<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad7f2491-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154"><num value="16154">§ 16154.</num><heading> Programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad7f2492-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary, in consultation with other Federal agencies and the private sector, shall conduct a research and development program on technologies relating to the production, purification, distribution, storage, and use of hydrogen energy, fuel cells, and related infrastructure.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad7f2493-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/b"><num value="b" class="bold">(b)</num><heading class="bold"> Goal</heading><content><p style="-uslm-lc:I11" class="indent0">The goal of the program shall be to demonstrate and commercialize the use of hydrogen for transportation (in light-duty vehicles and heavy-duty vehicles), utility, industrial, commercial, and residential applications.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad7f2494-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/c"><num value="c" class="bold">(c)</num><heading class="bold"> Focus</heading><chapeau style="-uslm-lc:I11" class="indent0">In carrying out activities under this section, the Secretary shall focus on factors that are common to the development of hydrogen infrastructure and the supply of vehicle and electric power for critical consumer and commercial applications, and that achieve continuous technical evolution and cost reduction, particularly for hydrogen production, the supply of hydrogen, storage of hydrogen, and end uses of hydrogen that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4ba5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/c/1"><num value="1">(1)</num><content> steadily increase production, distribution, and end use efficiency and reduce life-cycle emissions;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4ba6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/c/2"><num value="2">(2)</num><content> resolve critical problems relating to catalysts, membranes, storage, lightweight materials, electronic controls, manufacturability, and other problems that emerge from the program;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4ba7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/c/3"><num value="3">(3)</num><content> enhance sources of renewable fuels and biofuels for hydrogen production; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4ba8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/c/4"><num value="4">(4)</num><content> enable widespread use of distributed electricity generation and storage.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad7f4ba9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/d"><num value="d" class="bold">(d)</num><heading class="bold"> Public education and research</heading><content><p style="-uslm-lc:I11" class="indent0">In carrying out this section, the Secretary shall support enhanced public education and research conducted at institutions of higher education in fundamental sciences, application design, and systems concepts (including education and research relating to materials, subsystems, manufacturability, maintenance, and safety) relating to hydrogen and fuel cells.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad7f4baa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e"><num value="e" class="bold">(e)</num><heading class="bold"> Activities</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary, in partnership with the private sector, shall conduct programs to address—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4bab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/1"><num value="1">(1)</num><chapeau> production of hydrogen from diverse energy sources, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/1/A"><num value="A">(A)</num><content> fossil fuels, which may include carbon capture and sequestration;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/1/B"><num value="B">(B)</num><content> hydrogen-carrier fuels (including ethanol and methanol);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/1/C"><num value="C">(C)</num><content> renewable energy resources, including biomass; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4baf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/1/D"><num value="D">(D)</num><content> nuclear energy;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4bb0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/2"><num value="2">(2)</num><content> use of hydrogen for commercial, industrial, and residential electric power generation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4bb1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/3"><num value="3">(3)</num><chapeau> safe delivery of hydrogen or hydrogen-carrier fuels, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bb2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/3/A"><num value="A">(A)</num><content> transmission by pipeline and other distribution methods; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bb3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/3/B"><num value="B">(B)</num><content> convenient and economic refueling of vehicles either at central refueling stations or through distributed onsite generation;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4bb4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/4"><num value="4">(4)</num><chapeau> advanced vehicle technologies, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bb5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/4/A"><num value="A">(A)</num><content> engine and emission control systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bb6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/4/B"><num value="B">(B)</num><content> energy storage, electric propulsion, and hybrid systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bb7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/4/C"><num value="C">(C)</num><content> automotive materials; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bb8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/4/D"><num value="D">(D)</num><content> other advanced vehicle technologies;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4bb9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/5"><num value="5">(5)</num><content> storage of hydrogen or hydrogen-carrier fuels, including development of materials for safe and economic storage in gaseous, liquid, or solid form at refueling facilities and onboard vehicles;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4bba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/6"><num value="6">(6)</num><content> development of safe, durable, affordable, and efficient fuel cells, including fuel-flexible fuel cell power systems, improved manufacturing processes, high-temperature membranes, cost-effective fuel processing for natural gas, fuel cell stack and system reliability, low temperature operation, and cold start capability; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad7f4bbb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/e/7"><num value="7">(7)</num><content> the ability of domestic automobile manufacturers to manufacture commercially available competitive hybrid vehicle technologies in the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad7f4bbc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f"><num value="f" class="bold">(f)</num><heading class="bold"> Program goals</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad7f4bbd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Vehicles</heading><chapeau style="-uslm-lc:I12" class="indent1">For vehicles, the goals of the program are—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bbe-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/1/A"><num value="A">(A)</num><content> to enable a commitment by automakers no later than year 2015 to offer safe, affordable, and technically viable hydrogen fuel cell vehicles in the mass consumer market; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bbf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/1/B"><num value="B">(B)</num><chapeau> to enable production, delivery, and acceptance by consumers of model year 2020 hydrogen fuel cell and other hydrogen-powered vehicles that will have, when compared to light duty vehicles in model year 2005—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad7f4bc0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/1/B/i"><num value="i">(i)</num><content> fuel economy that is substantially higher;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad7f4bc1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/1/B/ii"><num value="ii">(ii)</num><content> substantially lower emissions of air pollutants; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad7f4bc2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/1/B/iii"><num value="iii">(iii)</num><content> equivalent or improved vehicle fuel system crash integrity and occupant protection.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad7f4bc3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Hydrogen energy and energy infrastructure</heading><chapeau style="-uslm-lc:I12" class="indent1">For hydrogen energy and energy infrastructure, the goals of the program are to enable a commitment not later than 2015 that will lead to infrastructure by 2020 that will provide—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bc4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/A"><num value="A">(A)</num><content> safe and convenient refueling;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bc5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/B"><num value="B">(B)</num><content> improved overall efficiency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f4bc6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/C"><num value="C">(C)</num><chapeau> widespread availability of hydrogen from domestic energy sources through—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad7f4bc7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/C/i"><num value="i">(i)</num><content> production, with consideration of emissions levels;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad7f71d8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/C/ii"><num value="ii">(ii)</num><content> delivery, including transmission by pipeline and other distribution methods for hydrogen; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad7f71d9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/C/iii"><num value="iii">(iii)</num><content> storage, including storage in surface transportation vehicles;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f71da-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/D"><num value="D">(D)</num><content> hydrogen for fuel cells, internal combustion engines, and other energy conversion devices for portable, stationary, micro, critical needs facilities, and transportation applications; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f71db-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/2/E"><num value="E">(E)</num><content> other technologies consistent with the Department’s plan.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad7f71dc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Fuel cells</heading><chapeau style="-uslm-lc:I12" class="indent1">The goals for fuel cells and their portable, stationary, and transportation applications are to enable—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad7f71dd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/f/3/A"><num value="A">(A)</num><content> safe, economical, and environmentally sound hydrogen fuel cells;</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad7f71e0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/g"><num value="g" class="bold">(g)</num><heading class="bold"> Funding</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad7f71e1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16154/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall carry out the programs under this section using a competitive, merit-based review process and consistent with the generally applicable Federal laws and regulations governing awards of financial assistance, contracts, or other agreements.</p>
