<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida796d752-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q"><num value="1395q">§ 1395q.</num><heading> Coverage period</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida796d753-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a"><num value="a" class="bold">(a)</num><heading class="bold"> Commencement</heading><chapeau style="-uslm-lc:I11" class="indent0">The period during which an individual is entitled to benefits under the insurance program established by this part (hereinafter referred to as his “coverage period”) shall begin on whichever of the following is the latest:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida796d754-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/1"><num value="1">(1)</num><content> <date date="1966-07-01">July 1, 1966</date>, or (in the case of a disabled individual who has not attained age 65) <date date="1973-07-01">July 1, 1973</date>; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida796d755-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/2"><num value="2">(2)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="ida796d756-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/2/A"><num value="A">(A)</num><content> in the case of an individual who enrolls pursuant to subsection (d) of <ref href="/us/usc/t42/s1395p">section 1395p of this title</ref> before the month in which he first satisfies paragraph (1) or (2) of section 1395<i>o</i> of this title, the first day of such month, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida796fe67-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/2/B"><num value="B">(B)</num><content> in the case of an individual who enrolls pursuant to such subsection (d) in the month in which he first satisfies such paragraph, the first day of the month following the month in which he so enrolls, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida796fe68-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/2/C"><num value="C">(C)</num><content> in the case of an individual who enrolls pursuant to such subsection (d) in the month following the month in which he first satisfies such paragraph, the first day of the second month following the month in which he so enrolls, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida796fe69-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/2/D"><num value="D">(D)</num><content> in the case of an individual who enrolls pursuant to such subsection (d) more than one month following the month in which he satisfies such paragraph, the first day of the third month following the month in which he so enrolls, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida796fe6a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/2/E"><num value="E">(E)</num><content> in the case of an individual who enrolls pursuant to subsection (e) of <ref href="/us/usc/t42/s1395p">section 1395p of this title</ref>, the July 1 following the month in which he so enrolls; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida796fe6b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/3"><num value="3">(3)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="ida796fe6c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/3/A"><num value="A">(A)</num><content> in the case of an individual who is deemed to have enrolled on or before the last day of the third month of his initial enrollment period, the first day of the month in which he first meets the applicable requirements of section 1395<i>o</i> of this title or <date date="1973-07-01">July 1, 1973</date>, whichever is later, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="ida796fe6d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/a/3/B"><num value="B">(B)</num><content> in the case of an individual who is deemed to have enrolled on or after the first day of the fourth month of his initial enrollment period, as prescribed under subparagraphs (B), (C), (D), and (E) of paragraph (2) of this subsection.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida796fe6e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/b"><num value="b" class="bold">(b)</num><heading class="bold"> Continuation</heading><chapeau style="-uslm-lc:I11" class="indent0">An individual’s coverage period shall continue until his enrollment has been terminated—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida796fe6f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/b/1"><num value="1">(1)</num><content> by the filing of notice that the individual no longer wishes to participate in the insurance program established by this part, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida7972580-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/b/2"><num value="2">(2)</num><content> for nonpayment of premiums.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">The termination of a coverage period under paragraph (1) shall (except as otherwise provided in <ref href="/us/usc/t42/s1395v/e">section 1395v(e) of this title</ref>) take effect at the close of the month following the month in which the notice is filed. The termination of a coverage period under paragraph (2) shall take effect on a date determined under regulations, which may be determined so as to provide a grace period in which overdue premiums may be paid and coverage continued. The grace period determined under the preceding sentence shall not exceed 90 days; except that it may be extended to not to exceed 180 days in any case where the Secretary determines that there was good cause for failure to pay the overdue premiums within such 90-day period.</continuation>

<continuation style="-uslm-lc:I11" class="indent0">Where an individual who is deemed to have enrolled for medical insurance pursuant to <ref href="/us/usc/t42/s1395p/f">section 1395p(f) of this title</ref> files a notice before the first day of the month in which his coverage period begins advising that he does not wish to be so enrolled, the termination of the coverage period resulting from such deemed enrollment shall take effect with the first day of the month the coverage would have been effective. Where an individual who is deemed enrolled for medical insurance benefits pursuant to <ref href="/us/usc/t42/s1395p/f">section 1395p(f) of this title</ref> files a notice requesting termination of his deemed coverage in or after the month in which such coverage becomes effective, the termination of such coverage shall take effect at the close of the month following the month in which the notice is filed.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida7972581-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/c"><num value="c" class="bold">(c)</num><heading class="bold"> Termination</heading><content><p style="-uslm-lc:I11" class="indent0">In the case of an individual satisfying paragraph (1) of section 1395<i>o</i> of this title whose entitlement to hospital insurance benefits under part A is based on a disability rather than on his having attained the age of 65, his coverage period (and his enrollment under this part) shall be terminated as of the close of the last month for which he is entitled to hospital insurance benefits.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida7974c92-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/d"><num value="d" class="bold">(d)</num><heading class="bold"> Payment of expenses incurred during coverage period</heading><content><p style="-uslm-lc:I11" class="indent0">No payments may be made under this part with respect to the expenses of an individual unless such expenses were incurred by such individual during a period which, with respect to him, is a coverage period.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida7974c93-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/e"><num value="e" class="bold">(e)</num><heading class="bold"> Commencement of coverage for special enrollment periods</heading><chapeau style="-uslm-lc:I11" class="indent0">Notwithstanding subsection (a), in the case of an individual who enrolls during a special enrollment period pursuant to section 1395p(i)(3) or 1395p(i)(4)(B) of this title—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida7974c94-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/e/1"><num value="1">(1)</num><content> in any month of the special enrollment period in which the individual is at any time enrolled in a plan (specified in subparagraph (A) or (B), as applicable, of <ref href="/us/usc/t42/s1395p/i/3">section 1395p(i)(3) of this title</ref> or specified in <ref href="/us/usc/t42/s1395p/i/4/A/i">section 1395p(i)(4)(A)(i) of this title</ref>) or in the first month following such a month, the coverage period shall begin on the first day of the month in which the individual so enrolls (or, at the option of the individual, on the first day of any of the following three months), or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida7974c95-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/e/2"><num value="2">(2)</num><content> in any other month of the special enrollment period, the coverage period shall begin on the first day of the month following the month in which the individual so enrolls.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida7974c96-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1395q/f"><num value="f" class="bold">(f)</num><heading class="bold"> Commencement of coverage for certain volunteers serving outside United States</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding subsection (a), in the case of an individual who enrolls during a special enrollment period pursuant to <ref href="/us/usc/t42/s1395p/k">section 1395p(k) of this title</ref>, the coverage period shall begin on the first day of the month following the month in which the individual so enrolls.</p>
