<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad63facd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323"><num value="14323">§ 14323.</num><heading> Requirements</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad63face-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/a"><num value="a" class="bold">(a)</num><heading class="bold"> Batteries subject to certain regulations</heading><chapeau style="-uslm-lc:I11" class="indent0">The collection, storage, or transportation of used rechargeable batteries, batteries described in <ref href="/us/usc/t42/s14302/5/C">section 14302(5)(C) of this title</ref> or in subchapter III, and used rechargeable consumer products containing rechargeable batteries that are not easily removable rechargeable batteries, shall, notwithstanding any law of a State or political subdivision thereof governing such collection, storage, or transportation, be regulated under applicable provisions of the regulations promulgated by the Environmental Protection Agency at 60 Fed. Reg. 25492 (<date date="1995-05-11">May 11, 1995</date>), as effective on <date date="1995-05-11">May 11, 1995</date>, except as provided in paragraph (2) of subsection (b) and except that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad63facf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/a/1"><num value="1">(1)</num><content> the requirements of 40 CFR 260.20, 260.40, and 260.41 and the equivalent requirements of an approved State program shall not apply, and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad63fad0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/a/2"><num value="2">(2)</num><content> this section shall not apply to any lead acid battery managed under 40 CFR 266 subpart G or the equivalent requirements of an approved State program.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad63fad1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/b"><num value="b" class="bold">(b)</num><heading class="bold"> Enforcement under Solid Waste Disposal Act</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idad63fad2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/b/1"><num value="1">(1)</num><content> Any person who fails to comply with the requirements imposed by subsection (a) of this section may be subject to enforcement under applicable provisions of the Solid Waste Disposal Act [<ref href="/us/usc/t42/s6901">42 U.S.C. 6901</ref> et seq.].</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idad63fad3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/b/2"><num value="2">(2)</num><chapeau> States may implement and enforce the requirements of subsection (a) if the Administrator finds that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idad6421e4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/b/2/A"><num value="A">(A)</num><content> the State has adopted requirements that are identical to those referred to in subsection (a) governing the collection, storage, or transportation of batteries referred to in subsection (a); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idad6421e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14323/b/2/B"><num value="B">(B)</num><content> the State provides for enforcement of such requirements.</content>
