L. 106–402, title I, § 127, Oct. 30, 2000, 114 Stat. 1711.)","seq_in_title":7263,"parent_identifier":"/us/usc/t42/ch144/schI/ptB","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch144","level":"chapter","num":"CHAPTER 144—","heading":"DEVELOPMENTAL DISABILITIES ASSISTANCE AND BILL OF RIGHTS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch144/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"PROGRAMS FOR INDIVIDUALS WITH DEVELOPMENTAL DISABILITIES","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch144/schI/ptB","level":"part","num":"Part B—","heading":"Federal Assistance to State Councils on Developmental Disabilities","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8fb5f2b5-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15027\"><num value=\"15027\">§ 15027.</num><heading> Withholding of payments for planning, administration, and services</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Whenever the Secretary, after providing reasonable notice and an opportunity for a hearing to the Council and the designated State agency, finds that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8fb5f2b6-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15027/1\"><num value=\"1\">(1)</num><content> the Council or agency has failed to comply substantially with any of the provisions required by <ref href=\"/us/usc/t42/s15024\">section 15024 of this title</ref> to be included in the State plan, particularly provisions required by paragraphs (4)(A) and (5)(B)(vii) of <ref href=\"/us/usc/t42/s15024/c\">section 15024(c) of this title</ref>, or with any of the provisions required by <ref href=\"/us/usc/t42/s15025/b/3\">section 15025(b)(3) of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8fb5f2b7-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15027/2\"><num value=\"2\">(2)</num><content> the Council or agency has failed to comply substantially with any regulations of the Secretary that are applicable to this part,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">the Secretary shall notify such Council and agency that the Secretary will not make further payments to the State under <ref href=\"/us/usc/t42/s15022\">section 15022 of this title</ref> (or, in the discretion of the Secretary, that further payments to the State under <ref href=\"/us/usc/t42/s15022\">section 15022 of this title</ref> for activities for which there is such failure), until the Secretary is satisfied that there will no longer be such failure. Until the Secretary is so satisfied, the Secretary shall make no further payments to the State under <ref href=\"/us/usc/t42/s15022\">section 15022 of this title</ref>, or shall limit further payments under <ref href=\"/us/usc/t42/s15022\">section 15022 of this title</ref> to such State to activities for which there is no such failure.</continuation>\n<sourceCredit id=\"id8fb619c8-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/106/402/tI/s127\">Pub.
