<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida75cb568-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k"><num value="1395k">§ 1395k.</num><heading> Scope of benefits; definitions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida75cb569-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a"><num value="a" class="bold">(a)</num><heading class="bold"> Scope of benefits</heading><chapeau style="-uslm-lc:I11" class="indent0">The benefits provided to an individual by the insurance program established by this part shall consist of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida75cb56a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/1"><num value="1">(1)</num><content> entitlement to have payment made to him or on his behalf (subject to the provisions of this part) for medical and other health services, except those described in subparagraphs (B) and (D) of paragraph (2) and subparagraphs (E) and (F) of <ref href="/us/usc/t42/s1395u/b/6">section 1395u(b)(6) of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida75cb56b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2"><num value="2">(2)</num><chapeau> entitlement to have payment made on his behalf (subject to the provisions of this part) for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida75cdb7c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/A"><num value="A">(A)</num><content> home health services (other than items described in subparagraph (G) or subparagraph (I));</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75cdb7d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/B"><num value="B">(B)</num><chapeau> medical and other health services (other than items described in subparagraph (G) or subparagraph (I)) furnished by a provider of services or by others under arrangement with them made by a provider of services, excluding—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida75cdb7e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/B/i"><num value="i">(i)</num><chapeau> physician services except where furnished by—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida75cdb7f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/B/i/I"><num value="I">(I)</num><content> a resident or intern of a hospital, or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida75cdb80-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/B/i/II"><num value="II">(II)</num><content> a physician to a patient in a hospital which has a teaching program approved as specified in paragraph (6) of <ref href="/us/usc/t42/s1395x/b">section 1395x(b) of this title</ref> (including services in conjunction with the teaching programs of such hospital whether or not such patient is an inpatient of such hospital) where the conditions specified in paragraph (7) of such section are met,</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida75cdb81-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/B/ii"><num value="ii">(ii)</num><content> services for which payment may be made pursuant to <ref href="/us/usc/t42/s1395n/b/2">section 1395n(b)(2) of this title</ref>,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida75cdb82-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/B/iii"><num value="iii">(iii)</num><content> services described by <ref href="/us/usc/t42/s1395x/s/2/K/i">section 1395x(s)(2)(K)(i) of this title</ref>, certified nurse-midwife services, qualified psychologist services, and services of a certified registered nurse anesthetist; <ref class="footnoteRef" idref="fn002732">1</ref><note type="footnote" id="fn002732"><num>1</num> So in original. </subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75cdb84-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/C"><num value="C">(C)</num><content> outpatient physical therapy services (other than services to which the second sentence of <ref href="/us/usc/t42/s1395x/p">section 1395x(p) of this title</ref> applies), outpatient occupational therapy services (other than services to which such sentence applies through the operation of <ref href="/us/usc/t42/s1395x/g">section 1395x(g) of this title</ref>), and outpatient speech-language pathology services (other than services to which the second sentence of <ref href="/us/usc/t42/s1395x/p">section 1395x(p) of this title</ref> applies through the application of section 1395x(<i>ll</i>)(2) of this title);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75cdb85-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/D"><num value="D">(D)</num><clause style="-uslm-lc:I13" class="indent2" id="ida75cdb86-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/D/i"><num value="i">(i)</num><content> rural health clinic services and (ii) Federally qualified health center services;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75cdb87-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/E"><num value="E">(E)</num><content> comprehensive outpatient rehabilitation facility services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75cdb88-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/F"><num value="F">(F)</num><chapeau> facility services furnished in connection with surgical procedures specified by the Secretary—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida75cdb89-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/F/i"><num value="i">(i)</num><content> pursuant to section 1395<i>l</i>(i)(1)(A) of this title and performed in an ambulatory surgical center (which meets health, safety, and other standards specified by the Secretary in regulations) if the center has an agreement in effect with the Secretary by which the center agrees to accept the standard overhead amount determined under section 1395<i>l</i>(i)(2)(A) of this title as full payment for such services (including intraocular lens in cases described in section 1395<i>l</i>(i)(2)(A)(iii) of this title) and to accept an assignment described in <ref href="/us/usc/t42/s1395u/b/3/B/ii">section 1395u(b)(3)(B)(ii) of this title</ref> with respect to payment for all such services (including intraocular lens in cases described in section 1395<i>l</i>(i)(2)(A)(iii) of this title) furnished by the center to individuals enrolled under this part, or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida75cdb8a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/F/ii"><num value="ii">(ii)</num><chapeau> pursuant to section 1395<i>l</i>(i)(1)(B) of this title and performed by a physician, described in paragraph (1), (2), or (3) of <ref href="/us/usc/t42/s1395x/r">section 1395x(r) of this title</ref>, in his office, if the Secretary has determined that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida75cdb8b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/F/ii/I"><num value="I">(I)</num><content> a quality improvement organization (having a contract with the Secretary under part B of subchapter XI of this chapter) is willing, able, and has agreed to carry out a review (on a sample or other reasonable basis) of the physician’s performing such procedures in the physician’s office,</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida75cdb8c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/F/ii/II"><num value="II">(II)</num><content> the particular physician involved has agreed to make available to such organization such records as the Secretary determines to be necessary to carry out the review, and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida75cdb8d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/F/ii/III"><num value="III">(III)</num><content> the physician is authorized to perform the procedure in a hospital located in the area in which the office is located,</content>
</subclause>
</clause>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> and if the physician agrees to accept the standard overhead amount determined under section 1395<i>l</i>(i)(2)(B) of this title as full payment for such services and to accept payment on an assignment-related basis with respect to payment for all services (including all pre- and post-operative services) described in paragraphs (1) and (2)(A) of <ref href="/us/usc/t42/s1395x/s">section 1395x(s) of this title</ref> and furnished in connection with such surgical procedure to individuals enrolled under this part;</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75d029e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/G"><num value="G">(G)</num><content> covered items (described in <ref href="/us/usc/t42/s1395m/a/13">section 1395m(a)(13) of this title</ref>) furnished by a provider of services or by others under arrangements with them made by a provider of services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75d029f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/H"><num value="H">(H)</num><content> outpatient critical access hospital services (as defined in <ref href="/us/usc/t42/s1395x/mm/3">section 1395x(mm)(3) of this title</ref>);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75d02a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/I"><num value="I">(I)</num><content> prosthetic devices and orthotics and prosthetics (described in <ref href="/us/usc/t42/s1395m/h/4">section 1395m(h)(4) of this title</ref>) furnished by a provider of services or by others under arrangements with them made by a provider of services; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida75d02a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395k/a/2/J"><num value="J">(J)</num><content> partial hospitalization services provided by a community mental health center (as described in <ref href="/us/usc/t42/s1395x/ff/2/B">section 1395x(ff)(2)(B) of this title</ref>).</content>
