<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida953c9ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h"><num value="1397h">§ 1397h.</num><heading> Program for early detection of certain medical conditions related to environmental health hazards</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953c9af-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/a"><num value="a" class="bold">(a)</num><heading class="bold"> Program establishment</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall establish a program in accordance with this section to make competitive grants to eligible entities specified in subsection (b) for the purpose of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida953c9b0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/a/1"><num value="1">(1)</num><content> screening at-risk individuals (as defined in subsection (c)(1)) for environmental health conditions (as defined in subsection (c)(3)); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida953c9b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/a/2"><num value="2">(2)</num><chapeau> developing and disseminating public information and education concerning—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida953c9b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/a/2/A"><num value="A">(A)</num><content> the availability of screening under the program under this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953c9b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/a/2/B"><num value="B">(B)</num><content> the detection, prevention, and treatment of environmental health conditions; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953c9b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/a/2/C"><num value="C">(C)</num><content> the availability of Medicare benefits for certain individuals diagnosed with environmental health conditions under <ref href="/us/usc/t42/s1395rr–1">section 1395rr–1 of this title</ref>.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953c9b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b"><num value="b" class="bold">(b)</num><heading class="bold"> Eligible entities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953c9b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of this section, an eligible entity is an entity described in paragraph (2) which submits an application to the Secretary in such form and manner, and containing such information and assurances, as the Secretary determines appropriate.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0c7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Types of eligible entities</heading><chapeau style="-uslm-lc:I12" class="indent1">The entities described in this paragraph are the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0c8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2/A"><num value="A">(A)</num><content> A hospital or community health center.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0c9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2/B"><num value="B">(B)</num><content> A Federally qualified health center.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0ca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2/C"><num value="C">(C)</num><content> A facility of the Indian Health Service.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0cb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2/D"><num value="D">(D)</num><content> A National Cancer Institute-designated cancer center.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0cc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2/E"><num value="E">(E)</num><content> An agency of any State or local government.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0cd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2/F"><num value="F">(F)</num><content> A nonprofit organization.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0ce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/b/2/G"><num value="G">(G)</num><content> Any other entity the Secretary determines appropriate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953f0cf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c"><num value="c" class="bold">(c)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0d0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> At-risk individual</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “at-risk individual” means an individual who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0d1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/1/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="ida953f0d2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/1/A/i"><num value="i">(i)</num><chapeau> as demonstrated in such manner as the Secretary determines appropriate, has been present for an aggregate total of 6 months in the geographic area subject to an emergency declaration specified under paragraph (2), during a period ending—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="ida953f0d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/1/A/i/I"><num value="I">(I)</num><content> not less than 10 years prior to the date of such individual’s application under subparagraph (B); and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="ida953f0d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/1/A/i/II"><num value="II">(II)</num><content> prior to the implementation of all the remedial and removal actions specified in the Record of Decision for Operating Unit 4 and the Record of Decision for Operating Unit 7; or</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="ida953f0d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/1/A/ii"><num value="ii">(ii)</num><content> meets such other criteria as the Secretary determines appropriate considering the type of environmental health condition at issue; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0d6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/1/B"><num value="B">(B)</num><content> has submitted an application (or has an application submitted on the individual’s behalf), to an eligible entity receiving a grant under this section, for screening under the program under this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0d7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Emergency declaration</heading><content><p style="-uslm-lc:I12" class="indent1">The term “emergency declaration” means a declaration of a public health emergency under <ref href="/us/usc/t42/s9604/a">section 9604(a) of this title</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Environmental health condition</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “environmental health condition” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/A"><num value="A">(A)</num><chapeau> asbestosis, pleural thickening, or pleural plaques, as established by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida953f0da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/A/i"><num value="i">(i)</num><content> interpretation by a “B Reader” qualified physician of a plain chest x-ray or interpretation of a computed tomographic radiograph of the chest by a qualified physician, as determined by the Secretary; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida953f0db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/A/ii"><num value="ii">(ii)</num><content> such other diagnostic standards as the Secretary specifies;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/B"><num value="B">(B)</num><chapeau> mesothelioma, or malignancies of the lung, colon, rectum, larynx, stomach, esophagus, pharynx, or ovary, as established by—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida953f0dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/B/i"><num value="i">(i)</num><content> pathologic examination of biopsy tissue;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida953f0de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/B/ii"><num value="ii">(ii)</num><content> cytology from bronchioalveolar lavage; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida953f0df-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/B/iii"><num value="iii">(iii)</num><content> such other diagnostic standards as the Secretary specifies; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/3/C"><num value="C">(C)</num><content> any other medical condition which the Secretary determines is caused by exposure to a hazardous substance or pollutant or contaminant at a Superfund site to which an emergency declaration applies, based on such criteria and as established by such diagnostic standards as the Secretary specifies.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0e1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Hazardous substance; pollutant; contaminant</heading><content><p style="-uslm-lc:I12" class="indent1">The terms “hazardous substance”, “pollutant”, and “contaminant” have the meanings given those terms in <ref href="/us/usc/t42/s9601">section 9601 of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0e2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Superfund site</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Superfund site” means a site included on the National Priorities List developed by the President in accordance with <ref href="/us/usc/t42/s9605/a/8/B">section 9605(a)(8)(B) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953f0e3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/d"><num value="d" class="bold">(d)</num><heading class="bold"> Health coverage unaffected</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section shall be construed to affect any coverage obligation of a governmental or private health plan or program relating to an at-risk individual.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953f0e4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/e"><num value="e" class="bold">(e)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">Out of any funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary, to carry out the program under this section—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0e6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/e/1/A"><num value="A">(A)</num><content> $23,000,000 for the period of fiscal years 2010 through 2014; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida953f0e7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/e/1/B"><num value="B">(B)</num><content> $20,000,000 for each 5-fiscal year period thereafter.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0e8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Availability</heading><content><p style="-uslm-lc:I12" class="indent1">Funds appropriated under paragraph (1) shall remain available until expended.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida953f0e9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/f"><num value="f" class="bold">(f)</num><heading class="bold"> Nonapplication</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida953f0ea-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (2), the preceding sections of this subchapter shall not apply to grants awarded under this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida95417fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1397h/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Limitations on use of grants</heading><content><p style="-uslm-lc:I12" class="indent1"><ref href="/us/usc/t42/s1397d/a">Section 1397d(a) of this title</ref> shall apply to a grant awarded under this section to the same extent and in the same manner as such section applies to payments to States under this subchapter, except that paragraph (4) of such section shall not be construed to prohibit grantees from conducting screening for environmental health conditions as authorized under this section.</p>
