L. 114–201, title I, § 114, July 29, 2016, 130 Stat. 804.)","seq_in_title":2124,"parent_identifier":"/us/usc/t42/ch8/schI","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch8","level":"chapter","num":"CHAPTER 8—","heading":"LOW-INCOME HOUSING","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch8/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"GENERAL PROGRAM OF ASSISTED HOUSING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"ida966dd1a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437\"><num value=\"1437\">§ 1437.</num><heading> Declaration of policy and public housing agency organization</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida966dd1b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Declaration of policy</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">It is the policy of the United States—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida966dd1c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a/1\"><num value=\"1\">(1)</num><chapeau> to promote the general welfare of the Nation by employing the funds and credit of the Nation, as provided in this chapter—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida967042d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a/1/A\"><num value=\"A\">(A)</num><content> to assist States and political subdivisions of States to remedy the unsafe housing conditions and the acute shortage of decent and safe dwellings for low-income families;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida967042e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a/1/B\"><num value=\"B\">(B)</num><content> to assist States and political subdivisions of States to address the shortage of housing affordable to low-income families; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida967042f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a/1/C\"><num value=\"C\">(C)</num><content> consistent with the objectives of this subchapter, to vest in public housing agencies that perform well, the maximum amount of responsibility and flexibility in program administration, with appropriate accountability to public housing residents, localities, and the general public;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9670430-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a/2\"><num value=\"2\">(2)</num><content> that the Federal Government cannot through its direct action alone provide for the housing of every American citizen, or even a majority of its citizens, but it is the responsibility of the Government to promote and protect the independent and collective actions of private citizens to develop housing and strengthen their own neighborhoods;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9670431-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a/3\"><num value=\"3\">(3)</num><content> that the Federal Government should act where there is a serious need that private citizens or groups cannot or are not addressing responsibly; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"ida9670432-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/a/4\"><num value=\"4\">(4)</num><content> that our Nation should promote the goal of providing decent and affordable housing for all citizens through the efforts and encouragement of Federal, State, and local governments, and by the independent and collective actions of private citizens, organizations, and the private sector.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida9670433-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Public housing agency organization</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9670434-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Required membership</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraphs (2) and (3), the membership of the board of directors or similar governing body of each public housing agency shall contain not less than 1 member—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9670435-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/1/A\"><num value=\"A\">(A)</num><content> who is directly assisted by the public housing agency; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9670436-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/1/B\"><num value=\"B\">(B)</num><content> who may, if provided for in the public housing agency plan, be elected by the residents directly assisted by the public housing agency.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9670437-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exception</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Paragraph (1) shall not apply to any public housing agency—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9670438-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/2/A\"><num value=\"A\">(A)</num><content> that is located in a State that requires the members of the board of directors or similar governing body of a public housing agency to be salaried and to serve on a full-time basis; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9670439-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/2/B\"><num value=\"B\">(B)</num><chapeau> with less than 300 public housing units, if—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida967043a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/2/B/i\"><num value=\"i\">(i)</num><content> the agency has provided reasonable notice to the resident advisory board of the opportunity of not less than 1 resident described in paragraph (1) to serve on the board of directors or similar governing body of the public housing agency pursuant to such paragraph; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida967043b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> within a reasonable time after receipt by the resident advisory board established by the agency pursuant to <ref href=\"/us/usc/t42/s1437c–1/e\">section 1437c–1(e) of this title</ref> of notice under clause (i), the public housing agency has not been notified of the intention of any resident to participate on the board of directors.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida967043c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Exception for certain jurisdictions</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida967043d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A covered agency (as such term is defined in subparagraph (C) of this paragraph) shall not be required to include on the board of directors or a similar governing board of such agency a member described in paragraph (1).</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida967043e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Advisory board requirement</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each covered agency that administers Federal housing assistance under <ref href=\"/us/usc/t42/s1437f\">section 1437f of this title</ref> that chooses not to include a member described in paragraph (1) on the board of directors or a similar governing board of the agency shall establish an advisory board of not less than 6 residents of public housing or recipients of assistance under <ref href=\"/us/usc/t42/s1437f\">section 1437f of this title</ref> to provide advice and comment to the agency or other administering entity on issues related to public housing and <ref href=\"/us/usc/t42/s1437f\">section 1437f of this title</ref>. Such advisory board shall meet not less than quarterly.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida967043f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Covered agency or entity</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this paragraph, the term “covered agency” means a public housing agency or such other entity that administers Federal housing assistance for—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9672b50-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/3/C/I\"><num value=\"I\">(I)</num><content> <ref class=\"footnoteRef\" idref=\"fn003040\">1</ref><note type=\"footnote\" id=\"fn003040\"><num>1</num> So in original. Probably should be “(i)”.</note> the Housing Authority of the county of Los Angeles, California; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"ida9672b51-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/3/C/ii\"><num value=\"ii\">(ii)</num><content> any of the States of Alaska, Iowa, and Mississippi.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida9672b52-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1437/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Nondiscrimination</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No person shall be prohibited from serving on the board of directors or similar governing body of a public housing agency because of the residence of that person in a public housing project or status as assisted under <ref href=\"/us/usc/t42/s1437f\">section 1437f of this title</ref>.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ida9672b53-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1937-09-01/ch896\">Sept. 1, 1937, ch. 896</ref>, title I, § 2, as added <ref href=\"/us/pl/93/383/tII/s201/a\">Pub. L. 105–276, title V, § 503</ref>, <date date=\"1998-10-21\">Oct. 21, 1998</date>, <ref href=\"/us/stat/112/2521\">112 Stat. 2521</ref>, provided that:<quotedContent origin=\"/us/pl/105/276/tV/s503\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>The amendments under this title [see Tables for classification] are made on the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>], but this title shall take effect, and the amendments made by this title shall apply beginning upon, <date date=\"1999-10-01\">October 1, 1999</date>, except—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> as otherwise specifically provided in this title; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> as otherwise specifically provided in any amendment made by this title.</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I33\" class=\"indent0 firstIndent0\">The Secretary may, by notice, implement any provision of this title or any amendment made by this title before such date, except to the extent that such provision or amendment specifically provides otherwise.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Savings Provision</inline>.—</heading><content>Notwithstanding any amendment under this title that is made (in accordance with subsection (a)) on the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>] but applies beginning on <date date=\"1999-10-01\">October 1, 1999</date>, the provisions of law amended by such amendment, as such provisions were in effect immediately before the making of such amendment, shall continue to apply during the period beginning on the date of the enactment of this Act and ending upon <date date=\"1999-10-01\">October 1, 1999</date>, unless otherwise specifically provided by this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Technical Recommendations</inline>.—</heading><content>Not later than 9 months after the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>], the Secretary shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Banking and Financial Services [now Committee on Financial Services] of the House of Representatives, recommended technical and conforming legislative changes necessary to carry out this title and the amendments made by this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">List of Obsolete Documents</inline>.—</heading><content>Not later than <date date=\"1999-10-01\">October 1, 1999</date>, the Secretary of Housing and Urban Development shall cause to be published in the Federal Register a list of all rules, regulations, and orders (including all handbooks, notices, and related requirements) pertaining to public housing or section 8 [<ref href=\"/us/usc/t42/s1437f\">42 U.S.C. 1437f</ref>] tenant-based programs issued or promulgated under the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437\">42 U.S.C. 1437</ref> et seq.] before the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>] that are or will be obsolete because of the enactment of this Act or are otherwise obsolete.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Protection of Certain Regulations</inline>.—</heading><content>No provision of this title may be construed to repeal the regulations of the Secretary regarding tenant participation and tenant opportunities in public housing (24 C.F.R. 964).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"g\">“(g)[(f)]</num><heading> <inline class=\"small-caps\">Effective Date</inline>.—</heading><content>This section shall take effect on the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>].”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"effectiveDateOfAmendment\" id=\"ida9675268-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Effective Date of 1981 Amendment</heading><p style=\"-uslm-lc:I21\" class=\"indent0\">Amendment by <ref href=\"/us/pl/97/35\">Pub. and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><chapeau> the interests of low-income persons, and the public interest, will best be served by a reformed public housing program that—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> consolidates many public housing programs into programs for the operation and capital needs of public housing;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> streamlines program requirements;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> vests in public housing agencies that perform well the maximum feasible authority, discretion, and control with appropriate accountability to public housing residents, localities, and the general public; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> rewards employment and economic self-sufficiency of public housing residents.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Purposes</inline>.—</heading><chapeau>The purpose of this title [see Tables for classification] is to promote homes that are affordable to low-income families in safe and healthy environments, and thereby contribute to the supply of affordable housing, by—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> deregulating and decontrolling public housing agencies, thereby enabling them to perform as property and asset managers;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> providing for more flexible use of Federal assistance to public housing agencies, allowing the authorities to leverage and combine assistance amounts with amounts obtained from other sources;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> facilitating mixed income communities and decreasing concentrations of poverty in public housing;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> increasing accountability and rewarding effective management of public housing agencies;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> creating incentives and economic opportunities for residents of dwelling units assisted by public housing agencies to work, become self-sufficient, and transition out of public housing and federally assisted dwelling units;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> consolidating the voucher and certificate programs for rental assistance under section 8 of the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437f\">42 U.S.C. 1437f</ref>] into a single market-driven program that will assist in making tenant-based rental assistance under such section more successful at helping low-income families obtain affordable housing and will increase housing choice for low-income families; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> remedying the problems of troubled public housing agencies and replacing or revitalizing severely distressed public housing projects.”</content>\n</paragraph>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida967c6a7-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Mental Health Action Plan</heading><p><ref href=\"/us/pl/105/276/tV/s517\">Pub. L. 105–276, title V, § 517</ref>, <date date=\"1998-10-21\">Oct. 21, 1998</date>, <ref href=\"/us/stat/112/2550\">112 Stat. 2550</ref>, provided that: <quotedContent origin=\"/us/pl/105/276/tV/s517\">\n<inline>“The Secretary of Housing and Urban Development, in consultation with the Secretary of Health and Human Services, the Secretary of Labor, and appropriate State and local officials and representatives, shall—</inline>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> develop an action plan and list of recommendations for the improvement of means of providing severe mental illness treatment to families and individuals receiving housing assistance under the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437\">42 U.S.C. 1437</ref> et seq.], including public housing residents, residents of multifamily housing assisted with project-based assistance under section 8 of such Act [<ref href=\"/us/usc/t42/s1437f\">42 U.S.C. 1437f</ref>], and recipients of tenant-based assistance under such section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> develop and disseminate a list of current practices among public housing agencies and owners of assisted housing that serve to benefit persons in need of mental health care.”</content>\n</paragraph>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida967c6a8-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Annual Report</heading><p><ref href=\"/us/pl/105/276/tV/s581\">Pub. L. 105–276, title V, § 585</ref>, <date date=\"1998-10-21\">Oct. 21, 1998</date>, <ref href=\"/us/stat/112/2645\">112 Stat. 2645</ref>, provided that:<quotedContent origin=\"/us/pl/105/276/tV/s585\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Study</inline>.—</heading><content>The Comptroller General of the United States shall conduct a study that provides an objective and independent accounting and analysis of the full cost to the Federal Government, public housing agencies, State and local governments, and other entities, per assisted household, of the Federal assisted housing programs, taking into account the qualitative differences among Federal assisted housing programs in accordance with applicable standards of the Department of Housing and Urban Development.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Contents</inline>.—</heading><chapeau>The study under this section shall—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> analyze the full cost to the Federal Government, public housing agencies, State and local governments, and other parties, per assisted household, of the Federal assisted housing programs, in accordance with generally accepted accounting principles, and shall conduct the analysis on a nationwide and regional basis and in a manner such that accurate per unit cost comparisons may be made between Federal assisted housing programs, including grants, direct subsidies, tax concessions, Federal mortgage insurance liability, periodic renovation and rehabilitation, and modernization costs, demolition costs, and other ancillary costs such as security; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> measure and evaluate qualitative differences among Federal assisted housing programs in accordance with applicable standards of the Department of Housing and Urban Development.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Prohibition of Recommendations</inline>.—</heading><content>In conducting the study under this section and reporting under subsection (e), the Comptroller General may not make any recommendations regarding Federal housing policy.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"d\">“(d)</num><heading> <inline class=\"small-caps\">Federal Assisted Housing Programs</inline>.—</heading><chapeau>For purposes of this section, the term ‘Federal assisted housing programs’ means—</chapeau><paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> the public housing program under the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437\">42 U.S.C. 1437</ref> et seq.], except that the study under this section shall differentiate between and compare the development and construction of new public housing and the assistance of existing public housing structures;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> the certificate program for rental assistance under section 8(b)(1) of the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437f/b/1\">42 U.S.C. 1437f(b)(1)</ref>];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><content> the voucher program for rental assistance under section 8(<i>o</i>) of the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437f\">42 U.S.C. 1437f</ref>(<i>o</i>)];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> the programs for project-based assistance under section 8 of the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437f\">42 U.S.C. 1437f</ref>];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> the rental assistance payments program under section 521(a)(2)(A) of the Housing Act of 1949 [<ref href=\"/us/usc/t42/s1490a/a/2/A\">42 U.S.C. 1490a(a)(2)(A)</ref>];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> the program for housing for the elderly under section 202 of the Housing Act of 1959 [<ref href=\"/us/usc/t12/s1701q\">12 U.S.C. 1701q</ref>];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> the program for housing for persons with disabilities under section 811 of the Cranston-Gonzalez National Affordable Housing Act [<ref href=\"/us/usc/t42/s8013\">42 U.S.C. 8013</ref>];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> the program for financing housing by a loan or mortgage insured under section 221(d)(3) of the National Housing Act [<ref href=\"/us/usc/t12/s1715\">12 U.S.C. 1715</ref><i>l</i>(d)(3)] that bears interest at a rate determined under the proviso of section 221(d)(5) of such Act [<ref href=\"/us/usc/t12/s1715\">12 U.S.C. 1715</ref><i>l</i>(d)(5)];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><content> the program under section 236 of the National Housing Act [<ref href=\"/us/usc/t12/s1715z–1\">12 U.S.C. 1715z–1</ref>];</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"10\">“(10)</num><content> the program for construction or substantial rehabilitation under section 8(b)(2) of the United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437f/b/2\">42 U.S.C. 1437f(b)(2)</ref>], as in effect before <date date=\"1983-10-01\">October 1, 1983</date>; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"11\">“(11)</num><content> any other program for housing assistance administered by the Secretary of Housing and Urban Development or the Secretary of Agriculture, under which occupancy in the housing assisted or housing assistance provided is based on income, as the Comptroller General may determine.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"e\">“(e)</num><heading> <inline class=\"small-caps\">Report</inline>.—</heading><content>Not later than 12 months after the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>], the Comptroller General shall submit to the Congress a final report which shall contain the results of the study under this section, including the analysis and estimates required under subsection (b).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"f\">“(f)</num><heading> <inline class=\"small-caps\">Effective Date</inline>.—</heading><content>This section shall take effect on the date of the enactment of this Act [<date date=\"1998-10-21\">Oct. 21, 1998</date>].”</content>\n</subsection>\n</quotedContent>\n</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"miscellaneous\" id=\"ida96814cb-09a0-11eb-a85b-f5cef3d06f4d\"><heading class=\"centered smallCaps\">Limitation on Withholding or Conditioning of Assistance</heading><p style=\"-uslm-lc:I21\" class=\"indent0\">Assistance provided for in Housing and Community Development Act of 1974 [<ref href=\"/us/usc/t42/s5301\">42 U.S.C. 5301</ref> et seq.], National Housing Act [<ref href=\"/us/usc/t12/s1701\">12 U.S.C. 1701</ref> et seq.], United States Housing Act of 1937 [<ref href=\"/us/usc/t42/s1437\">42 U.S.C. 1437</ref> et seq.], Housing Act of 1949 [see Short Title note set out under <ref href=\"/us/usc/t42/s1441\">section 1441 of this title</ref>], Demonstration Cities and Metropolitan Development Act of 1966 [see Short Title note set out under <ref href=\"/us/usc/t42/s3331\">section 3331 of this title</ref>], and Housing and Urban Development Acts of 1965, 1968, 1969, and 1970 not to be withheld or made subject to conditions by reason of tax-exempt status of obligations issued or to be issued for financing of assistance, except as otherwise provided by law, see <ref href=\"/us/pl/93/383/s817\">section 817 of Pub.
