<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad6533dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14502"><num value="14502">§ 14502.</num><heading> Preemption and election of State nonapplicability</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6533dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14502/a"><num value="a" class="bold">(a)</num><heading class="bold"> Preemption</heading><content><p style="-uslm-lc:I11" class="indent0">This chapter preempts the laws of any State to the extent that such laws are inconsistent with this chapter, except that this chapter shall not preempt any State law that provides additional protection from liability relating to volunteers or to any category of volunteers in the performance of services for a nonprofit organization or governmental entity.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6533de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14502/b"><num value="b" class="bold">(b)</num><heading class="bold"> Election of State regarding nonapplicability</heading><chapeau style="-uslm-lc:I11" class="indent0">This chapter shall not apply to any civil action in a State court against a volunteer in which all parties are citizens of the State if such State enacts a statute in accordance with State requirements for enacting legislation—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad6533df-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14502/b/1"><num value="1">(1)</num><content> citing the authority of this subsection;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad6533e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14502/b/2"><num value="2">(2)</num><content> declaring the election of such State that this chapter shall not apply, as of a date certain, to such civil action in the State; and</content>
