L. 106–279, title II, § 203, Oct. 6, 2000, 114 Stat. 832.)","seq_in_title":7235,"parent_identifier":"/us/usc/t42/ch143/schII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch143","level":"chapter","num":"CHAPTER 143—","heading":"INTERCOUNTRY ADOPTIONS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch143/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"PROVISIONS RELATING TO ACCREDITATION AND APPROVAL","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad6708c3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923\"><num value=\"14923\">§ 14923.</num><heading> Standards and procedures for providing accreditation or approval</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6708c4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6708c5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Promulgation of regulations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary, shall, by regulation, prescribe the standards and procedures to be used by accrediting entities for the accreditation of agencies and the approval of persons to provide adoption services in the United States in cases subject to the Convention.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6708c6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Consideration of views</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In developing such regulations, the Secretary shall consider any standards or procedures developed or proposed by, and the views of, individuals and entities with interest and expertise in international adoptions and family social services, including public and private entities with experience in licensing and accrediting adoption agencies.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6708c7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Applicability of notice and comment rules</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Subsections (b), (c), and (d) of <ref href=\"/us/usc/t5/s553\">section 553 of title 5</ref> shall apply in the development and issuance of regulations under this section.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6708c8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Minimum requirements</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6708c9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Accreditation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The standards prescribed under subsection (a) shall include the requirement that accreditation of an agency may not be provided or continued under this subchapter unless the agency meets the following requirements:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad6708ca-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Specific requirements</heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad6708cb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/A/i\"><num value=\"i\">(i)</num><content> The agency provides prospective adoptive parents of a child in a prospective Convention adoption a copy of the medical records of the child (which, to the fullest extent practicable, shall include an English-language translation of such records) on a date which is not later than the earlier of the date that is 2 weeks before: (I) the adoption; or (II) the date on which the prospective parents travel to a foreign country to complete all procedures in such country relating to the adoption.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad672edc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> The agency ensures that a thorough background report (home study) on the prospective adoptive parent or parents has been completed in accordance with the Convention and with applicable Federal and State requirements and transmitted to the Attorney General with respect to each Convention adoption. Each such report shall include a criminal background check and a full and complete statement of all facts relevant to the eligibility of the prospective adopting parent or parents to adopt a child under any requirements specified by the central authority of the child’s country of origin under <ref href=\"/us/usc/t42/s14912/b/3\">section 14912(b)(3) of this title</ref>, including, in the case of a child emigrating to the United States for the purpose of adoption, the requirements of the child’s country of origin applicable to adoptions taking place in such country. For purposes of this clause, the term “background report (home study)” includes any supplemental statement submitted by the agency to the Attorney General for the purpose of providing information relevant to any requirements specified by the child’s country of origin.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad672edd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/A/iii\"><num value=\"iii\">(iii)</num><content> The agency provides prospective adoptive parents with a training program that includes counseling and guidance for the purpose of promoting a successful intercountry adoption before such parents travel to adopt the child or the child is placed with such parents for adoption.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad672ede-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/A/iv\"><num value=\"iv\">(iv)</num><content> The agency employs personnel providing intercountry adoption services on a fee for service basis rather than on a contingent fee basis.</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad672edf-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/A/v\"><num value=\"v\">(v)</num><content> The agency discloses fully its policies and practices, the disruption rates of its placements for intercountry adoption, and all fees charged by such agency for intercountry adoption.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad672ee0-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Capacity to provide adoption services</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The agency has, directly or through arrangements with other persons, a sufficient number of appropriately trained and qualified personnel, sufficient financial resources, appropriate organizational structure, and appropriate procedures to enable the agency to provide, in accordance with this chapter, all adoption services in cases subject to the Convention.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad672ee1-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Use of social service professionals</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The agency has established procedures designed to ensure that social service functions requiring the application of clinical skills and judgment are performed only by professionals with appropriate qualifications and credentials.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad672ee2-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Records, reports, and information matters</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The agency is capable of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad672ee3-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/D/i\"><num value=\"i\">(i)</num><content> maintaining such records and making such reports as may be required by the Secretary, the United States central authority, and the accrediting entity that accredits the agency;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad672ee4-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/D/ii\"><num value=\"ii\">(ii)</num><content> cooperating with reviews, inspections, and audits;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad672ee5-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/D/iii\"><num value=\"iii\">(iii)</num><content> safeguarding sensitive individual information; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"idad672ee6-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/D/iv\"><num value=\"iv\">(iv)</num><content> complying with other requirements concerning information management necessary to ensure compliance with the Convention, this chapter, and any other applicable law.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad672ee7-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Liability insurance</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The agency agrees to have in force adequate liability insurance for professional negligence and any other insurance that the Secretary considers appropriate.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad672ee8-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Compliance with applicable rules</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The agency has established adequate measures to comply (and to ensure compliance of their agents and clients) with the Convention, this chapter, and any other applicable law.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad672ee9-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/1/G\"><num value=\"G\" class=\"bold\">(G)</num><heading class=\"bold\"> Nonprofit organization with state license to provide adoption services</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The agency is a private nonprofit organization licensed to provide adoption services in at least one State.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6755fa-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Approval</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The standards prescribed under subsection (a) shall include the requirement that a person shall not be approved under this subchapter unless the person is a private for-profit entity that meets the requirements of subparagraphs (A) through (F) of paragraph (1) of this subsection.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6755fb-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Renewal of accreditation or approval</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The standards prescribed under subsection (a) shall provide that the accreditation of an agency or approval of a person under this subchapter shall be for a period of not less than 3 years and not more than 5 years, and may be renewed on a showing that the agency or person meets the requirements applicable to original accreditation or approval under this subchapter.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad6755fc-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Temporary registration of community based agencies</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6755fd-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> One-year registration period for medium community based agencies</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For a 1-year period after the entry into force of the Convention and notwithstanding subsection (b), the Secretary may provide, in regulations issued pursuant to subsection (a), that an agency may register with the Secretary and be accredited to provide adoption services in the United States in cases subject to the Convention during such period if the agency has provided adoption services in fewer than 100 intercountry adoptions in the preceding calendar year and meets the criteria described in paragraph (3).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6755fe-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Two-year registration period for small community-based agencies</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For a 2-year period after the entry into force of the Convention and notwithstanding subsection (b), the Secretary may provide, in regulations issued pursuant to subsection (a), that an agency may register with the Secretary and be accredited to provide adoption services in the United States in cases subject to the Convention during such period if the agency has provided adoption services in fewer than 50 intercountry adoptions in the preceding calendar year and meets the criteria described in paragraph (3).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad6755ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Criteria for registration</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Agencies registered under this subsection shall meet the following criteria:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad675600-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/3/A\"><num value=\"A\">(A)</num><content> The agency is licensed in the State in which it is located and is a nonprofit agency.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad675601-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/3/B\"><num value=\"B\">(B)</num><content> The agency has been providing adoption services in connection with intercountry adoptions for at least 3 years.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad675602-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/3/C\"><num value=\"C\">(C)</num><content> The agency has demonstrated that it will be able to provide the United States Government with all information related to the elements described in <ref href=\"/us/usc/t42/s14914/b\">section 14914(b) of this title</ref> and provides such information.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad675603-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/3/D\"><num value=\"D\">(D)</num><content> The agency has initiated the process of becoming accredited under the provisions of this chapter and is actively taking steps to become an accredited agency.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad675604-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s14923/c/3/E\"><num value=\"E\">(E)</num><content> The agency has not been found to be involved in any improper conduct relating
