L. 106–279, title II, § 201, Oct. 6, 2000, 114 Stat. 830.)","seq_in_title":7233,"parent_identifier":"/us/usc/t42/ch143/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch143","level":"chapter","num":"CHAPTER 143—","heading":"INTERCOUNTRY ADOPTIONS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch143/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"PROVISIONS RELATING TO ACCREDITATION AND APPROVAL","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad66ba7b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921\"><num value=\"14921\">§ 14921.</num><heading> Accreditation or approval required in order to provide adoption services in cases subject to the Convention</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad66ba7c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Except as otherwise provided in this subchapter, no person may offer or provide adoption services in connection with a Convention adoption in the United States unless that person—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad66ba7d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/a/1\"><num value=\"1\">(1)</num><content> is accredited or approved in accordance with this subchapter; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad66ba7e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/a/2\"><num value=\"2\">(2)</num><content> is providing such services through or under the supervision and responsibility of an accredited agency or approved person.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad66ba7f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Exceptions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Subsection (a) shall not apply to the following:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad66ba80-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Background studies and home studies</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The performance of a background study on a child or a home study on a prospective adoptive parent, or any report on any such study by a social work professional or organization who is not providing any other adoption service in the case, if the background or home study is approved by an accredited agency.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad66e191-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Child welfare services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The provision of a child welfare service by a person who is not providing any other adoption service in the case.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad66e192-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Legal services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The provision of legal services by a person who is not providing any adoption service in the case.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad66e193-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14921/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Prospective adoptive parents acting on own behalf</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The conduct of a prospective adoptive parent on his or her own behalf in the case, to the extent not prohibited by the law of the State in which the prospective adoptive parent resides.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idad66e194-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/106/279/tII/s201\">Pub.
