L. 106–402, title III, § 301, Oct. 30, 2000, 114 Stat. 1734.)","seq_in_title":7291,"parent_identifier":"/us/usc/t42/ch144/schIII","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch144","level":"chapter","num":"CHAPTER 144—","heading":"DEVELOPMENTAL DISABILITIES ASSISTANCE AND BILL OF RIGHTS","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch144/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"PROGRAM FOR DIRECT SUPPORT WORKERS WHO ASSIST INDIVIDUALS WITH DEVELOPMENTAL DISABILITIES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id8fb8d96e-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111\"><num value=\"15111\">§ 15111.</num><heading> Findings</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Congress finds that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8fb8d96f-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111/1\"><num value=\"1\">(1)</num><content> direct support workers, especially young adults, have played essential roles in providing the support needed by individuals with developmental disabilities and expanding community options for those individuals;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8fb8d970-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111/2\"><num value=\"2\">(2)</num><chapeau> 4 factors have contributed to a decrease in the available pool of direct support workers, specifically—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8fb8d971-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111/2/A\"><num value=\"A\">(A)</num><content> the small population of individuals who are age 18 through 25, an age group that has been attracted to direct support work in the past;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8fb8d972-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111/2/B\"><num value=\"B\">(B)</num><content> the rapid expansion of the service sector, which attracts individuals who previously would have elected to pursue employment as direct support workers;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8fb8d973-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111/2/C\"><num value=\"C\">(C)</num><content> the failure of wages in the human services sector to keep pace with wages in other service sectors; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id8fb8d974-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111/2/D\"><num value=\"D\">(D)</num><content> the lack of quality training and career advancement opportunities available to direct support workers; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id8fb8d975-86fb-11e9-b915-8b3e54686b9f\" identifier=\"/us/usc/t42/s15111/3\"><num value=\"3\">(3)</num><content> individuals with developmental disabilities benefit from assistance from direct support workers who are well trained, and benefit from receiving services from professionals who have spent time as direct support workers.</content>\n</paragraph>\n<sourceCredit id=\"id8fb8d976-86fb-11e9-b915-8b3e54686b9f\">(<ref href=\"/us/pl/106/402/tIII/s301\">Pub.
