<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd9106236-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025"><num value="15025">§ 15025.</num><heading> State Councils on Developmental Disabilities and designated State agencies</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9106237-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">Each State that receives assistance under this part shall establish and maintain a Council to undertake advocacy, capacity building, and systemic change activities (consistent with subsections (b) and (c) of <ref href="/us/usc/t42/s15001">section 15001 of this title</ref>) that contribute to a coordinated, consumer- and family-centered, consumer- and family-directed, comprehensive system of community services, individualized supports, and other forms of assistance that contribute to the achievement of the purpose of this part. The Council shall have the authority to fulfill the responsibilities described in subsection (c).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9106238-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b"><num value="b" class="bold">(b)</num><heading class="bold"> Council membership</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106239-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Council appointments</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910623a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The members of the Council of a State shall be appointed by the Governor of the State from among the residents of that State.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910623b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Recommendations</heading><content><p style="-uslm-lc:I13" class="indent2">The Governor shall select members of the Council, at the discretion of the Governor, after soliciting recommendations from organizations representing a broad range of individuals with developmental disabilities and individuals interested in individuals with developmental disabilities, including the non-State agency members of the Council. The Council may, at the initiative of the Council, or on the request of the Governor, coordinate Council and public input to the Governor regarding all recommendations.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910623c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Representation</heading><content><p style="-uslm-lc:I13" class="indent2">The membership of the Council shall be geographically representative of the State and reflect the diversity of the State with respect to race and ethnicity.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd910623d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Membership rotation</heading><content><p style="-uslm-lc:I12" class="indent1">The Governor shall make appropriate provisions to rotate the membership of the Council. Such provisions shall allow members to continue to serve on the Council until such members’ successors are appointed. The Council shall notify the Governor regarding membership requirements of the Council, and shall notify the Governor when vacancies on the Council remain unfilled for a significant period of time.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd910623e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Representation of individuals with developmental disabilities</heading><chapeau style="-uslm-lc:I12" class="indent1">Not less than 60 percent of the membership of each Council shall consist of individuals who are—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd910623f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/3/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="idd9106240-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/3/A/i"><num value="i">(i)</num><content> individuals with developmental disabilities;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd9106241-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/3/A/ii"><num value="ii">(ii)</num><content> parents or guardians of children with developmental disabilities; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd9106242-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/3/A/iii"><num value="iii">(iii)</num><content> immediate relatives or guardians of adults with mentally impairing developmental disabilities who cannot advocate for themselves; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106243-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/3/B"><num value="B">(B)</num><content> not employees of a State agency that receives funds or provides services under this part, and who are not managing employees (as defined in section 1126(b) of the Social Security Act (<ref href="/us/usc/t42/s1320a–5/b">42 U.S.C. 1320a–5(b)</ref>) of any other entity that receives funds or provides services under this part.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106244-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Representation of agencies and organizations</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106245-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">Each Council shall include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd9106246-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/A/i"><num value="i">(i)</num><chapeau> representatives of relevant State entities, including—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd9106247-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/A/i/I"><num value="I">(I)</num><content> State entities that administer funds provided under Federal laws related to individuals with disabilities, including the Rehabilitation Act of 1973 (<ref href="/us/usc/t29/s701">29 U.S.C. 701</ref> et seq.), the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.), the Older Americans Act of 1965 (<ref href="/us/usc/t42/s3001">42 U.S.C. 3001</ref> et seq.), and titles V and XIX of the Social Security Act (<ref href="/us/usc/t42/s701">42 U.S.C. 701</ref> et seq. and 1396 et seq.);</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106248-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/A/i/II"><num value="II">(II)</num><content> Centers in the State; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106249-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/A/i/III"><num value="III">(III)</num><content> the State protection and advocacy system; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd910624a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/A/ii"><num value="ii">(ii)</num><content> representatives, at all times, of local and nongovernmental agencies, and private nonprofit groups concerned with services for individuals with developmental disabilities in the State in which such agencies and groups are located.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910624b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Authority and limitations</heading><chapeau style="-uslm-lc:I13" class="indent2">The representatives described in subparagraph (A) shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd910624c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/B/i"><num value="i">(i)</num><content> have sufficient authority to engage in policy planning and implementation on behalf of the department, agency, or program such representatives represent; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd910624d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/4/B/ii"><num value="ii">(ii)</num><content> recuse themselves from any discussion of grants or contracts for which such representatives’ departments, agencies, or programs are grantees, contractors, or applicants and comply with the conflict of interest assurance requirement under <ref href="/us/usc/t42/s15024/c/5/D">section 15024(c)(5)(D) of this title</ref>.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd910624e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Composition of membership with developmental disabilities</heading><chapeau style="-uslm-lc:I12" class="indent1">Of the members of the Council described in paragraph (3)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd910624f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/5/A"><num value="A">(A)</num><content> ⅓ shall be individuals with developmental disabilities described in paragraph (3)(A)(i);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106250-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/5/B"><num value="B">(B)</num><content> ⅓ shall be parents or guardians of children with developmental disabilities described in paragraph (3)(A)(ii), or immediate relatives or guardians of adults with developmental disabilities described in paragraph (3)(A)(iii); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106251-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/5/C"><num value="C">(C)</num><content> ⅓ shall be a combination of individuals described in paragraph (3)(A).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106252-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Institutionalized individuals</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106253-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Of the members of the Council described in paragraph (5), at least 1 shall be an immediate relative or guardian of an individual with a developmental disability who resides or previously resided in an institution or shall be an individual with a developmental disability who resides or previously resided in an institution.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106254-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/b/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">Subparagraph (A) shall not apply with respect to a State if such an individual does not reside in that State.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9106255-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c"><num value="c" class="bold">(c)</num><heading class="bold"> Council responsibilities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106256-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">A Council, through Council members, staff, consultants, contractors, or subgrantees, shall have the responsibilities described in paragraphs (2) through (10).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106257-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Advocacy, capacity building, and systemic change activities</heading><content><p style="-uslm-lc:I12" class="indent1">The Council shall serve as an advocate for individuals with developmental disabilities and conduct or support programs, projects, and activities that carry out the purpose of this part.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106258-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Examination of goals</heading><chapeau style="-uslm-lc:I12" class="indent1">At the end of each grant year, each Council shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106259-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/3/A"><num value="A">(A)</num><content> determine the extent to which each goal of the Council was achieved for that year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910625a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/3/B"><num value="B">(B)</num><content> determine to the extent that each goal was not achieved, the factors that impeded the achievement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910625b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/3/C"><num value="C">(C)</num><content> determine needs that require amendment of the 5-year strategic State plan required under <ref href="/us/usc/t42/s15024">section 15024 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910625c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/3/D"><num value="D">(D)</num><content> separately determine the information on the self-advocacy goal described in <ref href="/us/usc/t42/s15024/c/4/A/ii">section 15024(c)(4)(A)(ii) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910625d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/3/E"><num value="E">(E)</num><content> determine customer satisfaction with Council supported or conducted activities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd910625e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> State plan development</heading><content><p style="-uslm-lc:I12" class="indent1">The Council shall develop the State plan and submit the State plan to the Secretary after consultation with the designated State agency under the State plan. Such consultation shall be solely for the purposes of obtaining State assurances and ensuring consistency of the plan with State law.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd910625f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> State plan implementation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106260-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Council shall implement the State plan by conducting and supporting advocacy, capacity building, and systemic change activities such as those described in subparagraphs (B) through (L).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106261-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Outreach</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct outreach activities to identify individuals with developmental disabilities and their families who otherwise might not come to the attention of the Council and assist and enable the individuals and families to obtain services, individualized supports, and other forms of assistance, including access to special adaptation of generic community services or specialized services.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106262-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Training</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct training for persons who are individuals with developmental disabilities, their families, and personnel (including professionals, paraprofessionals, students, volunteers, and other community members) to enable such persons to obtain access to, or to provide, community services, individualized supports, and other forms of assistance, including special adaptation of generic community services or specialized services for individuals with developmental disabilities and their families. To the extent that the Council supports or conducts training activities under this subparagraph, such activities shall contribute to the achievement of the purpose of this part.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106263-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/D"><num value="D" class="bold">(D)</num><heading class="bold"> Technical assistance</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct technical assistance activities to assist public and private entities to contribute to the achievement of the purpose of this part.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106264-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/E"><num value="E" class="bold">(E)</num><heading class="bold"> Supporting and educating communities</heading><chapeau style="-uslm-lc:I13" class="indent2">The Council may support and conduct activities to assist neighborhoods and communities to respond positively to individuals with developmental disabilities and their families—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd9106265-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/E/i"><num value="i">(i)</num><content> by encouraging local networks to provide informal and formal supports;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9106266-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/E/ii"><num value="ii">(ii)</num><content> through education; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9106267-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/E/iii"><num value="iii">(iii)</num><content> by enabling neighborhoods and communities to offer such individuals and their families access to and use of services, resources, and opportunities.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106268-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/F"><num value="F" class="bold">(F)</num><heading class="bold"> Interagency collaboration and coordination</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct activities to promote interagency collaboration and coordination to better serve, support, assist, or advocate for individuals with developmental disabilities and their families.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106269-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/G"><num value="G" class="bold">(G)</num><heading class="bold"> Coordination with related councils, committees, and programs</heading><chapeau style="-uslm-lc:I13" class="indent2">The Council may support and conduct activities to enhance coordination of services with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd910626a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/G/i"><num value="i">(i)</num><content> other councils, entities, or committees, authorized by Federal or State law, concerning individuals with disabilities (such as the State interagency coordinating council established under part C of the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1431">20 U.S.C. 1431</ref> et seq.), the State Rehabilitation Council and the Statewide Independent Living Council established under the Rehabilitation Act of 1973 (<ref href="/us/usc/t29/s701">29 U.S.C. 701</ref> et seq.), the State mental health planning council established under subtitle B <ref class="footnoteRef" idref="fn004112">1</ref><note type="footnote" id="fn004112"><num>1</num> See References in Text note below.</note> of title XIX of the Public Health Service Act [<ref href="/us/usc/t42/s300x">42 U.S.C. 300x</ref> et seq.], and the activities authorized under section 3003 or 3004 of title 29, and entities carrying out other similar councils, entities, or committees);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd910626b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/G/ii"><num value="ii">(ii)</num><content> parent training and information centers under part D of the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1451">20 U.S.C. 1451</ref> et seq.) and other entities carrying out federally funded projects that assist parents of children with disabilities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd910626c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/G/iii"><num value="iii">(iii)</num><content> other groups interested in advocacy, capacity building, and systemic change activities to benefit individuals with disabilities.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910626d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/H"><num value="H" class="bold">(H)</num><heading class="bold"> Barrier elimination, systems design and redesign</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct activities to eliminate barriers to access and use of community services by individuals with developmental disabilities, enhance systems design and redesign, and enhance citizen participation to address issues identified in the State plan.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910626e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/I"><num value="I" class="bold">(I)</num><heading class="bold"> Coalition development and citizen participation</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct activities to educate the public about the capabilities, preferences, and needs of individuals with developmental disabilities and their families and to develop and support coalitions that support the policy agenda of the Council, including training in self-advocacy, education of policymakers, and citizen leadership skills.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910626f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/J"><num value="J" class="bold">(J)</num><heading class="bold"> Informing policymakers</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct activities to provide information to policymakers by supporting and conducting studies and analyses, gathering information, and developing and disseminating model policies and procedures, information, approaches, strategies, findings, conclusions, and recommendations. The Council may provide the information directly to Federal, State, and local policymakers, including Congress, the Federal executive branch, the Governors, State legislatures, and State agencies, in order to increase the ability of such policymakers to offer opportunities and to enhance or adapt generic services to meet the needs of, or provide specialized services to, individuals with developmental disabilities and their families.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106270-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/K"><num value="K" class="bold">(K)</num><heading class="bold"> Demonstration of new approaches to services and supports</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd9106271-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/K/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The Council may support and conduct, on a time-limited basis, activities to demonstrate new approaches to serving individuals with developmental disabilities that are a part of an overall strategy for systemic change. The strategy may involve the education of policymakers and the public about how to deliver effectively, to individuals with developmental disabilities and their families, services, supports, and assistance that contribute to the achievement of the purpose of this part.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd9106272-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/K/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Sources of funding</heading><content><p style="-uslm-lc:I14" class="indent3">The Council may carry out this subparagraph by supporting and conducting demonstration activities through sources of funding other than funding provided under this part, and by assisting entities conducting demonstration activities to develop strategies for securing funding from other sources.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106273-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/5/L"><num value="L" class="bold">(L)</num><heading class="bold"> Other activities</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may support and conduct other advocacy, capacity building, and systemic change activities to promote the development of a coordinated, consumer- and family-centered, consumer- and family-directed, comprehensive system of community services, individualized supports, and other forms of assistance that contribute to the achievement of the purpose of this part.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106274-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/6"><num value="6" class="bold">(6)</num><heading class="bold"> Review of designated State agency</heading><content><p style="-uslm-lc:I12" class="indent1">The Council shall periodically review the designated State agency and activities carried out under this part by the designated State agency and make any recommendations for change to the Governor.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106275-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7"><num value="7" class="bold">(7)</num><heading class="bold"> Reports</heading><chapeau style="-uslm-lc:I12" class="indent1">Beginning in fiscal year 2002, the Council shall annually prepare and transmit to the Secretary a report. Each report shall be in a form prescribed by the Secretary by regulation under <ref href="/us/usc/t42/s15004/b">section 15004(b) of this title</ref>. Each report shall contain information about the progress made by the Council in achieving the goals of the Council (as specified in <ref href="/us/usc/t42/s15024/c/4">section 15024(c)(4) of this title</ref>), including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106276-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/A"><num value="A">(A)</num><content> a description of the extent to which the goals were achieved;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106277-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/B"><num value="B">(B)</num><content> a description of the strategies that contributed to achieving the goals;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106278-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/C"><num value="C">(C)</num><content> to the extent to which the goals were not achieved, a description of factors that impeded the achievement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106279-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/D"><num value="D">(D)</num><content> separate information on the self-advocacy goal described in <ref href="/us/usc/t42/s15024/c/4/A/ii">section 15024(c)(4)(A)(ii) of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910627a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/E"><num value="E">(E)</num><clause style="-uslm-lc:I13" class="indent2" id="idd910627b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/E/i"><num value="i">(i)</num><content> as appropriate, an update on the results of the comprehensive review and analysis described in <ref href="/us/usc/t42/s15024/c/3">section 15024(c)(3) of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd910627c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/E/ii"><num value="ii">(ii)</num><content> information on consumer satisfaction with Council supported or conducted activities;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910627d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/F"><num value="F">(F)</num><clause style="-uslm-lc:I13" class="indent2" id="idd910627e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/F/i"><num value="i">(i)</num><content> a description of the adequacy of health care and other services, supports, and assistance that individuals with developmental disabilities in Intermediate Care Facilities (Mental Retardation) receive; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd910627f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/F/ii"><num value="ii">(ii)</num><content> a description of the adequacy of health care and other services, supports, and assistance that individuals with developmental disabilities served through home and community-based waivers (authorized under section 1915(c) of the Social Security Act (<ref href="/us/usc/t42/s1396n/c">42 U.S.C. 1396n(c)</ref>) receive;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106280-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/G"><num value="G">(G)</num><content> an accounting of the manner in which funds paid to the State under this part for a fiscal year were expended;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106281-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/H"><num value="H">(H)</num><chapeau> a description of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd9106282-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/H/i"><num value="i">(i)</num><content> resources made available to carry out activities to assist individuals with developmental disabilities that are directly attributable to Council actions; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9106283-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/H/ii"><num value="ii">(ii)</num><content> resources made available for such activities that are undertaken by the Council in collaboration with other entities; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106284-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/7/I"><num value="I">(I)</num><content> a description of the method by which the Council will widely disseminate the annual report to affected constituencies and the general public and will assure that the report is available in accessible formats.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106285-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8"><num value="8" class="bold">(8)</num><heading class="bold"> Budget</heading><chapeau style="-uslm-lc:I12" class="indent1">Each Council shall prepare, approve, and implement a budget using amounts paid to the State under this part to fund and implement all programs, projects, and activities carried out under this part, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106286-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="idd9106287-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/A/i"><num value="i">(i)</num><content> conducting such hearings and forums as the Council may determine to be necessary to carry out the duties of the Council; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd9106288-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/A/ii"><num value="ii">(ii)</num><chapeau> as determined in Council policy—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="idd9106289-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/A/ii/I"><num value="I">(I)</num><content> reimbursing members of the Council for reasonable and necessary expenses (including expenses for child care and personal assistance services) for attending Council meetings and performing Council duties;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idd910628a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/A/ii/II"><num value="II">(II)</num><content> paying a stipend to a member of the Council, if such member is not employed or must forfeit wages from other employment, to attend Council meetings and perform other Council duties;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idd910628b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/A/ii/III"><num value="III">(III)</num><content> supporting Council member and staff travel to authorized training and technical assistance activities including in-service training and leadership development activities; and</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idd910628c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/A/ii/IV"><num value="IV">(IV)</num><content> carrying out appropriate subcontracting activities;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910628d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/B"><num value="B">(B)</num><content> hiring and maintaining such numbers and types of staff (qualified by training and experience) and obtaining the services of such professional, consulting, technical, and clerical staff (qualified by training and experience), consistent with State law, as the Council determines to be necessary to carry out the functions of the Council under this part, except that such State shall not apply hiring freezes, reductions in force, prohibitions on travel, or other policies to the staff of the Council, to the extent that such policies would impact the staff or functions funded with Federal funds, or would prevent the Council from carrying out the functions of the Council under this part; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910628e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/8/C"><num value="C">(C)</num><content> directing the expenditure of funds for grants, contracts, interagency agreements that are binding contracts, and other activities authorized by the State plan approved under <ref href="/us/usc/t42/s15024">section 15024 of this title</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd910628f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/9"><num value="9" class="bold">(9)</num><heading class="bold"> Staff hiring and supervision</heading><content><p style="-uslm-lc:I12" class="indent1">The Council shall, consistent with State law, recruit and hire a Director of the Council, should the position of Director become vacant, and supervise and annually evaluate the Director. The Director shall hire, supervise, and annually evaluate the staff of the Council. Council recruitment, hiring, and dismissal of staff shall be conducted in a manner consistent with Federal and State nondiscrimination laws. Dismissal of personnel shall be conducted in a manner consistent with State law and personnel policies.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106290-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/10"><num value="10" class="bold">(10)</num><heading class="bold"> Staff assignments</heading><content><p style="-uslm-lc:I12" class="indent1">The staff of the Council, while working for the Council, shall be responsible solely for assisting the Council in carrying out the duties of the Council under this part and shall not be assigned duties by the designated State agency or any other agency or entity of the State.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106291-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/c/11"><num value="11" class="bold">(11)</num><heading class="bold"> Construction</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subchapter shall be construed to authorize a Council to direct, control, or exercise any policymaking authority or administrative authority over any program assisted under the Rehabilitation Act of 1973 (<ref href="/us/usc/t29/s701">29 U.S.C. 701</ref> et seq.) or the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.).</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9106292-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d"><num value="d" class="bold">(d)</num><heading class="bold"> Designated State agency</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106293-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each State that receives assistance under this part shall designate a State agency that shall, on behalf of the State, provide support to the Council. After <date date="1994-04-06">April 6, 1994</date>, any designation of a State agency under this paragraph shall be made in accordance with the requirements of this subsection.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9106294-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Designation</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106295-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Type of agency</heading><chapeau style="-uslm-lc:I13" class="indent2">Except as provided in this subsection, the designated State agency shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd9106296-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/A/i"><num value="i">(i)</num><content> the Council if such Council may be the designated State agency under the laws of the State;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9106297-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/A/ii"><num value="ii">(ii)</num><content> a State agency that does not provide or pay for services for individuals with developmental disabilities; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9106298-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/A/iii"><num value="iii">(iii)</num><content> a State office, including the immediate office of the Governor of the State or a State planning office.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd9106299-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Conditions for continuation of State service agency designation</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd910629a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> Designation before <date date="1994-04-06">April 6, 1994</date></heading><content><p style="-uslm-lc:I14" class="indent3">If a State agency that provides or pays for services for individuals with developmental disabilities was a designated State agency for purposes of part B of the Developmental Disabilities Assistance and Bill of Rights Act on <date date="1994-04-06">April 6, 1994</date>, and the Governor of the State (or the legislature, where appropriate and in accordance with State law) determines prior to <date date="1994-06-30">June 30, 1994</date>, not to change the designation of such agency, such agency may continue to be a designated State agency for purposes of this part.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd910629b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Criteria for continued designation</heading><chapeau style="-uslm-lc:I14" class="indent3">The determination, at the discretion of the Governor (or the legislature, as the case may be), shall be made after—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd910629c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/B/ii/I"><num value="I">(I)</num><content> the Governor has considered the comments and recommendations of the general public and a majority of the non-State agency members of the Council with respect to the designation of such State agency; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd910629d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/B/ii/II"><num value="II">(II)</num><content> the Governor (or the legislature, as the case may be) has made an independent assessment that the designation of such agency will not interfere with the budget, personnel, priorities, or other action of the Council, and the ability of the Council to serve as an independent advocate for individuals with developmental disabilities.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910629e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Review of designation</heading><content><p style="-uslm-lc:I13" class="indent2">The Council may request a review of and change in the designation of the designated State agency by the Governor (or the legislature, as the case may be). The Council shall provide documentation concerning the reason the Council desires a change to be made and make a recommendation to the Governor (or the legislature, as the case may be) regarding a preferred designated State agency.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd910629f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Appeal of designation</heading><content><p style="-uslm-lc:I13" class="indent2">After the review is completed under subparagraph (C), a majority of the non-State agency members of the Council may appeal to the Secretary for a review of and change in the designation of the designated State agency if the ability of the Council to serve as an independent advocate is not assured because of the actions or inactions of the designated State agency.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd91062a0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Responsibilities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062a1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The designated State agency shall, on behalf of the State, have the responsibilities described in subparagraphs (B) through (G).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062a2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Support services</heading><content><p style="-uslm-lc:I13" class="indent2">The designated State agency shall provide required assurances and support services as requested by and negotiated with the Council.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062a3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Fiscal responsibilities</heading><chapeau style="-uslm-lc:I13" class="indent2">The designated State agency shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd91062a4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/C/i"><num value="i">(i)</num><content> receive, account for, and disburse funds under this part based on the State plan required in <ref href="/us/usc/t42/s15024">section 15024 of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd91062a5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/C/ii"><num value="ii">(ii)</num><content> provide for such fiscal control and fund accounting procedures as may be necessary to assure the proper disbursement of, and accounting for, funds paid to the State under this part.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062a6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Records, access, and financial reports</heading><content><p style="-uslm-lc:I13" class="indent2">The designated State agency shall keep and provide access to such records as the Secretary and the Council may determine to be necessary. The designated State agency, if other than the Council, shall provide timely financial reports at the request of the Council regarding the status of expenditures, obligations, and liquidation by the agency or the Council, and the use of the Federal and non-Federal shares described in <ref href="/us/usc/t42/s15026">section 15026 of this title</ref>, by the agency or the Council.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062a7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/E"><num value="E" class="bold">(E)</num><heading class="bold"> Non-Federal share</heading><content><p style="-uslm-lc:I13" class="indent2">The designated State agency, if other than the Council, shall provide the required non-Federal share described in <ref href="/us/usc/t42/s15026/c">section 15026(c) of this title</ref>.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062a8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/F"><num value="F" class="bold">(F)</num><heading class="bold"> Assurances</heading><content><p style="-uslm-lc:I13" class="indent2">The designated State agency shall assist the Council in obtaining the appropriate State plan assurances and in ensuring that the plan is consistent with State law.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062a9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/3/G"><num value="G" class="bold">(G)</num><heading class="bold"> Memorandum of understanding</heading><content><p style="-uslm-lc:I13" class="indent2">On the request of the Council, the designated State agency shall enter into a memorandum of understanding with the Council delineating the roles and responsibilities of the designated State agency.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd91062aa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Use of funds for designated State agency responsibilities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idd91062ab-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Condition for Federal funding</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idd91062ac-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15025/d/4/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The Secretary shall provide amounts to a State under <ref href="/us/usc/t42/s15024/c/5/B/vi">section 15024(c)(5)(B)(vi) of this title</ref> for a fiscal year only if the State expends an amount from State sources for carrying out the responsibilities of the designated State agency under paragraph (3) for the fiscal year that is not less than the total amount the State expended from such sources for carrying out similar responsibilities for the previous fiscal year.</p>
