<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida9532e10-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g"><num value="1397g">§ 1397g.</num><heading> Demonstration projects to address health professions workforce needs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9532e11-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a"><num value="a" class="bold">(a)</num><heading class="bold"> Demonstration projects to provide low-income individuals with opportunities for education, training, and career advancement to address health professions workforce needs</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9532e12-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authority to award grants</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary, in consultation with the Secretary of Labor, shall award grants to eligible entities to conduct demonstration projects that are designed to provide eligible individuals with the opportunity to obtain education and training for occupations in the health care field that pay well and are expected to either experience labor shortages or be in high demand.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9532e13-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9532e14-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Aid and supportive services</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9532e15-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/2/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">A demonstration project conducted by an eligible entity awarded a grant under this section shall, if appropriate, provide eligible individuals participating in the project with financial aid, child care, case management, and other supportive services.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9532e16-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/2/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Treatment</heading><content><p style="-uslm-lc:I14" class="indent3">Any aid, services, or incentives provided to an eligible beneficiary participating in a demonstration project under this section shall not be considered income, and shall not be taken into account for purposes of determining the individual’s eligibility for, or amount of, benefits under any means-tested program.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9532e17-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Consultation and coordination</heading><content><p style="-uslm-lc:I13" class="indent2">An eligible entity applying for a grant to carry out a demonstration project under this section shall demonstrate in the application that the entity has consulted with the State agency responsible for administering the State TANF program, the local workforce investment board in the area in which the project is to be conducted (unless the applicant is such board), the State workforce development board established under <ref href="/us/usc/t29/s3111">section 3111 of title 29</ref>, and the State Apprenticeship Agency recognized under the Act of <date date="1937-08-16">August 16, 1937</date> (commonly known as the “National Apprenticeship Act”) [<ref href="/us/usc/t29/s50">29 U.S.C. 50</ref> et seq.] (or if no agency has been recognized in the State, the Office of Apprenticeship of the Department of Labor) and that the project will be carried out in coordination with such entities.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9532e18-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Assurance of opportunities for Indian populations</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall award at least 3 grants under this subsection to an eligible entity that is an Indian tribe, tribal organization, or Tribal College or University.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9532e19-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Reports and evaluation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9532e1a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Eligible entities</heading><content><p style="-uslm-lc:I13" class="indent2">An eligible entity awarded a grant to conduct a demonstration project under this subsection shall submit interim reports to the Secretary on the activities carried out under the project and a final report on such activities upon the conclusion of the entities’ participation in the project. Such reports shall include assessments of the effectiveness of such activities with respect to improving outcomes for the eligible individuals participating in the project and with respect to addressing health professions workforce needs in the areas in which the project is conducted.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9532e1b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Evaluation</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall, by grant, contract, or interagency agreement, evaluate the demonstration projects conducted under this subsection. Such evaluation shall include identification of successful activities for creating opportunities for developing and sustaining, particularly with respect to low-income individuals and other entry-level workers, a health professions workforce that has accessible entry points, that meets high standards for education, training, certification, and professional development, and that provides increased wages and affordable benefits, including health care coverage, that are responsive to the workforce’s needs.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953552c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Report to Congress</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall submit interim reports and, based on the evaluation conducted under subparagraph (B), a final report to Congress on the demonstration projects conducted under this subsection.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953552d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953552e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Eligible entity</heading><content><p style="-uslm-lc:I13" class="indent2">The term “eligible entity” means a State, an Indian tribe or tribal organization, an institution of higher education, a local workforce development board established under <ref href="/us/usc/t29/s3122">section 3122 of title 29</ref>, a sponsor of an apprenticeship program registered under the National Apprenticeship Act [<ref href="/us/usc/t29/s50">29 U.S.C. 50</ref> et seq.] or a community-based organization.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953552f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Eligible individual</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9535530-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The term “eligible individual” means a <ref class="footnoteRef" idref="fn003015">1</ref><note type="footnote" id="fn003015"><num>1</num> So in original. </subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9535532-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Indian tribe; tribal organization</heading><content><p style="-uslm-lc:I13" class="indent2">The terms “Indian tribe” and “tribal organization” have the meaning given such terms in <ref href="/us/usc/t25/s5304">section 5304 of title 25</ref>.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9535533-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/D"><num value="D" class="bold">(D)</num><heading class="bold"> Institution of higher education</heading><content><p style="-uslm-lc:I13" class="indent2">The term “institution of higher education” has the meaning given that term in <ref href="/us/usc/t20/s1001">section 1001 of title 20</ref>.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9535534-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/E"><num value="E" class="bold">(E)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I13" class="indent2">The term “State” means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, and American Samoa.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9535535-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/F"><num value="F" class="bold">(F)</num><heading class="bold"> State TANF program</heading><content><p style="-uslm-lc:I13" class="indent2">The term “State TANF program” means the temporary assistance for needy families program funded under part A of subchapter IV.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9535536-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/a/4/G"><num value="G" class="bold">(G)</num><heading class="bold"> Tribal College or University</heading><content><p style="-uslm-lc:I13" class="indent2">The term “Tribal College or University” has the meaning given that term in section 1059c(b)of title 20.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9535537-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b"><num value="b" class="bold">(b)</num><heading class="bold"> Demonstration project to develop training and certification programs for personal or home care aides</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9535538-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authority to award grants</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 18 months after <date date="2010-03-23">March 23, 2010</date>, the Secretary shall award grants to eligible entities that are States to conduct demonstration projects for purposes of developing core training competencies and certification programs for personal or home care aides. The Secretary shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9535539-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/1/A"><num value="A">(A)</num><content> evaluate the efficacy of the core training competencies described in paragraph (3)(A) for newly hired personal or home care aides and the methods used by States to implement such core training competencies in accordance with the issues specified in paragraph (3)(B); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953553a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/1/B"><num value="B">(B)</num><content> ensure that the number of hours of training provided by States under the demonstration project with respect to such core training competencies are not less than the number of hours of training required under any applicable State or Federal law or regulation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953553b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Duration</heading><content><p style="-uslm-lc:I12" class="indent1">A demonstration project shall be conducted under this subsection for not less than 3 years.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953553c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Core training competencies for personal or home care aides</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953553d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The core training competencies for personal or home care aides described in this subparagraph include competencies with respect to the following areas:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida953553e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/i"><num value="i">(i)</num><content> The role of the personal or home care aide (including differences between a personal or home care aide employed by an agency and a personal or home care aide employed directly by the health care consumer or an independent provider).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida953553f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/ii"><num value="ii">(ii)</num><content> Consumer rights, ethics, and confidentiality (including the role of proxy decision-makers in the case where a health care consumer has impaired decision-making capacity).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9535540-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/iii"><num value="iii">(iii)</num><content> Communication, cultural and linguistic competence and sensitivity, problem solving, behavior management, and relationship skills.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/iv"><num value="iv">(iv)</num><content> Personal care skills.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b52-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/v"><num value="v">(v)</num><content> Health care support.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b53-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/vi"><num value="vi">(vi)</num><content> Nutritional support.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b54-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/vii"><num value="vii">(vii)</num><content> Infection control.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b55-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/viii"><num value="viii">(viii)</num><content> Safety and emergency training.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b56-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/ix"><num value="ix">(ix)</num><content> Training specific to an individual consumer’s needs (including older individuals, younger individuals with disabilities, individuals with developmental disabilities, individuals with dementia, and individuals with mental and behavioral health needs).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b57-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/A/x"><num value="x">(x)</num><content> Self-Care.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9537b58-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Implementation</heading><chapeau style="-uslm-lc:I13" class="indent2">The implementation issues specified in this subparagraph include the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9537b59-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/B/i"><num value="i">(i)</num><content> The length of the training.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b5a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/B/ii"><num value="ii">(ii)</num><content> The appropriate trainer to student ratio.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b5b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/B/iii"><num value="iii">(iii)</num><content> The amount of instruction time spent in the classroom as compared to on-site in the home or a facility.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b5c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/B/iv"><num value="iv">(iv)</num><content> Trainer qualifications.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b5d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/B/v"><num value="v">(v)</num><content> Content for a “hands-on” and written certification exam.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b5e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/3/B/vi"><num value="vi">(vi)</num><content> Continuing education requirements.</content>

</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9537b5f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Application and selection criteria</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9537b60-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9537b61-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> Number of States</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall enter into agreements with not more than 6 States to conduct demonstration projects under this subsection.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9537b62-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Requirements for States</heading><chapeau style="-uslm-lc:I14" class="indent3">An agreement entered into under clause (i) shall require that a participating State—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida9537b63-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/A/ii/I"><num value="I">(I)</num><content> implement the core training competencies described in paragraph (3)(A); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida9537b64-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/A/ii/II"><num value="II">(II)</num><content> develop written materials and protocols for such core training competencies, including the development of a certification test for personal or home care aides who have completed such training competencies.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida9537b65-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/A/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Consultation and collaboration with community and vocational colleges</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall encourage participating States to consult with community and vocational colleges regarding the development of curricula to implement the project with respect to activities, as applicable, which may include consideration of such colleges as partners in such implementation.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9537b66-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Application and eligibility</heading><chapeau style="-uslm-lc:I13" class="indent2">A State seeking to participate in the project shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9537b67-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/B/i"><num value="i">(i)</num><content> submit an application to the Secretary containing such information and at such time as the Secretary may specify;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b68-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/B/ii"><num value="ii">(ii)</num><content> meet the selection criteria established under subparagraph (C); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b69-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/B/iii"><num value="iii">(iii)</num><content> meet such additional criteria as the Secretary may specify.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9537b6a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Selection criteria</heading><chapeau style="-uslm-lc:I13" class="indent2">In selecting States to participate in the program, the Secretary shall establish criteria to ensure (if applicable with respect to the activities involved)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9537b6b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C/i"><num value="i">(i)</num><content> geographic and demographic diversity;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b6c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C/ii"><num value="ii">(ii)</num><content> that participating States offer medical assistance for personal care services under the State Medicaid plan;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b6d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C/iii"><num value="iii">(iii)</num><chapeau> that the existing training standards for personal or home care aides in each participating State—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida9537b6e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C/iii/I"><num value="I">(I)</num><content> are different from such standards in the other participating States; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida9537b6f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C/iii/II"><num value="II">(II)</num><content> are different from the core training competencies described in paragraph (3)(A);</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b70-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C/iv"><num value="iv">(iv)</num><content> that participating States do not reduce the number of hours of training required under applicable State law or regulation after being selected to participate in the project; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9537b71-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/C/v"><num value="v">(v)</num><content> that participating States recruit a minimum number of eligible health and long-term care providers to participate in the project.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9537b72-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/4/D"><num value="D" class="bold">(D)</num><heading class="bold"> Technical assistance</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall provide technical assistance to States in developing written materials and protocols for such core training competencies.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9537b73-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Evaluation and report</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9537b74-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> Evaluation</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall develop an experimental or control group testing protocol in consultation with an independent evaluation contractor selected by the Secretary. Such contractor shall evaluate—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida953a285-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5/A/i"><num value="i">(i)</num><content> the impact of core training competencies described in paragraph (3)(A), including curricula developed to implement such core training competencies, for personal or home care aides within each participating State on job satisfaction, mastery of job skills, beneficiary and family caregiver satisfaction with services, and additional measures determined by the Secretary in consultation with the expert panel;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida953a286-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5/A/ii"><num value="ii">(ii)</num><content> the impact of providing such core training competencies on the existing training infrastructure and resources of States; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida953a287-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5/A/iii"><num value="iii">(iii)</num><content> whether a minimum number of hours of initial training should be required for personal or home care aides and, if so, what minimum number of hours should be required.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953a288-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Reports</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida953a289-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Report on initial implementation</heading><content><p style="-uslm-lc:I14" class="indent3">Not later than 2 years after <date date="2010-03-23">March 23, 2010</date>, the Secretary shall submit to Congress a report on the initial implementation of activities conducted under the demonstration project, including any available results of the evaluation conducted under subparagraph (A) with respect to such activities, together with such recommendations for legislation or administrative action as the Secretary determines appropriate.</p>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida953a28a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/5/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Final report</heading><content><p style="-uslm-lc:I14" class="indent3">Not later than 1 year after the completion of the demonstration project, the Secretary shall submit to Congress a report containing the results of the evaluation conducted under subparagraph (A), together with such recommendations for legislation or administrative action as the Secretary determines appropriate.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953a28b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953a28c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> Eligible health and long-term care provider</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “eligible health and long-term care provider” means a personal or home care agency (including personal or home care public authorities), a nursing home, a home health agency (as defined in section 1395x(<i>o</i>) of this title), or any other health care provider the Secretary determines appropriate which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida953a28d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/6/A/i"><num value="i">(i)</num><content> is licensed or authorized to provide services in a participating State; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida953a28e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/6/A/ii"><num value="ii">(ii)</num><content> receives payment for services under subchapter XIX.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953a28f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Personal care services</heading><content><p style="-uslm-lc:I13" class="indent2">The term “personal care services” has the meaning given such term for purposes of subchapter XIX.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953a290-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/6/C"><num value="C" class="bold">(C)</num><heading class="bold"> Personal or home care aide</heading><content><p style="-uslm-lc:I13" class="indent2">The term “personal or home care aide” means an individual who helps individuals who are elderly, disabled, ill, or mentally disabled (including an individual with Alzheimer’s disease or other dementia) to live in their own home or a residential care facility (such as a nursing home, assisted living facility, or any other facility the Secretary determines appropriate) by providing routine personal care services and other appropriate services to the individual.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida953a291-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/b/6/D"><num value="D" class="bold">(D)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I13" class="indent2">The term “State” has the meaning given that term for purposes of subchapter XIX.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953a292-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/c"><num value="c" class="bold">(c)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953a293-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject to paragraph (2), out of any funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary to carry out subsections (a) and (b), $85,000,000 for each of fiscal years 2010 through 2019.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953a294-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Training and certification programs for personal and home care aides</heading><content><p style="-uslm-lc:I12" class="indent1">With respect to the demonstration projects under subsection (b), the Secretary shall use $5,000,000 of the amount appropriated under paragraph (1) for each of fiscal years 2010 through 2012 to carry out such projects. No funds appropriated under paragraph (1) shall be used to carry out demonstration projects under subsection (b) after fiscal year 2012.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953a295-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/d"><num value="d" class="bold">(d)</num><heading class="bold"> Nonapplication</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953a296-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397g/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2), the preceding sections of this division shall not apply to grant <ref class="footnoteRef" idref="fn003016">2</ref><note type="footnote" id="fn003016"><num>2</num> So in original.</note> awarded under this section.</p>
