<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida9735fd8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e"><num value="1437e">§ 1437e.</num><heading> Designated housing for elderly and disabled families</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9735fd9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/a"><num value="a" class="bold">(a)</num><heading class="bold"> Authority to provide designated housing</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9735fda-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Subject only to provisions of this section and notwithstanding any other provision of law, a public housing agency for which a plan under subsection (d) is in effect may provide public housing projects (or portions of projects) designated for occupancy by (A) only elderly families, (B) only disabled families, or (C) elderly and disabled families.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9735fdb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Priority for occupancy</heading><content><p style="-uslm-lc:I12" class="indent1">In determining priority for admission to public housing projects (or portions of projects) that are designated for occupancy as provided in paragraph (1), the public housing agency may make units in such projects (or portions) available only to the types of families for whom the project is designated.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9735fdc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Eligibility of near-elderly families</heading><content><p style="-uslm-lc:I12" class="indent1">If a public housing agency determines that there are insufficient numbers of elderly families to fill all the units in a project (or portion of a project) designated under paragraph (1) for occupancy by only elderly families, the agency may provide that near-elderly families may occupy dwelling units in the project (or portion).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9735fdd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/b"><num value="b" class="bold">(b)</num><heading class="bold"> Standards regarding evictions</heading><content><p style="-uslm-lc:I11" class="indent0">Except as provided in section 1437n(e)(1)(B) <ref class="footnoteRef" idref="fn003060">1</ref><note type="footnote" id="fn003060"><num>1</num> See References in Text note below.</note> of this title, any tenant who is lawfully residing in a dwelling unit in a public housing project may not be evicted or otherwise required to vacate such unit because of the designation of the project (or portion of a project) pursuant to this section or because of any action taken by the Secretary or any public housing agency pursuant to this section.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9735fde-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/c"><num value="c" class="bold">(c)</num><heading class="bold"> Relocation assistance</heading><chapeau style="-uslm-lc:I11" class="indent0">A public housing agency that designates any existing project or building, or portion thereof, for occupancy as provided under subsection (a)(1) shall provide, to each person and family who agrees to be relocated in connection with such designation—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida9735fdf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/c/1"><num value="1">(1)</num><content> notice of the designation and an explanation of available relocation benefits, as soon as is practicable for the agency and the person or family;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9735fe0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/c/2"><num value="2">(2)</num><content> access to comparable housing (including appropriate services and design features), which may include tenant-based rental assistance under <ref href="/us/usc/t42/s1437f">section 1437f of this title</ref>, at a rental rate paid by the tenant that is comparable to that applicable to the unit from which the person or family has vacated; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida9735fe1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/c/3"><num value="3">(3)</num><content> payment of actual, reasonable moving expenses.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9735fe2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d"><num value="d" class="bold">(d)</num><heading class="bold"> Required plan</heading><chapeau style="-uslm-lc:I11" class="indent0">A plan under this subsection for designating a project (or portion of a project) for occupancy under subsection (a)(1) is a plan, prepared by the public housing agency for the project and submitted to the Secretary, that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida97386f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/1"><num value="1">(1)</num><chapeau> establishes that the designation of the project is necessary—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida97386f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/1/A"><num value="A">(A)</num><content> to achieve the housing goals for the jurisdiction under the comprehensive housing affordability strategy under <ref href="/us/usc/t42/s12705">section 12705 of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida97386f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/1/B"><num value="B">(B)</num><content> to meet the housing needs of the low-income population of the jurisdiction; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida97386f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/2"><num value="2">(2)</num><chapeau> includes a description of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida97386f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/2/A"><num value="A">(A)</num><content> the project (or portion of a project) to be designated;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida97386f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/2/B"><num value="B">(B)</num><content> the types of tenants for which the project is to be designated;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida97386f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/2/C"><num value="C">(C)</num><content> any supportive services to be provided to tenants of the designated project (or portion);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida97386fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/2/D"><num value="D">(D)</num><content> how the design and related facilities (as such term is defined in section 1701q(d)(8) <sup>1</sup> of title 12) of the project accommodate the special environmental needs of the intended occupants; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida97386fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/d/2/E"><num value="E">(E)</num><content> any plans to secure additional resources or housing assistance to provide assistance to families that may have been housed if occupancy in the project were not restricted pursuant to this section.</content>
</subparagraph>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">For purposes of this subsection, the term “supportive services” means services designed to meet the special needs of residents.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida97386fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/e"><num value="e" class="bold">(e)</num><heading class="bold"> Review of plans</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida97386fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Review and notification</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall conduct a limited review of each plan under subsection (d) that is submitted to the Secretary to ensure that the plan is complete and complies with the requirements of subsection (d). The Secretary shall notify each public housing agency submitting a plan whether the plan complies with such requirements not later than 60 days after receiving the plan. If the Secretary does not notify the public housing agency, as required under this paragraph or paragraph (2), the plan shall be considered, for purposes of this section, to comply with the requirements under subsection (d) and the Secretary shall be considered to have notified the agency of such compliance upon the expiration of such 60-day period.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida97386fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Notice of reasons for determination of noncompliance</heading><content><p style="-uslm-lc:I12" class="indent1">If the Secretary determines that a plan, as submitted, does not comply with the requirements under subsection (d), the Secretary shall specify in the notice under paragraph (1) the reasons for the noncompliance and any modifications necessary for the plan to meet such requirements.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida97386ff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Standards for determination of noncompliance</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may determine that a plan does not comply with the requirements under subsection (d) only if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9738700-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/e/3/A"><num value="A">(A)</num><content> the plan is incomplete in significant matters required under such subsection; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9738701-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/e/3/B"><num value="B">(B)</num><content> there is evidence available to the Secretary that challenges, in a substantial manner, any information provided in the plan.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9738702-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Treatment of existing plans</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of this section, a public housing agency shall be considered to have submitted a plan under this subsection if the agency has submitted to the Secretary an application and allocation plan under this section (as in effect before <date date="1996-03-28">March 28, 1996</date>) that have not been approved or disapproved before <date date="1996-03-28">March 28, 1996</date>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9738703-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/f"><num value="f" class="bold">(f)</num><heading class="bold"> Effectiveness</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9738704-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> 5-year effectiveness of original plan</heading><content><p style="-uslm-lc:I12" class="indent1">A plan under subsection (d) shall be in effect for purposes of this section during the 5-year period that begins upon notification under subsection (e)(1) of the public housing agency that the plan complies with the requirements under subsection (d).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9738705-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Renewal of plan</heading><content><p style="-uslm-lc:I12" class="indent1">Upon the expiration of the 5-year period under paragraph (1) or any 2-year period under this paragraph, an agency may extend the effectiveness of the designation and plan for an additional 2-year period (that begins upon such expiration) by submitting to the Secretary any information needed to update the plan. The Secretary may not limit the number of times a public housing agency extends the effectiveness of a designation and plan under this paragraph.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida973ae16-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Transition provision</heading><content><p style="-uslm-lc:I12" class="indent1">Any application and allocation plan approved under this section (as in effect before <date date="1996-03-28">March 28, 1996</date>) before <date date="1996-03-28">March 28, 1996</date>, shall be considered to be a plan under subsection (d) that is in effect for purposes of this section for the 5-year period beginning upon such approval.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida973ae17-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437e/g"><num value="g" class="bold">(g)</num><heading class="bold"> Inapplicability of Uniform Relocation Assistance and Real Property Acquisitions Policy Act of 1970</heading><content><p style="-uslm-lc:I11" class="indent0">No tenant of a public housing project shall be considered to be displaced for purposes of the Uniform Relocation Assistance and Real Property Acquisitions Policy Act of 1970 [<ref href="/us/usc/t42/s4601">42 U.S.C. 4601</ref> et seq.] because of the designation of any existing project or building, or portion thereof, for occupancy as provided under subsection (a) of this section.</p>
