<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd9237732-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232"><num value="16232">§ 16232.</num><heading> Bioenergy program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9237733-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd9237734-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Biomass</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “biomass” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd9237735-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a/1/A"><num value="A">(A)</num><content> any organic material grown for the purpose of being converted to energy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9237736-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a/1/B"><num value="B">(B)</num><content> any organic byproduct of agriculture (including wastes from food production and processing) that can be converted into energy; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd9237737-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a/1/C"><num value="C">(C)</num><chapeau> any waste material that can be converted to energy, is segregated from other waste materials, and is derived from—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd9237738-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a/1/C/i"><num value="i">(i)</num><content> any of the following forest-related resources: mill residues, precommercial thinnings, slash, brush, or otherwise nonmerchantable material; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd9237739-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a/1/C/ii"><num value="ii">(ii)</num><content> wood waste materials, including waste pallets, crates, dunnage, manufacturing and construction wood wastes (other than pressure-treated, chemically-treated, or painted wood wastes), and landscape or right-of-way tree trimmings, but not including municipal solid waste, gas derived from the biodegradation of municipal solid waste, or paper that is commonly recycled.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd923773a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Lignocellulosic feedstock</heading><content><p style="-uslm-lc:I12" class="indent1">The term “lignocellulosic feedstock” means any portion of a plant or coproduct from conversion, including crops, trees, forest residues, and agricultural residues not specifically grown for food, including from barley grain, grapeseed, rice bran, rice hulls, rice straw, soybean matter, and sugarcane bagasse.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd923773b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/b"><num value="b" class="bold">(b)</num><heading class="bold"> Program</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall conduct a program of research, development, demonstration, and commercial application for bioenergy, including—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd923773c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/b/1"><num value="1">(1)</num><content> biopower energy systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd923773d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/b/2"><num value="2">(2)</num><content> biofuels;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd923773e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/b/3"><num value="3">(3)</num><content> bioproducts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd923773f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/b/4"><num value="4">(4)</num><content> integrated biorefineries that may produce biopower, biofuels, and bioproducts;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9237740-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/b/5"><num value="5">(5)</num><content> cross-cutting research and development in feedstocks; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd9237741-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/b/6"><num value="6">(6)</num><content> economic analysis.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd9237742-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/c"><num value="c" class="bold">(c)</num><heading class="bold"> Biofuels and bioproducts</heading><chapeau style="-uslm-lc:I11" class="indent0">The goals of the biofuels and bioproducts programs shall be to develop, in partnership with industry and institutions of higher education—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd925e643-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/c/1"><num value="1">(1)</num><content> advanced biochemical and thermochemical conversion technologies capable of making fuels from lignocellulosic feedstocks that are price-competitive with gasoline or diesel in either internal combustion engines or fuel cell-powered vehicles;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd925e644-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/c/2"><num value="2">(2)</num><content> advanced biotechnology processes capable of making biofuels and bioproducts with emphasis on development of biorefinery technologies using enzyme-based processing systems;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd925e645-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/c/3"><num value="3">(3)</num><content> advanced biotechnology processes capable of increasing energy production from lignocellulosic feedstocks, with emphasis on reducing the dependence of industry on fossil fuels in manufacturing facilities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd925e646-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/c/4"><num value="4">(4)</num><content> other advanced processes that will enable the development of cost-effective bioproducts, including biofuels.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd925e647-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d"><num value="d" class="bold">(d)</num><heading class="bold"> Integrated biorefinery demonstration projects</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd925e648-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I12" class="indent1">The Secretary shall carry out a program to demonstrate the commercial application of integrated biorefineries. The Secretary shall ensure geographical distribution of biorefinery demonstrations under this subsection. The Secretary shall not provide more than $100,000,000 under this subsection for any single biorefinery demonstration. In making awards under this subsection, the Secretary shall encourage—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd925e649-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1/A"><num value="A">(A)</num><content> the demonstration of a wide variety of lignocellulosic feedstocks;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd925e64a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1/B"><num value="B">(B)</num><chapeau> the commercial application of biomass technologies for a variety of uses, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd925e64b-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1/B/i"><num value="i">(i)</num><content> liquid transportation fuels;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd925e64c-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1/B/ii"><num value="ii">(ii)</num><content> high-value biobased chemicals;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd925e64d-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1/B/iii"><num value="iii">(iii)</num><content> substitutes for petroleum-based feedstocks and products; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd925e64e-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1/B/iv"><num value="iv">(iv)</num><content> energy in the form of electricity or useful heat; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd925e64f-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/1/C"><num value="C">(C)</num><content> the demonstration of the collection and treatment of a variety of biomass feedstocks.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idd925e650-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Proposals</heading><chapeau style="-uslm-lc:I12" class="indent1">Not later than 6 months after <date date="2005-08-08">August 8, 2005</date>, the Secretary shall solicit proposals for demonstration of advanced biorefineries. The Secretary shall select only proposals that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd925e651-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/2/A"><num value="A">(A)</num><content> demonstrate that the project will be able to operate profitably without direct Federal subsidy after initial construction costs are paid; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd925e652-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/d/2/B"><num value="B">(B)</num><content> enable the biorefinery to be easily replicated.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd925e653-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/e"><num value="e" class="bold">(e)</num><heading class="bold"> University biodiesel program</heading><chapeau style="-uslm-lc:I11" class="indent0">The Secretary shall establish a demonstration program to determine the feasibility of the operation of diesel electric power generators, using biodiesel fuels with ratings as high as B100, at electric generation facilities owned by institutions of higher education. The program shall examine—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd925e654-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/e/1"><num value="1">(1)</num><content> heat rates of diesel fuels with large quantities of cellulosic content;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd925e655-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/e/2"><num value="2">(2)</num><content> the reliability of operation of various fuel blends;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd925e656-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/e/3"><num value="3">(3)</num><content> performance in cold or freezing weather;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd925e657-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/e/4"><num value="4">(4)</num><content> stability of fuel after extended storage; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd925e658-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/e/5"><num value="5">(5)</num><content> other criteria, as determined by the Secretary.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd925e659-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/g"><num value="g" class="bold">(g)</num><heading class="bold"> <ref class="footnoteRef" idref="fn004136">1</ref><note type="footnote" id="fn004136"><num>1</num> So in original. (f) has been enacted.</note> Biorefinery energy efficiency</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish a program of research, development, demonstration, and commercial application for increasing energy efficiency and reducing energy consumption in the operation of biorefinery facilities.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idd925e65a-406b-11eb-bd25-fd7436c081d8" identifier="/us/usc/t42/s16232/h"><num value="h" class="bold">(h)</num><heading class="bold"> Retrofit technologies for the development of ethanol from cellulosic materials</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall establish a program of research, development, demonstration, and commercial application on technologies and processes to enable biorefineries that exclusively use corn grain or corn starch as a feedstock to produce ethanol to be retrofitted to accept a range of biomass, including lignocellulosic feedstocks.</p>
