<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd91062ec-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043"><num value="15043">§ 15043.</num><heading> System required</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd91062ed-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a"><num value="a" class="bold">(a)</num><heading class="bold"> System required</heading><chapeau style="-uslm-lc:I11" class="indent0">In order for a State to receive an allotment under part B or this part—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd91062ee-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/1"><num value="1">(1)</num><content> the State shall have in effect a system to protect and advocate the rights of individuals with developmental disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd91062ef-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2"><num value="2">(2)</num><chapeau> such system shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062f0-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/A"><num value="A">(A)</num><chapeau> have the authority to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd91062f1-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/A/i"><num value="i">(i)</num><content> pursue legal, administrative, and other appropriate remedies or approaches to ensure the protection of, and advocacy for, the rights of such individuals within the State who are or who may be eligible for treatment, services, or habilitation, or who are being considered for a change in living arrangements, with particular attention to members of ethnic and racial minority groups; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd91062f2-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/A/ii"><num value="ii">(ii)</num><content> provide information on and referral to programs and services addressing the needs of individuals with developmental disabilities;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062f3-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/B"><num value="B">(B)</num><content> have the authority to investigate incidents of abuse and neglect of individuals with developmental disabilities if the incidents are reported to the system or if there is probable cause to believe that the incidents occurred;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062f4-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/C"><num value="C">(C)</num><content> on an annual basis, develop, submit to the Secretary, and take action with regard to goals (each of which is related to 1 or more areas of emphasis) and priorities, developed through data driven strategic planning, for the system’s activities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062f5-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/D"><num value="D">(D)</num><chapeau> on an annual basis, provide to the public, including individuals with developmental disabilities attributable to either physical impairment, mental impairment, or a combination of physical and mental impairment, and their representatives, and as appropriate, non-State agency representatives of the State Councils on Developmental Disabilities, and Centers, in the State, an opportunity to comment on—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd91062f6-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/D/i"><num value="i">(i)</num><content> the goals and priorities established by the system and the rationale for the establishment of such goals; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd91062f7-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/D/ii"><num value="ii">(ii)</num><content> the activities of the system, including the coordination of services with the entities carrying out advocacy programs under the Rehabilitation Act of 1973 (<ref href="/us/usc/t29/s701">29 U.S.C. 701</ref> et seq.), the Older Americans Act of 1965 (<ref href="/us/usc/t42/s3001">42 U.S.C. 3001</ref> et seq.), and the Protection and Advocacy for Mentally Ill Individuals Act of 1986 <ref class="footnoteRef" idref="fn004113">1</ref><note type="footnote" id="fn004113"><num>1</num> See References in Text note below.</note> (<ref href="/us/usc/t42/s10801">42 U.S.C. 10801</ref> et seq.), and with entities carrying out other related programs, including the parent training and information centers funded under the Individuals with Disabilities Education Act (<ref href="/us/usc/t20/s1400">20 U.S.C. 1400</ref> et seq.), and activities authorized under section 3003 or 3004 of title 29;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062f8-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/E"><num value="E">(E)</num><content> establish a grievance procedure for clients or prospective clients of the system to ensure that individuals with developmental disabilities have full access to services of the system;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062f9-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/F"><num value="F">(F)</num><content> not be administered by the State Council on Developmental Disabilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062fa-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/G"><num value="G">(G)</num><content> be independent of any agency that provides treatment, services, or habilitation to individuals with developmental disabilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062fb-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/H"><num value="H">(H)</num><content> have access at reasonable times to any individual with a developmental disability in a location in which services, supports, and other assistance are provided to such an individual, in order to carry out the purpose of this part;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd91062fc-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I"><num value="I">(I)</num><chapeau> have access to all records of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd91062fd-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/i"><num value="i">(i)</num><content> any individual with a developmental disability who is a client of the system if such individual, or the legal guardian, conservator, or other legal representative of such individual, has authorized the system to have such access;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd91062fe-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/ii"><num value="ii">(ii)</num><chapeau> any individual with a developmental disability, in a situation in which—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd91062ff-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/ii/I"><num value="I">(I)</num><content> the individual, by reason of such individual’s mental or physical condition, is unable to authorize the system to have such access;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106300-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/ii/II"><num value="II">(II)</num><content> the individual does not have a legal guardian, conservator, or other legal representative, or the legal guardian of the individual is the State; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106301-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/ii/III"><num value="III">(III)</num><content> a complaint has been received by the system about the individual with regard to the status or treatment of the individual or, as a result of monitoring or other activities, there is probable cause to believe that such individual has been subject to abuse or neglect; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9106302-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/iii"><num value="iii">(iii)</num><chapeau> any individual with a developmental disability, in a situation in which—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idd9106303-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/iii/I"><num value="I">(I)</num><content> the individual has a legal guardian, conservator, or other legal representative;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106304-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/iii/II"><num value="II">(II)</num><content> a complaint has been received by the system about the individual with regard to the status or treatment of the individual or, as a result of monitoring or other activities, there is probable cause to believe that such individual has been subject to abuse or neglect;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106305-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/iii/III"><num value="III">(III)</num><content> such representative has been contacted by such system, upon receipt of the name and address of such representative;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106306-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/iii/IV"><num value="IV">(IV)</num><content> such system has offered assistance to such representative to resolve the situation; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idd9106307-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/I/iii/V"><num value="V">(V)</num><content> such representative has failed or refused to act on behalf of the individual;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106308-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/J"><num value="J">(J)</num><clause style="-uslm-lc:I13" class="indent2" id="idd9106309-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/J/i"><num value="i">(i)</num><content> have access to the records of individuals described in subparagraphs (B) and (I), and other records that are relevant to conducting an investigation, under the circumstances described in those subparagraphs, not later than 3 business days after the system makes a written request for the records involved; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idd910630a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/J/ii"><num value="ii">(ii)</num><chapeau> have immediate access, not later than 24 hours after the system makes such a request, to the records without consent from another party, in a situation in which services, supports, and other assistance are provided to an individual with a developmental disability—</chapeau><subclause style="-uslm-lc:I14" class="indent3" id="idd910630b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/J/ii/I"><num value="I">(I)</num><content> if the system determines there is probable cause to believe that the health or safety of the individual is in serious and immediate jeopardy; or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="idd910630c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/J/ii/II"><num value="II">(II)</num><content> in any case of death of an individual with a developmental disability;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910630d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/K"><num value="K">(K)</num><content> hire and maintain sufficient numbers and types of staff (qualified by training and experience) to carry out such system’s functions, except that the State involved shall not apply hiring freezes, reductions in force, prohibitions on travel, or other policies to the staff of the system, to the extent that such policies would impact the staff or functions of the system funded with Federal funds or would prevent the system from carrying out the functions of the system under this part;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910630e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/L"><num value="L">(L)</num><content> have the authority to educate policymakers; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd910630f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/2/M"><num value="M">(M)</num><content> provide assurances to the Secretary that funds allotted to the State under <ref href="/us/usc/t42/s15042">section 15042 of this title</ref> will be used to supplement, and not supplant, the non-Federal funds that would otherwise be made available for the purposes for which the allotted funds are provided;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9106310-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/3"><num value="3">(3)</num><chapeau> to the extent that information is available, the State shall provide to the system—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106311-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/3/A"><num value="A">(A)</num><content> a copy of each independent review, pursuant to <ref href="/us/usc/t42/s1396a/a/30/C">section 1396a(a)(30)(C) of this title</ref>, of an Intermediate Care Facility (Mental Retardation) within the State, not later than 30 days after the availability of such a review; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106312-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/3/B"><num value="B">(B)</num><content> information about the adequacy of health care and other services, supports, and assistance that individuals with developmental disabilities who are served through home and community-based waivers (authorized under <ref href="/us/usc/t42/s1396n/c">section 1396n(c) of this title</ref>) receive; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9106313-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/4"><num value="4">(4)</num><chapeau> the agency implementing the system shall not be redesignated unless—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106314-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/4/A"><num value="A">(A)</num><content> there is good cause for the redesignation;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106315-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/4/B"><num value="B">(B)</num><content> the State has given the agency notice of the intention to make such redesignation, including notice regarding the good cause for such redesignation, and given the agency an opportunity to respond to the assertion that good cause has been shown;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106316-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/4/C"><num value="C">(C)</num><content> the State has given timely notice and an opportunity for public comment in an accessible format to individuals with developmental disabilities or their representatives; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9106317-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/a/4/D"><num value="D">(D)</num><content> the system has an opportunity to appeal the redesignation to the Secretary, on the basis that the redesignation was not for good cause.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9106318-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/b"><num value="b" class="bold">(b)</num><heading class="bold"> American Indian consortium</heading><content><p style="-uslm-lc:I11" class="indent0">Upon application to the Secretary, an American Indian consortium established to provide protection and advocacy services under this part, shall receive funding pursuant to <ref href="/us/usc/t42/s15042/a/6">section 15042(a)(6) of this title</ref> to provide the services. Such consortium shall be considered to be a system for purposes of this part and shall coordinate the services with other systems serving the same geographic area. The tribal council that designates the consortium shall carry out the responsibilities and exercise the authorities specified for a State in this part, with regard to the consortium.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9106319-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/c"><num value="c" class="bold">(c)</num><heading class="bold"> Record</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section, the term “record” includes—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd910631a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/c/1"><num value="1">(1)</num><content> a report prepared or received by any staff at any location at which services, supports, or other assistance is provided to individuals with developmental disabilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd910631b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/c/2"><num value="2">(2)</num><content> a report prepared by an agency or staff person charged with investigating reports of incidents of abuse or neglect, injury, or death occurring at such location, that describes such incidents and the steps taken to investigate such incidents; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd910631c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s15043/c/3"><num value="3">(3)</num><content> a discharge planning record.</content>
