<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad6840db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944"><num value="14944">§ 14944.</num><heading> Enforcement</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6840dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/a"><num value="a" class="bold">(a)</num><heading class="bold"> Civil penalties</heading><chapeau style="-uslm-lc:I11" class="indent0">Any person who—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad6840dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/a/1"><num value="1">(1)</num><content> violates <ref href="/us/usc/t42/s14921">section 14921 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad6840de-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/a/2"><num value="2">(2)</num><chapeau> makes a false or fraudulent statement, or misrepresentation, with respect to a material fact, or offers, gives, solicits, or accepts inducement by way of compensation, intended to influence or affect in the United States or a foreign country—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad6840df-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/a/2/A"><num value="A">(A)</num><content> a decision by an accrediting entity with respect to the accreditation of an agency or approval of a person under subchapter II;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad6840e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/a/2/B"><num value="B">(B)</num><content> the relinquishment of parental rights or the giving of parental consent relating to the adoption of a child in a case subject to the Convention; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad6840e1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/a/2/C"><num value="C">(C)</num><content> a decision or action of any entity performing a central authority function; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad6840e2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/a/3"><num value="3">(3)</num><content> engages another person as an agent, whether in the United States or in a foreign country, who in the course of that agency takes any of the actions described in paragraph (1) or (2),</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be subject, in addition to any other penalty that may be prescribed by law, to a civil money penalty of not more than $50,000 for a first violation, and not more than $100,000 for each succeeding violation.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6840e3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/b"><num value="b" class="bold">(b)</num><heading class="bold"> Civil enforcement</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6840e4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authority of Attorney General</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General may bring a civil action to enforce subsection (a) against any person in any United States district court.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6840e5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Factors to be considered in imposing penalties</heading><content><p style="-uslm-lc:I12" class="indent1">In imposing penalties the court shall consider the gravity of the violation, the degree of culpability of the defendant, and any history of prior violations by the defendant.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6867f6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s14944/c"><num value="c" class="bold">(c)</num><heading class="bold"> Criminal penalties</heading><content><p style="-uslm-lc:I11" class="indent0">Whoever knowingly and willfully violates paragraph (1) or (2) of subsection (a) shall be subject to a fine of not more than $250,000, imprisonment for not more than 5 years, or both.</p>
