The Secretary shall approve a residential building as meeting such standards if the building is constructed in accordance with (1) the minimum standards prescribed by the Secretary, (2) the minimum property standards prescribed by the Secretary of Housing and Urban Development for mortgages insured under title II of the National Housing Act [<ref href=\"/us/usc/t12/s1707\">12 U.S.C. 1707</ref> et seq.], (3) the standards contained in any of the voluntary national model building codes, or (4) in the case of manufactured housing, the standards referred to in <ref href=\"/us/usc/t42/s1472/e\">section 1472(e) of this title</ref>. To the maximum extent feasible, the Secretary shall promote the use of energy saving techniques through standards established by such Secretary for newly constructed residential housing assisted under this subchapter. Such standards shall, insofar as is practicable, be consistent with the standards established pursuant to section 526 of the National Housing Act [<ref href=\"/us/usc/t12/s1735f–4\">12 U.S.C. 1735f–4</ref>] and shall incorporate the energy performance requirements developed pursuant to such section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida99f9fd4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Terms or conditions of leases or occupancy agreements subject to change with approval of Secretary</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary may require any recipient of a loan or grant to agree that the availability of improvements constructed or repaired with the proceeds of the loan or grant under this subchapter shall not be a justification for directly or indirectly changing the terms or conditions of the lease or occupancy agreement with the occupants of such farms to the latter’s disadvantage without the approval of the Secretary.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida99f9fd5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Rural Housing Insurance Fund for payment of expenditures respecting construction defects; judicial review prohibition</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary is authorized, after <date date=\"1977-10-01\">October 1, 1977</date>, with respect to any unit or dwelling newly constructed during the period beginning eighteen months prior to <date date=\"1977-10-12\">October 12, 1977</date>, and purchased with financial assistance authorized by this subchapter which he finds to have structural defects to make expenditures for (1) correcting such defects, (2) paying the claims of the owner of the property arising from such defects, or (3) acquiring title to the property, if such assistance is requested by the owner of the property within thirty-six months after financial assistance under this subchapter is rendered to the owner of the property or, in the case of property with respect to which assistance was made available within eighteen months prior to <date date=\"1977-10-12\">October 12, 1977</date>, within thirty-six months after <date date=\"1977-10-12\">October 12, 1977</date>. Expenditures pursuant to this subsection may be paid from the Rural Housing Insurance Fund. Decisions by the Secretary regarding such expenditures or payments under this subsection, and the terms and conditions under which the same are approved or disapproved, shall not be subject to judicial review.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida99f9fd6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Defaults involving security interest in tribal lands</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In the event of default involving a security interest in tribal allotted or trust land, the Secretary shall only pursue liquidation after offering to transfer the account to an eligible tribal member, the tribe, or the Indian housing authority serving the tribe or tribes. If the Secretary subsequently proceeds to liquidate the account, the Secretary shall not sell, transfer, or otherwise dispose of or alienate the property except to one of the entities described in the preceding sentence.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida99f9fd7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Terms and conditions; regulations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Secretary shall, by regulation, prescribe the terms and conditions under which expenditures and payments may be made under the provisions of this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"ida99f9fd8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Housing in underserved areas</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99f9fd9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Designation of underserved area</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall designate as targeted underserved areas 100 counties and communities in each fiscal year that have severe, unmet housing needs as determined by the Secretary. A county or community shall be eligible for designation if, during the 5-year period preceding the year in which the designation is made, it has received an average annual amount of assistance under this subchapter that is substantially lower than the average annual amount of such assistance received during that 5-year period by other counties and communities in the State that are eligible for such assistance calculated on a per capita basis, and has—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fc6ea-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/1/A\"><num value=\"A\">(A)</num><content> 20 percent or more of its population at or below the poverty level; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fc6eb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/1/B\"><num value=\"B\">(B)</num><content> 10 percent or more of its population residing in substandard housing.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">As used in this paragraph, the term “poverty level” has the meaning given the term in <ref href=\"/us/usc/t42/s5302/a/9\">section 5302(a)(9) of this title</ref>.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99fc6ec-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Preferences</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In selecting projects to receive assistance with amounts set aside under paragraph (4), the Secretary shall give preference to any project located in a county or community that has, at the time of designation and as determined by the Secretary—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fc6ed-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/2/A\"><num value=\"A\">(A)</num><content> 28 percent or more of its population at or below poverty level; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fc6ee-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/2/B\"><num value=\"B\">(B)</num><content> 13 percent or more of its population residing in substandard housing.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">In designating underserved areas under paragraph (1), in each fiscal year the Secretary shall designate not less than 5 counties or communities that contain tribal allotted or Indian trust land.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99fc6ef-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Outreach program and review</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fc6f0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Outreach</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall publicize the availability to targeted underserved areas of grants and loans under this subchapter and promote, to the maximum extent feasible, efforts to apply for those grants and loans for housing in targeted underserved areas.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fc6f1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Review</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Upon the receipt of data from the 1990 decennial census, the Secretary shall conduct a review of any designations made under paragraph (1) and preferences given under paragraph (2) and the eligibility of communities and counties for such designation and preference, examining the effects of such data on such eligibility. The Secretary shall submit to the Congress, not later than 9 months after the availability of the data, a report regarding the review, which shall include any recommendations of the Secretary for modifications in the standards for designation and preference.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99fc6f2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Set-aside for targeted underserved areas and colonias</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fc6f3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall set aside and reserve for assistance in targeted underserved areas an amount equal to 5.0 percent in each fiscal year of the aggregate amount of lending authority under sections 1472, 1474, 1484, 1485, and 1490d of this title. During each fiscal year, the Secretary shall set aside from amounts available for assistance under paragraphs (2) and (5) of <ref href=\"/us/usc/t42/s1490a/a\">section 1490a(a) of this title</ref>, an amount that is appropriate to provide assistance with respect to the lending authority under sections 1484 and 1485 of this title that is set aside for such fiscal year. The Secretary shall establish a procedure to reallocate any assistance set aside in any fiscal year for targeted underserved areas that has not been expended during a reasonable period in such year for use in (i) colonias that have applied for and are eligible for assistance under subparagraph (B) or paragraph (7) and did not receive assistance, and (ii) counties and communities eligible for designation as targeted underserved areas but which were not so designated. The procedure shall also provide that any assistance reallocated under the preceding sentence that has not been expended by a reasonable date established by the Secretary (which shall be after the expiration of the period referred to in the preceding sentence) shall be made available and allocated under the laws and regulations relating to such assistance, notwithstanding this subsection.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fc6f4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Priority for colonias</heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fc6f5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/4/B/i\"><num value=\"i\">(i)</num><content> Notwithstanding the designation of counties and communities as targeted underserved areas under paragraph (1) and the provisions of <ref href=\"/us/usc/t42/s1490\">section 1490 of this title</ref>, colonias shall be eligible for assistance with amounts reserved under subparagraph (A), as provided in this subparagraph.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fee06-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/4/B/ii\"><num value=\"ii\">(ii)</num><content> In providing assistance from amounts reserved under this paragraph in each fiscal year, the Secretary shall give priority to any application for assistance to be used in, or in close proximity to, and serving the residents of, a colonia located in a State described under clause (iii). After the Secretary has provided assistance under the priority for colonias located in a State in an amount equal to 5 percent of the total amount of assistance allocated under this subchapter to such State in the fiscal year, the priority shall not apply to any applications for colonias in such State.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fee07-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/4/B/iii\"><num value=\"iii\">(iii)</num><content> This paragraph shall apply to any State for any fiscal year following 2 fiscal years in which the State obligated the total amount of assistance allocated to it under this subchapter during each of such 2 fiscal years.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99fee08-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> List of underserved areas</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall publish annually the current list of targeted underserved areas in the Federal Register.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99fee09-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Project preparation assistance</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fee0a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/6/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary may make grants to eligible applicants under subparagraph (D) to promote the development of affordable housing in targeted underserved areas and colonias.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fee0b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/6/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Use</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A grant under this paragraph shall not exceed an amount that the Secretary determines to equal the customary and reasonable costs incurred in preparing an application for a loan under section 1472, 1474, 1484, 1485, or 1490d of this title, or a grant under <ref href=\"/us/usc/t42/s1490m\">section 1490m of this title</ref> (including preapplication planning, site analysis, market analysis, and other necessary technical assistance). The Secretary shall adjust the loan or grant amount under such sections to take account of project preparation costs that have been paid from grant proceeds under this paragraph and that normally would be reimbursed with proceeds of the loan or grant.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fee0c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/6/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Approval</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Secretary shall approve a properly submitted application or issue a written statement indicating the reasons for disapproval not later than 60 days after the receipt of the application.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fee0d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/6/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Eligibility</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">For purposes of this paragraph, an eligible applicant may be a nonprofit organization or corporation, a community housing development organization, State, unit of general local government, or agency of a State or unit of general local government.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fee0e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/6/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Availability of funding</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Any amounts appropriated to carry out this paragraph shall remain available until expended.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99fee0f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Priority for colonias</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fee10-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/7/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In providing assistance under this subchapter in any fiscal year described under subparagraph (B), each State in which colonias are located shall give priority to any application for assistance to be used in a colonia. The priority under this subparagraph shall not apply in such State after 5 percent of the assistance available in such fiscal year has been allocated for colonias qualifying for the priority.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"ida99fee11-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/7/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Covered years</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">This paragraph shall apply to any fiscal year following 2 fiscal years in which the State did not obligate the total amount of assistance allocated it under this subchapter during each of such 2 fiscal years.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"ida99fee12-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> “Colonia” defined</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">For purposes of this subsection, the term “colonia” means any identifiable community that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fee13-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/8/A\"><num value=\"A\">(A)</num><content> is in the State of Arizona, California, New Mexico, or Texas;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fee14-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/8/B\"><num value=\"B\">(B)</num><content> is in the area of the United States within 150 miles of the border between the United States and Mexico, except that the term does not include any standard metropolitan statistical area that has a population exceeding 1,000,000;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida99fee15-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/8/C\"><num value=\"C\">(C)</num><content> is determined to be a colonia on the basis of objective criteria, including lack of potable water supply, lack of adequate sewage systems, and lack of decent, safe, and sanitary housing; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"ida9a01526-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s1479/f/8/D\"><num value=\"D\">(D)</num><content> was in existence as a colonia before <date date=\"1990-11-28\">November 28, 1990</date>.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"ida9a01527-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/act/1949-07-15/ch338\">July 15, 1949, ch. 338</ref>, title V, § 509, <ref href=\"/us/stat/63/436\">63 Stat. 436</ref>; <ref href=\"/us/pl/95/128/tV/s504\">Pub.
