<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad80f8a9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193"><num value="16193">§ 16193.</num><heading> National Building Performance Initiative</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad80f8aa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/a"><num value="a" class="bold">(a)</num><heading class="bold"> Interagency group</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad80f8ab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 90 days after <date date="2005-08-08">August 8, 2005</date>, the Director of the Office of Science and Technology Policy shall establish an interagency group to develop, in coordination with the advisory committee established under subsection (e), a National Building Performance Initiative (referred to in this section as the “Initiative”).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad80f8ac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Cochairs</heading><content><p style="-uslm-lc:I12" class="indent1">The interagency group shall be co-chaired by appropriate officials of the Department and the Department of Commerce, who shall jointly arrange for the provision of necessary administrative support to the group.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad80f8ad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/b"><num value="b" class="bold">(b)</num><heading class="bold"> Integration of efforts</heading><content><p style="-uslm-lc:I11" class="indent0">The Initiative shall integrate Federal, State, and voluntary private sector efforts to reduce the costs of construction, operation, maintenance, and renovation of commercial, industrial, institutional, and residential buildings.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad80f8ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/c"><num value="c" class="bold">(c)</num><heading class="bold"> Plan</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad80f8af-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 1 year after <date date="2005-08-08">August 8, 2005</date>, the interagency group shall submit to Congress a plan for carrying out the appropriate Federal role in the Initiative.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad80f8b0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Inclusions</heading><chapeau style="-uslm-lc:I12" class="indent1">The plan shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad80f8b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/c/2/A"><num value="A">(A)</num><content> research, development, demonstration, and commercial application of energy technology systems and materials for new construction and retrofit relating to the building envelope and building system components;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad80f8b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/c/2/B"><num value="B">(B)</num><content> research, development, demonstration, and commercial application of energy technology and infrastructure enabling the energy efficient, automated operation of buildings and building equipment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad80f8b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/c/2/C"><num value="C">(C)</num><content> the collection, analysis, and dissemination of research results and other pertinent information on enhancing building performance to industry, government entities, and the public.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad80f8b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/d"><num value="d" class="bold">(d)</num><heading class="bold"> Department of Energy role</heading><content><p style="-uslm-lc:I11" class="indent0">Within the Federal portion of the Initiative, the Department shall be the lead agency for all aspects of building performance related to use and conservation of energy.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad80f8b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/e"><num value="e" class="bold">(e)</num><heading class="bold"> Advisory committee</heading><chapeau style="-uslm-lc:I11" class="indent0">The Director of the Office of Science and Technology Policy shall establish an advisory committee to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad80f8b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/e/1"><num value="1">(1)</num><content> analyze and provide recommendations on potential private sector roles and participation in the Initiative; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad80f8b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/e/2"><num value="2">(2)</num><content> review and provide recommendations on the plan described in subsection (c).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad811fc8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16193/f"><num value="f" class="bold">(f)</num><heading class="bold"> Administration</heading><content><p style="-uslm-lc:I11" class="indent0">Nothing in this section provides any Federal agency with new authority to regulate building performance.</p>
