<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad811fca-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16194"><num value="16194">§ 16194.</num><heading> Building standards</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad811fcb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16194/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definition of high performance building</heading><content><p style="-uslm-lc:I11" class="indent0">In this section, the term “high performance building” means a building that integrates and optimizes all major high-performance building attributes, including energy efficiency, durability, life-cycle performance, and occupant productivity.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad811fcc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16194/b"><num value="b" class="bold">(b)</num><heading class="bold"> Assessment</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 120 days after <date date="2005-08-08">August 8, 2005</date>, the Secretary shall enter into an agreement with the National Institute of Building Sciences to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad811fcd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16194/b/1"><num value="1">(1)</num><content> conduct an assessment (in cooperation with industry, standards development organizations, and other entities, as appropriate) of whether the current voluntary consensus standards and rating systems for high performance buildings are consistent with the current technological state of the art, including relevant results from the research, development and demonstration activities of the Department;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad811fce-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16194/b/2"><num value="2">(2)</num><content> determine if additional research is required, based on the findings of the assessment; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idad811fcf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16194/b/3"><num value="3">(3)</num><content> recommend steps for the Secretary to accelerate the development of voluntary consensus-based standards for high performance buildings that are based on the findings of the assessment.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad811fd0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16194/c"><num value="c" class="bold">(c)</num><heading class="bold"> Grant and technical assistance program</heading><content><p style="-uslm-lc:I11" class="indent0">Consistent with subsection (b) and section 12(d) of the National Technology Transfer and Advancement Act of 1995 (<ref href="/us/usc/t15/s272">15 U.S.C. 272</ref> note), the Secretary shall establish a grant and technical assistance program to support the development of voluntary consensus-based standards for high performance buildings.</p>
