<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="ida9abd4dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s"><num value="1490s">§ 1490s.</num><heading> Enforcement provisions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9abd4de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/a"><num value="a" class="bold">(a)</num><heading class="bold"> Equity skimming</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9abd4df-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Criminal penalty</heading><content><p style="-uslm-lc:I12" class="indent1">Whoever, as an owner, agent, employee, or manager, or is otherwise in custody, control, or possession of property that is security for a loan made or guaranteed under this subchapter, willfully uses, or authorizes the use, of any part of the rents, assets, proceeds, income, or other funds derived from such property, for any purpose other than to meet actual, reasonable, and necessary expenses of the property, or for any other purpose not authorized by this subchapter or the regulations adopted pursuant to this subchapter, shall be fined under title 18 or imprisoned not more than 5 years, or both.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9abd4e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Civil sanctions</heading><content><p style="-uslm-lc:I12" class="indent1">An entity or individual who as an owner, operator, employee, or manager, or who acts as an agent for a property that is security for a loan made or guaranteed under this subchapter where any part of the rents, assets, proceeds, income, or other funds derived from such property are used for any purpose other than to meet actual, reasonable, and necessary expenses of the property, or for any other purpose not authorized by this subchapter or the regulations adopted pursuant to this subchapter, shall be subject to a fine of not more than $25,000 per violation. The sanctions provided in this paragraph may be imposed in addition to any other civil sanctions or civil monetary penalties authorized by law.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="ida9abd4e1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b"><num value="b" class="bold">(b)</num><heading class="bold"> Civil monetary penalties</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9abd4e2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary may, after notice and opportunity for a hearing, impose a civil monetary penalty in accordance with this subsection against any individual or entity, including its owners, officers, directors, general partners, limited partners, or employees, who knowingly and materially violate, or participate in the violation of, the provisions of this subchapter, the regulations issued by the Secretary pursuant to this subchapter, or agreements made in accordance with this subchapter, by—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="ida9abfbf3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/1/A"><num value="A">(A)</num><content> submitting information to the Secretary that is false;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9abfbf4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/1/B"><num value="B">(B)</num><content> providing the Secretary with false certifications;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9abfbf5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/1/C"><num value="C">(C)</num><content> failing to submit information requested by the Secretary in a timely manner;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9abfbf6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/1/D"><num value="D">(D)</num><content> failing to maintain the property subject to loans made or guaranteed under this subchapter in good repair and condition, as determined by the Secretary;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9abfbf7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/1/E"><num value="E">(E)</num><content> failing to provide management for a project which received a loan made or guaranteed under this subchapter that is acceptable to the Secretary; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="ida9abfbf8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/1/F"><num value="F">(F)</num><content> failing to comply with the provisions of applicable civil rights statutes and regulations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9abfbf9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Conditions for renewal or extension</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary may require that expiring loan or assistance agreements entered into under this subchapter shall not be renewed or extended unless the owner executes an agreement to comply with additional conditions prescribed by the Secretary, or executes a new loan or assistance agreement in the form prescribed by the Secretary.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9abfbfa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Amount</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9abfbfb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The amount of a civil monetary penalty imposed under this subsection shall not exceed the greater of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9abfbfc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/A/i"><num value="i">(i)</num><content> twice the damages the Department of Agriculture, the guaranteed lender, or the project that is secured for a loan under this section suffered or would have suffered as a result of the violation; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfbfd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/A/ii"><num value="ii">(ii)</num><content> $50,000 per violation.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9abfbfe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Determination</heading><chapeau style="-uslm-lc:I13" class="indent2">In determining the amount of a civil monetary penalty under this subsection, the Secretary shall take into consideration—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="ida9abfbff-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/i"><num value="i">(i)</num><content> the gravity of the offense;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfc00-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/ii"><num value="ii">(ii)</num><content> any history of prior offenses by the violator (including offenses occurring prior to the enactment of this section);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfc01-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/iii"><num value="iii">(iii)</num><content> the ability of the violator to pay the penalty;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfc02-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/iv"><num value="iv">(iv)</num><content> any injury to tenants;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfc03-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/v"><num value="v">(v)</num><content> any injury to the public;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfc04-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/vi"><num value="vi">(vi)</num><content> any benefits received by the violator as a result of the violation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfc05-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/vii"><num value="vii">(vii)</num><content> deterrence of future violations; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="ida9abfc06-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/3/B/viii"><num value="viii">(viii)</num><content> such other factors as the Secretary may establish by regulation.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9abfc07-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Payment of penalties</heading><content><p style="-uslm-lc:I12" class="indent1">No payment of a penalty assessed under this section may be made from funds provided under this subchapter or from funds of a project which serve as security for a loan made or guaranteed under this subchapter.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="ida9abfc08-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Remedies for noncompliance</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9abfc09-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> Judicial intervention</heading><content><p style="-uslm-lc:I13" class="indent2">If a person or entity fails to comply with a final determination by the Secretary imposing a civil monetary penalty under this subsection, the Secretary may request the Attorney General of the United States to bring an action in an appropriate United States district court to obtain a monetary judgment against such individual or entity and such other relief as may be available. The monetary judgment may, in the court’s discretion, include the attorney’s fees and other expenses incurred by the United States in connection with the action.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="ida9abfc0a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s1490s/b/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Reviewability of determination</heading><content><p style="-uslm-lc:I13" class="indent2">In an action under this paragraph, the validity and appropriateness of a determination by the Secretary imposing the penalty shall not be subject to review.</p>
