<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad81bc86-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215"><num value="16215">§ 16215.</num><heading> Electric transmission and distribution programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad81bc87-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a"><num value="a" class="bold">(a)</num><heading class="bold"> Program</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall establish a comprehensive research, development, and demonstration program to ensure the reliability, efficiency, and environmental integrity of electrical transmission and distribution systems, which shall include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad81bc88-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/1"><num value="1">(1)</num><content> advanced energy delivery technologies, energy storage technologies, materials, and systems, giving priority to new transmission technologies, including composite conductor materials and other technologies that enhance reliability, operational flexibility, or power-carrying capability;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e399-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/2"><num value="2">(2)</num><content> advanced grid reliability and efficiency technology development;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e39a-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/3"><num value="3">(3)</num><content> technologies contributing to significant load reductions;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e39b-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/4"><num value="4">(4)</num><content> advanced metering, load management, and control technologies;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e39c-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/5"><num value="5">(5)</num><content> technologies to enhance existing grid components;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e39d-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/6"><num value="6">(6)</num><chapeau> the development and use of high-temperature superconductors to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e39e-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/6/A"><num value="A">(A)</num><content> enhance the reliability, operational flexibility, or power-carrying capability of electric transmission or distribution systems; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e39f-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/6/B"><num value="B">(B)</num><content> increase the efficiency of electric energy generation, transmission, distribution, or storage systems;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e3a0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/7"><num value="7">(7)</num><content> integration of power systems, including systems to deliver high-quality electric power, electric power reliability, and combined heat and power;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e3a1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/8"><num value="8">(8)</num><content> supply of electricity to the power grid by small scale, distributed and residential-based power generators;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e3a2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/9"><num value="9">(9)</num><content> the development and use of advanced grid design, operation, and planning tools;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e3a3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/10"><num value="10">(10)</num><content> any other infrastructure technologies, as appropriate; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e3a4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/a/11"><num value="11">(11)</num><content> technology transfer and education.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad81e3a5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b"><num value="b" class="bold">(b)</num><heading class="bold"> Program plan</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad81e3a6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 1 year after <date date="2005-08-08">August 8, 2005</date>, the Secretary, in consultation with other appropriate Federal agencies, shall prepare and submit to Congress a 5-year program plan to guide activities under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad81e3a7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Consultation</heading><chapeau style="-uslm-lc:I12" class="indent1">In preparing the program plan, the Secretary shall consult with—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3a8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/A"><num value="A">(A)</num><content> utilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3a9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/B"><num value="B">(B)</num><content> energy service providers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3aa-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/C"><num value="C">(C)</num><content> manufacturers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3ab-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/D"><num value="D">(D)</num><content> institutions of higher education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3ac-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/E"><num value="E">(E)</num><content> other appropriate State and local agencies;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3ad-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/F"><num value="F">(F)</num><content> environmental organizations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3ae-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/G"><num value="G">(G)</num><content> professional and technical societies; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3af-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/b/2/H"><num value="H">(H)</num><content> any other persons the Secretary considers appropriate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad81e3b0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/c"><num value="c" class="bold">(c)</num><heading class="bold"> Implementation</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall consider implementing the program under this section using a consortium of participants from industry, institutions of higher education, and National Laboratories.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad81e3b1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/d"><num value="d" class="bold">(d)</num><heading class="bold"> Report</heading><chapeau style="-uslm-lc:I11" class="indent0">Not later than 2 years after the submission of the plan under subsection (b), the Secretary shall submit to Congress a report—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad81e3b2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/d/1"><num value="1">(1)</num><content> describing the progress made under this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad81e3b3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/d/2"><num value="2">(2)</num><content> identifying any additional resources needed to continue the development and commercial application of transmission and distribution of infrastructure technologies.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad81e3b4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e"><num value="e" class="bold">(e)</num><heading class="bold"> Power delivery research initiative</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad81e3b5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish a research, development, and demonstration initiative specifically focused on power delivery using components incorporating high temperature superconductivity.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad81e3b6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Goals</heading><chapeau style="-uslm-lc:I12" class="indent1">The goals of the Initiative shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3b7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/2/A"><num value="A">(A)</num><content> to establish world-class facilities to develop high temperature superconductivity power applications in partnership with manufacturers and utilities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3b8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/2/B"><num value="B">(B)</num><content> to provide technical leadership for establishing reliability for high temperature superconductivity power applications, including suitable modeling and analysis;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3b9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/2/C"><num value="C">(C)</num><content> to facilitate the commercial transition toward direct current power transmission, storage, and use for high power systems using high temperature superconductivity; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3ba-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/2/D"><num value="D">(D)</num><content> to facilitate the integration of very low impedance high temperature superconducting wires and cables in existing electric networks to improve system performance, power flow control, and reliability.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad81e3bb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Inclusions</heading><chapeau style="-uslm-lc:I12" class="indent1">The Initiative shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3bc-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/3/A"><num value="A">(A)</num><content> feasibility analysis, planning, research, and design to construct demonstrations of superconducting links in high power, direct current, and controllable alternating current transmission systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad81e3bd-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/3/B"><num value="B">(B)</num><content> public-private partnerships to demonstrate deployment of high temperature superconducting cable into testbeds simulating a realistic transmission grid and under varying transmission conditions, including actual grid insertions; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad820ace-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/3/C"><num value="C">(C)</num><chapeau> testbeds developed in cooperation with National Laboratories, industries, and institutions of higher education to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idad820acf-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/3/C/i"><num value="i">(i)</num><content> demonstrate those technologies;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad820ad0-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/3/C/ii"><num value="ii">(ii)</num><content> prepare the technologies for commercial introduction; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idad820ad1-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/e/3/C/iii"><num value="iii">(iii)</num><content> address cost or performance roadblocks to successful commercial use.</content>
</clause>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad820ad2-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f"><num value="f" class="bold">(f)</num><heading class="bold"> Transmission and distribution grid planning and operations initiative</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad820ad3-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall establish a research, development, and demonstration initiative specifically focused on tools needed to plan, operate, and expand the transmission and distribution grids in the presence of competitive market mechanisms for energy, load demand, customer response, and ancillary services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idad820ad4-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Goals</heading><chapeau style="-uslm-lc:I12" class="indent1">The goals of the Initiative shall be—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idad820ad5-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/2/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="idad820ad6-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/2/A/i"><num value="i">(i)</num><content> to develop and use a geographically distributed center, consisting of institutions of higher education, and National Laboratories, with expertise and facilities to develop the underlying theory and software for power system application; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idad820ad7-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/2/A/ii"><num value="ii">(ii)</num><content> to ensure commercial development in partnership with software vendors and utilities;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad820ad8-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/2/B"><num value="B">(B)</num><content> to provide technical leadership in engineering and economic analysis for the reliability and efficiency of power systems planning and operations in the presence of competitive markets for electricity;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad820ad9-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/2/C"><num value="C">(C)</num><content> to model, simulate, and experiment with new market mechanisms and operating practices to understand and optimize those new methods before actual use; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idad820ada-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/f/2/D"><num value="D">(D)</num><content> to provide technical support and technology transfer to electric utilities and other participants in the domestic electric industry and marketplace.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idad820adb-09a0-11eb-a85b-f5cef3d06f4d" identifier="/us/usc/t42/s16215/g"><num value="g" class="bold">(g)</num><heading class="bold"> High-voltage transmission lines</heading><content><p style="-uslm-lc:I11" class="indent0">As part of the program described in subsection (a), the Secretary shall award a grant to a university research program to design and test, in consultation with the Tennessee Valley Authority, state-of-the-art optimization techniques for power flow through existing high voltage transmission lines.</p>
