<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida985fd49-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g"><num value="1437g">§ 1437g.</num><heading> Public housing Capital and Operating Funds</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida985fd4a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/a"><num value="a" class="bold">(a)</num><heading class="bold"> Merger into Capital Fund</heading><content><p style="-uslm-lc:I11" class="indent0">Except as otherwise provided in the Quality Housing and Work Responsibility Act of 1998, any assistance made available for public housing under section 1437<i>l</i> of this title before <date date="1999-10-01">October 1, 1999</date>, shall be merged into the Capital Fund established under subsection (d).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida985fd4b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/b"><num value="b" class="bold">(b)</num><heading class="bold"> Merger into Operating Fund</heading><content><p style="-uslm-lc:I11" class="indent0">Except as otherwise provided in the Quality Housing and Work Responsibility Act of 1998, any assistance made available for public housing under this section before <date date="1999-10-01">October 1, 1999</date>, shall be merged into the Operating Fund established under subsection (e).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida985fd4c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/c"><num value="c" class="bold">(c)</num><heading class="bold"> Allocation amount</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida985fd4d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">For fiscal year 2000 and each fiscal year thereafter, the Secretary shall allocate amounts in the Capital Fund and Operating Funds <ref class="footnoteRef" idref="fn003068">1</ref><note type="footnote" id="fn003068"><num>1</num> So in original. Probably should be “Fund”.</note> for assistance for public housing agencies eligible for such assistance. The Secretary shall determine the amount of the allocation for each eligible agency, which shall be, for any fiscal year beginning after the effective date of the formulas described in subsections (d)(2) and (e)(2)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida985fd4e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/c/1/A"><num value="A">(A)</num><content> for assistance from the Capital Fund, the amount determined for the agency under the formula under subsection (d)(2); and</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida985fd50-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Funding</heading><chapeau style="-uslm-lc:I12" class="indent1">There are authorized to be appropriated for assistance for public housing agencies under this section the following amounts:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida985fd51-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Capital Fund</heading><content><p style="-uslm-lc:I13" class="indent2">For allocations of assistance from the Capital Fund, $3,000,000,000 for fiscal year 1999, and such sums as may be necessary for fiscal years 2000, 2001, 2002, and 2003.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida985fd52-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Operating Fund</heading><content><p style="-uslm-lc:I13" class="indent2">For allocations of assistance from the Operating Fund, $2,900,000,000 for fiscal year 1999, and such sums as may be necessary for each of fiscal years 2000, 2001, 2002, and 2003.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida985fd53-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d"><num value="d" class="bold">(d)</num><heading class="bold"> Capital Fund</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida985fd54-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall establish a Capital Fund for the purpose of making assistance available to public housing agencies to carry out capital and management activities, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862465-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/A"><num value="A">(A)</num><content> the development, financing, and modernization of public housing projects, including the redesign, reconstruction, and reconfiguration of public housing sites and buildings (including accessibility improvements) and the development of mixed-finance projects;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862466-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/B"><num value="B">(B)</num><content> vacancy reduction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862467-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/C"><num value="C">(C)</num><content> addressing deferred maintenance needs and the replacement of obsolete utility systems and dwelling equipment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862468-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/D"><num value="D">(D)</num><content> planned code compliance;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862469-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/E"><num value="E">(E)</num><content> management improvements, including the establishment and initial operation of computer centers in and around public housing through a Neighborhood Networks initiative, for the purpose of enhancing the self-sufficiency, employability, and economic self-reliance of public housing residents by providing them with onsite computer access and training resources;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986246a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/F"><num value="F">(F)</num><content> demolition and replacement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986246b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/G"><num value="G">(G)</num><content> resident relocation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986246c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/H"><num value="H">(H)</num><content> capital expenditures to facilitate programs to improve the empowerment and economic self-sufficiency of public housing residents and to improve resident participation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986246d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/I"><num value="I">(I)</num><content> capital expenditures to improve the security and safety of residents;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986246e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/J"><num value="J">(J)</num><content> homeownership activities, including programs under <ref href="/us/usc/t42/s1437z–4">section 1437z–4 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986246f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/K"><num value="K">(K)</num><content> improvement of energy and water-use efficiency by installing fixtures and fittings that conform to the American Society of Mechanical Engineers/American National Standards Institute standards A112.19.2–1998 and A112.18.1–2000, or any revision thereto, applicable at the time of installation, and by increasing energy efficiency and water conservation by such other means as the Secretary determines are appropriate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862470-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/1/L"><num value="L">(L)</num><content> integrated utility management and capital planning to maximize energy conservation and efficiency measures.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9862471-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Formula</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall develop a formula for determining the amount of assistance provided to public housing agencies from the Capital Fund for a fiscal year, which shall include a mechanism to reward performance. The formula may take into account such factors as—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862472-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/2/A"><num value="A">(A)</num><content> the number of public housing dwelling units owned, assisted, or operated by the public housing agency, the characteristics and locations of the projects, and the characteristics of the families served and to be served (including the incomes of the families);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862473-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/2/B"><num value="B">(B)</num><content> the need of the public housing agency to carry out rehabilitation and modernization activities, replacement housing, and reconstruction, construction, and demolition activities related to public housing dwelling units owned, assisted, or operated by the public housing agency, including backlog and projected future needs of the agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862474-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/2/C"><num value="C">(C)</num><content> the cost of constructing and rehabilitating property in the area;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862475-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/2/D"><num value="D">(D)</num><content> the need of the public housing agency to carry out activities that provide a safe and secure environment in public housing units owned, assisted, or operated by the public housing agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862476-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/2/E"><num value="E">(E)</num><content> any record by the public housing agency of exemplary performance in the operation of public housing, as indicated by the system of performance indicators established pursuant to <ref href="/us/usc/t42/s1437d/j">section 1437d(j) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9862477-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/2/F"><num value="F">(F)</num><content> any other factors that the Secretary determines to be appropriate.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9862478-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Conditions on use for development and modernization</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9862479-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Development</heading><content><p style="-uslm-lc:I13" class="indent2">Except as otherwise provided in this chapter, any public housing developed using amounts provided under this subsection, or under section 1437<i>l</i> of this title as in effect before the effective date under section 503(a) of the Quality Housing and Work Responsibility Act of 1998, shall be operated under the terms and conditions applicable to public housing during the 40-year period that begins on the date on which the project (or stage of the project) becomes available for occupancy.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986247a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Modernization</heading><content><p style="-uslm-lc:I13" class="indent2">Except as otherwise provided in this chapter, any public housing or portion thereof that is modernized using amounts provided under this subsection or under section 1437<i>l</i> of this title (as in effect before the effective date under section 503(a) of the Quality Housing and Work Responsibility Act of 1998) shall be maintained and operated under the terms and conditions applicable to public housing during the 20-year period that begins on the latest date on which modernization is completed.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9864b8b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/d/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Applicability of latest expiration date</heading><content><p style="-uslm-lc:I13" class="indent2">Public housing subject to this paragraph or to any other provision of law mandating the operation of the housing as public housing or under the terms and conditions applicable to public housing for a specified length of time, shall be maintained and operated as required until the latest such expiration date.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9864b8c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e"><num value="e" class="bold">(e)</num><heading class="bold"> Operating Fund</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9864b8d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall establish an Operating Fund for the purpose of making assistance available to public housing agencies for the operation and management of public housing, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b8e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/A"><num value="A">(A)</num><content> procedures and systems to maintain and ensure the efficient management and operation of public housing units (including amounts sufficient to pay for the reasonable costs of review by an independent auditor of the documentation or other information maintained pursuant to <ref href="/us/usc/t42/s1437d/j/6">section 1437d(j)(6) of this title</ref> by a public housing agency or resident management corporation to substantiate the performance of that agency or corporation);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b8f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/B"><num value="B">(B)</num><content> activities to ensure a program of routine preventative maintenance;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b90-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/C"><num value="C">(C)</num><content> anticrime and antidrug activities, including the costs of providing adequate security for public housing residents, including above-baseline police service agreements;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b91-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/D"><num value="D">(D)</num><content> activities related to the provision of services, including service coordinators for elderly persons or persons with disabilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b92-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/E"><num value="E">(E)</num><content> activities to provide for management and participation in the management and policymaking of public housing by public housing residents;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b93-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/F"><num value="F">(F)</num><content> the costs of insurance;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b94-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/G"><num value="G">(G)</num><content> the energy costs associated with public housing units, with an emphasis on energy conservation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b95-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/H"><num value="H">(H)</num><content> the costs of administering a public housing work program under <ref href="/us/usc/t42/s1437j">section 1437j of this title</ref>, including the costs of any related insurance needs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b96-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/I"><num value="I">(I)</num><content> the costs of repaying, together with rent contributions, debt incurred to finance the rehabilitation and development of public housing units, which shall be subject to such reasonable requirements as the Secretary may establish;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b97-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/J"><num value="J">(J)</num><content> the costs associated with the operation and management of mixed finance projects, to the extent appropriate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9864b98-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/1/K"><num value="K">(K)</num><content> the costs of operating computer centers in public housing through a Neighborhood Networks initiative described in subsection (d)(1)(E), and of activities related to that initiative.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9864b99-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Formula</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9864b9a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Secretary shall establish a formula for determining the amount of assistance provided to public housing agencies from the Operating Fund for a fiscal year. The formula may take into account—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9864b9b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A/i"><num value="i">(i)</num><content> standards for the costs of operating and reasonable projections of income, taking into account the characteristics and locations of the public housing projects and characteristics of the families served and to be served (including the incomes of the families), or the costs of providing comparable services as determined in accordance with criteria or a formula representing the operations of a prototype well-managed public housing project;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9864b9c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A/ii"><num value="ii">(ii)</num><content> the number of public housing dwelling units owned, assisted, or operated by the public housing agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9864b9d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A/iii"><num value="iii">(iii)</num><content> the number of public housing dwelling units owned, assisted, or operated by the public housing agency that are chronically vacant and the amount of assistance appropriate for those units;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9864b9e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A/iv"><num value="iv">(iv)</num><content> to the extent quantifiable, the extent to which the public housing agency provides programs and activities designed to promote the economic self-sufficiency and management skills of public housing residents;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9864b9f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A/v"><num value="v">(v)</num><content> the need of the public housing agency to carry out anti-crime and anti-drug activities, including providing adequate security for public housing residents;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9864ba0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A/vi"><num value="vi">(vi)</num><content> the amount of public housing rental income foregone by the public housing agency as a result of escrow savings accounts under <ref href="/us/usc/t42/s1437u/d/2">section 1437u(d)(2) of this title</ref> for families participating in a family self-sufficiency program of the agency under such <ref href="/us/usc/t42/s1437u">section 1437u of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida98672b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/A/vii"><num value="vii">(vii)</num><content> any other factors that the Secretary determines to be appropriate.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98672b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Incentive to increase certain rental income</heading><content><p style="-uslm-lc:I13" class="indent2">The formula shall provide an incentive to encourage public housing agencies to facilitate increases in earned income by families in occupancy. Any such incentive shall provide that the agency shall benefit from increases in such rental income and that such amounts accruing to the agency pursuant to such benefit may be used only for low-income housing or to benefit the residents of the public housing agency.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98672b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Treatment of savings</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The treatment of utility and waste management costs under the formula shall provide that a public housing agency shall receive the full financial benefit from any reduction in the cost of utilities or waste management resulting from any contract with a third party to undertake energy conservation improvements in one or more of its public housing projects.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Third party contracts</heading><content><p style="-uslm-lc:I14" class="indent3">Contracts described in clause (i) may include contracts for equipment conversions to less costly utility sources, projects with resident-paid utilities, and adjustments to frozen base year consumption, including systems repaired to meet applicable building and safety codes and adjustments for occupancy rates increased by rehabilitation.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/C/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Term of contract</heading><content><p style="-uslm-lc:I14" class="indent3">The total term of a contract described in clause (i) shall not exceed 20 years to allow longer payback periods for retrofits, including windows, heating system replacements, wall insulation, site-based generation, advanced energy savings technologies, including renewable energy generation, and other such retrofits.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/C/iv"><num value="iv" class="bold">(iv)</num><heading class="bold"> Existing contracts</heading><content><p style="-uslm-lc:I14" class="indent3">The term of a contract described in clause (i) that, as of <date date="2007-12-26">December 26, 2007</date>, is in repayment and has a term of not more than 12 years, may be extended to a term of not more than 20 years to permit additional energy conservation improvements without requiring the reprocurement of energy performance contractors.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98672b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Freeze of consumption levels</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">A small public housing agency, as defined in <ref href="/us/usc/t42/s1437z–10/a">section 1437z–10(a) of this title</ref>, may elect to be paid for its utility and waste management costs under the formula for a period, at the discretion of the small public housing agency, of not more than 20 years based on the small public housing agency’s average annual consumption during the 3-year period preceding the year in which the election is made (in this subparagraph referred to as the “consumption base level”).</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Initial adjustment in consumption base level</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall make an initial one-time adjustment in the consumption base level to account for differences in the heating degree day average over the most recent 20-year period compared to the average in the consumption base level.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Adjustments in consumption base level</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall make adjustments in the consumption base level to account for an increase or reduction in units, a change in fuel source, a change in resident controlled electricity consumption, or for other reasons.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/iv"><num value="iv" class="bold">(iv)</num><heading class="bold"> Savings</heading><chapeau style="-uslm-lc:I14" class="indent3">All cost savings resulting from an election made by a small public housing agency under this subparagraph—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida98672bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/iv/I"><num value="I">(I)</num><content> shall accrue to the small public housing agency; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida98672be-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/iv/II"><num value="II">(II)</num><content> may be used for any public housing purpose at the discretion of the small public housing agency.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="ida98672bf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/v"><num value="v" class="bold">(v)</num><heading class="bold"> Third parties</heading><chapeau style="-uslm-lc:I14" class="indent3">A small public housing agency making an election under this subparagraph—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="ida98672c0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/v/I"><num value="I">(I)</num><content> may use, but shall not be required to use, the services of a third party in its energy conservation program; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="ida98672c1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/2/D/v/II"><num value="II">(II)</num><content> shall have the sole discretion to determine the source, and terms and conditions, of any financing used for its energy conservation program.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida98672c2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Condition on use</heading><content><p style="-uslm-lc:I12" class="indent1">No portion of any public housing project operated using amounts provided under this subsection, or under this section as in effect before the effective date under section 503(a) of the Quality Housing and Work Responsibility Act of 1998, may be disposed of before the expiration of the 10-year period beginning upon the conclusion of the fiscal year for which such amounts were provided, except as otherwise provided in this chapter.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida98699d3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/f"><num value="f" class="bold">(f)</num><heading class="bold"> Negotiated rulemaking procedure</heading><content><p style="-uslm-lc:I11" class="indent0">The formulas under subsections (d)(2) and (e)(2) shall be developed according to procedures for issuance of regulations under the negotiated rulemaking procedure under subchapter III of chapter 5 of title 5.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida98699d4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g"><num value="g" class="bold">(g)</num><heading class="bold"> Limitations on use of funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida98699d5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> Flexibility in use of funds</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98699d6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Flexibility for Capital Fund amounts</heading><content><p style="-uslm-lc:I13" class="indent2">Of any amounts appropriated for fiscal year 2000 or any fiscal year thereafter that are allocated for fiscal year 2000 or any fiscal year thereafter from the Capital Fund for any public housing agency, the agency may use not more than 20 percent for activities that are eligible under subsection (e) for assistance with amounts from the Operating Fund, but only if the public housing agency plan for the agency provides for such use.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98699d7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Flexibility for Operating Fund amounts</heading><content><p style="-uslm-lc:I13" class="indent2">Of any amounts appropriated for fiscal year 2016 or any fiscal year thereafter that are allocated for fiscal year 2016 or any fiscal year thereafter from the Operating Fund for any public housing agency, the agency may use not more than 20 percent for activities that are eligible under subsection (d) for assistance with amounts from the Capital Fund, but only if the public housing plan under <ref href="/us/usc/t42/s1437c–1">section 1437c–1 of this title</ref> for the agency provides for such use.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida98699d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Full flexibility for small PHAs</heading><content><p style="-uslm-lc:I12" class="indent1">Of any amounts allocated for any fiscal year for any public housing agency that owns or operates less than 250 public housing dwelling units, is not designated pursuant to <ref href="/us/usc/t42/s1437d/j/2">section 1437d(j)(2) of this title</ref> as a troubled public housing agency, and (in the determination of the Secretary) is operating and maintaining its public housing in a safe, clean, and healthy condition, the agency may use any such amounts for any eligible activities under subsections (d)(1) and (e)(1), regardless of the fund from which the amounts were allocated and provided. This subsection shall take effect on <date date="1998-10-21">October 21, 1998</date>.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida98699d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitation on new construction</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98699da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraphs (B) and (C), a public housing agency may not use any of the amounts allocated for the agency from the Capital Fund or Operating Fund for the purpose of constructing any public housing unit, if such construction would result in a net increase from the number of public housing units owned, assisted, or operated by the public housing agency on <date date="1999-10-01">October 1, 1999</date>, including any public housing units demolished as part of any revitalization effort.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98699db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exception regarding use of assistance</heading><content><p style="-uslm-lc:I13" class="indent2">A public housing agency may use amounts allocated for the agency from the Capital Fund or Operating Fund for the construction and operation of housing units that are available and affordable to low-income families in excess of the limitations on new construction set forth in subparagraph (A), but the formulas established under subsections (d)(2) and (e)(2) shall not provide additional funding for the specific purpose of allowing construction and operation of housing in excess of those limitations (except to the extent provided in subparagraph (C)).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida98699dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Exception regarding formulas</heading><chapeau style="-uslm-lc:I13" class="indent2">Subject to reasonable limitations set by the Secretary, the formulas established under subsections (d)(2) and (e)(2) may provide additional funding for the operation and modernization costs (but not the initial development costs) of housing in excess of amounts otherwise permitted under this paragraph, and such amounts may be so used, if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida98699dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/3/C/i"><num value="i">(i)</num><content> such units are part of a mixed-finance project or otherwise leverage significant additional private or public investment; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida98699de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/g/3/C/ii"><num value="ii">(ii)</num><content> the estimated cost of the useful life of the project is less than the estimated cost of providing tenant-based assistance under section 1437f(<i>o</i>) of this title for the same period of time.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida986c0ef-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h"><num value="h" class="bold">(h)</num><heading class="bold"> Technical assistance</heading><chapeau style="-uslm-lc:I11" class="indent0">To the extent amounts are provided in advance in appropriations Acts, the Secretary may make grants or enter into contracts or cooperative agreements in accordance with this subsection for purposes of providing, either directly or indirectly—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/1"><num value="1">(1)</num><content> technical assistance to public housing agencies, resident councils, resident organizations, and resident management corporations, including assistance relating to monitoring and inspections;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/2"><num value="2">(2)</num><content> training for public housing agency employees and residents;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/3"><num value="3">(3)</num><content> data collection and analysis;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/4"><num value="4">(4)</num><chapeau> training, technical assistance, and education to public housing agencies that are—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida986c0f4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/4/A"><num value="A">(A)</num><content> at risk of being designated as troubled under <ref href="/us/usc/t42/s1437d/j">section 1437d(j) of this title</ref>, to assist such agencies from being so designated; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986c0f5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/4/B"><num value="B">(B)</num><content> designated as troubled under <ref href="/us/usc/t42/s1437d/j">section 1437d(j) of this title</ref>, to assist such agencies in achieving the removal of that designation;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/5"><num value="5">(5)</num><content> contract expertise;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/6"><num value="6">(6)</num><content> training and technical assistance to assist in the oversight and management of public housing or tenant-based assistance;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/7"><num value="7">(7)</num><content> clearinghouse services in furtherance of the goals and activities of this subsection; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="ida986c0f9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/h/8"><num value="8">(8)</num><content> assistance in connection with the establishment and operation of computer centers in public housing through a Neighborhood Networks initiative described in subsection (d)(1)(E).</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">As used in this subsection, the terms “training” and “technical assistance” shall include training or technical assistance and the cost of necessary travel for participants in such training or technical assistance, by or to officials and employees of the Department and of public housing agencies, and to residents and to other eligible grantees.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida986c0fa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/i"><num value="i" class="bold">(i)</num><heading class="bold"> Eligibility of units acquired from proceeds of sales under demolition or disposition plan</heading><content><p style="-uslm-lc:I11" class="indent0">If a public housing agency uses proceeds from the sale of units under a homeownership program in accordance with <ref href="/us/usc/t42/s1437z–4">section 1437z–4 of this title</ref> to acquire additional units to be sold to low-income families, the additional units shall be counted as public housing for purposes of determining the amount of the allocation to the agency under this section until sale by the agency, but in no case longer than 5 years.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida986c0fb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j"><num value="j" class="bold">(j)</num><heading class="bold"> Penalty for slow expenditure of capital funds</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986c0fc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/1"><num value="1" class="bold">(1)</num><heading class="bold"> Obligation of amounts</heading><chapeau style="-uslm-lc:I12" class="indent1">Except as provided in paragraph (4) and subject to paragraph (2), a public housing agency shall obligate any assistance received under this section not later than 24 months after, as applicable—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida986c0fd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/1/A"><num value="A">(A)</num><content> the date on which the funds become available to the agency for obligation in the case of modernization; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986c0fe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/1/B"><num value="B">(B)</num><content> the date on which the agency accumulates adequate funds to undertake modernization, substantial rehabilitation, or new construction of units.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986c0ff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2"><num value="2" class="bold">(2)</num><heading class="bold"> Extension of time period for obligation</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida986c100-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/A"><num value="A">(A)</num><chapeau> may, extend the time period under paragraph (1) for a public housing agency, for such period as the Secretary determines to be necessary, if the Secretary determines that the failure of the agency to obligate assistance in a timely manner is attributable to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida986c101-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/A/i"><num value="i">(i)</num><content> litigation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986c102-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/A/ii"><num value="ii">(ii)</num><content> obtaining approvals of the Federal Government or a State or local government;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986c103-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/A/iii"><num value="iii">(iii)</num><content> complying with environmental assessment and abatement requirements;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986c104-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/A/iv"><num value="iv">(iv)</num><content> relocating residents;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986c105-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/A/v"><num value="v">(v)</num><content> an event beyond the control of the public housing agency; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986c106-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/A/vi"><num value="vi">(vi)</num><content> any other reason established by the Secretary by notice published in the Federal Register;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986c107-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/B"><num value="B">(B)</num><content> shall disregard the requirements of paragraph (1) with respect to any unobligated amounts made available to a public housing agency, to the extent that the total of such amounts does not exceed 10 percent of the original amount made available to the public housing agency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida986e818-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/C"><num value="C">(C)</num><chapeau> may, with the prior approval of the Secretary, extend the time period under paragraph (1), for an additional period not to exceed 12 months, based on—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida986e819-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/C/i"><num value="i">(i)</num><content> the size of the public housing agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986e81a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/C/ii"><num value="ii">(ii)</num><content> the complexity of capital program of the public housing agency;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986e81b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/C/iii"><num value="iii">(iii)</num><content> any limitation on the ability of the public housing agency to obligate the amounts allocated for the agency from the Capital Fund in a timely manner as a result of State or local law; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida986e81c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/2/C/iv"><num value="iv">(iv)</num><content> such other factors as the Secretary determines to be relevant.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986e81d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/3"><num value="3" class="bold">(3)</num><heading class="bold"> Effect of failure to comply</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986e81e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Prohibition of new assistance</heading><content><p style="-uslm-lc:I13" class="indent2">A public housing agency shall not be awarded assistance under this section for any month during any fiscal year in which the public housing agency has funds unobligated in violation of paragraph (1) or (2).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986e81f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Withholding of assistance</heading><content><p style="-uslm-lc:I13" class="indent2">During any fiscal year described in subparagraph (A), the Secretary shall withhold all assistance that would otherwise be provided to the public housing agency. If the public housing agency cures its failure to comply during the year, it shall be provided with the share attributable to the months remaining in the year.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986e820-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Redistribution</heading><content><p style="-uslm-lc:I13" class="indent2">The total amount of any funds not provided public housing agencies by operation of this paragraph shall be allocated for agencies determined under <ref href="/us/usc/t42/s1437d/j">section 1437d(j) of this title</ref> to be high-performing.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986e821-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/4"><num value="4" class="bold">(4)</num><heading class="bold"> Exception to obligation requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986e822-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to subparagraph (B), if the Secretary has consented, before the effective date under section 503(a) of the Quality Housing and Work Responsibility Act of 1998, to an obligation period for any agency longer than provided under paragraph (1), a public housing agency that obligates its funds before the expiration of that period shall not be considered to be in violation of paragraph (1).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986e823-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Prior fiscal years</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding subparagraph (A), any funds appropriated to a public housing agency for fiscal year 1997 or prior fiscal years shall be fully obligated by the public housing agency not later than <date date="1999-09-30">September 30, 1999</date>.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986e824-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/5"><num value="5" class="bold">(5)</num><heading class="bold"> Expenditure of amounts</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986e825-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">A public housing agency shall spend any assistance received under this section not later than 4 years (plus the period of any extension approved by the Secretary under paragraph (2)) after the date on which funds become available to the agency for obligation.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida986e826-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Enforcement</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall enforce the requirement of subparagraph (A) through default remedies up to and including withdrawal of the funding.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986e827-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/6"><num value="6" class="bold">(6)</num><heading class="bold"> Right of recapture</heading><content><p style="-uslm-lc:I12" class="indent1">Any obligation entered into by a public housing agency shall be subject to the right of the Secretary to recapture the obligated amounts for violation by the public housing agency of the requirements of this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986e828-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/j/7"><num value="7" class="bold">(7)</num><heading class="bold"> Treatment of replacement reserve</heading><content><p style="-uslm-lc:I12" class="indent1">The requirements of this subsection shall not apply to funds held in replacement reserves established pursuant to subsection (n).</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida986e829-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/k"><num value="k" class="bold">(k)</num><heading class="bold"> Treatment of nonrental income</heading><content><p style="-uslm-lc:I11" class="indent0">A public housing agency that receives income from nonrental sources (as determined by the Secretary) may retain and use such amounts without any decrease in the amounts received under this section from the Capital or Operating Fund. Any such nonrental amounts retained shall be used only for low-income housing or to benefit the residents assisted by the public housing agency.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida986e82a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/l"><num value="l" class="bold">(l)</num><heading class="bold"> Provision of only capital or operating assistance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986e82b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/l/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authority</heading><content><p style="-uslm-lc:I12" class="indent1">In appropriate circumstances, as determined by the Secretary, a public housing agency may commit capital assistance only, or operating assistance only, for public housing units, which assistance shall be subject to all of the requirements applicable to public housing except as otherwise provided in this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida986e82c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/l/2"><num value="2" class="bold">(2)</num><heading class="bold"> Exemptions</heading><content><p style="-uslm-lc:I12" class="indent1">In the case of any public housing unit assisted pursuant to the authority under paragraph (1), the Secretary may, by regulation, reduce the period under subsection (d)(3) or (e)(3), as applicable, during which such units must be operated under requirements applicable to public housing. In cases in which there is commitment of operating assistance but no commitment of capital assistance, the Secretary may make section 8 [<ref href="/us/usc/t42/s1437f">42 U.S.C. 1437f</ref>] requirements applicable, as appropriate, by regulation.</p>
</content>
</paragraph>

The Secretary shall consult with the Administrator of the Environmental Protection Agency and the Secretary of Health and Human Services to identify and consider sources of funding for the reduction of the incidence of asthma among recipients of assistance under this subchapter.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9870f40-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/m/3"><num value="3" class="bold">(3)</num><heading class="bold"> Services for elderly residents</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of this section, the New York City Housing Authority may, in its sole discretion, from amounts provided from the Operating and Capital Funds, or from amounts provided for public housing before the amounts are made available from such Funds, use not more than $600,000 per year for the purpose of developing a comprehensive plan to address the need for services for elderly residents. Such plan may be developed by a partnership created by such Housing Authority and may include the creation of a model project for assisted living at one or more developments. The model project may provide for contracting with private parties for the delivery of services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9870f41-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/m/4"><num value="4" class="bold">(4)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I12" class="indent1">This subsection shall apply to fiscal year 1999 and each fiscal year thereafter.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9870f42-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n"><num value="n" class="bold">(n)</num><heading class="bold"> Establishment of replacement reserves</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9870f43-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Public housing agencies shall be permitted to establish a replacement reserve to fund any of the capital activities listed in subsection (d)(1).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9870f44-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/2"><num value="2" class="bold">(2)</num><heading class="bold"> Source and amount of funds for replacement reserve</heading><chapeau style="-uslm-lc:I12" class="indent1">At any time, a public housing agency may deposit funds from such agency’s Capital Fund into a replacement reserve, subject to the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9870f45-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/2/A"><num value="A">(A)</num><content> At the discretion of the Secretary, public housing agencies may transfer and hold in a replacement reserve funds originating from additional sources.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9870f46-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/2/B"><num value="B">(B)</num><content> No minimum transfer of funds to a replacement reserve shall be required.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9870f47-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/2/C"><num value="C">(C)</num><content> At any time, a public housing agency may not hold in a replacement reserve more than the amount the public housing authority has determined necessary to satisfy the anticipated capital needs of properties in its portfolio assisted under this section, as outlined in its Capital Fund 5-Year Action Plan, or a comparable plan, as determined by the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9870f48-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/2/D"><num value="D">(D)</num><content> The Secretary may establish, by regulation, a maximum replacement reserve level or levels that are below amounts determined under subparagraph (C), which may be based upon the size of the portfolio assisted under this section or other factors.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9870f49-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/3"><num value="3" class="bold">(3)</num><heading class="bold"> Transfer of operating funds</heading><content><p style="-uslm-lc:I12" class="indent1">In first establishing a replacement reserve, the Secretary may allow public housing agencies to transfer more than 20 percent of its operating funds into its replacement reserve.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9870f4a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/4"><num value="4" class="bold">(4)</num><heading class="bold"> Expenditure</heading><content><p style="-uslm-lc:I12" class="indent1">Funds in a replacement reserve may be used for purposes authorized by subsection (d)(1) and contained in its Capital Fund 5-Year Action Plan.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9870f4b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/n/5"><num value="5" class="bold">(5)</num><heading class="bold"> Management and report</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish appropriate accounting and reporting requirements to ensure that public housing agencies are spending funds on eligible projects and that funds in the replacement reserve are connected to capital needs.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida987365c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1437g/o"><num value="o" class="bold">(o)</num><heading class="bold"> Public housing heating guidelines</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall publish model guidelines for minimum heating requirements for public housing dwelling units operated by public housing agencies receiving assistance under this section.</p>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Qualifications</inline>.—</heading><chapeau>Before the implementation of formulas pursuant to sections 9(d)(2) and 9(e)(2) of the United States Housing Act of 1937 [<ref href="/us/usc/t42/s1437g/d/2">42 U.S.C. 1437g(d)(2)</ref>, (e)(2)] (as amended by subsection (a) of this section)—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> if a public housing agency establishes a rental amount that is based on a ceiling rent established pursuant to subsection (d)(1) of this section [<ref href="/us/usc/t42/s1437a">42 U.S.C. 1437a</ref> note], the Secretary shall take into account any reduction of the per unit dwelling rental income of the public housing agency resulting from the use of that rental amount in calculating the contributions for the public housing agency for the operation of the public housing under section 9 of the United States Housing Act of 1937 [<ref href="/us/usc/t42/s1437g">42 U.S.C. 1437g</ref>];</content>

<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> if a public housing agency establishes a rental amount that is based on an adjustment to income under section 3(b)(5)(G) of the United States Housing Act of 1937 [<ref href="/us/usc/t42/s1437a/b/5/G">42 U.S.C. 1437a(b)(5)(G)</ref>] (as in effect immediately before the enactment of this Act [<date date="1998-10-21">Oct. 21, 1998</date>]), the Secretary shall not take into account any reduction of or any increase in the per unit dwelling rental income of the public housing agency resulting from the use of that rental amount in calculating the contributions for the public housing agency for the operation of the public housing under section 9 of the United States Housing Act of 1937 [<ref href="/us/usc/t42/s1437g">42 U.S.C. 1437g</ref>]; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> if a public housing agency establishes a rental amount other than as provided under subparagraph (A) or (B) that is less than the greatest of the amounts determined under subparagraphs (A), (B), and (C) of section 3(a)(1) of the United States Housing Act of 1937 [<ref href="/us/usc/t42/s1437a/a/1/A">42 U.S.C. 1437a(a)(1)(A)</ref>, (B), (C)], the Secretary shall not take into account any reduction of the per unit dwelling rental income of the public housing agency resulting from the use of that rental amount in calculating the contributions for the public housing agency for the operation of the public housing under section 9 of the United States Housing Act of 1937 [<ref href="/us/usc/t42/s1437g">42 U.S.C. 1437g</ref>].</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Effective Date of Operating Formula</inline>.—</heading><content>Notwithstanding the effective date under section 503(a) [<ref href="/us/usc/t42/s1437">42 U.S.C. 1437</ref> note], the Secretary may extend the effective date of the formula under section 9(e)(2) of the United States Housing Act of 1937 [<ref href="/us/usc/t42/s1437g/e/2">42 U.S.C. 1437g(e)(2)</ref>] (as amended by subsection (a) of this section) for up to 6 months if such additional time is necessary to implement such formula.</content>
</subsection>
