligible individuals.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bdf2b5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Oversight</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bdf2b6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Annual, close oversight during trial period</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">During the trial period (as defined in subsection (a)(9)) with respect to a PACE program operated by a PACE provider, the Secretary (in cooperation with the State administering agency) shall conduct a comprehensive annual review of the operation of the PACE program by the provider in order to assure compliance with the requirements of this section and regulations. Such a review shall include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bdf2b7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/A/i\"><num value=\"i\">(i)</num><content> an on-site visit to the program site;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bdf2b8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/A/ii\"><num value=\"ii\">(ii)</num><content> comprehensive assessment of a provider’s fiscal soundness;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bdf2b9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/A/iii\"><num value=\"iii\">(iii)</num><content> comprehensive assessment of the provider’s capacity to provide all PACE services to all enrolled participants;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bdf2ba-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/A/iv\"><num value=\"iv\">(iv)</num><content> detailed analysis of the entity’s substantial compliance with all significant requirements of this section and regulations; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be19cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/A/v\"><num value=\"v\">(v)</num><content> any other elements the Secretary or State administering agency considers necessary or appropriate.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be19cc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Continuing oversight</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">After the trial period, the Secretary (in cooperation with the State administering agency) shall continue to conduct such review of the operation of PACE providers and PACE programs as may be appropriate, taking into account the performance level of a provider and compliance of a provider with all significant requirements of this section and regulations.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be19cd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Disclosure</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The results of reviews under this paragraph shall be reported promptly to the PACE provider, along with any recommendations for changes to the provider’s program, and shall be made available to the public upon request.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8be19ce-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Termination of PACE provider agreements</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be19cf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Under regulations—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be19d0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/A/i\"><num value=\"i\">(i)</num><content> the Secretary or a State administering agency may terminate a PACE program agreement for cause; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be19d1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/A/ii\"><num value=\"ii\">(ii)</num><content> a PACE provider may terminate an agreement after appropriate notice to the Secretary, the State agency, and enrollees.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be19d2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Causes for termination</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In accordance with regulations establishing procedures for termination of PACE program agreements, the Secretary or a State administering agency may terminate a PACE program agreement with a PACE provider for, among other reasons, the fact that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be40e3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/B/i\"><num value=\"i\">(i)</num><chapeau> the Secretary or State administering agency determines that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8be40e4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/B/i/I\"><num value=\"I\">(I)</num><content> there are significant deficiencies in the quality of care provided to enrolled participants; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"ida8be40e5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/B/i/II\"><num value=\"II\">(II)</num><content> the provider has failed to comply substantially with conditions for a program or provider under this section or <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>; and</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be40e6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/B/ii\"><num value=\"ii\">(ii)</num><content> the entity has failed to develop and successfully initiate, within 30 days of the date of the receipt of written notice of such a determination, a plan to correct the deficiencies, or has failed to continue implementation of such a plan.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be40e7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/5/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Termination and transition procedures</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">An entity whose PACE provider agreement is terminated under this paragraph shall implement the transition procedures required under subsection (a)(2)(C).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8be40e8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Secretary’s oversight; enforcement authority</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be40e9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/6/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Under regulations, if the Secretary determines (after consultation with the State administering agency) that a PACE provider is failing substantially to comply with the requirements of this section and regulations, the Secretary (and the State administering agency) may take any or all of the following actions:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be67fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/6/A/i\"><num value=\"i\">(i)</num><content> Condition the continuation of the PACE program agreement upon timely execution of a corrective action plan.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be67fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/6/A/ii\"><num value=\"ii\">(ii)</num><content> Withhold some or all further payments under the PACE program agreement under this section or <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref> with respect to PACE program services furnished by such provider until the deficiencies have been corrected.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8be67fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/6/A/iii\"><num value=\"iii\">(iii)</num><content> Terminate such agreement.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be67fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/6/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Application of intermediate sanctions</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Under regulations, the Secretary may provide for the application against a PACE provider of remedies described in section 1395w–27(g)(2) (or, for periods before <date date=\"1999-01-01\">January 1, 1999</date>, <ref href=\"/us/usc/t42/s1395mm/i/6/B\">section 1395mm(i)(6)(B) of this title</ref>) or 1396b(m)(5)(B) of this title in the case of violations by the provider of the type described in section 1395w–27(g)(1) (or <ref href=\"/us/usc/t42/s1395mm/i/6/A\">section 1395mm(i)(6)(A) of this title</ref> for such periods) or 1396b(m)(5)(A) of this title, respectively (in relation to agreements, enrollees, and requirements under this section or <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>, respectively).</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8be67fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Procedures for termination or imposition of sanctions</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Under regulations, the provisions of <ref href=\"/us/usc/t42/s1395w–27/h\">section 1395w–27(h) of this title</ref> (or for periods before <date date=\"1999-01-01\">January 1, 1999</date>, <ref href=\"/us/usc/t42/s1395mm/i/9\">section 1395mm(i)(9) of this title</ref>) shall apply to termination and sanctions respecting a PACE program agreement and PACE provider under this subsection in the same manner as they apply to a termination and sanctions with respect to a contract and a Medicare+Choice organization under part C (or for such periods an eligible organization under <ref href=\"/us/usc/t42/s1395mm\">section 1395mm of this title</ref>).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8be8f0f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/e/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Timely consideration of applications for PACE program provider status</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In considering an application for PACE provider program status, the application shall be deemed approved unless the Secretary, within 90 days after the date of the submission of the application to the Secretary, either denies such request in writing or informs the applicant in writing with respect to any additional information that is needed in order to make a final determination with respect to the application. After the date the Secretary receives such additional information, the application shall be deemed approved unless the Secretary, within 90 days of such date, denies such request.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida8be8f10-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Regulations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8be8f11-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall issue interim final or final regulations to carry out this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8be8f12-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Use of PACE protocol</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8be8f13-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In issuing such regulations, the Secretary shall, to the extent consistent with the provisions of this section, incorporate the requirements applied to PACE demonstration waiver programs under the PACE protocol.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8beb624-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Flexibility</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In order to provide for reasonable flexibility in adapting the PACE service delivery model to the needs of particular organizations (such as those in rural areas or those that may determine it appropriate to use nonstaff physicians according to State licensing law requirements) under this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>, the Secretary (in close consultation with State administering agencies) may modify or waive provisions of the PACE protocol so long as any such modification or waiver is not inconsistent with and would not impair the essential elements, objectives, and requirements of this section, but may not modify or waive any of the following provisions:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8beb625-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/B/i\"><num value=\"i\">(i)</num><content> The focus on frail elderly qualifying individuals who require the level of care provided in a nursing facility.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8beb626-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/B/ii\"><num value=\"ii\">(ii)</num><content> The delivery of comprehensive, integrated acute and long-term care services.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8beb627-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/B/iii\"><num value=\"iii\">(iii)</num><content> The interdisciplinary team approach to care management and service delivery.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8beb628-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/B/iv\"><num value=\"iv\">(iv)</num><content> Capitated, integrated financing that allows the provider to pool payments received from public and private programs and individuals.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8beb629-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/B/v\"><num value=\"v\">(v)</num><content> The assumption by the provider of full financial risk.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8beb62a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Continuation of modifications or waivers of operational requirements under demonstration status</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If a PACE program operating under demonstration authority has contractual or other operating arrangements which are not otherwise recognized in regulation and which were in effect on <date date=\"2000-07-01\">July 1, 2000</date>, the Secretary (in close consultation with, and with the concurrence of, the State administering agency) shall permit any such program to continue such arrangements so long as such arrangements are found by the Secretary and the State to be reasonably consistent with the objectives of the PACE program.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bedd3b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Application of certain additional beneficiary and program protections</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bedd3c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In issuing such regulations and subject to subparagraph (B), the Secretary may apply with respect to PACE programs, providers, and agreements such requirements of part C (or, for periods before <date date=\"1999-01-01\">January 1, 1999</date>, <ref href=\"/us/usc/t42/s1395mm\">section 1395mm of this title</ref>) and sections 1396b(m) and 1396u–2 of this title relating to protection of beneficiaries and program integrity as would apply to Medicare+Choice organizations under part C (or for such periods eligible organizations under risk-sharing contracts under <ref href=\"/us/usc/t42/s1395mm\">section 1395mm of this title</ref>) and to medicaid managed care organizations under prepaid capitation agreements under <ref href=\"/us/usc/t42/s1396b/m\">section 1396b(m) of this title</ref>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bf044d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Considerations</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In issuing such regulations, the Secretary shall—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bf044e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/3/B/i\"><num value=\"i\">(i)</num><content> take into account the differences between populations served and benefits provided under this section and under part C (or, for periods before <date date=\"1999-01-01\">January 1, 1999</date>, <ref href=\"/us/usc/t42/s1395mm\">section 1395mm of this title</ref>) and <ref href=\"/us/usc/t42/s1396b/m\">section 1396b(m) of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bf044f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/3/B/ii\"><num value=\"ii\">(ii)</num><content> not include any requirement that conflicts with carrying out PACE programs under this section; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida8bf0450-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/3/B/iii\"><num value=\"iii\">(iii)</num><content> not include any requirement restricting the proportion of enrollees who are eligible for benefits under this subchapter or subchapter XIX.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bf0451-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/f/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Construction</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subsection shall be construed as preventing the Secretary from including in regulations provisions to ensure the health and safety of individuals enrolled in a PACE program under this section that are in addition to those otherwise provided under paragraphs (2) and (3).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida8bf0452-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Waivers of requirements</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">With respect to carrying out a PACE program under this section, the following requirements of this subchapter (and regulations relating to such requirements) are waived and shall not apply:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida8bf0453-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/g/1\"><num value=\"1\">(1)</num><content> <ref href=\"/us/usc/t42/s1395d\">Section 1395d of this title</ref>, insofar as it limits coverage of institutional services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida8bf0454-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/g/2\"><num value=\"2\">(2)</num><content> Sections 1395e, 1395f, 1395<i>l</i>, and 1395ww of this title, insofar as such sections relate to rules for payment for benefits.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida8bf2b65-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/g/3\"><num value=\"3\">(3)</num><content> Sections 1395f(a)(2)(B), 1395f(a)(2)(C), and 1395n(a)(2)(A) of this title, insofar as they limit coverage of extended care services or home health services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida8bf2b66-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/g/4\"><num value=\"4\">(4)</num><content> <ref href=\"/us/usc/t42/s1395x/i\">Section 1395x(i) of this title</ref>, insofar as it imposes a 3-day prior hospitalization requirement for coverage of extended care services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida8bf2b67-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/g/5\"><num value=\"5\">(5)</num><content> Paragraphs (1) and (9) of <ref href=\"/us/usc/t42/s1395y/a\">section 1395y(a) of this title</ref>, insofar as they may prevent payment for PACE program services to individuals enrolled under PACE programs.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida8bf2b68-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Demonstration project for for-profit entities</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bf2b69-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/h/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In order to demonstrate the operation of a PACE program by a private, for-profit entity, the Secretary (in close consultation with State administering agencies) shall grant waivers from the requirement under subsection (a)(3) that a PACE provider may not be a for-profit, private entity.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida8bf2b6a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/h/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Similar terms and conditions</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bf2b6b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/h/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided under subparagraph (B), and paragraph (1), the terms and conditions for operation of a PACE program by a provider under this subsection shall be the same as those for PACE providers that are nonprofit, private organizations.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida8bf2b6c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1395eee/h/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Numerical limitation</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The number of programs for which waivers are granted under this subsection shall not exceed 10. style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Secretary</inline>.—</heading><content>The term ‘Secretary’ means the Secretary of Health and Human Services.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Site Development Grants and Technical Assistance Program.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Site development grants.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Secretary shall establish a process and criteria to award site development grants to qualified PACE providers that have been approved to serve a rural area.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Amount per award</inline>.—</heading><content>A site development grant awarded under subparagraph (A) to any individual rural PACE pilot site shall not exceed $750,000.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Number of awards</inline>.—</heading><content>Not more than 15 rural PACE pilot sites shall be awarded a site development grant under subparagraph (A).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><heading> <inline class=\"small-caps\">Use of funds</inline>.—</heading><chapeau>Funds made available under a site development grant awarded under subparagraph (A) may be used for the following expenses only to the extent such expenses are incurred in relation to establishing or delivering PACE program services in a rural area:</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> Feasibility analysis and planning.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> Interdisciplinary team development.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> Development of a provider network, including contract development.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iv\">“(iv)</num><content> Development or adaptation of claims processing systems.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"v\">“(v)</num><content> Preparation of special education and outreach efforts required for the PACE program.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"vi\">“(vi)</num><content> Development of expense reporting required for calculation of outlier payments or reconciliation processes.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"vii\">“(vii)</num><content> Development of any special quality of care or patient satisfaction data collection efforts.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"viii\">“(viii)</num><content> Establishment of a working capital fund to sustain fixed administrative, facility, or other fixed costs until the provider reaches sufficient enrollment size.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ix\">“(ix)</num><content> Startup and development costs incurred prior to the approval of the rural PACE pilot site’s PACE provider application by CMS.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"x\">“(x)</num><content> Any other efforts determined by the rural PACE pilot site to be critical to its successful startup, as approved by the Secretary.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><heading> <inline class=\"small-caps\">Appropriation.—</inline></heading><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Out of funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary to carry out this subsection for fiscal year 2006, $7,500,000.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><heading> <inline class=\"small-caps\">Availability</inline>.—</heading><content>Funds appropriated under clause (i) shall remain available for expenditure through fiscal year 2008.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Technical assistance program</inline>.—</heading><chapeau>The Secretary shall establish a technical assistance program to provide—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> outreach and education to State agencies and provider organizations interested in establishing PACE programs in rural areas; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> technical assistance necessary to support rural PACE pilot sites.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Cost Outlier Protection for Rural PACE Pilot Sites.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Establishment of fund for reimbursement of outlier costs</inline>.—</heading><content>Notwithstanding any other provision of law, the Secretary shall establish an outlier fund to reimburse rural PACE pilot sites for recognized outlier costs (as defined in paragraph (3)) incurred for eligible outlier participants (as defined in paragraph (2)) in an amount, subject to paragraph (4), equal to 80 percent of the amount by which the recognized outlier costs exceeds $50,000.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Eligible outlier participant</inline>.—</heading><content>For purposes of this subsection, the term ‘eligible outlier participant’ means a PACE program eligible individual (as defined in sections 1894(a)(5) and 1934(a)(5) of the Social Security Act (<ref href=\"/us/usc/t42/s1395eee/a/5\">42 U.S.C. 1395eee(a)(5)</ref>; 1396u–4(a)(5))) who resides in a rural area and with respect to whom the rural PACE pilot site incurs more than $50,000 in recognized costs in a 12-month period.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Recognized outlier costs defined.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>For purposes of this subsection, the term ‘recognized outlier costs’ means, with respect to services furnished to an eligible outlier participant by a rural PACE pilot site, the least of the following (as documented by the site to the satisfaction of the Secretary) for the provision of inpatient and related physician and ancillary services for the eligible outlier participant in a given 12-month period:</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> If the services are provided under a contract between the pilot site and the provider, the payment rate specified under the contract.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> The payment rate established under the original Medicare fee-for-service program for such service.</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"iii\">“(iii)</num><content> The amount actually paid for the services by the pilot site.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Inclusion in only one period</inline>.—</heading><content>Recognized outlier costs may not be included in more than one 12-month period.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading>[two pars. (3) have been enacted] <inline class=\"small-caps\">Outlier expense payment.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading>[no subpar. (B) has been enacted] <inline class=\"small-caps\">Payment for outlier costs</inline>.—</heading><content>Subject to subparagraph (B), in the case of a rural PACE pilot site that has incurred outlier costs for an eligible outlier participant, the rural PACE pilot site shall receive an outlier expense payment equal to 80 percent of such costs that exceed $50,000.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><heading> <inline class=\"small-caps\">Limitations.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">Costs incurred per eligible outlier participant</inline>.—</heading><content>The total amount of outlier expense payments made under this subsection to a rural PACE pilot site with respect to an eligible outlier participant for any 12-month period shall not exceed $100,000 for the 12-month period used to calculate the payment.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Costs incurred per provider</inline>.—</heading><content>No rural PACE pilot site may receive more than $500,000 in total outlier expense payments in a 12-month period.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><heading> <inline class=\"small-caps\">Limitation of outlier cost reimbursement period</inline>.—</heading><content>A rural PACE pilot site shall only receive outlier expense payments under this subsection with respect to costs incurred during the first 3 years of the site’s operation.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><heading> <inline class=\"small-caps\">Requirement to access risk reserves prior to payment</inline>.—</heading><content>A rural PACE pilot site shall access and exhaust any risk reserves held or arranged for the provider (other than revenue or reserves maintained to satisfy the requirements of section 460.80(c) of title 42, Code of Federal Regulations) and any working capital established through a site development grant awarded under subsection (b)(1), prior to receiving any payment from the outlier fund.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><heading> <inline class=\"small-caps\">Application</inline>.—</heading><chapeau>In order to receive an outlier expense payment under this subsection with respect to an eligible outlier participant, a rural PACE pilot site shall submit an application containing—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> documentation of the costs incurred with respect to the participant;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> a certification that the site has complied with the requirements under paragraph (4); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> such additional information as the Secretary may require.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><heading> <inline class=\"small-caps\">Appropriation.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Out of funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary $10,000,000 to carry out this subsection for the period of fiscal years 2006 through 2010.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">Availability</inline>.—</heading><content>Funds appropriated under subparagraph (A) shall remain available for obligation through fiscal year 2010.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Evaluation of PACE Providers Serving Rural Service Areas</inline>.—</heading><content>Not later than 60 months after the date of enactment of this Act [<date date=\"2006-02-08\">Feb. 8, 2006</date>], the Secretary shall submit a report to Congress containing an evaluation of the experience of rural PACE pilot sites.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Amounts in Addition to Payments Under Social Security Act</inline>.—</heading><content>Any amounts paid under the authority of this section to a PACE provider shall be in addition to payments made to the provider under section 1894 or 1934 of the Social Security Act (<ref href=\"/us/usc/t42/s1395eee\">42 U.S.C. 1395eee</ref>; 1396u–4).”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida8c08b07-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Flexibility in Exercising Waiver Authority</heading><p><ref href=\"/us/pl/106/554/s1/a/6/tIX/s903\">Pub. L. 106–554, § 1(a)(6) [title IX, § 903]</ref>, <date date=\"2000-12-21\">Dec. 21, 2000</date>, <ref href=\"/us/stat/114/2763\">114 Stat. 2763</ref>, 2763A–583, provided that: <quotedContent origin=\"/us/pl/106/554/s1/a/6/tIX/s903\">\n<inline>“In applying sections 1894(f)(2)(B) and 1934(f)(2)(B) of the Social Security Act (<ref href=\"/us/usc/t42/s1395eee/f/2/B\">42 U.S.C. 1395eee(f)(2)(B)</ref>, 1396u–4(f)(2)(B)), the Secretary of Health and Human Services—</inline>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> shall approve or deny a request for a modification or a waiver of provisions of the PACE protocol not later than 90 days after the date the Secretary receives the request; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> may exercise authority to modify or waive such provisions in a manner that responds promptly to the needs of PACE programs relating to areas of employment and the use of community-based primary care physicians.”</content>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida8c08b08-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Transition; Regulations</heading><p><ref href=\"/us/pl/105/33/tIV/s4803\">Pub. L. 105–33</ref>, enacting this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref>, amending sections 1396b, 1396d, 1396r–5, and 1396v of this title, and enacting provisions set out as notes under this section and <ref href=\"/us/usc/t42/s1395b–6\">section 1395b–6 of this title</ref>] in a timely manner. Such regulations shall be designed so that entities may establish and operate PACE programs under sections 1894 and 1934 of the Social Security Act [<ref href=\"/us/usc/t42/s1395eee\">42 U.S.C. 1395eee</ref>, 1396u–4] (as added by sections 4801 and 4802 of this subtitle) for periods beginning not later than 1 year after the date of the enactment of this Act [<date date=\"1997-08-05\">Aug. 5, 1997</date>].</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Expansion and Transition for PACE Demonstration Project Waivers.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Expansion in current number and extension of demonstration projects</inline>.—</heading><chapeau>Section 9412(b) of the Omnibus Budget Reconciliation Act of 1986 [see subsec. (d) below], as amended by section 4118(g) of the Omnibus Budget Reconciliation Act of 1987, is amended—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> in paragraph (1), by inserting before the period at the end the following: ‘, except that the Secretary shall grant waivers of such requirements to up to the applicable numerical limitation specified in sections 1894(e)(1)(B) and 1934(e)(1)(B) of the Social Security Act’ [<ref href=\"/us/usc/t42/s1395eee/e/1/B\">42 U.S.C. 1395eee(e)(1)(B)</ref>, 1396u–4(e)(1)(B)]; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><chapeau> in paragraph (2)—</chapeau><clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"i\">“(i)</num><content> in subparagraph (A), by striking ‘, including permitting the organization to assume progressively (over the initial 3-year period of the waiver) the full financial risk’; and</content>\n</clause>\n<clause style=\"-uslm-lc:I24\" class=\"indent3\"><num value=\"ii\">“(ii)</num><content> in subparagraph (C), by adding at the end the following: ‘In granting further extensions, an organization shall not be required to provide for reporting of information which is only required because of the demonstration nature of the project.’</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Elimination of replication requirement</inline>.—</heading><content>Section 9412(b)(2)(B) of such Act, as so amended, shall not apply to waivers granted under such section after the date of the enactment of this Act [<date date=\"1997-08-05\">Aug. 5, 1997</date>].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Timely consideration of applications</inline>.—</heading><content>In considering an application for waivers under such section before the effective date of the repeals under subsection (d), subject to the numerical limitation under the amendment made by paragraph (1), the application shall be deemed approved unless the Secretary of Health and Human Services, within 90 days after the date of its submission to the Secretary, either denies such request in writing or informs the applicant in writing with respect to any additional information which is needed in order to make a final determination with respect to the application. After the date the Secretary receives such additional information, the application shall be deemed approved unless the Secretary, within 90 days of such date, denies such request.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Priority and Special Consideration in Application</inline>.—</heading><chapeau>During the 3-year period beginning on the date of the enactment of this Act [<date date=\"1997-08-05\">Aug. 5, 1997</date>]:</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">Provider status</inline>.—</heading><chapeau>The Secretary of Health and Human Services shall give priority in processing applications of entities to qualify as PACE programs under section 1894 or 1934 of the Social Security Act [<ref href=\"/us/usc/t42/s1395eee\">42 U.S.C. 1395eee</ref>, 1396u–4]—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> first, to entities that are operating a PACE demonstration waiver program (as defined in sections 1894(a)(7) and 1934(a)(7) of such Act [<ref href=\"/us/usc/t42/s1395eee/a/7\">42 U.S.C. 1395eee(a)(7)</ref>, 1396u–4(a)(7)]); and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> then to entities that have applied to operate such a program as of <date date=\"1997-05-01\">May 1, 1997</date>.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">New waivers</inline>.—</heading><chapeau>The Secretary shall give priority, in the awarding of additional waivers under section 9412(b) of the Omnibus Budget Reconciliation Act of 1986 [see subsec. (d) below]—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> to any entities that have applied for such waivers under such section as of <date date=\"1997-05-01\">May 1, 1997</date>; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> to any entity that, as of <date date=\"1997-05-01\">May 1, 1997</date>, has formally contracted with a State to provide services for which payment is made on a capitated basis with an understanding that the entity was seeking to become a PACE provider.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><heading> <inline class=\"small-caps\">Special consideration</inline>.—</heading><content>The Secretary shall give special consideration, in the processing of applications described in paragraph (1) and the awarding of waivers described in paragraph (2), to an entity which as of <date date=\"1997-05-01\">May 1, 1997</date>, through formal activities (such as entering into contracts for feasibility studies) has indicated a specific intent to become a PACE provider.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Repeal of Current PACE Demonstration Project Waiver Authority.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>Subject to paragraph (2), the following provisions of law are repealed:</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> Section 603(c) of the Social Security Amendments of 1983 (<ref href=\"/us/pl/98/21\">Public Law 98–21</ref>) [<ref href=\"/us/stat/97/168\">97 Stat. 168</ref>].</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> Section 9220 of the Consolidated Omnibus Budget Reconciliation Act of 1985 (<ref href=\"/us/pl/99/272\">Public Law 99–272</ref>) [<ref href=\"/us/stat/100/183\">100 Stat. 183</ref>].</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> Section 9412(b) of the Omnibus Budget Reconciliation Act of 1986 (<ref href=\"/us/pl/99/509\">Public Law 99–509</ref>) [<ref href=\"/us/stat/100/2062\">100 Stat. 2062</ref>].</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Delay in application to current waivers.—</inline></heading><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Subject to subparagraph (B), in the case of waivers granted with respect to a PACE program before <date date=\"2000-07-01\">July 1, 2000</date>, the repeals made by paragraph (1) shall not apply until the end of a transition period (of up to 36 months) that begins on the initial effective date of such regulations, and that allows sufficient time for an orderly transition from demonstration project authority to general authority provided under the amendments made by this subtitle [subtitle I (§§ 4801–4804) of title IV of <ref href=\"/us/pl/105/33\">Pub. L. 105–33</ref>, enacting this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref> and amending sections 1396b, 1396d, 1396r–5, and 1396v of this title].</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><heading> <inline class=\"small-caps\">State option to seek extension of current period</inline>.—</heading><content>A State may elect to maintain the PACE programs which (as of the date of the enactment of this Act [<date date=\"1997-08-05\">Aug. 5, 1997</date>]) were operating in the State under the authority described in paragraph (1) until a date (specified by the State) that is not later than 4 years after the initial effective date of regulations described in subsection (a). If a State makes such an election, the repeals made by paragraph (1) shall not apply to the programs until the date so specified, but only so long as such programs continue to operate under the same terms and conditions as apply to such programs as of the date of the enactment of this Act, and subparagraph (A) shall not apply to such programs.”</content>\n</subparagraph>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida8c14e59-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">PACE Programs; Study and Reports</heading><p><ref href=\"/us/pl/105/33/tIV/s4804/a\">Pub. L. 105–33, title IV, § 4804(a)</ref>, (b), <date date=\"1997-08-05\">Aug. 5, 1997</date>, <ref href=\"/us/stat/111/551\">111 Stat. 551</ref>, provided that:<quotedContent origin=\"/us/pl/105/33/tIV/s4804/a\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Study.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>The Secretary of Health and Human Services (in close consultation with State administering agencies, as defined in sections 1894(a)(8) and 1934(a)(8) of the Social Security Act [<ref href=\"/us/usc/t42/s1395eee/a/8\">42 U.S.C. 1395eee(a)(8)</ref>, 1396u–4(a)(8)]) shall conduct a study of the quality and cost of providing PACE program services under the medicare and medicaid programs under the amendments made by this subtitle [subtitle I (§§ 4801–4804) of title IV of <ref href=\"/us/pl/105/33\">Pub. L. 105–33</ref>, enacting this section and <ref href=\"/us/usc/t42/s1396u–4\">section 1396u–4 of this title</ref> and amending sections 1396b, 1396d, 1396r–5, and 1396v of this title].</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><heading> <inline class=\"small-caps\">Study of private, for-profit providers</inline>.—</heading><content>Such study shall specifically compare the costs, quality, and access to services by entities that are private, for-profit entities operating under demonstration projects waivers granted under sections 1894(h) and 1934(h) of the Social Security Act [<ref href=\"/us/usc/t42/s1395eee/h\">42 U.S.C. 1395eee(h)</ref>, 1396u–4(h)] with the costs, quality, and access to services of other PACE providers.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Report.—</inline></heading><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Not later than 4 years after the date of the enactment of this Act [<date date=\"1997-08-05\">Aug. 5, 1997</date>], the Secretary shall provide for a report to Congress on the impact of such amendments on quality and cost of services.
