<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida94e4c16-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w"><num value="1396w">§ 1396w.</num><heading> Asset verification through access to information held by financial institutions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e4c17-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a"><num value="a" class="bold">(a)</num><heading class="bold"> Implementation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e4c18-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to the provisions of this section, each State shall implement an asset verification program described in subsection (b), for purposes of determining or redetermining the eligibility of an individual for medical assistance under the State plan under this subchapter.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e4c19-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Plan submittal</heading><chapeau style="-uslm-lc:I12" class="indent1">In order to meet the requirement of paragraph (1), each State shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e4c1a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/2/A"><num value="A">(A)</num><content> submit not later than a deadline specified by the Secretary consistent with paragraph (3), a State plan amendment under this subchapter that describes how the State intends to implement the asset verification program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e4c1b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/2/B"><num value="B">(B)</num><content> provide for implementation of such program for eligibility determinations and redeterminations made on or after 6 months after the deadline established for submittal of such plan amendment.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e4c1c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Phase-in</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida94e4c1d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida94e4c1e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> Implementation in current asset verification demo States</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall require those States specified in subparagraph (C) (to which an asset verification program has been applied before <date date="2008-06-30">June 30, 2008</date>) to implement an asset verification program under this subsection by the end of fiscal year 2009.</p>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida94e732f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Implementation in other States</heading><chapeau style="-uslm-lc:I14" class="indent3">The Secretary shall require other States to submit and implement an asset verification program under this subsection in such manner as is designed to result in the application of such programs, in the aggregate for all such other States, to enrollment of approximately, but not less than, the following percentage of enrollees, in the aggregate for all such other States, by the end of the fiscal year involved:</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida94e7330-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A/ii/I"><num value="I">(I)</num><content> 12.5 percent by the end of fiscal year 2009.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida94e7331-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A/ii/II"><num value="II">(II)</num><content> 25 percent by the end of fiscal year 2010.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida94e7332-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A/ii/III"><num value="III">(III)</num><content> 50 percent by the end of fiscal year 2011.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida94e7333-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A/ii/IV"><num value="IV">(IV)</num><content> 75 percent by the end of fiscal year 2012.</content>

<subclause style="-uslm-lc:I16" class="indent4" id="ida94e7334-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/A/ii/V"><num value="V">(V)</num><content> 100 percent by the end of fiscal year 2013.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida94e7335-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Consideration</heading><content><p style="-uslm-lc:I13" class="indent2">In selecting States under subparagraph (A)(ii), the Secretary shall consult with the States involved and take into account the feasibility of implementing asset verification programs in each such State.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida94e7336-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> States specified</heading><content><p style="-uslm-lc:I13" class="indent2">The States specified in this subparagraph are California, New York, and New Jersey.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida94e7337-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Construction</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in subparagraph (A)(ii) shall be construed as preventing a State from requesting, and the Secretary from approving, the implementation of an asset verification program in advance of the deadline otherwise established under such subparagraph.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e7338-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Exemption of territories</heading><content><p style="-uslm-lc:I12" class="indent1">This section shall only apply to the 50 States and the District of Columbia.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e7339-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/b"><num value="b" class="bold">(b)</num><heading class="bold"> Asset verification program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e733a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">For purposes of this section, an asset verification program means a program described in paragraph (2) under which a State—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e733b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/b/1/A"><num value="A">(A)</num><content> requires each applicant for, or recipient of, medical assistance under the State plan under this subchapter on the basis of being aged, blind, or disabled to provide authorization by such applicant or recipient (and any other person whose resources are required by law to be disclosed to determine the eligibility of the applicant or recipient for such assistance) for the State to obtain (subject to the cost reimbursement requirements of section 1115(a) of the Right to Financial Privacy Act <ref class="footnoteRef" idref="fn003010">1</ref><note type="footnote" id="fn003010"><num>1</num> See References in Text note below.</note> [<ref href="/us/usc/t12/s3415">12 U.S.C. 3415</ref>] but at no cost to the applicant or recipient) from any financial institution (within the meaning of section 1101(1) of such Act [<ref href="/us/usc/t12/s3401/1">12 U.S.C. 3401(1)</ref>]) any financial record (within the meaning of section 1101(2) of such Act) held by the institution with respect to the applicant or recipient (and such other person, as applicable), whenever the State determines the record is needed in connection with a determination with respect to such eligibility for (or the amount or extent of) such medical assistance; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e733c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/b/1/B"><num value="B">(B)</num><content> uses the authorization provided under subparagraph (A) to verify the financial resources of such applicant or recipient (and such other person, as applicable), in order to determine or redetermine the eligibility of such applicant or recipient for medical assistance under the State plan.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e733d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Program described</heading><content><p style="-uslm-lc:I12" class="indent1">A program described in this paragraph is a program for verifying individual assets in a manner consistent with the approach used by the Commissioner of Social Security under <ref href="/us/usc/t42/s1383/e/1/B/ii">section 1383(e)(1)(B)(ii) of this title</ref>.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e733e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/c"><num value="c" class="bold">(c)</num><heading class="bold"> Duration of authorization</heading><chapeau style="-uslm-lc:I11" class="indent0">Notwithstanding section 1104(a)(1) of the Right to Financial Privacy Act <sup>1</sup> [<ref href="/us/usc/t12/s3404/a/1">12 U.S.C. 3404(a)(1)</ref>], an authorization provided to a State under subsection (b)(1) shall remain effective until the earliest of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida94e733f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/c/1"><num value="1">(1)</num><content> the rendering of a final adverse decision on the applicant’s application for medical assistance under the State’s plan under this subchapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida94e7340-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/c/2"><num value="2">(2)</num><content> the cessation of the recipient’s eligibility for such medical assistance; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida94e7341-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/c/3"><num value="3">(3)</num><content> the express revocation by the applicant or recipient (or such other person described in subsection (b)(1), as applicable) of the authorization, in a written notification to the State.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e9952-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/d"><num value="d" class="bold">(d)</num><heading class="bold"> Treatment of Right to Financial Privacy Act requirements</heading><paragraph style="-uslm-lc:I11" class="indent0" id="ida94e9953-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/d/1"><num value="1">(1)</num><content> An authorization obtained by the State under subsection (b)(1) shall be considered to meet the requirements of the Right to Financial Privacy Act <sup>1</sup> for purposes of section 1103(a) of such Act [<ref href="/us/usc/t12/s3403/a">12 U.S.C. 3403(a)</ref>], and need not be furnished to the financial institution, notwithstanding section 1104(a) of such Act [<ref href="/us/usc/t12/s3404/a">12 U.S.C. 3404(a)</ref>].</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida94e9954-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/d/2"><num value="2">(2)</num><content> The certification requirements of section 1103(b) of the Right to Financial Privacy Act <sup>1</sup> [<ref href="/us/usc/t12/s3403/b">12 U.S.C. 3403(b)</ref>] shall not apply to requests by the State pursuant to an authorization provided under subsection (b)(1).</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="ida94e9955-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/d/3"><num value="3">(3)</num><content> A request by the State pursuant to an authorization provided under subsection (b)(1) is deemed to meet the requirements of section 1104(a)(3) of the Right to Financial Privacy Act <sup>1</sup> [<ref href="/us/usc/t12/s3404/a/3">12 U.S.C. 3404(a)(3)</ref>] and of section 1102 of such Act [<ref href="/us/usc/t12/s3402">12 U.S.C. 3402</ref>], relating to a reasonable description of financial records.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e9956-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/e"><num value="e" class="bold">(e)</num><heading class="bold"> Required disclosure</heading><content><p style="-uslm-lc:I11" class="indent0">The State shall inform any person who provides authorization pursuant to subsection (b)(1)(A) of the duration and scope of the authorization.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e9957-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/f"><num value="f" class="bold">(f)</num><heading class="bold"> Refusal or revocation of authorization</heading><content><p style="-uslm-lc:I11" class="indent0">If an applicant for, or recipient of, medical assistance under the State plan under this subchapter (or such other person described in subsection (b)(1), as applicable) refuses to provide, or revokes, any authorization made by the applicant or recipient (or such other person, as applicable) under subsection (b)(1)(A) for the State to obtain from any financial institution any financial record, the State may, on that basis, determine that the applicant or recipient is ineligible for medical assistance.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e9958-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/g"><num value="g" class="bold">(g)</num><heading class="bold"> Use of contractor</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of implementing an asset verification program under this section, a State may select and enter into a contract with a public or private entity meeting such criteria and qualifications as the State determines appropriate, consistent with requirements in regulations relating to general contracting provisions and with <ref href="/us/usc/t42/s1396b/i/2">section 1396b(i)(2) of this title</ref>. In carrying out activities under such contract, such an entity shall be subject to the same requirements and limitations on use and disclosure of information as would apply if the State were to carry out such activities directly.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e9959-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/h"><num value="h" class="bold">(h)</num><heading class="bold"> Technical assistance</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall provide States with technical assistance to aid in implementation of an asset verification program under this section.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e995a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/i"><num value="i" class="bold">(i)</num><heading class="bold"> Reports</heading><content><p style="-uslm-lc:I11" class="indent0">A State implementing an asset verification program under this section shall furnish to the Secretary such reports concerning the program, at such times, in such format, and containing such information as the Secretary determines appropriate.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e995b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/j"><num value="j" class="bold">(j)</num><heading class="bold"> Treatment of program expenses</heading><content><p style="-uslm-lc:I11" class="indent0">Notwithstanding any other provision of law, reasonable expenses of States in carrying out the program under this section shall be treated, for purposes of <ref href="/us/usc/t42/s1396b/a">section 1396b(a) of this title</ref>, in the same manner as State expenditures specified in paragraph (7) of such section.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida94e995c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k"><num value="k" class="bold">(k)</num><heading class="bold"> Reduction in FMAP after 2020 for non-compliant States</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e995d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">With respect to a calendar quarter beginning on or after <date date="2021-01-01">January 1, 2021</date>, the Federal medical assistance percentage otherwise determined under <ref href="/us/usc/t42/s1396d/b">section 1396d(b) of this title</ref> for a non-compliant State shall be reduced—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e995e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/1/A"><num value="A">(A)</num><content> for calendar quarters in 2021 and 2022, by 0.12 percentage points;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e995f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/1/B"><num value="B">(B)</num><content> for calendar quarters in 2023, by 0.25 percentage points;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e9960-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/1/C"><num value="C">(C)</num><content> for calendar quarters in 2024, by 0.35 percentage points; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida94e9961-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/1/D"><num value="D">(D)</num><content> for calendar quarters in 2025 and each year thereafter, by 0.5 percentage points.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida94e9962-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/2"><num value="2" class="bold">(2)</num><heading class="bold"> Non-compliant State defined</heading><chapeau style="-uslm-lc:I12" class="indent1">For purposes of this subsection, the term “non-compliant State” means a State—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida94ec073-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/2/A"><num value="A">(A)</num><content> that is one of the 50 States or the District of Columbia;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida94ec074-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/2/B"><num value="B">(B)</num><content> with respect to which the Secretary has not approved a State plan amendment submitted under subsection (a)(2); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida94ec075-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1396w/k/2/C"><num value="C">(C)</num><content> that is not operating, on an ongoing basis, an asset verification program in accordance with this section.</content>
