<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida861c89c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn"><num value="1395nn">§ 1395nn.</num><heading> Limitation on certain physician referrals</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida861c89d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/a"><num value="a" class="bold">(a)</num><heading class="bold"> Prohibition of certain referrals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida861c89e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in subsection (b), if a physician (or an immediate family member of such physician) has a financial relationship with an entity specified in paragraph (2), then—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida861c89f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/a/1/A"><num value="A">(A)</num><content> the physician may not make a referral to the entity for the furnishing of designated health services for which payment otherwise may be made under this subchapter, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida861efb0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/a/1/B"><num value="B">(B)</num><content> the entity may not present or cause to be presented a claim under this subchapter or bill to any individual, third party payor, or other entity for designated health services furnished pursuant to a referral prohibited under subparagraph (A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida861efb1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Financial relationship specified</heading><chapeau style="-uslm-lc:I12" class="indent1">For purposes of this section, a financial relationship of a physician (or an immediate family member of such physician) with an entity specified in this paragraph is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida861efb2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/a/2/A"><num value="A">(A)</num><content> except as provided in subsections (c) and (d), an ownership or investment interest in the entity, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida861efb3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/a/2/B"><num value="B">(B)</num><content> except as provided in subsection (e), a compensation arrangement (as defined in subsection (h)(1)) between the physician (or an immediate family member of such physician) and the entity.</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">An ownership or investment interest described in subparagraph (A) may be through equity, debt, or other means and includes an interest in an entity that holds an ownership or investment interest in any entity providing the designated health service.</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida861efb4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b"><num value="b" class="bold">(b)</num><heading class="bold"> General exceptions to both ownership and compensation arrangement prohibitions</heading><chapeau style="-uslm-lc:I11" class="indent0">Subsection (a)(1) shall not apply in the following cases:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida861efb5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Physicians’ services</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of physicians’ services (as defined in <ref href="/us/usc/t42/s1395x/q">section 1395x(q) of this title</ref>) provided personally by (or under the personal supervision of) another physician in the same group practice (as defined in subsection (h)(4)) as the referring physician.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida861efb6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> In-office ancillary services</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of services (other than durable medical equipment (excluding infusion pumps) and parenteral and enteral nutrients, equipment, and supplies)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida861efb7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/A"><num value="A">(A)</num><chapeau> that are furnished—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida861efb8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/A/i"><num value="i">(i)</num><content> personally by the referring physician, personally by a physician who is a member of the same group practice as the referring physician, or personally by individuals who are directly supervised by the physician or by another physician in the group practice, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida861efb9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/A/ii"><num value="ii">(ii)</num><subclause style="-uslm-lc:I14" class="indent3" id="ida861efba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/A/ii/I"><num value="I">(I)</num><content> in a building in which the referring physician (or another physician who is a member of the same group practice) furnishes physicians’ services unrelated to the furnishing of designated health services, or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida861efbb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/A/ii/II"><num value="II">(II)</num><chapeau> in the case of a referring physician who is a member of a group practice, in another building which is used by the group practice—</chapeau><item style="-uslm-lc:I16" class="indent4" id="ida86216cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/A/ii/II/aa"><num value="aa">(aa)</num><content> for the provision of some or all of the group’s clinical laboratory services, or</content>
</item>
<item style="-uslm-lc:I16" class="indent4" id="ida86216cd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/A/ii/II/bb"><num value="bb">(bb)</num><content> for the centralized provision of the group’s designated health services (other than clinical laboratory services),</content>
</item>
</subclause>
</clause>

<continuation style="-uslm-lc:I66" class="indent3 firstIndent-1"> unless the Secretary determines other terms and conditions under which the provision of such services does not present a risk of program or patient abuse, and</continuation>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida86216ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/2/B"><num value="B">(B)</num><content> that are billed by the physician performing or supervising the services, by a group practice of which such physician is a member under a billing number assigned to the group practice, or by an entity that is wholly owned by such physician or such group practice,</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">if the ownership or investment interest in such services meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse. Such requirements shall, with respect to magnetic resonance imaging, computed tomography, positron emission tomography, and any other designated health services specified under subsection (h)(6)(D) that the Secretary determines appropriate, include a requirement that the referring physician inform the individual in writing at the time of the referral that the individual may obtain the services for which the individual is being referred from a person other than a person described in subparagraph (A)(i) and provide such individual with a written list of suppliers (as defined in <ref href="/us/usc/t42/s1395x/d">section 1395x(d) of this title</ref>) who furnish such services in the area in which such individual resides.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida86216cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Prepaid plans</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of services furnished by an organization—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida86216d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/3/A"><num value="A">(A)</num><content> with a contract under <ref href="/us/usc/t42/s1395mm">section 1395mm of this title</ref> to an individual enrolled with the organization,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida86216d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/3/B"><num value="B">(B)</num><content> described in section 1395<i>l</i>(a)(1)(A) of this title to an individual enrolled with the organization,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida86216d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/3/C"><num value="C">(C)</num><content> receiving payments on a prepaid basis, under a demonstration project under <ref href="/us/usc/t42/s1395b–1/a">section 1395b–1(a) of this title</ref> or under section 222(a) of the Social Security Amendments of 1972, to an individual enrolled with the organization,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida86216d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/3/D"><num value="D">(D)</num><content> that is a qualified health maintenance organization (within the meaning of section 300e–9(d) <ref class="footnoteRef" idref="fn002873">1</ref><note type="footnote" id="fn002873"><num>1</num> See References in Text note below.</note> of this title) to an individual enrolled with the organization, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida86216d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/3/E"><num value="E">(E)</num><content> that is a Medicare+Choice organization under part C that is offering a coordinated care plan described in <ref href="/us/usc/t42/s1395w–21/a/2/A">section 1395w–21(a)(2)(A) of this title</ref> to an individual enrolled with the organization.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8623de5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Other permissible exceptions</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of any other financial relationship which the Secretary determines, and specifies in regulations, does not pose a risk of program or patient abuse.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8623de6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Electronic prescribing</heading><content><p style="-uslm-lc:I12" class="indent1">An exception established by regulation under <ref href="/us/usc/t42/s1395w–104/e/6">section 1395w–104(e)(6) of this title</ref>.<sup>1</sup></p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida8623de7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/c"><num value="c" class="bold">(c)</num><heading class="bold"> General exception related only to ownership or investment prohibition for ownership in publicly traded securities and mutual funds</heading><chapeau style="-uslm-lc:I11" class="indent0">Ownership of the following shall not be considered to be an ownership or investment interest described in subsection (a)(2)(A):</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida8623de8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/c/1"><num value="1">(1)</num><chapeau> Ownership of investment securities (including shares or bonds, debentures, notes, or other debt instruments) which may be purchased on terms generally available to the public and which are—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida8623de9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/c/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="ida8623dea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/c/1/A/i"><num value="i">(i)</num><content> securities listed on the New York Stock Exchange, the American Stock Exchange, or any regional exchange in which quotations are published on a daily basis, or foreign securities listed on a recognized foreign, national, or regional exchange in which quotations are published on a daily basis, or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida8623deb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/c/1/A/ii"><num value="ii">(ii)</num><content> traded under an automated interdealer quotation system operated by the National Association of Securities Dealers, and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida8623dec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/c/1/B"><num value="B">(B)</num><content> in a corporation that had, at the end of the corporation’s most recent fiscal year, or on average during the previous 3 fiscal years, stockholder equity exceeding $75,000,000.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida8623ded-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/c/2"><num value="2">(2)</num><content> Ownership of shares in a regulated investment company as defined in section 851(a) of the Internal Revenue Code of 1986, if such company had, at the end of the company’s most recent fiscal year, or on average during the previous 3 fiscal years, total assets exceeding $75,000,000.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida8623dee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d"><num value="d" class="bold">(d)</num><heading class="bold"> Additional exceptions related only to ownership or investment prohibition</heading><chapeau style="-uslm-lc:I11" class="indent0">The following, if not otherwise excepted under subsection (b), shall not be considered to be an ownership or investment interest described in subsection (a)(2)(A):</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8623def-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Hospitals in Puerto Rico</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of designated health services provided by a hospital located in Puerto Rico.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8623df0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Rural providers</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of designated health services furnished in a rural area (as defined in <ref href="/us/usc/t42/s1395ww/d/2/D">section 1395ww(d)(2)(D) of this title</ref>) by an entity, if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida8623df1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/2/A"><num value="A">(A)</num><content> substantially all of the designated health services furnished by the entity are furnished to individuals residing in such a rural area;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida8626502-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/2/B"><num value="B">(B)</num><content> effective for the 18-month period beginning on <date date="2003-12-08">December 8, 2003</date>, the entity is not a specialty hospital (as defined in subsection (h)(7)); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida8626503-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/2/C"><num value="C">(C)</num><content> in the case where the entity is a hospital, the hospital meets the requirements of paragraph (3)(D).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8626504-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Hospital ownership</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of designated health services provided by a hospital (other than a hospital described in paragraph (1)) if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida8626505-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/3/A"><num value="A">(A)</num><content> the referring physician is authorized to perform services at the hospital;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida8626506-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/3/B"><num value="B">(B)</num><content> effective for the 18-month period beginning on <date date="2003-12-08">December 8, 2003</date>, the hospital is not a specialty hospital (as defined in subsection (h)(7));</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida8626507-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/3/C"><num value="C">(C)</num><content> the ownership or investment interest is in the hospital itself (and not merely in a subdivision of the hospital); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida8626508-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/d/3/D"><num value="D">(D)</num><content> the hospital meets the requirements described in subsection (i)(1) not later than 18 months after <date date="2010-03-23">March 23, 2010</date>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida8626509-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e"><num value="e" class="bold">(e)</num><heading class="bold"> Exceptions relating to other compensation arrangements</heading><chapeau style="-uslm-lc:I11" class="indent0">The following shall not be considered to be a compensation arrangement described in subsection (a)(2)(B):</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida862650a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Rental of office space; rental of equipment</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida862650b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Office space</heading><chapeau style="-uslm-lc:I13" class="indent2">Payments made by a lessee to a lessor for the use of premises if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida862650c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/A/i"><num value="i">(i)</num><content> the lease is set out in writing, signed by the parties, and specifies the premises covered by the lease,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862650d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/A/ii"><num value="ii">(ii)</num><content> the space rented or leased does not exceed that which is reasonable and necessary for the legitimate business purposes of the lease or rental and is used exclusively by the lessee when being used by the lessee, except that the lessee may make payments for the use of space consisting of common areas if such payments do not exceed the lessee’s pro rata share of expenses for such space based upon the ratio of the space used exclusively by the lessee to the total amount of space (other than common areas) occupied by all persons using such common areas,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862650e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/A/iii"><num value="iii">(iii)</num><content> the lease provides for a term of rental or lease for at least 1 year,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862650f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/A/iv"><num value="iv">(iv)</num><content> the rental charges over the term of the lease are set in advance, are consistent with fair market value, and are not determined in a manner that takes into account the volume or value of any referrals or other business generated between the parties,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8626510-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/A/v"><num value="v">(v)</num><content> the lease would be commercially reasonable even if no referrals were made between the parties, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c21-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/A/vi"><num value="vi">(vi)</num><content> the lease meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8628c22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Equipment</heading><chapeau style="-uslm-lc:I13" class="indent2">Payments made by a lessee of equipment to the lessor of the equipment for the use of the equipment if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida8628c23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/B/i"><num value="i">(i)</num><content> the lease is set out in writing, signed by the parties, and specifies the equipment covered by the lease,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/B/ii"><num value="ii">(ii)</num><content> the equipment rented or leased does not exceed that which is reasonable and necessary for the legitimate business purposes of the lease or rental and is used exclusively by the lessee when being used by the lessee,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/B/iii"><num value="iii">(iii)</num><content> the lease provides for a term of rental or lease of at least 1 year,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c26-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/B/iv"><num value="iv">(iv)</num><content> the rental charges over the term of the lease are set in advance, are consistent with fair market value, and are not determined in a manner that takes into account the volume or value of any referrals or other business generated between the parties,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c27-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/B/v"><num value="v">(v)</num><content> the lease would be commercially reasonable even if no referrals were made between the parties, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c28-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/B/vi"><num value="vi">(vi)</num><content> the lease meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8628c29-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Holdover lease arrangements</heading><chapeau style="-uslm-lc:I13" class="indent2">In the case of a holdover lease arrangement for the lease of office space or equipment, which immediately follows a lease arrangement described in subparagraph (A) for the use of such office space or subparagraph (B) for the use of such equipment and that expired after a term of at least 1 year, payments made by the lessee to the lessor pursuant to such holdover lease arrangement, if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida8628c2a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/C/i"><num value="i">(i)</num><content> the lease arrangement met the conditions of subparagraph (A) for the lease of office space or subparagraph (B) for the use of equipment when the arrangement expired;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c2b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/C/ii"><num value="ii">(ii)</num><content> the holdover lease arrangement is on the same terms and conditions as the immediately preceding arrangement; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8628c2c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/1/C/iii"><num value="iii">(iii)</num><content> the holdover arrangement continues to satisfy the conditions of subparagraph (A) for the lease of office space or subparagraph (B) for the use of equipment.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8628c2d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Bona fide employment relationships</heading><chapeau style="-uslm-lc:I12" class="indent1">Any amount paid by an employer to a physician (or an immediate family member of such physician) who has a bona fide employment relationship with the employer for the provision of services if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida862b33e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/2/A"><num value="A">(A)</num><content> the employment is for identifiable services,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida862b33f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/2/B"><num value="B">(B)</num><chapeau> the amount of the remuneration under the employment—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida862b340-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/2/B/i"><num value="i">(i)</num><content> is consistent with the fair market value of the services, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862b341-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/2/B/ii"><num value="ii">(ii)</num><content> is not determined in a manner that takes into account (directly or indirectly) the volume or value of any referrals by the referring physician,</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida862b342-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/2/C"><num value="C">(C)</num><content> the remuneration is provided pursuant to an agreement which would be commercially reasonable even if no referrals were made to the employer, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida862b343-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/2/D"><num value="D">(D)</num><content> the employment meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">Subparagraph (B)(ii) shall not prohibit the payment of remuneration in the form of a productivity bonus based on services performed personally by the physician (or an immediate family member of such physician).</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida862b344-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Personal service arrangements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida862b345-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">Remuneration from an entity under an arrangement (including remuneration for specific physicians’ services furnished to a nonprofit blood center) if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida862b346-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A/i"><num value="i">(i)</num><content> the arrangement is set out in writing, signed by the parties, and specifies the services covered by the arrangement,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862b347-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A/ii"><num value="ii">(ii)</num><content> the arrangement covers all of the services to be provided by the physician (or an immediate family member of such physician) to the entity,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862b348-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A/iii"><num value="iii">(iii)</num><content> the aggregate services contracted for do not exceed those that are reasonable and necessary for the legitimate business purposes of the arrangement,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862b349-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A/iv"><num value="iv">(iv)</num><content> the term of the arrangement is for at least 1 year,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862b34a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A/v"><num value="v">(v)</num><content> the compensation to be paid over the term of the arrangement is set in advance, does not exceed fair market value, and except in the case of a physician incentive plan described in subparagraph (B), is not determined in a manner that takes into account the volume or value of any referrals or other business generated between the parties,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862b34b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A/vi"><num value="vi">(vi)</num><content> the services to be performed under the arrangement do not involve the counseling or promotion or a business arrangement or other activity that violates any State or Federal law, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862b34c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/A/vii"><num value="vii">(vii)</num><content> the arrangement meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida862b34d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Physician incentive plan exception</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida862b34e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I14" class="indent3">In the case of a physician incentive plan (as defined in clause (ii)) between a physician and an entity, the compensation may be determined in a manner (through a withhold, capitation, bonus, or otherwise) that takes into account directly or indirectly the volume or value of any referrals or other business generated between the parties, if the plan meets the following requirements:</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida862da5f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/B/i/I"><num value="I">(I)</num><content> No specific payment is made directly or indirectly under the plan to a physician or a physician group as an inducement to reduce or limit medically necessary services provided with respect to a specific individual enrolled with the entity.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida862da60-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/B/i/II"><num value="II">(II)</num><content> In the case of a plan that places a physician or a physician group at substantial financial risk as determined by the Secretary pursuant to <ref href="/us/usc/t42/s1395mm/i/8/A/ii">section 1395mm(i)(8)(A)(ii) of this title</ref>, the plan complies with any requirements the Secretary may impose pursuant to such section.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida862da61-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/B/i/III"><num value="III">(III)</num><content> Upon request by the Secretary, the entity provides the Secretary with access to descriptive information regarding the plan, in order to permit the Secretary to determine whether the plan is in compliance with the requirements of this clause.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida862da62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> “Physician incentive plan” defined</heading><content><p style="-uslm-lc:I14" class="indent3">For purposes of this subparagraph, the term “physician incentive plan” means any compensation arrangement between an entity and a physician or physician group that may directly or indirectly have the effect of reducing or limiting services provided with respect to individuals enrolled with the entity.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida862da63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Holdover personal service arrangement</heading><chapeau style="-uslm-lc:I13" class="indent2">In the case of a holdover personal service arrangement, which immediately follows an arrangement described in subparagraph (A) that expired after a term of at least 1 year, remuneration from an entity pursuant to such holdover personal service arrangement, if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida862da64-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/C/i"><num value="i">(i)</num><content> the personal service arrangement met the conditions of subparagraph (A) when the arrangement expired;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862da65-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/C/ii"><num value="ii">(ii)</num><content> the holdover personal service arrangement is on the same terms and conditions as the immediately preceding arrangement; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida862da66-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/3/C/iii"><num value="iii">(iii)</num><content> the holdover arrangement continues to satisfy the conditions of subparagraph (A).</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida862da67-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Remuneration unrelated to the provision of designated health services</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of remuneration which is provided by a hospital to a physician if such remuneration does not relate to the provision of designated health services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida862da68-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/5"><num value="5" class="bold">(5)</num><heading class="bold"> Physician recruitment</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of remuneration which is provided by a hospital to a physician to induce the physician to relocate to the geographic area served by the hospital in order to be a member of the medical staff of the hospital, if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida8630179-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/5/A"><num value="A">(A)</num><content> the physician is not required to refer patients to the hospital,</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863017a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/5/B"><num value="B">(B)</num><content> the amount of the remuneration under the arrangement is not determined in a manner that takes into account (directly or indirectly) the volume or value of any referrals by the referring physician, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863017b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/5/C"><num value="C">(C)</num><content> the arrangement meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida863017c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/6"><num value="6" class="bold">(6)</num><heading class="bold"> Isolated transactions</heading><chapeau style="-uslm-lc:I12" class="indent1">In the case of an isolated financial transaction, such as a one-time sale of property or practice, if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida863017d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/6/A"><num value="A">(A)</num><content> the requirements described in subparagraphs (B) and (C) of paragraph (2) are met with respect to the entity in the same manner as they apply to an employer, and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863017e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/6/B"><num value="B">(B)</num><content> the transaction meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida863017f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7"><num value="7" class="bold">(7)</num><heading class="bold"> Certain group practice arrangements with a hospital</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8630180-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> <ref class="footnoteRef" idref="fn002874">2</ref><note type="footnote" id="fn002874"><num>2</num> So in original. (B) has been enacted.</note> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">An arrangement between a hospital and a group under which designated health services are provided by the group but are billed by the hospital if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida8630181-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A/i"><num value="i">(i)</num><content> with respect to services provided to an inpatient of the hospital, the arrangement is pursuant to the provision of inpatient hospital services under <ref href="/us/usc/t42/s1395x/b/3">section 1395x(b)(3) of this title</ref>,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8630182-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A/ii"><num value="ii">(ii)</num><content> the arrangement began before <date date="1989-12-19">December 19, 1989</date>, and has continued in effect without interruption since such date,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8630183-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A/iii"><num value="iii">(iii)</num><content> with respect to the designated health services covered under the arrangement, substantially all of such services furnished to patients of the hospital are furnished by the group under the arrangement,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8630184-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A/iv"><num value="iv">(iv)</num><content> the arrangement is pursuant to an agreement that is set out in writing and that specifies the services to be provided by the parties and the compensation for services provided under the agreement,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8630185-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A/v"><num value="v">(v)</num><content> the compensation paid over the term of the agreement is consistent with fair market value and the compensation per unit of services is fixed in advance and is not determined in a manner that takes into account the volume or value of any referrals or other business generated between the parties,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8632896-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A/vi"><num value="vi">(vi)</num><content> the compensation is provided pursuant to an agreement which would be commercially reasonable even if no referrals were made to the entity, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8632897-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/7/A/vii"><num value="vii">(vii)</num><content> the arrangement between the parties meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8632898-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/8"><num value="8" class="bold">(8)</num><heading class="bold"> Payments by a physician for items and services</heading><chapeau style="-uslm-lc:I12" class="indent1">Payments made by a physician—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida8632899-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/8/A"><num value="A">(A)</num><content> to a laboratory in exchange for the provision of clinical laboratory services, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863289a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/e/8/B"><num value="B">(B)</num><content> to an entity as compensation for other items or services if the items or services are furnished at a price that is consistent with fair market value.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida863289b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/f"><num value="f" class="bold">(f)</num><heading class="bold"> Reporting requirements</heading><chapeau style="-uslm-lc:I11" class="indent0">Each entity providing covered items or services for which payment may be made under this subchapter shall provide the Secretary with the information concerning the entity’s ownership, investment, and compensation arrangements, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida863289c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/f/1"><num value="1">(1)</num><content> the covered items and services provided by the entity, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida863289d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/f/2"><num value="2">(2)</num><content> the names and unique physician identification numbers of all physicians with an ownership or investment interest (as described in subsection (a)(2)(A)), or with a compensation arrangement (as described in subsection (a)(2)(B)), in the entity, or whose immediate relatives have such an ownership or investment interest or who have such a compensation relationship with the entity.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">Such information shall be provided in such form, manner, and at such times as the Secretary shall specify. The requirement of this subsection shall not apply to designated health services provided outside the United States or to entities which the Secretary determines provides <ref class="footnoteRef" idref="fn002875">3</ref><note type="footnote" id="fn002875"><num>3</num> So in original. Probably should be “provide”.</note> services for which payment may be made under this subchapter very infrequently.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida863289e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g"><num value="g" class="bold">(g)</num><heading class="bold"> Sanctions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida863289f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> Denial of payment</heading><content><p style="-uslm-lc:I12" class="indent1">No payment may be made under this subchapter for a designated health service which is provided in violation of subsection (a)(1).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida86328a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requiring refunds for certain claims</heading><content><p style="-uslm-lc:I12" class="indent1">If a person collects any amounts that were billed in violation of subsection (a)(1), the person shall be liable to the individual for, and shall refund on a timely basis to the individual, any amounts so collected.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida86328a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Civil money penalty and exclusion for improper claims</heading><content><p style="-uslm-lc:I12" class="indent1">Any person that presents or causes to be presented a bill or a claim for a service that such person knows or should know is for a service for which payment may not be made under paragraph (1) or for which a refund has not been made under paragraph (2) shall be subject to a civil money penalty of not more than $15,000 for each such service. The provisions of <ref href="/us/usc/t42/s1320a–7a">section 1320a–7a of this title</ref> (other than the first sentence of subsection (a) and other than subsection (b)) shall apply to a civil money penalty under the previous sentence in the same manner as such provisions apply to a penalty or proceeding under <ref href="/us/usc/t42/s1320a–7a/a">section 1320a–7a(a) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8634fb2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/4"><num value="4" class="bold">(4)</num><heading class="bold"> Civil money penalty and exclusion for circumvention schemes</heading><content><p style="-uslm-lc:I12" class="indent1">Any physician or other entity that enters into an arrangement or scheme (such as a cross-referral arrangement) which the physician or entity knows or should know has a principal purpose of assuring referrals by the physician to a particular entity which, if the physician directly made referrals to such entity, would be in violation of this section, shall be subject to a civil money penalty of not more than $100,000 for each such arrangement or scheme. The provisions of <ref href="/us/usc/t42/s1320a–7a">section 1320a–7a of this title</ref> (other than the first sentence of subsection (a) and other than subsection (b)) shall apply to a civil money penalty under the previous sentence in the same manner as such provisions apply to a penalty or proceeding under <ref href="/us/usc/t42/s1320a–7a/a">section 1320a–7a(a) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8634fb3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/5"><num value="5" class="bold">(5)</num><heading class="bold"> Failure to report information</heading><content><p style="-uslm-lc:I12" class="indent1">Any person who is required, but fails, to meet a reporting requirement of subsection (f) is subject to a civil money penalty of not more than $10,000 for each day for which reporting is required to have been made. The provisions of <ref href="/us/usc/t42/s1320a–7a">section 1320a–7a of this title</ref> (other than the first sentence of subsection (a) and other than subsection (b)) shall apply to a civil money penalty under the previous sentence in the same manner as such provisions apply to a penalty or proceeding under <ref href="/us/usc/t42/s1320a–7a/a">section 1320a–7a(a) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8634fb4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/6"><num value="6" class="bold">(6)</num><heading class="bold"> Advisory opinions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8634fb5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall issue written advisory opinions concerning whether a referral relating to designated health services (other than clinical laboratory services) is prohibited under this section. Each advisory opinion issued by the Secretary shall be binding as to the Secretary and the party or parties requesting the opinion.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8634fb6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Application of certain rules</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall, to the extent practicable, apply the rules under subsections (b)(3) and (b)(4) and take into account the regulations promulgated under subsection (b)(5) of <ref href="/us/usc/t42/s1320a–7d">section 1320a–7d of this title</ref> in the issuance of advisory opinions under this paragraph.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida86376c7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/6/C"><num value="C" class="bold">(C)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I13" class="indent2">In order to implement this paragraph in a timely manner, the Secretary may promulgate regulations that take effect on an interim basis, after notice and pending opportunity for public comment.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida86376c8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/g/6/D"><num value="D" class="bold">(D)</num><heading class="bold"> Applicability</heading><content><p style="-uslm-lc:I13" class="indent2">This paragraph shall apply to requests for advisory opinions made after the date which is 90 days after <date date="1997-08-05">August 5, 1997</date>, and before the close of the period described in <ref href="/us/usc/t42/s1320a–7d/b/6">section 1320a–7d(b)(6) of this title</ref>.</p>

</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida86376c9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h"><num value="h" class="bold">(h)</num><heading class="bold"> Definitions and special rules</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida86376ca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> Compensation arrangement; remuneration</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="ida86376cb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/A"><num value="A">(A)</num><content> The term “compensation arrangement” means any arrangement involving any remuneration between a physician (or an immediate family member of such physician) and an entity other than an arrangement involving only remuneration described in subparagraph (C).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida86376cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/B"><num value="B">(B)</num><content> The term “remuneration” includes any remuneration, directly or indirectly, overtly or covertly, in cash or in kind.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida86376cd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C"><num value="C">(C)</num><chapeau> Remuneration described in this subparagraph is any remuneration consisting of any of the following:</chapeau><clause style="-uslm-lc:I13" class="indent2" id="ida86376ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/i"><num value="i">(i)</num><content> The forgiveness of amounts owed for inaccurate tests or procedures, mistakenly performed tests or procedures, or the correction of minor billing errors.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida86376cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/ii"><num value="ii">(ii)</num><chapeau> The provision of items, devices, or supplies that are used solely to—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida86376d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/ii/I"><num value="I">(I)</num><content> collect, transport, process, or store specimens for the entity providing the item, device, or supply, or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida86376d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/ii/II"><num value="II">(II)</num><content> order or communicate the results of tests or procedures for such entity.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida86376d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/iii"><num value="iii">(iii)</num><chapeau> A payment made by an insurer or a self-insured plan to a physician to satisfy a claim, submitted on a fee for service basis, for the furnishing of health services by that physician to an individual who is covered by a policy with the insurer or by the self-insured plan, if—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida86376d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/iii/I"><num value="I">(I)</num><content> the health services are not furnished, and the payment is not made, pursuant to a contract or other arrangement between the insurer or the plan and the physician,</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida86376d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/iii/II"><num value="II">(II)</num><content> the payment is made to the physician on behalf of the covered individual and would otherwise be made directly to such individual,</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida86376d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/iii/III"><num value="III">(III)</num><content> the amount of the payment is set in advance, does not exceed fair market value, and is not determined in a manner that takes into account directly or indirectly the volume or value of any referrals, and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida8639de6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/C/iii/IV"><num value="IV">(IV)</num><content> the payment meets such other requirements as the Secretary may impose by regulation as needed to protect against program or patient abuse.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida8639de7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/D"><num value="D">(D)</num><heading> <inline class="small-caps">Written requirement clarified</inline>.—</heading><content>In the case of any requirement pursuant to this section for a compensation arrangement to be in writing, such requirement shall be satisfied by such means as determined by the Secretary, including by a collection of documents, including contemporaneous documents evidencing the course of conduct between the parties involved.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida8639de8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/E"><num value="E">(E)</num><heading> <inline class="small-caps">Special rule for signature requirements</inline>.—</heading><chapeau>In the case of any requirement pursuant to this section for a compensation arrangement to be in writing and signed by the parties, such signature requirement shall be met if—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="ida8639de9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/E/i"><num value="i">(i)</num><content> not later than 90 consecutive calendar days immediately following the date on which the compensation arrangement became noncompliant, the parties obtain the required signatures; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida8639dea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/1/E/ii"><num value="ii">(ii)</num><content> the compensation arrangement otherwise complies with all criteria of the applicable exception.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8639deb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Employee</heading><content><p style="-uslm-lc:I12" class="indent1">An individual is considered to be “employed by” or an “employee” of an entity if the individual would be considered to be an employee of the entity under the usual common law rules applicable in determining the employer-employee relationship (as applied for purposes of section 3121(d)(2) of the Internal Revenue Code of 1986).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8639dec-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/3"><num value="3" class="bold">(3)</num><heading class="bold"> Fair market value</heading><content><p style="-uslm-lc:I12" class="indent1">The term “fair market value” means the value in arms length transactions, consistent with the general market value, and, with respect to rentals or leases, the value of rental property for general commercial purposes (not taking into account its intended use) and, in the case of a lease of space, not adjusted to reflect the additional value the prospective lessee or lessor would attribute to the proximity or convenience to the lessor where the lessor is a potential source of patient referrals to the lessee.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8639ded-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4"><num value="4" class="bold">(4)</num><heading class="bold"> Group practice</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8639dee-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Definition of group practice</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “group practice” means a group of 2 or more physicians legally organized as a partnership, professional corporation, foundation, not-for-profit corporation, faculty practice plan, or similar association—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida8639def-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/A/i"><num value="i">(i)</num><content> in which each physician who is a member of the group provides substantially the full range of services which the physician routinely provides, including medical care, consultation, diagnosis, or treatment, through the joint use of shared office space, facilities, equipment and personnel,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863c500-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/A/ii"><num value="ii">(ii)</num><content> for which substantially all of the services of the physicians who are members of the group are provided through the group and are billed under a billing number assigned to the group and amounts so received are treated as receipts of the group,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863c501-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/A/iii"><num value="iii">(iii)</num><content> in which the overhead expenses of and the income from the practice are distributed in accordance with methods previously determined,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863c502-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/A/iv"><num value="iv">(iv)</num><content> except as provided in subparagraph (B)(i), in which no physician who is a member of the group directly or indirectly receives compensation based on the volume or value of referrals by the physician,</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863c503-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/A/v"><num value="v">(v)</num><content> in which members of the group personally conduct no less than 75 percent of the physician-patient encounters of the group practice, and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863c504-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/A/vi"><num value="vi">(vi)</num><content> which meets such other standards as the Secretary may impose by regulation.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida863c505-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Special rules</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida863c506-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Profits and productivity bonuses</heading><content><p style="-uslm-lc:I14" class="indent3">A physician in a group practice may be paid a share of overall profits of the group, or a productivity bonus based on services personally performed or services incident to such personally performed services, so long as the share or bonus is not determined in any manner which is directly related to the volume or value of referrals by such physician.</p>
</content>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida863c507-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/4/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Faculty practice plans</heading><content><p style="-uslm-lc:I14" class="indent3">In the case of a faculty practice plan associated with a hospital, institution of higher education, or medical school with an approved medical residency training program in which physician members may provide a variety of different specialty services and provide professional services both within and outside the group, as well as perform other tasks such as research, subparagraph (A) shall be applied only with respect to the services provided within the faculty practice plan.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida863c508-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/5"><num value="5" class="bold">(5)</num><heading class="bold"> Referral; referring physician</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida863c509-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> Physicians’ services</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (C), in the case of an item or service for which payment may be made under part B, the request by a physician for the item or service, including the request by a physician for a consultation with another physician (and any test or procedure ordered by, or to be performed by (or under the supervision of) that other physician), constitutes a “referral” by a “referring physician”.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida863ec1a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Other items</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (C), the request or establishment of a plan of care by a physician which includes the provision of the designated health service constitutes a “referral” by a “referring physician”.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida863ec1b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Clarification respecting certain services integral to a consultation by certain specialists</heading><content><p style="-uslm-lc:I13" class="indent2">A request by a pathologist for clinical diagnostic laboratory tests and pathological examination services, a request by a radiologist for diagnostic radiology services, and a request by a radiation oncologist for radiation therapy, if such services are furnished by (or under the supervision of) such pathologist, radiologist, or radiation oncologist pursuant to a consultation requested by another physician does not constitute a “referral” by a “referring physician”.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida863ec1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6"><num value="6" class="bold">(6)</num><heading class="bold"> Designated health services</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “designated health services” means any of the following items or services:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/A"><num value="A">(A)</num><content> Clinical laboratory services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/B"><num value="B">(B)</num><content> Physical therapy services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec1f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/C"><num value="C">(C)</num><content> Occupational therapy services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec20-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/D"><num value="D">(D)</num><content> Radiology services, including magnetic resonance imaging, computerized axial tomography scans, and ultrasound services.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec21-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/E"><num value="E">(E)</num><content> Radiation therapy services and supplies.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec22-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/F"><num value="F">(F)</num><content> Durable medical equipment and supplies.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec23-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/G"><num value="G">(G)</num><content> Parenteral and enteral nutrients, equipment, and supplies.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec24-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/H"><num value="H">(H)</num><content> Prosthetics, orthotics, and prosthetic devices and supplies.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida863ec25-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/6/I"><num value="I">(I)</num><content> Home health services.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida863ec29-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7"><num value="7" class="bold">(7)</num><heading class="bold"> Specialty hospital</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida863ec2a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">For purposes of this section, except as provided in subparagraph (B), the term “specialty hospital” means a subsection (d) hospital (as defined in <ref href="/us/usc/t42/s1395ww/d/1/B">section 1395ww(d)(1)(B) of this title</ref>) that is primarily or exclusively engaged in the care and treatment of one of the following categories:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida863ec2b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/A/i"><num value="i">(i)</num><content> Patients with a cardiac condition.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863ec2c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/A/ii"><num value="ii">(ii)</num><content> Patients with an orthopedic condition.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863ec2d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/A/iii"><num value="iii">(iii)</num><content> Patients receiving a surgical procedure.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida863ec2e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/A/iv"><num value="iv">(iv)</num><content> Any other specialized category of services that the Secretary designates as inconsistent with the purpose of permitting physician ownership and investment interests in a hospital under this section.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida863ec2f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exception</heading><chapeau style="-uslm-lc:I13" class="indent2">For purposes of this section, the term “specialty hospital” does not include any hospital—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida8641240-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B/i"><num value="i">(i)</num><chapeau> determined by the Secretary—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida8641241-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B/i/I"><num value="I">(I)</num><content> to be in operation before <date date="2003-11-18">November 18, 2003</date>; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida8641242-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B/i/II"><num value="II">(II)</num><content> under development as of such date;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8641243-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B/ii"><num value="ii">(ii)</num><content> for which the number of physician investors at any time on or after such date is no greater than the number of such investors as of such date;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8641244-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B/iii"><num value="iii">(iii)</num><content> for which the type of categories described in subparagraph (A) at any time on or after such date is no different than the type of such categories as of such date;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8641245-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B/iv"><num value="iv">(iv)</num><content> for which any increase in the number of beds occurs only in the facilities on the main campus of the hospital and does not exceed 50 percent of the number of beds in the hospital as of <date date="2003-11-18">November 18, 2003</date>, or 5 beds, whichever is greater; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida8641246-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/h/7/B/v"><num value="v">(v)</num><content> that meets such other requirements as the Secretary may specify.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida8641247-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i"><num value="i" class="bold">(i)</num><heading class="bold"> Requirements for hospitals to qualify for rural provider and hospital exception to ownership or investment prohibition</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8641248-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> Requirements described</heading><chapeau style="-uslm-lc:I12" class="indent1">For purposes of subsection (d)(3)(D), the requirements described in this paragraph for a hospital are as follows:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8641249-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Provider agreement</heading><chapeau style="-uslm-lc:I13" class="indent2">The hospital had—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida864124a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/A/i"><num value="i">(i)</num><content> physician ownership or investment on <date date="2010-12-31">December 31, 2010</date>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida864124b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/A/ii"><num value="ii">(ii)</num><content> a provider agreement under <ref href="/us/usc/t42/s1395cc">section 1395cc of this title</ref> in effect on such date.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864124c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitation on expansion of facility capacity</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in paragraph (3), the number of operating rooms, procedure rooms, and beds for which the hospital is licensed at any time on or after <date date="2010-03-23">March 23, 2010</date>, is no greater than the number of operating rooms, procedure rooms, and beds for which the hospital is licensed as of such date.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864124d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Preventing conflicts of interest</heading><clause style="-uslm-lc:I13" class="indent2" id="ida864124e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/i"><num value="i">(i)</num><chapeau> The hospital submits to the Secretary an annual report containing a detailed description of—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida864124f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/i/I"><num value="I">(I)</num><content> the identity of each physician owner or investor and any other owners or investors of the hospital; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida8641250-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/i/II"><num value="II">(II)</num><content> the nature and extent of all ownership and investment interests in the hospital.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida8641251-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/ii"><num value="ii">(ii)</num><chapeau> The hospital has procedures in place to require that any referring physician owner or investor discloses to the patient being referred, by a time that permits the patient to make a meaningful decision regarding the receipt of care, as determined by the Secretary—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida8641252-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/ii/I"><num value="I">(I)</num><content> the ownership or investment interest, as applicable, of such referring physician in the hospital; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida8643963-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/ii/II"><num value="II">(II)</num><content> if applicable, any such ownership or investment interest of the treating physician.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida8643964-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/iii"><num value="iii">(iii)</num><content> The hospital does not condition any physician ownership or investment interests either directly or indirectly on the physician owner or investor making or influencing referrals to the hospital or otherwise generating business for the hospital.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida8643965-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/iv"><num value="iv">(iv)</num><chapeau> The hospital discloses the fact that the hospital is partially owned or invested in by physicians—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida8643966-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/iv/I"><num value="I">(I)</num><content> on any public website for the hospital; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida8643967-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/C/iv/II"><num value="II">(II)</num><content> in any public advertising for the hospital.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8643968-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Ensuring bona fide investment</heading><clause style="-uslm-lc:I13" class="indent2" id="ida8643969-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D/i"><num value="i">(i)</num><content> The percentage of the total value of the ownership or investment interests held in the hospital, or in an entity whose assets include the hospital, by physician owners or investors in the aggregate does not exceed such percentage as of <date date="2010-03-23">March 23, 2010</date>.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida864396a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D/ii"><num value="ii">(ii)</num><content> Any ownership or investment interests that the hospital offers to a physician owner or investor are not offered on more favorable terms than the terms offered to a person who is not a physician owner or investor.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida864396b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D/iii"><num value="iii">(iii)</num><content> The hospital (or any owner or investor in the hospital) does not directly or indirectly provide loans or financing for any investment in the hospital by a physician owner or investor.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida864396c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D/iv"><num value="iv">(iv)</num><content> The hospital (or any owner or investor in the hospital) does not directly or indirectly guarantee a loan, make a payment toward a loan, or otherwise subsidize a loan, for any individual physician owner or investor or group of physician owners or investors that is related to acquiring any ownership or investment interest in the hospital.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida864396d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D/v"><num value="v">(v)</num><content> Ownership or investment returns are distributed to each owner or investor in the hospital in an amount that is directly proportional to the ownership or investment interest of such owner or investor in the hospital.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida864396e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D/vi"><num value="vi">(vi)</num><content> Physician owners and investors do not receive, directly or indirectly, any guaranteed receipt of or right to purchase other business interests related to the hospital, including the purchase or lease of any property under the control of other owners or investors in the hospital or located near the premises of the hospital.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida864396f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/D/vii"><num value="vii">(vii)</num><content> The hospital does not offer a physician owner or investor the opportunity to purchase or lease any property under the control of the hospital or any other owner or investor in the hospital on more favorable terms than the terms offered to an individual who is not a physician owner or investor.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8646080-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/E"><num value="E" class="bold">(E)</num><heading class="bold"> Patient safety</heading><clause style="-uslm-lc:I13" class="indent2" id="ida8646081-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/E/i"><num value="i">(i)</num><chapeau> Insofar as the hospital admits a patient and does not have any physician available on the premises to provide services during all hours in which the hospital is providing services to such patient, before admitting the patient—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida8646082-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/E/i/I"><num value="I">(I)</num><content> the hospital discloses such fact to a patient; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida8646083-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/E/i/II"><num value="II">(II)</num><content> following such disclosure, the hospital receives from the patient a signed acknowledgment that the patient understands such fact.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida8646084-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/E/ii"><num value="ii">(ii)</num><chapeau> The hospital has the capacity to—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida8646085-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/E/ii/I"><num value="I">(I)</num><content> provide assessment and initial treatment for patients; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida8646086-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/E/ii/II"><num value="II">(II)</num><content> refer and transfer patients to hospitals with the capability to treat the needs of the patient involved.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida8646087-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/1/F"><num value="F" class="bold">(F)</num><heading class="bold"> Limitation on application to certain converted facilities</heading><content><p style="-uslm-lc:I13" class="indent2">The hospital was not converted from an ambulatory surgical center to a hospital on or after <date date="2010-03-23">March 23, 2010</date>.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8646088-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Publication of information reported</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall publish, and update on an annual basis, the information submitted by hospitals under paragraph (1)(C)(i) on the public Internet website of the Centers for Medicare &amp; Medicaid Services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida8646089-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3"><num value="3" class="bold">(3)</num><heading class="bold"> Exception to prohibition on expansion of facility capacity</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864608a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Process</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida864608b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall establish and implement a process under which a hospital that is an applicable hospital (as defined in subparagraph (E)) or is a high Medicaid facility described in subparagraph (F) may apply for an exception from the requirement under paragraph (1)(B).</p>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida864608c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Opportunity for community input</heading><content><p style="-uslm-lc:I14" class="indent3">The process under clause (i) shall provide individuals and entities in the community in which the applicable hospital applying for an exception is located with the opportunity to provide input with respect to the application.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida864608d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/A/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Timing for implementation</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall implement the process under clause (i) on <date date="2012-02-01">February 1, 2012</date>.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida864608e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/A/iv"><num value="iv" class="bold">(iv)</num><heading class="bold"> Regulations</heading><content><p style="-uslm-lc:I14" class="indent3">Not later than <date date="2012-01-01">January 1, 2012</date>, the Secretary shall promulgate regulations to carry out the process under clause (i).</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864608f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Frequency</heading><content><p style="-uslm-lc:I13" class="indent2">The process described in subparagraph (A) shall permit an applicable hospital to apply for an exception up to once every 2 years.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida86487a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Permitted increase</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida86487a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Subject to clause (ii) and subparagraph (D), an applicable hospital granted an exception under the process described in subparagraph (A) may increase the number of operating rooms, procedure rooms, and beds for which the applicable hospital is licensed above the baseline number of operating rooms, procedure rooms, and beds of the applicable hospital (or, if the applicable hospital has been granted a previous exception under this paragraph, above the number of operating rooms, procedure rooms, and beds for which the hospital is licensed after the application of the most recent increase under such an exception).</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida86487a2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> 100 percent increase limitation</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall not permit an increase in the number of operating rooms, procedure rooms, and beds for which an applicable hospital is licensed under clause (i) to the extent such increase would result in the number of operating rooms, procedure rooms, and beds for which the applicable hospital is licensed exceeding 200 percent of the baseline number of operating rooms, procedure rooms, and beds of the applicable hospital.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida86487a3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/C/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Baseline number of operating rooms, procedure rooms, and beds</heading><content><p style="-uslm-lc:I14" class="indent3">In this paragraph, the term “baseline number of operating rooms, procedure rooms, and beds” means the number of operating rooms, procedure rooms, and beds for which the applicable hospital is licensed as of <date date="2010-03-23">March 23, 2010</date> (or, in the case of a hospital that did not have a provider agreement in effect as of such date but does have such an agreement in effect on <date date="2010-12-31">December 31, 2010</date>, the effective date of such provider agreement).</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida86487a4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Increase limited to facilities on the main campus of the hospital</heading><content><p style="-uslm-lc:I13" class="indent2">Any increase in the number of operating rooms, procedure rooms, and beds for which an applicable hospital is licensed pursuant to this paragraph may only occur in facilities on the main campus of the applicable hospital.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida86487a5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/E"><num value="E" class="bold">(E)</num><heading class="bold"> Applicable hospital</heading><chapeau style="-uslm-lc:I13" class="indent2">In this paragraph, the term “applicable hospital” means a hospital—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida86487a6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/E/i"><num value="i">(i)</num><content> that is located in a county in which the percentage increase in the population during the most recent 5-year period (as of the date of the application under subparagraph (A)) is at least 150 percent of the percentage increase in the population growth of the State in which the hospital is located during that period, as estimated by Bureau of the Census;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida864aeb7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/E/ii"><num value="ii">(ii)</num><content> whose annual percent of total inpatient admissions that represent inpatient admissions under the program under subchapter XIX is equal to or greater than the average percent with respect to such admissions for all hospitals located in the county in which the hospital is located;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida864aeb8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/E/iii"><num value="iii">(iii)</num><content> that does not discriminate against beneficiaries of Federal health care programs and does not permit physicians practicing at the hospital to discriminate against such beneficiaries;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida864aeb9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/E/iv"><num value="iv">(iv)</num><content> that is located in a State in which the average bed capacity in the State is less than the national average bed capacity; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida864aeba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/E/v"><num value="v">(v)</num><content> that has an average bed occupancy rate that is greater than the average bed occupancy rate in the State in which the hospital is located.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864aebb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/F"><num value="F" class="bold">(F)</num><heading class="bold"> High Medicaid facility described</heading><chapeau style="-uslm-lc:I13" class="indent2">A high Medicaid facility described in this subparagraph is a hospital that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida864aebc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/F/i"><num value="i">(i)</num><content> is not the sole hospital in a county;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida864aebd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/F/ii"><num value="ii">(ii)</num><content> with respect to each of the 3 most recent years for which data are available, has an annual percent of total inpatient admissions that represent inpatient admissions under subchapter XIX that is estimated to be greater than such percent with respect to such admissions for any other hospital located in the county in which the hospital is located; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida864aebe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/F/iii"><num value="iii">(iii)</num><content> meets the conditions described in subparagraph (E)(iii).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864aebf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/G"><num value="G" class="bold">(G)</num><heading class="bold"> Procedure rooms</heading><content><p style="-uslm-lc:I13" class="indent2">In this subsection, the term “procedure rooms” includes rooms in which catheterizations, angiographies, angiograms, and endoscopies are performed, except such term shall not include emergency rooms or departments (exclusive of rooms in which catheterizations, angiographies, angiograms, and endoscopies are performed).</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864aec0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/H"><num value="H" class="bold">(H)</num><heading class="bold"> Publication of final decisions</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 60 days after receiving a complete application under this paragraph, the Secretary shall publish in the Federal Register the final decision with respect to such application.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida864aec1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395nn/i/3/I"><num value="I" class="bold">(I)</num><heading class="bold"> Limitation on review</heading><content><p style="-uslm-lc:I13" class="indent2">There shall be no administrative or judicial review under <ref href="/us/usc/t42/s1395ff">section 1395ff of this title</ref>, section 1395<i>oo</i> of this title, or otherwise of the process under this paragraph (including the establishment of such process).</p>

<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> instruction on the implication of the SRDP on corporate integrity agreements and corporate compliance agreements.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Publication on internet website of srdp information</inline>.—</heading><content>The Secretary of Health and Human Services shall post information on the public Internet website of the Centers for Medicare &amp; Medicaid Services to inform relevant stakeholders of how to disclose actual or potential violations pursuant to an SRDP.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Relation to advisory opinions</inline>.—</heading><content>The SRDP shall be separate from the advisory opinion process set forth in regulations implementing section 1877(g) of the Social Security Act [<ref href="/us/usc/t42/s1395nn/g">42 U.S.C. 1395nn(g)</ref>].</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Reduction in Amounts Owed</inline>.—</heading><chapeau>The Secretary of Health and Human Services is authorized to reduce the amount due and owing for all violations under section 1877 of the Social Security Act [<ref href="/us/usc/t42/s1395nn">42 U.S.C. 1395nn</ref>] to an amount less than that specified in subsection (g) of such section. In establishing such amount for a violation, the Secretary may consider the following factors:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> The nature and extent of the improper or illegal practice.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> The timeliness of such self-disclosure.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> The cooperation in providing additional information related to the disclosure.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> Such other factors as the Secretary considers appropriate.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>Not later than 18 months after the date on which the SRDP protocol is established under subsection (a)(1), the Secretary shall submit to Congress a report on the implementation of this section. Such report shall include—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the number of health care providers of services and suppliers making disclosures pursuant to the SRDP;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the amounts collected pursuant to the SRDP;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the types of violations reported under the SRDP; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> such other information as may be necessary to evaluate the impact of this section.”</content>

<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> the extent to which specialty hospitals, relative to local full-service community hospitals, treat patients in certain diagnosis-related groups within a category, such as cardiology, and an analysis of the selection;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> the financial impact of physician-owned specialty hospitals on local full-service community hospitals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> how the current diagnosis-related group system should be updated to better reflect the cost of delivering care in a hospital setting; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="E">“(E)</num><content> the proportions of payments received, by type of payer, between the specialty hospitals and local full-service community hospitals.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><heading> HHS <inline class="small-caps">study</inline>.—</heading><chapeau>The Secretary [of Health and Human Services] shall conduct a study of a representative sample of specialty hospitals—</chapeau><subparagraph style="-uslm-lc:I22" class="indent1"><num value="A">“(A)</num><content> to determine the percentage of patients admitted to physician-owned specialty hospitals who are referred by physicians with an ownership interest;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="B">“(B)</num><content> to determine the referral patterns of physician owners, including the percentage of patients they referred to physician-owned specialty hospitals and the percentage of patients they referred to local full-service community hospitals for the same condition;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="C">“(C)</num><content> to compare the quality of care furnished in physician-owned specialty hospitals and in local full-service community hospitals for similar conditions and patient satisfaction with such care; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I22" class="indent1"><num value="D">“(D)</num><content> to assess the differences in uncompensated care, as defined by the Secretary, between the specialty hospital and local full-service community hospitals, and the relative value of any tax exemption available to such hospitals.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="3">“(3)</num><heading> <inline class="small-caps">Reports</inline>.—</heading><content>Not later than 15 months after the date of the enactment of this Act [<date date="2003-12-08">Dec. 8, 2003</date>], the Commission and the Secretary, respectively, shall each submit to Congress a report on the studies conducted under paragraphs (1) and (2), respectively, and shall include any recommendations for legislation or administrative changes.”</content>
