L. 109–162, title XI, § 1112, Jan. 5, 2006, 119 Stat. 3103.)","seq_in_title":7297,"parent_identifier":"/us/usc/t42/ch145","ancestors":[{"identifier":"/us/usc/t42","level":"title","num":"Title 42—","heading":"THE PUBLIC HEALTH AND WELFARE","status":null,"is_section":false},{"identifier":"/us/usc/t42/ch145","level":"chapter","num":"CHAPTER 145—","heading":"PUBLIC SAFETY OFFICER MEDAL OF VALOR AND TRIBUTES","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad7008ff-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202\"><num value=\"15202\">§ 15202.</num><heading> Medal of Valor Board</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad700900-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Establishment of Board</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">There is established a Medal of Valor Review Board (hereinafter in this chapter referred to as the “Board”), which shall be composed of 11 members appointed in accordance with subsection (b) and shall conduct its business in accordance with this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad700901-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Membership</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad700902-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Members</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The members of the Board shall be individuals with knowledge or expertise, whether by experience or training, in the field of public safety, of which—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad700903-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/1/A\"><num value=\"A\">(A)</num><content> two shall be appointed by the majority leader of the Senate;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad703014-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/1/B\"><num value=\"B\">(B)</num><content> two shall be appointed by the minority leader of the Senate;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad703015-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/1/C\"><num value=\"C\">(C)</num><content> two shall be appointed by the Speaker of the House of Representatives;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad703016-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/1/D\"><num value=\"D\">(D)</num><content> two shall be appointed by the minority leader of the House of Representatives; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad703017-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/1/E\"><num value=\"E\">(E)</num><content> three shall be appointed by the President, including one with experience in firefighting, one with experience in law enforcement, and one with experience in emergency services.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad703018-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Term</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term of a Board member shall be 4 years.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad703019-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Vacancies</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any vacancy in the membership of the Board shall not affect the powers of the Board and shall be filled in the same manner as the original appointment.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad70301a-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Operation of the Board</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad70301b-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/4/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Chairman</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Chairman of the Board shall be elected by the members of the Board from among the members of the Board.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad70301c-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/4/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Meetings</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Board shall conduct its first meeting not later than 90 days after the appointment of the last member appointed of the initial group of members appointed to the Board. Thereafter, the Board shall meet at the call of the Chairman of the Board. The Board shall meet not less often than twice each year.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"idad70301d-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/b/4/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Voting and rules</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">A majority of the members shall constitute a quorum to conduct business, but the Board may establish a lesser quorum for conducting hearings scheduled by the Board. The Board may establish by majority vote any other rules for the conduct of the Board’s business, if such rules are not inconsistent with this chapter or other applicable law.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad70301e-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Duties</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Board shall select candidates as recipients of the Medal of Valor from among those applications received by the National Medal of Valor Office. Not more often than once each year, the Board shall present to the Attorney General the name or names of those it recommends as Medal of Valor recipients. In a given year, the Board shall not be required to select any recipients but may not select more than 5 individuals, or groups of individuals, as recipients. The Attorney General may in extraordinary cases increase the number of recipients in a given year. The Board shall set an annual timetable for fulfilling its duties under this chapter.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad70301f-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Hearings</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad703020-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Board may hold such hearings, sit and act at such times and places, administer such oaths, take such testimony, and receive such evidence as the Board considers advisable to carry out its duties.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"idad703021-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Witness expenses</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Witnesses requested to appear before the Board may be paid the same fees as are paid to witnesses under <ref href=\"/us/usc/t28/s1821\">section 1821 of title 28</ref>. The per diem and mileage allowances for witnesses shall be paid from funds appropriated to the Board.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad703022-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Information from Federal agencies</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Board may secure directly from any Federal department or agency such information as the Board considers necessary to carry out its duties. Upon the request of the Board, the head of such department or agency may furnish such information to the Board.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"idad703023-09a0-11eb-a85b-f5cef3d06f4d\" identifier=\"/us/usc/t42/s15202/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Information to be kept confidential</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Board shall not disclose any information which may compromise an ongoing law enforcement investigation or is otherwise required by law to be kept confidential.</p>\n</content>\n</subsection>\n<sourceCredit id=\"idad703024-09a0-11eb-a85b-f5cef3d06f4d\">(<ref href=\"/us/pl/107/12/s3\">Pub.
