and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idd90ba84b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/a/2\"><num value=\"2\">(2)</num><content> suspend or cancel the designation of an accrediting entity found to be substantially out of compliance with the Convention, this chapter, other applicable laws, or implementing regulations under this chapter.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd90ba84c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Suspension or cancellation of accreditation or approval</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba84d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Secretary’s authority</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary shall suspend or cancel the accreditation or approval granted by an accrediting entity to an agency or person pursuant to <ref href=\"/us/usc/t42/s14922\">section 14922 of this title</ref> when the Secretary finds that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba84e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/1/A\"><num value=\"A\">(A)</num><content> the agency or person is substantially out of compliance with applicable requirements; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba84f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/1/B\"><num value=\"B\">(B)</num><content> the accrediting entity has failed or refused, after consultation with the Secretary, to take appropriate enforcement action.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba850-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Correction of deficiency</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">At any time when the Secretary is satisfied that the deficiencies on the basis of which an adverse action is taken under paragraph (1) have been corrected, the Secretary shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba851-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/2/A\"><num value=\"A\">(A)</num><content> notify the accrediting entity that the deficiencies have been corrected; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba852-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/2/B\"><num value=\"B\">(B)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba853-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/2/B/i\"><num value=\"i\">(i)</num><content> in the case of a suspension, terminate the suspension; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba854-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> in the case of a cancellation, notify the agency or person that the agency or person may re-apply to the accrediting entity for accreditation or approval.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd90ba855-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Debarment</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba856-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Secretary’s authority</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">On the initiative of the Secretary, or on request of an accrediting entity, the Secretary may temporarily or permanently debar an agency from accreditation or a person from approval under this subchapter, but only if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba857-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/c/1/A\"><num value=\"A\">(A)</num><content> there is substantial evidence that the agency or person is out of compliance with applicable requirements; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba858-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/c/1/B\"><num value=\"B\">(B)</num><content> there has been a pattern of serious, willful, or grossly negligent failures to comply or other aggravating circumstances indicating that continued accreditation or approval would not be in the best interests of the children and families concerned.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba859-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Period of debarment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Secretary’s debarment order shall state whether the debarment is temporary or permanent. If the debarment is temporary, the Secretary shall specify a date, not earlier than 3 years after the date of the order, on or after which the agency or person may apply to the Secretary for withdrawal of the debarment.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba85a-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/c/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Effect of debarment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An accrediting entity may take into account the circumstances of the debarment of an agency or person that has been debarred pursuant to this subsection in considering any subsequent application of the agency or person, or of any other entity in which the agency or person has an ownership or control interest, for accreditation or approval under this subchapter.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd90ba85b-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Judicial review</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A person (other than a prospective adoptive parent), an agency, or an accrediting entity who is the subject of a final action of suspension, cancellation, or debarment by the Secretary under this subchapter may petition the United States District Court for the District of Columbia or the United States district court in the judicial district in which the person resides or the agency or accrediting entity is located to set aside the action. The court shall review the action in accordance with <ref href=\"/us/usc/t5/s706\">section 706 of title 5</ref>.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idd90ba85c-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Failure to ensure a full and complete home study</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba85d-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Willful, grossly negligent, or repeated failure to ensure the completion and transmission of a background report (home study) that fully complies with the requirements of <ref href=\"/us/usc/t42/s14923/b/1/A/ii\">section 14923(b)(1)(A)(ii) of this title</ref> shall constitute substantial noncompliance with applicable requirements.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba85e-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Regulations</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Regulations promulgated under <ref href=\"/us/usc/t42/s14923\">section 14923 of this title</ref> shall provide for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba85f-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/e/2/A\"><num value=\"A\">(A)</num><content> frequent and careful monitoring of compliance by agencies and approved persons with the requirements of section 14923(b)(A)(ii) <ref class=\"footnoteRef\" idref=\"fn004110\">1</ref><note type=\"footnote\" id=\"fn004110\"><num>1</num> So in original. Probably should be section “14923(b)(1)(A)(ii)”.</note> of this title; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idd90ba860-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/e/2/B\"><num value=\"B\">(B)</num><content> consultation between the Secretary and the accrediting entity where an agency or person has engaged in substantial noncompliance with the requirements of section 14923(b)(A)(ii) <sup>1</sup> of this title, unless the accrediting entity has taken appropriate corrective action and the noncompliance has not recurred.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba861-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/e/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Repeated failures to comply</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Repeated serious, willful, or grossly negligent failures to comply with the requirements of <ref href=\"/us/usc/t42/s14923/b/1/A/ii\">section 14923(b)(1)(A)(ii) of this title</ref> by an agency or person after consultation between Secretary and the accrediting entity with respect to previous noncompliance by such agency or person shall constitute a pattern of serious, willful, or grossly negligent failures to comply under subsection (c)(1)(B).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idd90ba862-406b-11eb-bd25-fd7436c081d8\" identifier=\"/us/usc/t42/s14924/e/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Failure to comply with certain requirements</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">A failure to comply with the requirements of <ref href=\"/us/usc/t42/s14923/b/1/A/ii\">section 14923(b)(1)(A)(ii) of this title</ref> shall constitute a serious failure to comply under subsection (c)(1)(B) unless it is shown by clear and convincing evidence that such noncompliance had neither the purpose nor the effect of determining the outcome of a decision or proceeding by a court or other competent authority in the United States or the child’s country of origin.</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idd90ba863-406b-11eb-bd25-fd7436c081d8\">(<ref href=\"/us/pl/106/279/tII/s204\">Pub.
