<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad6dbe92-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044"><num value="15044">§ 15044.</num><heading> Administration</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6dbe93-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a"><num value="a" class="bold">(a)</num><heading class="bold"> Governing board</heading><chapeau style="-uslm-lc:I11" class="indent0">In a State in which the system described in <ref href="/us/usc/t42/s15043">section 15043 of this title</ref> is organized as a private nonprofit entity with a multimember governing board, or a public system with a multimember governing board, such governing board shall be selected according to the policies and procedures of the system, except that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad6dbe94-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="idad6dbe95-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/1/A"><num value="A">(A)</num><content> the governing board shall be composed of members who broadly represent or are knowledgeable about the needs of the individuals served by the system;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idad6dbe96-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/1/B"><num value="B">(B)</num><chapeau> a majority of the members of the board shall be—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idad6dbe97-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/1/B/i"><num value="i">(i)</num><content> individuals with disabilities, including individuals with developmental disabilities, who are eligible for services, or have received or are receiving services through the system; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idad6dbe98-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/1/B/ii"><num value="ii">(ii)</num><content> parents, family members, guardians, advocates, or authorized representatives of individuals referred to in clause (i); and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idad6de5a9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/1/C"><num value="C">(C)</num><content> the board may include a representative of the State Council on Developmental Disabilities, the Centers in the State, and the self-advocacy organization described in <ref href="/us/usc/t42/s15024/c/4/A/ii/I">section 15024(c)(4)(A)(ii)(I) of this title</ref>;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad6de5aa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/2"><num value="2">(2)</num><content> not more than ⅓ of the members of the governing board may be appointed by the chief executive officer of the State involved, in the case of any State in which such officer has the authority to appoint members of the board;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad6de5ab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/3"><num value="3">(3)</num><content> the membership of the governing board shall be subject to term limits set by the system to ensure rotating membership;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad6de5ac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/4"><num value="4">(4)</num><content> any vacancy in the board shall be filled not later than 60 days after the date on which the vacancy occurs; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad6de5ad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/5"><num value="5">(5)</num><chapeau> in a State in which the system is organized as a public system without a multimember governing or advisory board, the system shall establish an advisory council—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad6de5ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/5/A"><num value="A">(A)</num><content> that shall advise the system on policies and priorities to be carried out in protecting and advocating the rights of individuals with developmental disabilities; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad6de5af-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/5/B"><num value="B">(B)</num><chapeau> on which a majority of the members shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad6de5b0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/5/B/i"><num value="i">(i)</num><content> individuals with developmental disabilities who are eligible for services, or have received or are receiving services, through the system; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad6de5b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/a/5/B/ii"><num value="ii">(ii)</num><content> parents, family members, guardians, advocates, or authorized representatives of individuals referred to in clause (i).</content>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6de5b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/b"><num value="b" class="bold">(b)</num><heading class="bold"> Legal action</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6de5b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subchapter shall preclude a system from bringing a suit on behalf of individuals with developmental disabilities against a State, or an agency or instrumentality of a State.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6de5b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use of amounts from judgment</heading><content><p style="-uslm-lc:I12" class="indent1">An amount received pursuant to a suit described in paragraph (1) through a court judgment may only be used by the system to further the purpose of this part and shall not be used to augment payments to legal contractors or to award personal bonuses.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad6de5b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I12" class="indent1">The system shall use assistance provided under this part in a manner consistent with <ref href="/us/usc/t42/s14404">section 14404 of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6de5b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/c"><num value="c" class="bold">(c)</num><heading class="bold"> Disclosure of information</heading><content><p style="-uslm-lc:I11" class="indent0">For purposes of any periodic audit, report, or evaluation required under this part, the Secretary shall not require an entity carrying out a program to disclose the identity of, or any other personally identifiable information related to, any individual requesting assistance under such program.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6de5b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/d"><num value="d" class="bold">(d)</num><heading class="bold"> Public notice of Federal onsite review</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall provide advance public notice of any Federal programmatic or administrative onsite review of a system conducted under this part and solicit public comment on the system through such notice. The Secretary shall prepare an onsite visit report containing the results of such review, which shall be distributed to the Governor of the State and to other interested public and private parties. The comments received in response to the public comment solicitation notice shall be included in the onsite visit report.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad6de5b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s15044/e"><num value="e" class="bold">(e)</num><heading class="bold"> Reports</heading><content><p style="-uslm-lc:I11" class="indent0">Beginning in fiscal year 2002, each system established in a State pursuant to this part shall annually prepare and transmit to the Secretary a report that describes the activities, accomplishments, and expenditures of the system during the preceding fiscal year, including a description of the system’s goals, the extent to which the goals were achieved, barriers to their achievement, the process used to obtain public input, the nature of such input, and how such input was used.</p>
