<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad66e198-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922"><num value="14922">§ 14922.</num><heading> Process for accreditation and approval; role of accrediting entities</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad66e199-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a"><num value="a" class="bold">(a)</num><heading class="bold"> Designation of accrediting entities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad66e19a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall enter into agreements with one or more qualified entities under which such entities will perform the duties described in subsection (b) in accordance with the Convention, this subchapter, and the regulations prescribed under <ref href="/us/usc/t42/s14923">section 14923 of this title</ref>, and upon entering into each such agreement shall designate the qualified entity as an accrediting entity.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad66e19b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Qualified entities</heading><chapeau style="-uslm-lc:I12" class="indent1">In paragraph (1), the term “qualified entity” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad66e19c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a/2/A"><num value="A">(A)</num><content> a nonprofit private entity that has expertise in developing and administering standards for entities providing child welfare services and that meets such other criteria as the Secretary may by regulation establish; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad66e19d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a/2/B"><num value="B">(B)</num><chapeau> a public entity (other than a Federal entity), including an agency or instrumentality of State government having responsibility for licensing adoption agencies, that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad66e19e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a/2/B/i"><num value="i">(i)</num><content> has expertise in developing and administering standards for entities providing child welfare services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad66e19f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a/2/B/ii"><num value="ii">(ii)</num><content> accredits only agencies located in the State in which the public entity is located; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad66e1a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/a/2/B/iii"><num value="iii">(iii)</num><content> meets such other criteria as the Secretary may by regulation establish.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad66e1a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b"><num value="b" class="bold">(b)</num><heading class="bold"> Duties of accrediting entities</heading><chapeau style="-uslm-lc:I11" class="indent0">The duties described in this subsection are the following:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad66e1a2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Accreditation and approval</heading><content><p style="-uslm-lc:I12" class="indent1">Accreditation of agencies, and approval of persons, to provide adoption services in the United States in cases subject to the Convention.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad66e1a3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Oversight</heading><content><p style="-uslm-lc:I12" class="indent1">Ongoing monitoring of the compliance of accredited agencies and approved persons with applicable requirements, including review of complaints against such agencies and persons in accordance with procedures established by the accrediting entity and approved by the Secretary.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad66e1a4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Enforcement</heading><content><p style="-uslm-lc:I12" class="indent1">Taking of adverse actions (including requiring corrective action, imposing sanctions, and refusing to renew, suspending, or canceling accreditation or approval) for noncompliance with applicable requirements, and notifying the agency or person against whom adverse actions are taken of the deficiencies necessitating the adverse action.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad66e1a5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Data, records, and reports</heading><content><p style="-uslm-lc:I12" class="indent1">Collection of data, maintenance of records, and reporting to the Secretary, the United States central authority, State courts, and other entities (including on persons and agencies granted or denied approval or accreditation), to the extent and in the manner that the Secretary requires.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad66e1a6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Report on use of Federal funding</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 90 days after an accrediting entity receives Federal funding authorized by <ref href="/us/usc/t42/s14943">section 14943 of this title</ref>, the entity shall submit a report to the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives that describes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad6708b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b/5/A"><num value="A">(A)</num><content> the amount of such funding the entity received; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad6708b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/b/5/B"><num value="B">(B)</num><content> how such funding was, or will be, used by the entity.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6708b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/c"><num value="c" class="bold">(c)</num><heading class="bold"> Remedies for adverse action by accrediting entity</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6708ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Correction of deficiency</heading><content><p style="-uslm-lc:I12" class="indent1">An agency or person who is the subject of an adverse action by an accrediting entity may re-apply for accreditation or approval (or petition for termination of the adverse action) on demonstrating to the satisfaction of the accrediting entity that the deficiencies necessitating the adverse action have been corrected.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6708bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> No other administrative review</heading><content><p style="-uslm-lc:I12" class="indent1">An adverse action by an accrediting entity shall not be subject to administrative review.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6708bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Judicial review</heading><content><p style="-uslm-lc:I12" class="indent1">An agency or person who is the subject of an adverse action by an accrediting entity may petition the United States district court in the judicial district in which the agency is located or the person resides to set aside the adverse action. The court shall review the adverse action in accordance with <ref href="/us/usc/t5/s706">section 706 of title 5</ref>, and for purposes of such review the accrediting entity shall be considered an agency within the meaning of section 701 of such title.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6708bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14922/d"><num value="d" class="bold">(d)</num><heading class="bold"> Fees</heading><content><p style="-uslm-lc:I11" class="indent0">The amount of fees assessed by accrediting entities for the costs of accreditation shall be subject to approval by the Secretary. Such fees may not exceed the costs of accreditation. In reviewing the level of such fees, the Secretary shall consider the relative size of, the geographic location of, and the number of Convention adoption cases managed by the agencies or persons subject to accreditation or approval by the accrediting entity.</p>
