<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd90e19c0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009"><num value="15009">§ 15009.</num><heading> Rights of individuals with developmental disabilities</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd90e19c1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">Congress makes the following findings respecting the rights of individuals with developmental disabilities:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd90e19c2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/1"><num value="1">(1)</num><content> Individuals with developmental disabilities have a right to appropriate treatment, services, and habilitation for such disabilities, consistent with <ref href="/us/usc/t42/s15001/c">section 15001(c) of this title</ref>.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idd90e19c3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/2"><num value="2">(2)</num><content> The treatment, services, and habitation <ref class="footnoteRef" idref="fn004111">1</ref><note type="footnote" id="fn004111"><num>1</num> So in original. Probably should be “habilitation”.</note> for an individual with developmental disabilities should be designed to maximize the potential of the individual and should be provided in the setting that is least restrictive of the individual’s personal liberty.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd90e19c4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3"><num value="3">(3)</num><chapeau> The Federal Government and the States both have an obligation to ensure that public funds are provided only to institutional programs, residential programs, and other community programs, including educational programs in which individuals with developmental disabilities participate, that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd90e19c5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3/A"><num value="A">(A)</num><content> provide treatment, services, and habilitation that are appropriate to the needs of such individuals; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd90e19c6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3/B"><num value="B">(B)</num><chapeau> meet minimum standards relating to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd90e19c7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3/B/i"><num value="i">(i)</num><content> provision of care that is free of abuse, neglect, sexual and financial exploitation, and violations of legal and human rights and that subjects individuals with developmental disabilities to no greater risk of harm than others in the general population;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd90e19c8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3/B/ii"><num value="ii">(ii)</num><content> provision to such individuals of appropriate and sufficient medical and dental services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd90e19c9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3/B/iii"><num value="iii">(iii)</num><content> prohibition of the use of physical restraint and seclusion for such an individual unless absolutely necessary to ensure the immediate physical safety of the individual or others, and prohibition of the use of such restraint and seclusion as a punishment or as a substitute for a habilitation program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd90e19ca-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3/B/iv"><num value="iv">(iv)</num><content> prohibition of the excessive use of chemical restraints on such individuals and the use of such restraints as punishment or as a substitute for a habilitation program or in quantities that interfere with services, treatment, or habilitation for such individuals; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd90e19cb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/3/B/v"><num value="v">(v)</num><content> provision for close relatives or guardians of such individuals to visit the individuals without prior notice.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd90e19cc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4"><num value="4">(4)</num><chapeau> All programs for individuals with developmental disabilities should meet standards—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd90e19cd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/A"><num value="A">(A)</num><content> that are designed to assure the most favorable possible outcome for those served; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd90e19ce-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/B"><num value="B">(B)</num><clause style="-uslm-lc:I13" class="indent2" id="idd90e19cf-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/B/i"><num value="i">(i)</num><content> in the case of residential programs serving individuals in need of comprehensive health-related, habilitative, assistive technology or rehabilitative services, that are at least equivalent to those standards applicable to intermediate care facilities for the mentally retarded, promulgated in regulations of the Secretary on <date date="1988-06-03">June 3, 1988</date>, as appropriate, taking into account the size of the institutions and the service delivery arrangements of the facilities of the programs;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd90e19d0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/B/ii"><num value="ii">(ii)</num><chapeau> in the case of other residential programs for individuals with developmental disabilities, that assure that—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="idd90e19d1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/B/ii/I"><num value="I">(I)</num><content> care is appropriate to the needs of the individuals being served by such programs;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idd90e19d2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/B/ii/II"><num value="II">(II)</num><content> the individuals admitted to facilities of such programs are individuals whose needs can be met through services provided by such facilities; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idd90e19d3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/B/ii/III"><num value="III">(III)</num><content> the facilities of such programs provide for the humane care of the residents of the facilities, are sanitary, and protect their rights; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd90e19d4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/a/4/B/iii"><num value="iii">(iii)</num><content> in the case of nonresidential programs, that assure that the care provided by such programs is appropriate to the individuals served by the programs.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd90e19d5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15009/b"><num value="b" class="bold">(b)</num><heading class="bold"> Clarification</heading><content><p style="-uslm-lc:I11" class="indent0">The rights of individuals with developmental disabilities described in findings made in this section shall be considered to be in addition to any constitutional or other rights otherwise afforded to all individuals.</p>
