<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad635f2d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302"><num value="14302">§ 14302.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For purposes of this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad635f2e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/1"><num value="1" class="bold">(1)</num><heading class="bold"> Administrator</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Administrator” means the Administrator of the Environmental Protection Agency.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad635f2f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/2"><num value="2" class="bold">(2)</num><heading class="bold"> Button cell</heading><content><p style="-uslm-lc:I12" class="indent1">The term “button cell” means a button- or coin-shaped battery.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad635f30-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/3"><num value="3" class="bold">(3)</num><heading class="bold"> Easily removable</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “easily removable”, with respect to a battery, means detachable or removable at the end of the life of the battery—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad635f31-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/3/A"><num value="A">(A)</num><content> from a consumer product by a consumer with the use of common household tools; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad635f32-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/3/B"><num value="B">(B)</num><content> by a retailer of replacements for a battery used as the principal electrical power source for a vehicle.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad635f33-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/4"><num value="4" class="bold">(4)</num><heading class="bold"> Mercuric-oxide battery</heading><content><p style="-uslm-lc:I12" class="indent1">The term “mercuric-oxide battery” means a battery that uses a mercuric-oxide electrode.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad635f34-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5"><num value="5" class="bold">(5)</num><heading class="bold"> Rechargeable battery</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “rechargeable battery”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad635f35-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5/A"><num value="A">(A)</num><content> means 1 or more voltaic or galvanic cells, electrically connected to produce electric energy, that is designed to be recharged for repeated uses; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad635f36-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5/B"><num value="B">(B)</num><content> includes any type of enclosed device or sealed container consisting of 1 or more such cells, including what is commonly called a battery pack (and in the case of a battery pack, for the purposes of the requirements of easy removability and labeling under <ref href="/us/usc/t42/s14322">section 14322 of this title</ref>, means the battery pack as a whole rather than each component individually); but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad635f37-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5/C"><num value="C">(C)</num><chapeau> does not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad635f38-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5/C/i"><num value="i">(i)</num><content> a lead-acid battery used to start an internal combustion engine or as the principal electrical power source for a vehicle, such as an automobile, a truck, construction equipment, a motorcycle, a garden tractor, a golf cart, a wheelchair, or a boat;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad638649-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5/C/ii"><num value="ii">(ii)</num><content> a lead-acid battery used for load leveling or for storage of electricity generated by an alternative energy source, such as a solar cell or wind-driven generator;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad63864a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5/C/iii"><num value="iii">(iii)</num><content> a battery used as a backup power source for memory or program instruction storage, timekeeping, or any similar purpose that requires uninterrupted electrical power in order to function if the primary energy supply fails or fluctuates momentarily; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad63864b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/5/C/iv"><num value="iv">(iv)</num><content> a rechargeable alkaline battery.</content>
</clause>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad63864c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/6"><num value="6" class="bold">(6)</num><heading class="bold"> Rechargeable consumer product</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “rechargeable consumer product”—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad63864d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/6/A"><num value="A">(A)</num><content> means a product that, when sold at retail, includes a regulated battery as a primary energy supply, and that is primarily intended for personal or household use; but</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad63864e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/6/B"><num value="B">(B)</num><content> does not include a product that only uses a battery solely as a source of backup power for memory or program instruction storage, timekeeping, or any similar purpose that requires uninterrupted electrical power in order to function if the primary energy supply fails or fluctuates momentarily.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad63864f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/7"><num value="7" class="bold">(7)</num><heading class="bold"> Regulated battery</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “regulated battery” means a rechargeable battery that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad638650-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/7/A"><num value="A">(A)</num><content> contains a cadmium or a lead electrode or any combination of cadmium and lead electrodes; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad638651-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/7/B"><num value="B">(B)</num><content> contains other electrode chemistries and is the subject of a determination by the Administrator under <ref href="/us/usc/t42/s14322/d">section 14322(d) of this title</ref>.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad638652-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14302/8"><num value="8" class="bold">(8)</num><heading class="bold"> Remanufactured product</heading><content><p style="-uslm-lc:I12" class="indent1">The term “remanufactured product” means a rechargeable consumer product that has been altered by the replacement of parts, repackaged, or repaired after initial sale by the original manufacturer.</p>
